Z\u00e1kladn\u00ed smlouva o do\u010dasn\u00e9m zam\u011bstn\u00e1v\u00e1n\u00ed je sice pom\u011brn\u011b standardizovan\u00e1, ale mnoho jej\u00edch ustanoven\u00ed je zalo\u017eeno na z\u00e1kon\u011b o do\u010dasn\u00e9m zam\u011bstn\u00e1v\u00e1n\u00ed (japonsk\u00fd z\u00e1kon o do\u010dasn\u00e9m zam\u011bstn\u00e1v\u00e1n\u00ed). Proto je pro vytvo\u0159en\u00ed z\u00e1kladn\u00ed smlouvy o do\u010dasn\u00e9m zam\u011bstn\u00e1v\u00e1n\u00ed nezbytn\u00e1 z\u00e1kladn\u00ed znalost z\u00e1kona o do\u010dasn\u00e9m zam\u011bstn\u00e1v\u00e1n\u00ed.<\/p>\n\n\n\n<p>V tomto kontextu budeme diskutovat o typick\u00fdch ustanoven\u00edch v z\u00e1kladn\u00ed smlouv\u011b o do\u010dasn\u00e9m class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> Vysl\u00e1n\u00ed pracovn\u00edk\u016f je syst\u00e9m, kdy pracovn\u00edk uzav\u0159e pracovn\u00ed smlouvu s vys\u00edlaj\u00edc\u00ed spole\u010dnost\u00ed (vys\u00edlaj\u00edc\u00ed strana) a je vysl\u00e1n do jin\u00e9 spole\u010dnosti (p\u0159\u00edjemce), kde skute\u010dn\u011b pracuje pod veden\u00edm a dohledem. Rozd\u00edly mezi vysl\u00e1n\u00edm, delegov\u00e1n\u00edm, kvazipov\u011b\u0159en\u00edm, subdod\u00e1vkou, fale\u0161nou subdod\u00e1vkou a dod\u00e1vkou pracovn\u00edk\u016f jsou podrobn\u011b vysv\u011btleny v n\u00e1sleduj\u00edc\u00edm \u010dl\u00e1nku. <\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/difference-contract-dispatch-loan-labor-supply\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/difference-contract-dispatch-loan-labor-supply[ja]<\/a><\/p>\n\n\n\n<p> Velkou charakteristikou vysl\u00e1n\u00ed pracovn\u00edk\u016f je, \u017ee spole\u010dnost, se kterou je uzav\u0159ena pracovn\u00ed smlouva, a spole\u010dnost, ve kter\u00e9 pracovn\u00edk skute\u010dn\u011b pracuje pod veden\u00edm a dohledem, jsou r\u016fzn\u00e9. Je tak\u00e9 d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee mezi vyslan\u00fdm pracovn\u00edkem a p\u0159\u00edjemcem neexistuje smluvn\u00ed vztah. <\/p>\n\n\n\n<p> D\u0159\u00edve existovaly dva typy vysl\u00e1n\u00ed pracovn\u00edk\u016f: &#8220;specifick\u00e9 vysl\u00e1n\u00ed pracovn\u00edk\u016f&#8221;, zn\u00e1m\u00e9 jako registrace, a &#8220;obecn\u00e9 vysl\u00e1n\u00ed pracovn\u00edk\u016f&#8221;, zn\u00e1m\u00e9 jako st\u00e1l\u00e9 vysl\u00e1n\u00ed. Prvn\u00ed byl syst\u00e9m povolen\u00ed a druh\u00fd byl syst\u00e9m ozn\u00e1men\u00ed. Av\u0161ak, odm\u011bna za vysl\u00e1n\u00ed pracovn\u00edk\u016f, kter\u00e1 byla zavedena v roce 2015 (2015), zru\u0161ila tento rozd\u00edl a nyn\u00ed je v\u0161echno vysl\u00e1n\u00ed pracovn\u00edk\u016f syst\u00e9mem povolen\u00ed. <\/p>\n\n\n\n<p> Je t\u0159eba poznamenat, \u017ee denn\u00ed vysl\u00e1n\u00ed, kter\u00e9 bylo v minulosti v\u00fdrazn\u011b vyu\u017e\u00edv\u00e1no p\u0159edev\u0161\u00edm mlad\u00fdmi lidmi, bylo zru\u0161eno jako soci\u00e1ln\u00ed probl\u00e9m a nyn\u00ed je z\u00e1sadn\u011b zak\u00e1z\u00e1no. <\/p>\n\n\n\n<p> Krom\u011b toho, podrobn\u00fd v\u00fdklad o fale\u0161n\u00e9 subdod\u00e1vce, kter\u00e1 je podobn\u00e1, ale odli\u0161n\u00e1 