od AKB48, kter\u00e9 se stalo popul\u00e1rn\u00edm d\u00edky videu, ve kter\u00e9m tan\u010d\u00ed zam\u011bstnanci m\u00edstn\u00edch ve\u0159ejn\u00fdch instituc\u00ed, &#8220;Koi Dance&#8221; ze skladby &#8220;Koi&#8221; D\u00edla program\u016f<\/p>\n<\/blockquote>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/intellectual-property-infringement-risk\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/intellectual-property-infringement-risk[ja]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Muze_byt_choreografie_chranena_autorskymi_pravy\"><\/span>M\u016f\u017ee b\u00fdt choreografie chr\u00e1n\u011bna autorsk\u00fdmi pr\u00e1vy?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>V\u00fd\u0161e jsme obecn\u011b vysv\u011btlili autorsk\u00e1 pr\u00e1va, ale mohou b\u00fdt autorsk\u00e1 pr\u00e1va uzn\u00e1na pro choreografii tance?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripady_kdy_byla_choreografie_tance_chranena_autorskymi_pravy\"><\/span>P\u0159\u00edpady, kdy byla choreografie tance chr\u00e1n\u011bna autorsk\u00fdmi pr\u00e1vy<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>V \u010dl\u00e1nku 10 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona (Japanese Copyright Law), kter\u00fd jsme zm\u00ednili v\u00fd\u0161e, je &#8220;tanec&#8221; uveden jako p\u0159\u00edklad v bod\u011b 3.<\/p>\n\n\n\n<p>Tanec je um\u011bleck\u00e1 forma, kter\u00e1 vyjad\u0159uje emoce a v\u016fli t\u00edm, \u017ee t\u011blo se pohybuje rytmicky v souladu s hudbou, a choreografie tance je pova\u017eov\u00e1na za sou\u010d\u00e1st &#8220;tance&#8221;.<\/p>\n\n\n\n<p>Existuj\u00ed p\u0159\u00edpady, kdy soudy uznaly autorsk\u00e1 pr\u00e1va na choreografii tance, jako je rozhodnut\u00ed Tokijsk\u00e9ho okresn\u00edho soudu ze dne 20. listopadu 1998 (Heisei 10) (1998), kter\u00e9 uznalo autorsk\u00e1 pr\u00e1va na choreografii baletu, nebo rozhodnut\u00ed Fukuoka High Court ze dne 26. prosince 2002 (Heisei 14) (2002), kter\u00e9 uznalo autorsk\u00e1 pr\u00e1va na choreografii japonsk\u00e9ho tance.<\/p>\n\n\n\n<p>V ned\u00e1vn\u00e9m p\u0159\u00edpad\u011b, rozhodnut\u00ed \u00d3sack\u00e9ho okresn\u00edho soudu ze dne 21. z\u00e1\u0159\u00ed 2018 (Heisei 30) (2018) uznalo autorsk\u00e1 pr\u00e1va na choreografii hula tance.<\/p>\n\n\n\n<p>P\u0159esto\u017ee p\u0159\u00edpady t\u00fdkaj\u00edc\u00ed se autorsk\u00fdch pr\u00e1v na choreografii tance se z\u0159\u00eddka dost\u00e1vaj\u00ed a\u017e k soudu, existuj\u00ed p\u0159\u00edpady, kdy byla autorsk\u00e1 pr\u00e1va uzn\u00e1na, jak je uvedeno v\u00fd\u0161e.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripady_kdy_nebyla_choreografie_tance_chranena_autorskymi_pravy\"><\/span>P\u0159\u00edpady, kdy nebyla choreografie tance chr\u00e1n\u011bna autorsk\u00fdmi pr\u00e1vy<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>V\u00fd\u0161e jsme p\u0159edstavili p\u0159\u00edpady, kdy byla autorsk\u00e1 pr\u00e1va na choreografii tance uzn\u00e1na, ale existuj\u00ed tak\u00e9 p\u0159\u00edpady, kdy byla autorsk\u00e1 pr\u00e1va zam\u00edtnuta.<\/p>\n\n\n\n<p>Takov\u00fdm p\u0159\u00edpadem je p\u0159\u00edpad choreografie &#8220;Shall we dance?&#8221; (Rozhodnut\u00ed Tokijsk\u00e9ho okresn\u00edho soudu ze dne 28. \u00fanora 2012 (Heisei 24) (2012)).<\/p>\n\n\n\n<p>V tomto p\u0159\u00edpad\u011b byla ot\u00e1zka autorsk\u00fdch pr\u00e1v na &#8220;spole\u010densk\u00fd tanec&#8221; p\u0159edm\u011btem sporu. Rozhodnut\u00ed zam\u00edtlo autorsk\u00e1 pr\u00e1va na choreografii, kterou \u017ealobce tvrdil, \u017ee je chr\u00e1n\u011bna autorsk\u00fdmi pr\u00e1vy, proto\u017ee nebyla pova\u017eov\u00e1na za origin\u00e1ln\u00ed.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Choreografie spole\u010densk\u00e9ho tance spo\u010d\u00edv\u00e1 v tom, \u017ee se kombinuj\u00ed existuj\u00edc\u00ed kroky, jako jsou z\u00e1kladn\u00ed kroky nebo kroky z PV, a p\u0159id\u00e1vaj\u00ed se k nim vhodn\u00e9 \u00fapravy, aby se vytvo\u0159il tanec s ur\u010dit\u00fdm pr\u016fb\u011bhem. To proto, \u017ee spole\u010densk\u00fd tanec je p\u0159edpokl\u00e1d\u00e1n jako n\u011bco, co se tancuje voln\u00fdm kombinov\u00e1n\u00edm existuj\u00edc\u00edch krok\u016f, a vzhledem k tomu, \u017ee je \u0161iroce tancov\u00e1n nejen sout\u011b\u017e\u00edc\u00edmi, ale tak\u00e9 obecn\u00fdmi milovn\u00edky, pokud by byla uzn\u00e1na autorsk\u00e1 pr\u00e1va na choreografii s jak\u00fdmkoli charakterem kombinace, mohlo by doj\u00edt k tomu, \u017ee by byla uzn\u00e1na autorsk\u00e1 pr\u00e1va na nes\u010detn\u00e9 choreografie s jen mal\u00fdmi rozd\u00edly, co\u017e by umo\u017enilo monopol jednotlivce a mohlo by omezit svobodu choreografie.
