Zd\u00e1 se, \u017ee existuj\u00ed n\u00e1sleduj\u00edc\u00ed t\u0159i typy:<\/p>\n\n\n\n<ul>\n<li>Kreativn\u00ed tanec<\/li>\n\n\n\n<li>Lidov\u00fd tanec<\/li>\n\n\n\n<li>Tanec modern\u00edho rytmu<\/li>\n<\/ul>\n\n\n\n<p>V let\u00e1ku pro v\u00fduku tance, kter\u00fd zve\u0159ejnilo Japonsk\u00e9 ministerstvo \u0161kolstv\u00ed, kultury, sportu, v\u011bdy a technologie, je uvedeno, \u017ee p\u0159\u00edkladem &#8220;rytmu a pohybu&#8221; v &#8220;tanci modern\u00edho rytmu&#8221; je &#8220;tanec, kter\u00fd zachycuje charakteristick\u00e9 rytmy rocku nebo hip-hopu&#8221;.<\/p>\n\n\n\n<p>A\u010dkoli je obt\u00ed\u017enost vy\u0161\u0161\u00ed ne\u017e u &#8220;kreativn\u00edho tance&#8221; a &#8220;lidov\u00e9ho tance&#8221;, sn\u011bn\u00ed o &#8220;tanci jako tane\u010dn\u00edci, kter\u00e9 vid\u00edme v televizi&#8221; by mohlo zv\u00fd\u0161it motivaci k u\u010den\u00ed tance.<\/p>\n\n\n\n<p>Ov\u0161em, jsou kroky a choreografie tohoto tance chr\u00e1n\u011bny jako autorsk\u00e1 d\u00edla?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tanec_a_autorska_prava\"><\/span>Tanec a autorsk\u00e1 pr\u00e1va<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Autorsk\u00e1 pr\u00e1va jsou pr\u00e1va, kter\u00e1 chr\u00e1n\u00ed d\u00edla.<\/p>\n\n\n\n<p>V \u010dl\u00e1nku 2 odstavec 1 bod 1 Japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona (Japanese Copyright Law) je uvedeno, \u017ee d\u00edlem se rozum\u00ed &#8220;n\u011bco, co kreativn\u011b vyjad\u0159uje my\u0161lenky nebo pocity a pat\u0159\u00ed do oblasti literatury, v\u011bdy, um\u011bn\u00ed nebo hudby&#8221;.<\/p>\n\n\n\n<p>Je uvedeno, \u017ee d\u00edlem se rozum\u00ed &#8220;n\u011bco, co kreativn\u011b vyjad\u0159uje my\u0161lenky nebo pocity a pat\u0159\u00ed do oblasti literatury, v\u011bdy, um\u011bn\u00ed nebo hudby&#8221;.<\/p>\n\n\n\n<p>D\u00e1le v \u010dl\u00e1nku 10 odstavec 1 je uveden &#8220;p\u0159\u00edklad d\u00edla&#8221;, a v tomto bodu 3 je uvedeno &#8220;d\u00edlo tance nebo pantomimy&#8221;, co\u017e nazna\u010duje, \u017ee choreografie tance by mohla b\u00fdt pova\u017eov\u00e1na za &#8220;tanec&#8221;.<\/p>\n\n\n\n<p>Ve skute\u010dnosti existuj\u00ed soudn\u00ed p\u0159\u00edpady, kter\u00e9 potvrdily, \u017ee balet (rozhodnut\u00ed Tokijsk\u00e9ho okresn\u00edho soudu ze dne 20. listopadu 1998) a japonsk\u00fd tanec (rozhodnut\u00ed Fukuoksk\u00e9ho vrchn\u00edho soudu ze dne 26. prosince 2002) jsou d\u00edla.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2021\/07\/Dance-Choreographer-Copyright1.jpg\" alt=\"\" class=\"wp-image-33732\" \/><\/figure>\n\n\n\n<p>Na druhou stranu, ne v\u0161echny choreografie jsou uzn\u00e1v\u00e1ny jako d\u00edla.<\/p>\n\n\n\n<p>Nap\u0159\u00edklad v p\u0159\u00edpad\u011b choreografie d\u011btsk\u00e9 p\u00edsni\u010dky &#8220;Twinkle Twinkle Little Star&#8221; bylo rozhodnuto, \u017ee &#8220;oto\u010den\u00ed obou z\u00e1p\u011bst\u00ed podle textu p\u00edsn\u011b, co\u017e je b\u011b\u017en\u00fd zp\u016fsob vyj\u00e1d\u0159en\u00ed, jak se hv\u011bzdy t\u0159pyt\u00ed&#8221;, nen\u00ed d\u00edlem (rozhodnut\u00ed Tokijsk\u00e9ho okresn\u00edho soudu ze dne 28. srpna 2009).