Podle z\u00e1kona o autorsk\u00fdch pr\u00e1vech (Japonsk\u00fd z\u00e1kon o autorsk\u00fdch pr\u00e1vech),<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Z\u00e1kon o autorsk\u00fdch pr\u00e1vech (Pr\u00e1vo na kop\u00edrov\u00e1n\u00ed)<\/p>\n\n\n\n<p>\u010cl\u00e1nek 21: Autor m\u00e1 v\u00fdhradn\u00ed pr\u00e1vo na kop\u00edrov\u00e1n\u00ed sv\u00e9ho d\u00edla.<\/p>\n<\/blockquote>\n\n\n\n<p>je stanoveno, \u017ee pokud n\u011bkdo kop\u00edruje d\u00edlo bez svolen\u00ed autora, doch\u00e1z\u00ed k poru\u0161en\u00ed pr\u00e1va na kop\u00edrov\u00e1n\u00ed. Kop\u00edrov\u00e1n\u00ed, v p\u0159\u00edpad\u011b hudby, je \u010dasto ozna\u010dov\u00e1no jako &#8220;plagi\u00e1torstv\u00ed&#8221; nebo &#8220;kr\u00e1de\u017e&#8221;, co\u017e \u010dasto vede k kontroverz\u00edm.<\/p>\n\n\n\n<p>Na druh\u00e9 stran\u011b, podle z\u00e1kona o autorsk\u00fdch pr\u00e1vech (Japonsk\u00fd z\u00e1kon o autorsk\u00fdch pr\u00e1vech), je aran\u017eov\u00e1n\u00ed hudebn\u00edho d\u00edla pova\u017eov\u00e1no za sekund\u00e1rn\u00ed d\u00edlo a je povoleno, pokud m\u00e1te svolen\u00ed autora.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Z\u00e1kon o autorsk\u00fdch pr\u00e1vech \u010cl\u00e1nek 27 (Pr\u00e1vo na p\u0159eklad, pr\u00e1vo na adaptaci atd.)<\/p>\n\n\n\n<p>Autor m\u00e1 v\u00fdhradn\u00ed pr\u00e1vo p\u0159elo\u017eit, upravit, zm\u011bnit, dramatizovat, filmovat nebo jinak adaptovat sv\u00e9 d\u00edlo.<\/p>\n<\/blockquote>\n\n\n\n<p>Vysv\u011btl\u00edm kop\u00edrov\u00e1n\u00ed a sekund\u00e1rn\u00ed d\u00edla na p\u0159\u00edkladu soudn\u00edho p\u0159\u00edpadu, kter\u00fd se stal velk\u00fdm t\u00e9matem v souvislosti s aran\u017eov\u00e1n\u00edm.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"%E3%80%8CPojdme_kamkoliv_vs_Pripad_pametniho_stromu%E3%80%8D\"><\/span>\u300cPoj\u010fme kamkoliv vs P\u0159\u00edpad pam\u011btn\u00edho stromu\u300d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2023\/01\/shutterstock_719893405.jpg\" alt=\"\u300cPoj\u010fme kamkoliv vs P\u0159\u00edpad pam\u011btn\u00edho stromu\u300d\" class=\"wp-image-58607\" \/><\/figure>\n\n\n\n<p>Tento soudn\u00ed spor se t\u00fdk\u00e1 skladatele p\u00edsn\u011b &#8220;Poj\u010fme kamkoliv&#8221; (1966) pana Asei Kobayashiho a vydavatelstv\u00ed Kanai Music Publishing, kter\u00e9 vlastn\u00ed autorsk\u00e1 pr\u00e1va k t\u00e9to skladb\u011b, a kter\u00e9 podalo \u017ealobu na skladatele p\u00edsn\u011b &#8220;Pam\u011btn\u00ed strom&#8221; (1992) pana Katsuhisa Hattoriho. \u017dalobci tvrdili, \u017ee &#8220;Pam\u011btn\u00ed strom&#8221; je kopie &#8220;Poj\u010fme kamkoliv&#8221; a pan Kobayashi po\u017eadoval od\u0161kodn\u011bn\u00ed za