chr\u00e1n\u00ed d\u00edla. <br><\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;Ozna\u010duje se t\u00edm v\u00fdtvory, kter\u00e9 kreativn\u011b vyjad\u0159uj\u00ed my\u0161lenky nebo pocity a pat\u0159\u00ed do oblasti literatury, v\u011bdy, um\u011bn\u00ed nebo hudby&#8221;, a v \u010dl\u00e1nku 10 odstavec 1 je uveden &#8220;p\u0159\u00edklad d\u00edla&#8221;, kde v bod\u011b 5 je uvedeno &#8220;architektonick\u00e9 d\u00edlo&#8221;.<\/p>\n<cite>\u010cl\u00e1nek 2 odstavec 1 bod 1 Japonsk\u00e9ho z\u00e1kona o autorsk\u00fdch pr\u00e1vech<\/cite><\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stavby_a_autorska_prava\"><\/span>Stavby a autorsk\u00e1 pr\u00e1va<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Stavbou se obecn\u011b rozum\u00ed nejen obytn\u00e9 domy a budovy, ale tak\u00e9 divadla, svatyn\u011b, chr\u00e1my, mosty, zahrady, parky, v\u011b\u017ee atd. Z nich jsou &#8220;stavby, kter\u00e9 kreativn\u011b vyjad\u0159uj\u00ed my\u0161lenky nebo pocity&#8221;, uzn\u00e1v\u00e1ny jako architektonick\u00e1 d\u00edla chr\u00e1n\u011bn\u00e1 autorsk\u00fdmi pr\u00e1vy.<\/p>\n\n\n\n<p>V \u010dl\u00e1nku 46 Japonsk\u00e9ho z\u00e1kona o autorsk\u00fdch pr\u00e1vech je uvedeno:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Pou\u017eit\u00ed ve\u0159ejn\u00fdch um\u011bleck\u00fdch d\u011bl atd.<\/p>\n\n\n\n<p>Um\u011bleck\u00e9 d\u00edlo, jeho\u017e origin\u00e1l je trvale um\u00edst\u011bn na m\u00edst\u011b uveden\u00e9m v p\u0159edchoz\u00edm \u010dl\u00e1nku odstavec 2, nebo architektonick\u00e9 d\u00edlo m\u016f\u017ee b\u00fdt pou\u017eito jak\u00fdmkoli zp\u016fsobem, s v\u00fdjimkou n\u00e1sleduj\u00edc\u00edch p\u0159\u00edpad\u016f.<\/p>\n\n\n\n<p>1. Reprodukce sochy a jej\u00ed nab\u00eddnut\u00ed ve\u0159ejnosti prost\u0159ednictv\u00edm p\u0159evodu reprodukce<\/p>\n\n\n\n<p>2. Reprodukce architektonick\u00e9ho d\u00edla architekturou a jeho nab\u00eddnut\u00ed ve\u0159ejnosti prost\u0159ednictv\u00edm p\u0159evodu reprodukce<\/p>\n\n\n\n<p>3. Reprodukce pro trval\u00e9 um\u00edst\u011bn\u00ed na m\u00edst\u011b uveden\u00e9m v p\u0159edchoz\u00edm \u010dl\u00e1nku odstavec 2<\/p>\n\n\n\n<p>4. Reprodukce v\u00fdhradn\u011b pro \u00fa\u010dely prodeje reprodukce um\u011bleck\u00e9ho d\u00edla nebo prodej t\u00e9to reprodukce<\/p>\n<cite>\u010cl\u00e1nek 46 Japonsk\u00e9ho z\u00e1kona o autorsk\u00fdch pr\u00e1vech<\/cite><\/blockquote>\n\n\n\n<p>Jak je uvedeno v\u00fd\u0161e, je zak\u00e1z\u00e1no stav\u011bt stejn\u00e9 budovy (reprodukce), ale jin\u00e9 \u010dinnosti, nap\u0159\u00edklad fotografov\u00e1n\u00ed nebo komer\u010dn\u00ed vyu\u017eit\u00ed, jsou povoleny.<\/p>\n\n\n\n<p>Jin\u00fdmi slovy, architektonick\u00e1 d\u00edla mohou b\u00fdt vyu\u017eita v r\u00e1mci Japonsk\u00e9ho z\u00e1kona o autorsk\u00fdch pr\u00e1vech bez souhlasu dr\u017eitele autorsk\u00fdch pr\u00e1v, nap\u0159\u00edklad ve fotografi\u00edch, filmech, animac\u00edch, hr\u00e1ch nebo v r\u016fzn\u00fdch druz\u00edch zbo\u017e\u00ed.