<\/p>\n\n\n\n<p>Nyn\u00ed bychom cht\u011bli p\u0159em\u00fd\u0161let o tom, jak\u00e9 jsou kl\u00ed\u010dov\u00e9 body pro uzn\u00e1n\u00ed n\u011b\u010deho jako d\u00edlo, na z\u00e1klad\u011b n\u011bkolika p\u0159\u00edklad\u016f.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripad_kdy_nebylo_uznano_autorske_pravo\"><\/span>P\u0159\u00edpad, kdy nebylo uzn\u00e1no autorsk\u00e9 pr\u00e1vo<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Choreograf, kter\u00fd vymyslel choreografii pro tane\u010dn\u00ed sc\u00e9ny ve filmu &#8220;Shall we dance?&#8221; a instruoval tane\u010dn\u00edky, podal \u017ealobu proti filmov\u00e9 spole\u010dnosti. Tvrdil, \u017ee jeho autorsk\u00e1 pr\u00e1va (pr\u00e1vo na reprodukci, pr\u00e1vo na prom\u00edt\u00e1n\u00ed, pr\u00e1vo na ve\u0159ejn\u00e9 vys\u00edl\u00e1n\u00ed a pr\u00e1vo na distribuci) spojen\u00e1 s danou choreografi\u00ed byla poru\u0161ena sekund\u00e1rn\u00edm vyu\u017eit\u00edm, jako je prodej a p\u016fj\u010dov\u00e1n\u00ed videogram\u016f a vys\u00edl\u00e1n\u00ed na televizi. \u017d\u00e1dal o n\u00e1hradu \u0161kody (Rozsudek Okresn\u00edho soudu v Tokiu ze dne 28. \u00fanora 2012 (2012)).<\/p>\n\n\n\n<p>Hlavn\u00edm bodem sporu je, zda je na choreografii tohoto filmu uzn\u00e1no autorsk\u00e9 pr\u00e1vo.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Spole\u010densk\u00fd tanec m\u00e1 mnoho z\u00e1kladn\u00edch krok\u016f. Choreografie je vytvo\u0159ena extrakc\u00ed t\u011bchto z\u00e1kladn\u00edch krok\u016f a jejich kombinac\u00ed do jednoho proudu. Tento proces vy\u017eaduje kreativitu a invenci. Tato choreografie m\u00e1 originalitu a kreativitu a j\u00e1 jsem jej\u00edm autorem.<\/p>\n<\/blockquote>\n\n\n\n<p>Takto argumentoval.<\/p>\n\n\n\n<p>Na to soud odpov\u011bd\u011bl:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Spole\u010densk\u00fd tanec je v z\u00e1sad\u011b tancov\u00e1n voln\u00fdm kombinov\u00e1n\u00edm existuj\u00edc\u00edch krok\u016f, jako jsou z\u00e1kladn\u00ed kroky nebo kroky PV uveden\u00e9 v &#8220;Popular Variations&#8221;. Tyto existuj\u00edc\u00ed kroky jsou velmi kr\u00e1tk\u00e9 a jsou b\u011b\u017en\u011b pou\u017e\u00edv\u00e1ny v spole\u010densk\u00e9m tanci, tak\u017ee na n\u011b nelze uznat autorsk\u00e9 pr\u00e1vo.<\/p>\n<\/blockquote>\n\n\n\n<p>A tak\u00e9:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Je b\u011b\u017en\u00e9 p\u0159id\u00e1vat \u00fapravy k z\u00e1kladn\u00edm krok\u016fm. Vzhledem k tomu, \u017ee z\u00e1kladn\u00ed kroky jsou velmi kr\u00e1tk\u00e9 a b\u011b\u017en\u00e9, i kdy\u017e k nim p\u0159id\u00e1te \u00fapravy, ty, kter\u00e9 st\u00e1le umo\u017e\u0148uj\u00ed rozpoznat z\u00e1kladn\u00ed kroky, na kter\u00e9 se \u00fapravy vztahuj\u00ed, jsou pova\u017eov\u00e1ny za b\u011b\u017en\u00e9 a nejsou uzn\u00e1ny jako autorsk\u00e9 pr\u00e1vo. Aby bylo mo\u017en\u00e9 uznat choreografii spole\u010densk\u00e9ho tance jako autorsk\u00e9 d\u00edlo, mus\u00ed m\u00edt v\u00fdraznou originalitu, kter\u00e1 p\u0159esahuje pouh\u00e9 kombinace existuj\u00edc\u00edch krok\u016f.<\/p>\n<\/blockquote>\n\n\n\n<p>Takto rozhodl.