podnik\u00e1n\u00ed, kter\u00e9 spo\u010d\u00edv\u00e1 v tom, \u017ee se uchaze\u010d\u016fm o pr\u00e1ci p\u0159edstavuj\u00ed zam\u011bstnavatel\u00e9 a od zam\u011bstnavatel\u016f se vyb\u00edraj\u00ed poplatky za zprost\u0159edkov\u00e1n\u00ed.<\/p>\n\n\n\n<p>Tento poplatek za zprost\u0159edkov\u00e1n\u00ed je bu\u010f &#8220;poplatek na z\u00e1klad\u011b ozn\u00e1men\u00ed&#8221; nebo &#8220;maxim\u00e1ln\u00ed poplatek&#8221;, p\u0159i\u010dem\u017e v prvn\u00edm p\u0159\u00edpad\u011b m\u016f\u017ee agentura za zprost\u0159edkov\u00e1n\u00ed p\u0159ijmout a\u017e 50% ro\u010dn\u00edho p\u0159\u00edjmu uchaze\u010de o pr\u00e1ci, v druh\u00e9m p\u0159\u00edpad\u011b 10,5% z vyplacen\u00e9 mzdy (maxim\u00e1ln\u011b za 6 m\u011bs\u00edc\u016f).<\/p>\n\n\n\n<p>Dnes v\u011bt\u0161ina agentur za zprost\u0159edkov\u00e1n\u00ed \u00fa\u010dtuje poplatek na z\u00e1klad\u011b ozn\u00e1men\u00ed a b\u011b\u017en\u00e1 sazba je 30-40% ro\u010dn\u00edho p\u0159\u00edjmu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripady_kdy_je_nutne_mit_povoleni_pro_placene_zprostredkovani_zamestnani\"><\/span>P\u0159\u00edpady, kdy je nutn\u00e9 m\u00edt povolen\u00ed pro placen\u00e9 zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" (japonsk\u00fd Z\u00e1kon o stabilizaci zam\u011bstnanosti) definuje v \u010dl\u00e1nku 4 odstavec 1 &#8220;zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed&#8221; jako p\u0159ij\u00edm\u00e1n\u00ed nab\u00eddek zam\u011bstn\u00e1n\u00ed a hled\u00e1n\u00ed pr\u00e1ce a zprost\u0159edkov\u00e1n\u00ed vzniku pracovn\u00edho vztahu mezi zam\u011bstnavatelem a uchaze\u010dem o zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>Z tohoto vymezen\u00ed &#8220;vzniku pracovn\u00edho vztahu&#8221; vypl\u00fdv\u00e1, \u017ee pokud doch\u00e1z\u00ed k uzav\u0159en\u00ed jin\u00fdch ne\u017e pracovn\u00edch vztah\u016f, jako jsou smlouvy o zprost\u0159edkov\u00e1n\u00ed slu\u017eeb nebo smlouvy o d\u00edlo, nejedn\u00e1 se o &#8220;zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed&#8221;.<\/p>\n\n\n\n<p>D\u00e1le &#8220;zprost\u0159edkov\u00e1n\u00ed&#8221; v r\u00e1mci &#8220;zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed&#8221; znamen\u00e1 \u010dinnost, p\u0159i kter\u00e9 se po p\u0159ijet\u00ed nab\u00eddek zam\u011bstn\u00e1n\u00ed a hled\u00e1n\u00ed pr\u00e1ce zasahuje mezi zam\u011bstnavatelem a uchaze\u010dem o zam\u011bstn\u00e1n\u00ed, usnad\u0148uje vznik pracovn\u00edho vztahu mezi ob\u011bma stranami a usnad\u0148uje jeho vznik.<\/p>\n\n\n\n<p>Slu\u017eby, kdy agent, podobn\u011b jako v tradi\u010dn\u00edm byznysu s lidsk\u00fdmi zdroji, p\u0159edkl\u00e1d\u00e1 uchaze\u010d\u016fm o zam\u011bstn\u00e1n\u00ed informace o nab\u00eddk\u00e1ch zam\u011bstn\u00e1n\u00ed od zam\u011bstnavatel\u016f, doporu\u010duje jim se p\u0159ihl\u00e1sit, organizuje pohovory nebo zastupuje je p\u0159i vyjedn\u00e1v\u00e1n\u00ed o mzdov\u00fdch podm\u00ednk\u00e1ch, jsou typick\u00fdm p\u0159\u00edkladem &#8220;zprost\u0159edkov\u00e1n\u00ed&#8221;.