od vysl\u00e1n\u00ed a \u010dasto zp\u016fsobuje probl\u00e9my v IT odv\u011btv\u00ed, je uveden v n\u00e1sleduj\u00edc\u00edm \u010dl\u00e1nku. <\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/criteria-for-disguised-contract\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/criteria-for-disguised-contract[ja]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Klicove_body_zakladni_smlouvy_o_vysilani_pracovniku\"><\/span>Kl\u00ed\u010dov\u00e9 body z\u00e1kladn\u00ed smlouvy o vys\u00edl\u00e1n\u00ed pracovn\u00edk\u016f<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2020\/06\/worker-dispatch-contract.jpg\" alt=\"\" class=\"wp-image-12763\" \/><\/figure>\n\n\n\n<p>Je b\u011b\u017en\u00e9, \u017ee kdy\u017e vys\u00edlaj\u00edc\u00ed strana vys\u00edl\u00e1 pracovn\u00edky k p\u0159\u00edjemci, uzav\u0159e se mezi vys\u00edlaj\u00edc\u00ed stranou a p\u0159\u00edjemcem z\u00e1kladn\u00ed smlouva o vys\u00edl\u00e1n\u00ed pracovn\u00edk\u016f, a pot\u00e9 se uzav\u0159e individu\u00e1ln\u00ed smlouva t\u00fdkaj\u00edc\u00ed se konkr\u00e9tn\u00edch vys\u00edlac\u00edch prac\u00ed. Zde vysv\u011btl\u00edme kl\u00ed\u010dov\u00e9 body z\u00e1kladn\u00ed smlouvy o vys\u00edl\u00e1n\u00ed pracovn\u00edk\u016f. V n\u00e1sleduj\u00edc\u00edch p\u0159\u00edkladech dolo\u017eek &#8220;A&#8221; ozna\u010duje p\u0159\u00edjemce a &#8220;B&#8221; ozna\u010duje vys\u00edlaj\u00edc\u00ed stranu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Klauzule_o_individualnich_smlouvach\"><\/span> Klauzule o individu\u00e1ln\u00edch smlouv\u00e1ch <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">Strany A a B uzav\u00edraj\u00ed p\u0159i ka\u017ed\u00e9m poskytnut\u00ed pracovn\u00edk\u016f stranou B stran\u011b A individu\u00e1ln\u00ed smlouvu (d\u00e1le jen &#8220;individu\u00e1ln\u00ed smlouva&#8221;) podle \u010dl\u00e1nku 26 odst. 1 japonsk\u00e9ho z\u00e1kona o poskytov\u00e1n\u00ed pracovn\u00edk\u016f (Japanese Worker Dispatch Law), kter\u00e1 stanov\u00ed podrobnosti t\u00fdkaj\u00edc\u00ed se povahy pr\u00e1ce, kterou maj\u00ed vykon\u00e1vat poskytnut\u00ed pracovn\u00edci, m\u00edsta pr\u00e1ce, pracovn\u00ed doby a dal\u0161\u00edch detail\u016f pot\u0159ebn\u00fdch pro poskytnut\u00ed pracovn\u00edk\u016f.<\/p>\n\n\n\n<p>Smlouva o poskytnut\u00ed pracovn\u00edk\u016f je &#8220;smlouva, ve kter\u00e9 jedna ze stran slibuje druh\u00e9 stran\u011b poskytnout pracovn\u00edky&#8221; (\u010dl\u00e1nek 26 odst. 1 japonsk\u00e9ho z\u00e1kona o poskytnut\u00ed pracovn\u00edk\u016f). Tato smlouva je uzav\u0159ena mezi firmou poskytuj\u00edc\u00ed pracovn\u00edky a firmou, kter\u00e1 pracovn\u00edky p\u0159ij\u00edm\u00e1.<\/p>\n\n\n\n<p>V mnoha p\u0159\u00edpadech, po uzav\u0159en\u00ed z\u00e1kladn\u00ed smlouvy o poskytnut\u00ed pracovn\u00edk\u016f mezi firmou poskytuj\u00edc\u00ed pracovn\u00edky a firmou, kter\u00e1 pracovn\u00edky p\u0159ij\u00edm\u00e1, se pro ka\u017ed\u00e9 poskytnut\u00ed pracovn\u00edk\u016f uzav\u00edr\u00e1 individu\u00e1ln\u00ed smlouva, kter\u00e1 stanov\u00ed konkr\u00e9tn\u00ed pracovn\u00ed podm\u00ednky atd. Je t\u0159eba si uv\u011bdomit, \u017ee smlouva o poskytnut\u00ed pracovn\u00edk\u016f podle \u010dl\u00e1nku 26 japonsk\u00e9ho z\u00e1kona o poskytnut\u00ed pracovn\u00edk\u016f se nevztahuje na z\u00e1kladn\u00ed smlouvu, ale na individu\u00e1ln\u00ed smlouvu.