<\/p>\n\n\n\n<p>Pokud bychom uvolnili po\u017eadavky na originalitu choreografie a uznali autorsk\u00e9 pr\u00e1vo na z\u00e1klad\u011b jak\u00fdchkoli charakteristik kombinace, vzniklo by autorsk\u00e9 pr\u00e1vo na nes\u010detn\u00e9 choreografie s jen mal\u00fdmi rozd\u00edly.<\/p>\n\n\n\n<p>V d\u016fsledku toho by mohlo doj\u00edt k monopolizaci ur\u010dit\u00fdmi jednotlivci a mohlo by doj\u00edt k p\u0159\u00edli\u0161n\u00fdm omezen\u00edm svobody choreografie. To je obava, kter\u00e1 vedla k tomuto rozhodnut\u00ed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Priklady_uznani_dila\"><\/span>P\u0159\u00edklady uzn\u00e1n\u00ed d\u00edla<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Americk\u00e1 \u017eena, kter\u00e1 je jednou z &#8216;Kumu Hula&#8217;, co\u017e znamen\u00e1 uzn\u00e1van\u00e9ho u\u010ditele hula tance, <\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2021\/07\/Dance-Choreographer-Copyright2.jpg\" alt=\"\" class=\"wp-image-33733\" \/><\/figure>\n\n\n\n<p>se dom\u00e1hala z\u00e1kazu vystoupen\u00ed a dal\u0161\u00edch opat\u0159en\u00ed proti provozovateli hula tane\u010dn\u00ed \u0161koly, kter\u00fd pokra\u010doval v pou\u017e\u00edv\u00e1n\u00ed jej\u00ed vlastn\u00ed choreografie bez povolen\u00ed, \u010d\u00edm\u017e poru\u0161oval jej\u00ed autorsk\u00e1 pr\u00e1va (rozsudek Oklahomsk\u00e9ho okresn\u00edho soudu ze dne 20. z\u00e1\u0159\u00ed 2018 (2018)).<\/p>\n\n\n\n<p>\u017dalobkyn\u011b tvrdila, \u017ee:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Od 80. let 20. stolet\u00ed za\u010dala na \u017e\u00e1dost provozovatele hula tane\u010dn\u00ed \u0161koly u\u010dit v Japonsku a kdy\u017e byla v roce 2014 smlouva ukon\u010dena, po\u017e\u00e1dala je, aby nepou\u017e\u00edvali choreografii, kterou u\u010dila, ale provozovatel pokra\u010doval v jej\u00edm vystoupen\u00ed.<\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Hula tane\u010dn\u00ed pohyby rukou a kroky vyjad\u0159uj\u00ed l\u00e1sku k rodin\u011b a milenc\u016fm a zahrnuj\u00ed tak\u00e9 prvky p\u0159edan\u00e9 z generace na generaci, kter\u00e9 vyjad\u0159uj\u00ed individualitu.<\/p>\n<\/blockquote>\n\n\n\n<p>Na druh\u00e9 stran\u011b, provozovatel \u0161koly argumentoval, \u017ee:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Hula tanec je jen kombinac\u00ed z\u00e1kladn\u00edch pohyb\u016f a nem\u00e1 autorsk\u00e1 pr\u00e1va.<\/p>\n<\/blockquote>\n\n\n\n<p>A tak se hlavn\u00edm bodem sporu stala ot\u00e1zka, zda m\u00e1 choreografie autorsk\u00e1 pr\u00e1va.<\/p>\n\n\n\n<p>Soud konstatoval, \u017ee:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Z\u00e1kladem hula tance je vyj\u00e1d\u0159en\u00ed v\u00fdznamu textu p\u00edsn\u011b pomoc\u00ed pohyb\u016f rukou a vytv\u00e1\u0159en\u00ed toku tancem na rytmus. I kdy\u017e jsou jednotliv\u00e9 pohyby b\u011b\u017en\u00e9, pokud je choreografie pro dan\u00fd text p\u00edsn\u011b jedine\u010dn\u00e1, je spr\u00e1vn\u00e9 uznat, \u017ee se v n\u00ed projevuje individualita autora.<\/p>\n<\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Hula tanec jako choreografie p\u00edsn\u011b je soubor pohyb\u016f, kter\u00fd se skl\u00e1d\u00e1 z \u010d\u00e1st\u00ed, kde se projevuje individualita autora, a \u010d\u00e1st\u00ed, kter\u00e9 nejsou takto uzn\u00e1ny.