poru\u0161en\u00ed pr\u00e1va na uzn\u00e1n\u00ed autorstv\u00ed a pr\u00e1va na zachov\u00e1n\u00ed integrity. Kanai Music Publishing po\u017eadovalo od\u0161kodn\u011bn\u00ed za poru\u0161en\u00ed pr\u00e1va na reprodukci. Na druh\u00e9 stran\u011b, \u017ealovan\u00fd pan Hattori tvrdil, \u017ee &#8220;Pam\u011btn\u00ed strom&#8221; je samostatn\u00e1 skladba od &#8220;Poj\u010fme kamkoliv&#8221; a podal proti\u017ealobu, aby potvrdil sv\u00e1 autorsk\u00e1 pr\u00e1va na &#8220;Pam\u011btn\u00ed strom&#8221;.<\/p>\n\n\n\n<p>Souvisej\u00edc\u00ed \u010dl\u00e1nek: <a href=\"https:\/\/monolith.law\/corporate\/intellectual-property-infringement-risk\" target=\"_blank\" rel=\"noreferrer noopener\">Rizika poru\u0161en\u00ed pr\u00e1v k du\u0161evn\u00edmu vlastnictv\u00ed, jako jsou patenty, ochrann\u00e9 zn\u00e1mky a autorsk\u00e1 pr\u00e1va, a jak se jim vyhnout[ja]<\/a><\/p>\n\n\n\n<p>Souvisej\u00edc\u00ed \u010dl\u00e1nek: <a href=\"https:\/\/monolith.law\/reputation\/defamation-counterclaim-flow\" target=\"_blank\" rel=\"noreferrer noopener\">Vysv\u011btlen\u00ed pr\u016fb\u011bhu soudn\u00edch spor\u016f o pomluvu a proti\u017ealob[ja]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rozhodnuti_prvostupnoveho_soudu_zaloba_byla_zamitnuta\"><\/span>Rozhodnut\u00ed prvostup\u0148ov\u00e9ho soudu: \u017ealoba byla zam\u00edtnuta<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2023\/01\/shutterstock_2227057063.jpg\" alt=\"Rozhodnut\u00ed prvostup\u0148ov\u00e9ho soudu: \u017ealoba byla zam\u00edtnuta\" class=\"wp-image-58618\" \/><\/figure>\n\n\n\n<p>\u017dalobci tvrdili, \u017ee ob\u011b skladby jsou zhruba 72% identick\u00e9 a zbyl\u00e9 t\u00f3ny jsou tak\u00e9 kompatibiln\u00ed na stejn\u00e9m harmonick\u00e9m z\u00e1kladu. S pomoc\u00ed aran\u017eov\u00e1n\u00ed by mohly b\u00fdt okam\u017eit\u011b variov\u00e1ny, co\u017e p\u0159esahuje m\u00edru podobnosti, a proto maj\u00ed ob\u011b melodie identitu.<\/p>\n\n\n\n<p>D\u00e1le tvrdili, \u017ee &#8220;Poj\u010fme kamkoliv&#8221; bylo publikov\u00e1no v mnoha aran\u017em\u00e1, je uvedeno v u\u010debnic\u00edch a bylo vyd\u00e1no mnoho nahr\u00e1vek, CD a publikac\u00ed. Je tak dob\u0159e zn\u00e1m\u00e9, \u017ee nikdo, kdo o n\u011bm nev\u00ed, nem\u016f\u017ee existovat, a &#8220;Pam\u011btn\u00ed strom&#8221; je replikou &#8220;Poj\u010fme kamkoliv&#8221;, kter\u00e1 byla vytvo\u0159ena na z\u00e1klad\u011b t\u00e9to skladby.