<\/p>\n\n\n\n<p>Podle Z\u00e1kona o stabilizaci zam\u011bstnanosti, ti, kte\u0159\u00ed prov\u00e1d\u011bj\u00ed zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed za \u00faplatu, mus\u00ed z\u00edskat povolen\u00ed pro placen\u00e9 zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed od Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed (\u010dl\u00e1nek 30 odstavec 1 Z\u00e1kona o stabilizaci zam\u011bstnanosti).<\/p>\n\n\n\n<p>Nav\u00edc, i ti, kte\u0159\u00ed prov\u00e1d\u011bj\u00ed zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed zdarma, mus\u00ed v n\u011bkter\u00fdch p\u0159\u00edpadech z\u00edskat povolen\u00ed od Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed (\u010dl\u00e1nek 33 odstavec 1 Z\u00e1kona o stabilizaci zam\u011bstnanosti).<\/p>\n\n\n\n<p>Pokud n\u011bkdo prov\u00e1d\u00ed zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed za \u00faplatu bez z\u00edsk\u00e1n\u00ed povolen\u00ed pro placen\u00e9 zprost\u0159edkov\u00e1n\u00ed zam\u011bstnan\u00ed, m\u016f\u017ee b\u00fdt potrest\u00e1n trestem odn\u011bt\u00ed svobody a\u017e na jeden rok nebo pokutou do v\u00fd\u0161e 1 milionu jen\u016f (\u010dl\u00e1nek 64 Z\u00e1kona o stabilizaci zam\u011bstnanosti).<\/p>\n\n\n\n<p>Jin\u00fdmi slovy, pokud neposkytujete individu\u00e1ln\u00ed zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed uchaze\u010d\u016fm o zam\u011bstn\u00e1n\u00ed, ale pouze poskytujete informace o nab\u00eddk\u00e1ch zam\u011bstn\u00e1n\u00ed nebo informace o uchaze\u010d\u00edch o zam\u011bstn\u00e1n\u00ed, nep\u0159ij\u00edm\u00e1te nab\u00eddky zam\u011bstn\u00e1n\u00ed nebo hled\u00e1n\u00ed pr\u00e1ce a nezprost\u0159edkov\u00e1v\u00e1te vznik pracovn\u00edho vztahu, nejedn\u00e1 se o &#8220;zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed&#8221; a i kdy\u017e to prov\u00e1d\u00edte jako podnik\u00e1n\u00ed, nepot\u0159ebujete povolen\u00ed pro placen\u00e9 zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>Co se t\u00fd\u010de vyu\u017eit\u00ed lidsk\u00fdch zdroj\u016f mimo zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed, jako je vysl\u00e1n\u00ed, do\u010dasn\u00e9 p\u0159id\u011blen\u00ed, kvazipov\u011b\u0159en\u00ed, smlouvy o d\u00edlo atd., vysv\u011btlujeme to v n\u00e1sleduj\u00edc\u00edm placen\u00e9 slu\u017eby zam\u011bstnaneck\u00e9ho zprost\u0159edkov\u00e1n\u00ed.<\/p>\n\n\n\n<p>D\u016fvodem je, \u017ee neukazuj\u00ed pouze specifick\u00e9 informace o pracovn\u00edch m\u00edstech, ale ukazuj\u00ed v\u0161echny pracovn\u00ed nab\u00eddky, kter\u00e9 odpov\u00eddaj\u00ed vyhled\u00e1vac\u00edm krit\u00e9ri\u00edm uchaze\u010d\u016f o zam\u011bstn\u00e1n\u00ed, a tak\u00e9 nekomunikuj\u00ed s uchaze\u010di o zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>Pro p\u00e1rov\u00e1n\u00ed uchaze\u010d\u016f o zam\u011bstn\u00e1n\u00ed a nab\u00edzej\u00edc\u00edch stran se vyu\u017e\u00edv\u00e1 syst\u00e9m \u0159e\u0161en\u00ed \u0161ed\u00e9 z\u00f3ny Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed.