<\/p>\n\n\n\n<p>Pr\u00e1vn\u00ed p\u0159edpisy stanovuj\u00ed, co by m\u011blo b\u00fdt uvedeno v individu\u00e1ln\u00ed smlouv\u011b. N\u00e1sleduj\u00edc\u00ed je jen p\u0159\u00edklad, ale v\u011bci, kter\u00e9 by m\u011bly b\u00fdt uvedeny v individu\u00e1ln\u00ed smlouv\u011b, jsou velmi rozmanit\u00e9.<\/p>\n\n\n\n<ul>\n<li>Podrobnosti o pr\u00e1ci, kterou maj\u00ed vykon\u00e1vat poskytnut\u00ed pracovn\u00edci<\/li>\n\n\n\n<li>N\u00e1zev a adresa pracovi\u0161t\u011b, kde budou poskytnut\u00ed pracovn\u00edci pracovat, a dal\u0161\u00ed m\u00edsta, kde budou poskytnut\u00ed pracovn\u00edci pracovat v souvislosti s poskytnut\u00edm pracovn\u00edk\u016f<\/li>\n\n\n\n<li>Podrobnosti o osob\u011b, kter\u00e1 m\u00e1 p\u0159\u00edm\u00fd dohled a \u0159\u00edzen\u00ed nad poskytnut\u00fdmi pracovn\u00edky b\u011bhem jejich pr\u00e1ce pro osobu, kter\u00e1 p\u0159ij\u00edm\u00e1 slu\u017eby poskytnut\u00ed pracovn\u00edk\u016f<\/li>\n\n\n\n<li>Doba poskytnut\u00ed pracovn\u00edk\u016f a dny, kdy budou poskytnut\u00ed pracovn\u00edci pracovat<\/li>\n\n\n\n<li>\u010casy za\u010d\u00e1tku a konce pr\u00e1ce poskytnut\u00fdch pracovn\u00edk\u016f, doba p\u0159est\u00e1vky, a z\u00e1le\u017eitosti t\u00fdkaj\u00edc\u00ed se bezpe\u010dnosti a hygieny<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ustanoveni_o_dobe_prijimani_docasnych_pracovniku\"><\/span>Ustanoven\u00ed o dob\u011b p\u0159ij\u00edm\u00e1n\u00ed do\u010dasn\u00fdch pracovn\u00edk\u016f<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">Strany A a B se dohodly, \u017ee pro ka\u017edou pracovn\u00ed \u010dinnost v provozovn\u011b nebo jin\u00e9m m\u00edst\u011b do\u010dasn\u00e9ho zam\u011bstn\u00e1n\u00ed (d\u00e1le jen &#8220;provozovna atd.&#8221;) nep\u0159ijmou ani nezas\u00edlaj\u00ed do\u010dasn\u00e9 pracovn\u00edky po dobu del\u0161\u00ed ne\u017e t\u0159i roky (s v\u00fdjimkou p\u0159\u00edpad\u016f, kdy je tato doba prodlou\u017eena na z\u00e1klad\u011b konzultace s ve\u0159ejnost\u00ed), s v\u00fdjimkou do\u010dasn\u00e9ho zam\u011bstn\u00e1n\u00ed pracovn\u00edk\u016f, kter\u00e9 nespad\u00e1 pod omezen\u00ed doby (tj. do\u010dasn\u00e9 zam\u011bstn\u00e1n\u00ed pracovn\u00edk\u016f, kter\u00e9 odpov\u00edd\u00e1 ustanoven\u00edm odstavce 1 \u010dl\u00e1nku 40.2 japonsk\u00e9ho z\u00e1kona o do\u010dasn\u00e9m zam\u011bstn\u00e1n\u00ed pracovn\u00edk\u016f).<\/p>\n\n\n\n<p>V roce 2015 (rok 27 Heisei) byl zaveden revidovan\u00fd japonsk\u00fd z\u00e1kon o do\u010dasn\u00e9m zam\u011bstn\u00e1n\u00ed pracovn\u00edk\u016f, kter\u00fd stanovuje pravidlo, \u017ee doba, po kterou m\u016f\u017ee b\u00fdt jeden do\u010dasn\u00fd pracovn\u00edk vysl\u00e1n do provozovny, je v z\u00e1sad\u011b omezena na t\u0159i roky. Stejn\u011b tak, pokud dojde k dopravn\u00ed nehod\u011b b\u011bhem \u0159\u00edzen\u00ed automobilu, m\u016f\u017ee b\u00fdt strana A povinna nahradit \u0161kodu.