<\/p>\n\n\n\n<p>Na druhou stranu, \u017ealovan\u00fd uvedl \u010d\u00e1st melodie a tvrdil, \u017ee vliv, kter\u00fd ka\u017ed\u00e1 \u010d\u00e1st melodie m\u00e1 na poslucha\u010de, je v obou skladb\u00e1ch z\u00e1sadn\u011b odli\u0161n\u00fd. Neexistuje \u017e\u00e1dn\u00e1 identita ani ve form\u011b ani v harmonii, a nav\u00edc, ka\u017ed\u00e1 \u010d\u00e1st &#8220;Poj\u010fme kamkoliv&#8221; je tvo\u0159ena sekvenc\u00ed fr\u00e1z\u00ed, kter\u00e9 jsou b\u011b\u017en\u00e9 pro americk\u00e9 skladby a rusk\u00e9 lidov\u00e9 p\u00edsn\u011b. Proto je vysok\u00e1 pravd\u011bpodobnost, \u017ee se n\u00e1hodou vytvo\u0159\u00ed fr\u00e1ze podobn\u00e9 &#8220;Poj\u010fme kamkoliv&#8221;, i kdy\u017e ji nezn\u00e1te.<\/p>\n\n\n\n<p>Na to Tokijsk\u00fd okresn\u00ed soud odpov\u011bd\u011bl, \u017ee p\u0159i posuzov\u00e1n\u00ed identity obou skladeb by m\u011bla b\u00fdt nejd\u0159\u00edve zv\u00e1\u017eena identita melodie, ale m\u011bly by b\u00fdt zv\u00e1\u017eeny i dal\u0161\u00ed prvky, pokud je to nutn\u00e9. Soud porovnal ob\u011b skladby fr\u00e1zi po fr\u00e1zi a rozhodl o jejich identit\u011b. Uznal, \u017ee existuj\u00ed fr\u00e1ze, kter\u00e9 jsou v\u00fdznamn\u011b podobn\u00e9, ale nelze \u0159\u00edci, \u017ee je uzn\u00e1na identita ka\u017ed\u00e9 fr\u00e1ze, v\u010detn\u011b t\u00e9to fr\u00e1ze.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Ob\u011b skladby nemaj\u00ed identitu v melodii, kter\u00e1 je nejd\u016fle\u017eit\u011bj\u0161\u00edm prvkem p\u0159i porovn\u00e1v\u00e1n\u00ed, a co se t\u00fd\u010de harmonie, i kdy\u017e maj\u00ed stejn\u00fd z\u00e1kladn\u00ed r\u00e1mec, konkr\u00e9tn\u00ed jednotliv\u00e9 harmonie se li\u0161\u00ed, stejn\u011b jako rytmus. Tak\u017ee ani bez posuzov\u00e1n\u00ed ostatn\u00edch aspekt\u016f nelze uznat, \u017ee &#8220;Pam\u011btn\u00ed strom&#8221; m\u00e1 identitu s &#8220;Poj\u010fme kamkoliv&#8221;, a proto nelze \u0159\u00edci, \u017ee &#8220;Pam\u011btn\u00ed strom&#8221; je replikou &#8220;Poj\u010fme kamkoliv&#8221;.<\/p>\n<cite>Rozhodnut\u00ed Tokijsk\u00e9ho okresn\u00edho soudu ze dne 18. \u00fanora 2000 (rok 2000 podle gregori\u00e1nsk\u00e9ho kalend\u00e1\u0159e)<\/cite><\/blockquote>\n\n\n\n<p>Soud zam\u00edtl \u017ealobu pana Kobayashiho a dal\u0161\u00edch a uznal, \u017ee pan Hattori m\u00e1 autorsk\u00e1 pr\u00e1va na &#8220;Pam\u011btn\u00ed strom&#8221;.<\/p>\n\n\n\n<p>Pan Kobayashi a dal\u0161\u00ed se proti tomuto rozhodnut\u00ed odvolali k Tokijsk\u00e9mu vrchn\u00edmu soudu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rozhodnuti_odvolaciho_soudu_Zaloba_je_prijata\"><\/span>Rozhodnut\u00ed odvolac\u00edho soudu: \u017daloba je p\u0159ijata<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Odvolatel\u00e9, pan Kobayashi a dal\u0161\u00ed, st\u00e1hli ve sv\u00e9m odvol\u00e1n\u00ed tvrzen\u00ed o poru\u0161en\u00ed pr\u00e1va na reprodukci. Tvrdili, \u017ee &#8220;Pam\u011btn\u00ed strom&#8221; je sekund\u00e1rn\u00edm d\u00edlem, jak je definov\u00e1no v \u010dl\u00e1nku 2 odstavec 1 bod 11 Japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona (Japanese Copyright Law), a obvinili z poru\u0161en\u00ed pr\u00e1va na \u00fapravu.