V tomto p\u0159\u00edpad\u011b mus\u00ed b\u00fdt mzda a pracovn\u00ed doba a dal\u0161\u00ed z\u00e1le\u017eitosti stanoven\u00e9 na\u0159\u00edzen\u00edm Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed jasn\u011b stanoveny zp\u016fsobem stanoven\u00fdm t\u00edmto na\u0159\u00edzen\u00edm.<\/p>\n\n\n\n<p>Obsah &#8220;mzdy, pracovn\u00ed doby a dal\u0161\u00edch pracovn\u00edch podm\u00ednek&#8221; je stanoven v prov\u00e1d\u011bc\u00edm na\u0159\u00edzen\u00ed k Japonsk\u00e9mu z\u00e1kon\u00edku pr\u00e1ce a n\u00e1sleduj\u00edc\u00ed body souvisej\u00edc\u00ed s prac\u00ed na d\u00e1lku mus\u00ed b\u00fdt v\u017edy jasn\u011b stanoveny:<\/p>\n\n\n\n<ul>\n<li>Z\u00e1le\u017eitosti t\u00fdkaj\u00edc\u00ed se m\u00edsta pr\u00e1ce a povinnost\u00ed, kter\u00e9 zam\u011bstnanec m\u00e1 vykon\u00e1vat<\/li>\n\n\n\n<li>\u010cas za\u010d\u00e1tku a konce pr\u00e1ce, p\u0159\u00edtomnost pr\u00e1ce p\u0159es\u010das, doba p\u0159est\u00e1vky, voln\u00e9 dny, dovolen\u00e1 a z\u00e1le\u017eitosti t\u00fdkaj\u00edc\u00ed se zm\u011bny pracovn\u00ed doby v p\u0159\u00edpad\u011b, \u017ee zam\u011bstnanci jsou rozd\u011bleni do dvou nebo v\u00edce skupin<\/li>\n\n\n\n<li>Z\u00e1le\u017eitosti t\u00fdkaj\u00edc\u00ed se stanoven\u00ed, v\u00fdpo\u010dtu a zp\u016fsobu platby mzdy (krom\u011b odstupn\u00e9ho a mimo\u0159\u00e1dn\u011b vyplacen\u00e9 mzdy), term\u00ednu uzav\u0159en\u00ed a doby platby mzdy a z\u00e1le\u017eitosti t\u00fdkaj\u00edc\u00ed se zv\u00fd\u0161en\u00ed mzdy<\/li>\n<\/ul>\n\n\n\n<p>Zm\u011bna t\u011bchto &#8220;pracovn\u00edch podm\u00ednek&#8221; vy\u017eaduje podle Japonsk\u00e9ho z\u00e1kona o pracovn\u00ed smlouv\u011b (Japanese Labor Contract Act) jako z\u00e1sadu individu\u00e1ln\u00ed dohodu mezi zam\u011bstnancem a zam\u011bstnavatelem. Av\u0161ak, i kdy\u017e se jedn\u00e1 o zm\u011bnu na z\u00e1klad\u011b dohody, nesm\u00ed b\u00fdt ni\u017e\u0161\u00ed ne\u017e pracovn\u00ed podm\u00ednky stanoven\u00e9 v pracovn\u00edm \u0159\u00e1du.<\/p>\n\n\n\n<p>Zm\u011bna pracovn\u00edch podm\u00ednek je mo\u017en\u00e1 tak\u00e9 prost\u0159ednictv\u00edm zm\u011bny pracovn\u00edho \u0159\u00e1du, ale v tomto p\u0159\u00edpad\u011b je t\u0159eba splnit n\u00e1sleduj\u00edc\u00ed po\u017eadavky:<\/p>\n\n\n\n<ul>\n<li>Zam\u011bstnanci mus\u00ed b\u00fdt sezn\u00e1meni s pracovn\u00edm \u0159\u00e1dem po zm\u011bn\u011b<\/li>\n\n\n\n<li>M\u00edra nev\u00fdhod, kter\u00e9 zam\u011bstnanci utrp\u00ed v d\u016fsledku zm\u011bny pracovn\u00edho \u0159\u00e1du, a nutnost zm\u011bny mus\u00ed b\u00fdt rozumn\u00e9<\/li>\n<\/ul>\n\n\n\n<p>P\u0159i zohledn\u011bn\u00ed v\u00fd\u0161e uveden\u00e9ho lze p\u0159edpokl\u00e1dat, \u017ee pokud spole\u010dnost na\u0159\u00edd\u00ed pr\u00e1ci na d\u00e1lku, nelze sn\u00ed\u017eit plat zam\u011bstnanc\u016fm bez jejich souhlasu, pokud nen\u00ed v pracovn\u00edm \u0159\u00e1du stanoveno &#8220;pracovn\u00ed doba na d\u00e1lku&#8221;.