<\/p>\n\n\n\n<p>Z tohoto d\u016fvodu je b\u011b\u017en\u00e9, \u017ee strana A jako vys\u00edlaj\u00edc\u00ed strana zakazuje pracovn\u00edk\u016fm zach\u00e1zen\u00ed s pen\u011bzi a pou\u017e\u00edv\u00e1n\u00ed automobil\u016f jako z\u00e1kladn\u00ed pravidlo, ale povoluje to v p\u0159\u00edpad\u011b pot\u0159eby na z\u00e1klad\u011b individu\u00e1ln\u00ed dohody.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ustanoveni_o_zajisteni_spravedliveho_zamestnani\"><\/span>Ustanoven\u00ed o zaji\u0161t\u011bn\u00ed spravedliv\u00e9ho zam\u011bstn\u00e1n\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">1. Strana A se zavazuje dodr\u017eovat pracovn\u00ed podm\u00ednky stanoven\u00e9 v pracovn\u00edm z\u00e1kon\u011b a dal\u0161\u00edch p\u0159edpisech, stejn\u011b jako v t\u00e9to smlouv\u011b a individu\u00e1ln\u00edch smlouv\u00e1ch pro pracovn\u00edky na dohodu, a zajistit, aby byla pr\u00e1ce na dohodu prov\u00e1d\u011bna spr\u00e1vn\u011b a hladce. Strana A se tak\u00e9 zavazuje br\u00e1t v \u00favahu prevenci sexu\u00e1ln\u00edho obt\u011b\u017eov\u00e1n\u00ed a usilovat o poskytnut\u00ed v\u00fdhod pro pracovn\u00edky na dohodu v za\u0159\u00edzen\u00edch, jako jsou l\u00e9ka\u0159sk\u00e9 ordinace a stravovac\u00ed za\u0159\u00edzen\u00ed, pokud je to mo\u017en\u00e9.<br>2. Strana A se zavazuje co nejv\u00edce spolupracovat na vzd\u011bl\u00e1v\u00e1n\u00ed a \u0161kolen\u00ed pracovn\u00edk\u016f na dohodu, kter\u00e9 prov\u00e1d\u00ed Strana B, v oblasti znalost\u00ed, dovednost\u00ed, technick\u00fdch dovednost\u00ed atd., a na bezpe\u010dnostn\u00edm a zdravotn\u00edm vzd\u011bl\u00e1v\u00e1n\u00ed, stejn\u011b jako na samostatn\u00e9m rozvoji schopnost\u00ed pracovn\u00edk\u016f na dohodu. Strana A se tak\u00e9 zavazuje usilovat o to, aby byli pracovn\u00edci na dohodu zahrnuti do vzd\u011bl\u00e1vac\u00edch a \u0161kolen\u00edch program\u016f pro pracovn\u00edky Strany A, kte\u0159\u00ed vykon\u00e1vaj\u00ed stejnou pr\u00e1ci.<\/p>\n\n\n\n<p>Je mo\u017en\u00e9, \u017ee v z\u00e1kladn\u00ed smlouv\u011b o poskytov\u00e1n\u00ed pracovn\u00edk\u016f na dohodu budou stanoveny tak\u00e9 z\u00e1vazky, jako je prevence sexu\u00e1ln\u00edho obt\u011b\u017eov\u00e1n\u00ed ze strany firmy, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu, a snaha o poskytnut\u00ed stejn\u00e9ho vzd\u011bl\u00e1v\u00e1n\u00ed a \u0161kolen\u00ed jako pro zam\u011bstnance firmy, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu.<\/p>\n\n\n\n<p>Podle \u010dl\u00e1nku 40 z\u00e1kona o poskytov\u00e1n\u00ed pracovn\u00edk\u016f na dohodu (Z\u00e1kon o poskytov\u00e1n\u00ed pracovn\u00edk\u016f na dohodu) je firma, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu, povinna usilovat o udr\u017een\u00ed spr\u00e1vn\u00e9ho pracovn\u00edho prost\u0159ed\u00ed. Konkr\u00e9tn\u011b, pokud firma, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu, obdr\u017e\u00ed st\u00ed\u017enost t\u00fdkaj\u00edc\u00ed se pr\u00e1ce od pracovn\u00edka na dohodu, mus\u00ed o tom