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2021\/01\/building-image-use-illegal1.jpg\" alt=\"\" class=\"wp-image-27481\" \/><\/figure>\n\n\n\n<p>Nav\u00edc, na rozd\u00edl od um\u011bleck\u00fdch d\u011bl, u architektonick\u00fdch d\u011bl neexistuje omezen\u00ed &#8220;um\u00edst\u011bn\u00ed venku&#8221;, tak\u017ee teoreticky je mo\u017en\u00e9 vyu\u017e\u00edt i \u010d\u00e1sti budov, jako jsou interi\u00e9ry nebo schodi\u0161t\u011b.<\/p>\n\n\n\n<p>Av\u0161ak podle bodu 4 v\u00fd\u0161e, u architektonick\u00fdch d\u011bl s vysokou m\u00edrou kreativity, kter\u00e1 by mohla b\u00fdt tak\u00e9 pova\u017eov\u00e1na za &#8220;um\u011bleck\u00e1 d\u00edla&#8221;, jako je nap\u0159\u00edklad &#8220;V\u011b\u017e slunce&#8221; od Taro Okamoto, je rozsah voln\u00e9ho pou\u017eit\u00ed omezen.<\/p>\n\n\n\n<p>Fotografov\u00e1n\u00ed pro soukrom\u00e9 \u00fa\u010dely nebo zdarma, stejn\u011b jako fotografov\u00e1n\u00ed pro prodej, pokud je to jen \u010d\u00e1st pozad\u00ed, je mo\u017en\u00e9. Av\u0161ak pro vytv\u00e1\u0159en\u00ed a prodej reprodukc\u00ed, jako jsou pohlednice nebo plak\u00e1ty zam\u011b\u0159en\u00e9 na budovu, nebo pro jin\u00e9 komer\u010dn\u00ed \u00fa\u010dely, je nutn\u00fd souhlas dr\u017eitele autorsk\u00fdch pr\u00e1v.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rozhodovani_o_charakteru_dila\"><\/span>Rozhodov\u00e1n\u00ed o charakteru d\u00edla<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Ur\u010den\u00ed, zda c\u00edlov\u00e1 budova odpov\u00edd\u00e1 d\u00edlu, je v praxi pom\u011brn\u011b slo\u017eit\u00fd probl\u00e9m, kter\u00fd m\u016f\u017ee v\u00e9st k soudn\u00edmu sporu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Budova_ktera_nebyla_uznana_jako_dilo\"><\/span>Budova, kter\u00e1 nebyla uzn\u00e1na jako d\u00edlo<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Existuje p\u0159\u00edpad, kdy \u017ealobce, kter\u00fd vytvo\u0159il pl\u00e1ny budovy, po\u017e\u00e1dal o p\u0159edb\u011b\u017en\u00e9 opat\u0159en\u00ed k zastaven\u00ed v\u00fdstavby budovy s t\u00edm, \u017ee v\u00fdstavba budovy podle pl\u00e1n\u016f poru\u0161uje autorsk\u00e1 pr\u00e1va \u017ealobce (pr\u00e1vo na rozmno\u017eov\u00e1n\u00ed).<\/p>\n\n\n\n<p>Soud rozhodl:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>P\u0159i zkoum\u00e1n\u00ed, zda konceptu\u00e1ln\u00ed budova vyj\u00e1d\u0159en\u00e1 v t\u011bchto pl\u00e1nech odpov\u00edd\u00e1 &#8220;architektonick\u00e9mu d\u00edlu&#8221;, by m\u011blo b\u00fdt zkoum\u00e1no p\u0159edev\u0161\u00edm z hlediska vzhledu budovy jako vyj\u00e1d\u0159en\u00ed kulturn\u00ed duchovnosti, nikoli z hlediska prakti\u010dnosti nebo funk\u010dnosti. Soud dosp\u011bl k z\u00e1v\u011bru, \u017ee budova v tomto p\u0159\u00edpad\u011b nem\u016f\u017ee b\u00fdt uzn\u00e1na jako um\u011bleck\u00e9 d\u00edlo, kter\u00e9 by umo\u017enilo b\u011b\u017en\u00e9mu \u010dlov\u011bku vn\u00edmat