<\/p>\n\n\n\n<p>Pokud chcete v\u011bd\u011bt v\u00edce o pracovn\u00ed smlouv\u011b (zam\u011bstnaneck\u00e9 smlouv\u011b), pod\u00edvejte se na n\u00e1sleduj\u00edc\u00ed \u010dl\u00e1nek, kde je to podrobn\u011b pops\u00e1no spolu s t\u00edmto \u010dl\u00e1nkem.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/checkpoints-of-employment-agreement\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/checkpoints-of-employment-agreement[ja]<\/a><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2021\/12\/telecommuting-employee-salary-gap-2.jpg\" alt=\"\" class=\"wp-image-40735\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Snizeni_platu_v_pripade_kdy_zamestnanec_sam_vyjadri_prani_pracovat_na_dalku\"><\/span>Sn\u00ed\u017een\u00ed platu v p\u0159\u00edpad\u011b, kdy zam\u011bstnanec s\u00e1m vyj\u00e1d\u0159\u00ed p\u0159\u00e1n\u00ed pracovat na d\u00e1lku<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Pokud zam\u011bstnanec vyj\u00e1d\u0159\u00ed p\u0159\u00e1n\u00ed pracovat na d\u00e1lku a spole\u010dnost to schv\u00e1l\u00ed, je mo\u017en\u00e9 zm\u011bnit pracovn\u00ed podm\u00ednky podle \u010dl\u00e1nku 8 z\u00e1kona o pracovn\u00edch smlouv\u00e1ch. P\u0159i t\u00e9to zm\u011bn\u011b se obvykle zva\u017euj\u00ed tak\u00e9 dal\u0161\u00ed pracovn\u00ed podm\u00ednky, jako je &#8220;m\u00edsto pr\u00e1ce&#8221;, &#8220;obsah pr\u00e1ce&#8221;, &#8220;pracovn\u00ed doba&#8221; a &#8220;mzda&#8221;.<\/p>\n\n\n\n<p>Nap\u0159\u00edklad, pokud jsou v pracovn\u00edm \u0159\u00e1du stanoveny hodiny pr\u00e1ce v kancel\u00e1\u0159i, nen\u00ed probl\u00e9m, pokud zam\u011bstnanec pracuje z domova a z\u00edsk\u00e1v\u00e1 tak \u010das na p\u00e9\u010di o d\u011bti nebo o star\u0161\u00ed osoby, pokud je to dohodnuto se sn\u00ed\u017een\u00edm platu. Av\u0161ak v n\u00e1sleduj\u00edc\u00edch p\u0159\u00edpadech je t\u0159eba b\u00fdt opatrn\u00fd.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Snizeni_priplatku_za_prescas_z_duvodu_%E2%80%9Cprace_mimo_pracoviste%E2%80%9D\"><\/span>Sn\u00ed\u017een\u00ed p\u0159\u00edplatku za p\u0159es\u010das z d\u016fvodu &#8220;pr\u00e1ce mimo pracovi\u0161t\u011b&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Pokud zam\u011bstnanec pracuje mimo kancel\u00e1\u0159 d\u00edky pr\u00e1ci na d\u00e1lku a spl\u0148uje ur\u010dit\u00e9 podm\u00ednky, je mo\u017en\u00e9 uplatnit &#8220;syst\u00e9m pracovn\u00ed doby mimo pracovi\u0161t\u011b&#8221; stanoven\u00fd v z\u00e1kon\u011b o pracovn\u00edch norm\u00e1ch, kter\u00fd pova\u017euje za pracovn\u00ed dobu stanovenou pracovn\u00ed dobu stanovenou v pracovn\u00edm \u0159\u00e1du a podobn\u011b.<\/p>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">\u010cl\u00e1nek 38, odstavec 2, bod 1 <br> Pokud zam\u011bstnanec pracuje mimo pracovi\u0161t\u011b po celou nebo \u010d\u00e1st pracovn\u00ed doby a je obt\u00ed\u017en\u00e9 vypo\u010d\u00edtat pracovn\u00ed dobu, pova\u017euje se za to, \u017ee pracoval stanovenou pracovn\u00ed dobu.