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u010cl\u00e1nek 2 odstavec 1 bod 11 Japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona (Japanese Copyright Law)<\/p>\n\n\n\n<p>Sekund\u00e1rn\u00ed d\u00edlo &#8211; d\u00edlo vytvo\u0159en\u00e9 p\u0159ekladem, \u00fapravou, transformac\u00ed, dramatizac\u00ed, filmovou adaptac\u00ed nebo jinou adaptac\u00ed p\u016fvodn\u00edho d\u00edla.<\/p>\n<\/blockquote>\n\n\n\n<p>Pot\u00e9, co bylo rozhodnuto, \u017ee se jedn\u00e1 o &#8220;\u00fapravu&#8221; a ne &#8220;reprodukci&#8221;, bylo konstatov\u00e1no, \u017ee porovn\u00e1v\u00e1n\u00ed fr\u00e1z\u00ed a posuzov\u00e1n\u00ed toto\u017enosti nen\u00ed zcela vhodn\u00e9. Tak\u017ee \u010dinnost pana Hattoriho, kter\u00fd slo\u017eil &#8220;Pam\u011btn\u00ed strom&#8221;, je nic jin\u00e9ho ne\u017e \u00faprava &#8220;Poj\u010fme kamkoliv&#8221; podle Japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona (Japanese Copyright Law), a v tomto p\u0159\u00edpad\u011b, kdy je jasn\u00e9, \u017ee nebylo ud\u011bleno povolen\u00ed od pana Kanaiho, kter\u00fd m\u00e1 pr\u00e1vo na \u00fapravu, \u010dinnost pana Hattoriho poru\u0161uje pr\u00e1vo pana Kanaiho na \u00fapravu.<\/p>\n<cite>Rozhodnut\u00ed Tokijsk\u00e9ho vrchn\u00edho soudu ze dne 6. z\u00e1\u0159\u00ed 2002 (2002)<\/cite><\/blockquote>\n\n\n\n<p>A tak bylo rozhodnuto, \u017ee &#8220;Pam\u011btn\u00ed strom&#8221; je sekund\u00e1rn\u00edm d\u00edlem &#8220;Poj\u010fme kamkoliv&#8221; a pan Hattori poru\u0161il pr\u00e1va p\u016fvodn\u00edho autora, kter\u00fd m\u00e1 stejn\u00fd druh pr\u00e1v jako dr\u017eitel sekund\u00e1rn\u00edch autorsk\u00fdch pr\u00e1v.<\/p>\n\n\n\n<p>D\u00e1le bylo konstatov\u00e1no, \u017ee \u010dinnost pana Hattoriho, kter\u00fd slo\u017eil &#8220;Pam\u011btn\u00ed strom&#8221; t\u00edm, \u017ee zm\u011bnil &#8220;Poj\u010fme kamkoliv&#8221; proti v\u016fli pana Kobayashiho, poru\u0161uje pr\u00e1vo na zachov\u00e1n\u00ed toto\u017enosti a \u017ee skute\u010dnost, \u017ee &#8220;Pam\u011btn\u00ed strom&#8221; byl prezentov\u00e1n jako jeho vlastn\u00ed d\u00edlo, kter\u00e9 nen\u00ed sekund\u00e1rn\u00edm d\u00edlem, poru\u0161uje pr\u00e1vo na uveden\u00ed jm\u00e9na. To souvis\u00ed s m\u00edrou \u00faprav nebo \u00faprav p\u016fvodn\u00edho d\u00edla. Hranice je velmi jemn\u00e1 a \u010dasto je nutn\u00e9 prov\u00e9st kontrolu z odborn\u00e9ho hlediska, aby se p\u0159ede\u0161lo pr\u00e1vn\u00edm rizik\u016fm.