kulturn\u00ed duchovnost n\u00e1vrh\u00e1\u0159e, a \u017ee je st\u00e1le jen b\u011b\u017en\u00fdm domem, kter\u00fd nem\u016f\u017ee b\u00fdt pova\u017eov\u00e1n za architektonick\u00e9 um\u011bn\u00ed. Proto bylo rozhodnuto, \u017ee se nejedn\u00e1 o &#8220;architektonick\u00e9 d\u00edlo&#8221; a tedy v\u00fdstavba v tomto p\u0159\u00edpad\u011b neporu\u0161uje &#8220;pr\u00e1vo na rozmno\u017eov\u00e1n\u00ed&#8221;, a \u017e\u00e1dost byla zam\u00edtnuta.<\/p>\n<cite>Fukushima District Court, rozhodnut\u00ed ze dne 9. dubna 1991 (1991)<\/cite><\/blockquote>\n\n\n\n<p>Podobn\u00e9 rozhodnut\u00ed bylo u\u010din\u011bno i v p\u0159\u00edpad\u011b luxusn\u00edch dom\u016f na zak\u00e1zku, kter\u00e9 z\u00edskaly cenu Good Design. Sekisui House, Ltd. navrhla a postavila s\u00e9rii luxusn\u00edch dom\u016f na zak\u00e1zku a vystavila je na v\u00fdstavn\u00edch m\u00edstech po cel\u00e9 zemi. Na druh\u00e9 stran\u011b, ob\u017ealovan\u00e1 stavebn\u00ed spole\u010dnost postavila modelov\u00fd d\u016fm a vystavila ho na v\u00fdstavn\u00edch m\u00edstech po cel\u00e9 zemi. Existuje p\u0159\u00edpad, kdy Sekisui House, Ltd. po\u017e\u00e1dala o zastaven\u00ed v\u00fdstavby modelov\u00e9ho domu ob\u017ealovan\u00e9 spole\u010dnosti, tvrd\u00edc, \u017ee tato budova je kopie nebo adaptace jejich vlastn\u00ed budovy a poru\u0161uje autorsk\u00e1 pr\u00e1va.<\/p>\n\n\n\n<p>Soud rozhodl:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u017dalobcova budova je architektonick\u00e9 d\u00edlo, kter\u00e9 m\u00e1 ur\u010ditou kreativitu nejen z hlediska prakti\u010dnosti a funk\u010dnosti, ale tak\u00e9 z estetick\u00e9ho hlediska, a kter\u00e9 bylo vytvo\u0159eno po mnoha pokusech a omylech kombinov\u00e1n\u00ed prvk\u016f japonsk\u00e9 a z\u00e1padn\u00ed architektury. Je nepochybn\u00e9, \u017ee je to v\u00fdsledek intelektu\u00e1ln\u00ed \u010dinnosti, kter\u00e9ho bylo dosa\u017eeno po mnoha pokusech a omylech a za \u00fa\u010dasti n\u011bkolika osob s odborn\u00fdmi znalostmi a zku\u0161enostmi. P\u0159i v\u00fdb\u011bru ceny Good Design jsou zohled\u0148ov\u00e1ny prvky souvisej\u00edc\u00ed s estetikou a um\u011bleckost\u00ed, jako je kr\u00e1sa, novost a originalita, a je uzn\u00e1no, \u017ee existuj\u00ed unik\u00e1tn\u00ed prvky, kter\u00e9 nejsou \u010dist\u011b japonskou ani z\u00e1padn\u00ed architekturou.<\/p>\n<\/blockquote>\n\n\n\n<p>Ale,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Pokud porovn\u00e1me dokon\u010denou \u017ealobcovu budovu s existuj\u00edc\u00edmi b\u011b\u017en\u00fdmi bytov\u00fdmi budovami, nem\u016f\u017ee b\u00fdt uzn\u00e1no, \u017ee \u017ealobcova budova m\u00e1 um\u011bleck\u00e9 a estetick\u00e9 kvality, kter\u00e9 se li\u0161\u00ed od t\u011bch, kter\u00e9 maj\u00ed. I kdy\u017e bylo p\u0159i n\u00e1vrhu br\u00e1no v \u00favahu to, co bylo uvedeno v\u00fd\u0161e, nem\u016f\u017ee b\u00fdt uzn\u00e1no, \u017ee \u017ealobcova budova m\u00e1 um\u011bleck\u00e9 a estetick\u00e9 kvality.