informovat firmu, kter\u00e1 poskytuje pracovn\u00edky na dohodu, a zpracovat st\u00ed\u017enost. Firma, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu, je tak\u00e9 povinna usilovat o udr\u017een\u00ed spr\u00e1vn\u00e9ho pracovn\u00edho prost\u0159ed\u00ed, v\u010detn\u011b prevence sexu\u00e1ln\u00edho obt\u011b\u017eov\u00e1n\u00ed. Prvn\u00ed odstavec tohoto ustanoven\u00ed potvrzuje tyto povinnosti firmy, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu, v z\u00e1kladn\u00ed smlouv\u011b o poskytov\u00e1n\u00ed pracovn\u00edk\u016f na dohodu.<\/p>\n\n\n\n<p>Podle \u010dl\u00e1nku 40 z\u00e1kona o poskytov\u00e1n\u00ed pracovn\u00edk\u016f na dohodu je firma, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu, povinna usilovat o to, aby byly vzd\u011bl\u00e1vac\u00ed a \u0161kolen\u00ed a soci\u00e1ln\u00ed zabezpe\u010den\u00ed pro pracovn\u00edky na dohodu stejn\u00e9 jako pro zam\u011bstnance firmy, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu. Druh\u00fd odstavec tohoto ustanoven\u00ed odpov\u00edd\u00e1 na tyto povinnosti firmy, kter\u00e1 p\u0159ij\u00edm\u00e1 pracovn\u00edky na dohodu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Klauzule_tykajici_se_prace_mimo_stanovenou_pracovni_dobu\"><\/span> Klauzule t\u00fdkaj\u00edc\u00ed se pr\u00e1ce mimo stanovenou pracovn\u00ed dobu <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">Strana A m\u016f\u017ee na\u0159\u00eddit pracovn\u00edk\u016fm na dohodu (d\u00e1le jen &#8220;36 dohoda&#8221;), kter\u00e1 byla ozn\u00e1mena stranou B v souladu s \u010dl\u00e1nkem 36 japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech (Labour Standards Act), aby pracovali mimo stanovenou pracovn\u00ed dobu a o sv\u00e1tc\u00edch, a to v r\u00e1mci t\u00e9to dohody a v souladu s individu\u00e1ln\u00ed smlouvou.<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b do\u010dasn\u00e9ho nasazen\u00ed pracovn\u00edk\u016f jsou podm\u00ednky zam\u011bstn\u00e1n\u00ed do\u010dasn\u011b nasazen\u00fdch pracovn\u00edk\u016f na m\u00edst\u011b nasazen\u00ed stanoveny v pracovn\u00ed smlouv\u011b uzav\u0159en\u00e9 mezi p\u016fvodn\u00edm zam\u011bstnavatelem a m\u00edstem nasazen\u00ed. V mnoha p\u0159\u00edpadech jsou v z\u00e1kladn\u00ed smlouv\u011b o do\u010dasn\u00e9m nasazen\u00ed pracovn\u00edk\u016f stanoveny pouze abstraktn\u00ed z\u00e1le\u017eitosti a konkr\u00e9tn\u00ed obsah je stanoven v individu\u00e1ln\u00ed smlouv\u011b.<\/p>\n\n\n\n<p>M\u00edsto nasazen\u00ed mus\u00ed dodr\u017eovat podm\u00ednky zam\u011bstn\u00e1n\u00ed stanoven\u00e9 v smlouv\u011b o do\u010dasn\u00e9m nasazen\u00ed pracovn\u00edk\u016f. M\u00edsto nasazen\u00ed tak\u00e9 nese odpov\u011bdnost za dodr\u017eov\u00e1n\u00ed povinnost\u00ed t\u00fdkaj\u00edc\u00edch se pr\u00e1ce mimo stanovenou pracovn\u00ed dobu, p\u0159est\u00e1vek a sv\u00e1tk\u016f podle japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech.<\/p>\n\n\n\n<p>Podle japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech je nutn\u00e9, pokud se od pracovn\u00edk\u016f vy\u017eaduje, aby pracovali v\u00edce ne\u017e 8 hodin denn\u011b nebo 40 hodin t\u00fddn\u011b, podat takzvanou &#8220;36 dohodu&#8221;. V p\u0159\u00edpad\u011b do\u010dasn\u00e9ho nasazen\u00ed pracovn\u00edk\u016f nese b\u0159emeno pod\u00e1n\u00ed &#8220;36 dohody&#8221; p\u016fvodn\u00ed zam\u011bstnavatel, ale je t\u0159eba poznamenat, \u017ee odpov\u011bdnost za \u0159\u00edzen\u00ed pr\u00e1ce mimo stanovenou pracovn\u00ed dobu atd. nese m\u00edsto nasazen\u00ed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Klauzule_o_nahrade_skody\"><\/span> Klauzule o n\u00e1hrad\u011b \u0161kody <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2020\/06\/worker-dispatch-contract3.jpg\" alt=\"\" class=\"wp-image-12767\" \/><\/figure>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\"> Pokud pracovn\u00edk nasazen\u00fd na do\u010dasnou pr\u00e1ci zp\u016fsob\u00ed \u00famysln\u011b nebo z hrub\u00e9 nedbalosti \u0161kodu stran\u011b A nebo t\u0159et\u00ed osob\u011b p\u0159i v\u00fdkonu sv\u00e9 pr\u00e1ce, strana B nese odpov\u011bdnost za n\u00e1hradu \u0161kody stran\u011b A. Av\u0161ak, pokud se prok\u00e1\u017ee, \u017ee \u0161koda vznikla v d\u016fsledku pokyn\u016f nebo p\u0159\u00edkaz\u016f vyd\u00e1van\u00fdch pracovn\u00edkem nasazen\u00fdm na do\u010dasnou pr\u00e1ci stranou A nebo jinou osobou, kterou strana A pou\u017e\u00edv\u00e1 (d\u00e1le jen &#8220;osoba vyd\u00e1vaj\u00edc\u00ed pokyny atd.&#8221;), v\u010detn\u011b ne\u010dinnosti, kdy nebyly poskytnuty nezbytn\u00e9 pokyny nebo instrukce, toto omezen\u00ed neplat\u00ed. <\/p>\n\n\n\n<p> Pokud pracovn\u00edk nasazen\u00fd na do\u010dasnou pr\u00e1ci zp\u016fsob\u00ed \u0161kodu t\u0159et\u00ed stran\u011b, jako je spole\u010dnost, kam byl nasazen, nebo z\u00e1kazn\u00edk, v souvislosti s do\u010dasnou prac\u00ed, m\u016f\u017ee b\u00fdt ot\u00e1zkou, kdo nese odpov\u011bdnost za n\u00e1hradu \u0161kody. V p\u0159\u00edkladu klauzule se p\u0159edpokl\u00e1d\u00e1, \u017ee odpov\u011bdnost za n\u00e1hradu \u0161kody nese v z\u00e1sad\u011b strana, kter\u00e1 pracovn\u00edka nasadila, ale pokud je p\u0159\u00ed\u010dinou pokyny nebo p\u0159\u00edkazy ze strany spole\u010dnosti, kam byl pracovn\u00edk nasazen, nebere na sebe odpov\u011bdnost za n\u00e1hradu \u0161kody nebo sni\u017euje sv\u016fj pod\u00edl na n\u00e1hrad\u011b \u0161kody. <\/p>\n\n\n\n<p> D\u00e1le, pokud pracovn\u00edk nasazen\u00fd na do\u010dasnou pr\u00e1ci manipuluje s pen\u011bzi nebo pou\u017e\u00edv\u00e1 automobil, m\u016f\u017ee b\u00fdt \u010d\u00e1stka n\u00e1hrady \u0161kody snadno p\u0159emr\u0161t\u011bn\u00e1, tak\u017ee je \u00fa\u010dinn\u00e9 stanovit horn\u00ed limit \u010d\u00e1stky n\u00e1hrady \u0161kody. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Shrnuti\"><\/span> Shrnut\u00ed <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Co se t\u00fd\u010de z\u00e1kladn\u00ed smlouvy o vys\u00edl\u00e1n\u00ed pracovn\u00edk\u016f, mnoho ustanoven\u00ed je stanoveno na z\u00e1klad\u011b japonsk\u00e9ho z\u00e1kona o vys\u00edl\u00e1n\u00ed pracovn\u00edk\u016f (Z\u00e1kon o vys\u00edl\u00e1n\u00ed pracovn\u00edk\u016f).
