Autorsk\u00e9 pr\u00e1vo vznik\u00e1 sou\u010dasn\u011b s vytvo\u0159en\u00edm d\u00edla a nen\u00ed t\u0159eba \u017e\u00e1dn\u00e9ho postupu, jako je \u017e\u00e1dost o patent.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"d\u00edlo-a-autor\"><span class=\"ez-toc-section\" id=\"Dilo_a_autor\"><\/span>D\u00edlo a autor<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Definice &#8220;d\u00edla&#8221; je stanovena v \u010dl\u00e1nku 2 odstavec 1 bod 1 Japonsk\u00e9ho z\u00e1kona o autorsk\u00e9m pr\u00e1vu (Japanese Copyright Law) n\u00e1sledovn\u011b:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u010cl\u00e1nek 2 odstavec 1 bod 1: Mysl\u00ed se t\u00edm n\u011bco, co kreativn\u011b vyjad\u0159uje my\u0161lenky nebo pocity a pat\u0159\u00ed do oblasti literatury, v\u011bdy, um\u011bn\u00ed nebo hudby.<\/p>\n<\/blockquote>\n\n\n\n<p>D\u00edlo m\u016f\u017ee zahrnovat n\u00e1sleduj\u00edc\u00ed:<\/p>\n\n\n\n<ul>\n<li>V\u011bdeck\u00e9 pr\u00e1ce, rom\u00e1ny, sc\u00e9n\u00e1\u0159e, poezie, haiku, p\u0159edn\u00e1\u0161ky<\/li>\n\n\n\n<li>Hudebn\u00ed skladby a texty k nim<\/li>\n\n\n\n<li>Japonsk\u00e9 tradi\u010dn\u00ed tance, balet, choreografie pro tance a pantomimy<\/li>\n\n\n\n<li>Malby, grafiky, sochy, komiksy, kaligrafie, divadeln\u00ed dekorace<\/li>\n\n\n\n<li>Um\u011bleck\u00e9 stavby<\/li>\n\n\n\n<li>Mapy a v\u011bdeck\u00e9 v\u00fdkresy, diagramy, modely<\/li>\n\n\n\n<li>Filmy pro divadlo, televizn\u00ed seri\u00e1ly, online videa<\/li>\n\n\n\n<li>Fotografie, gravury<\/li>\n\n\n\n<li>Po\u010d\u00edta\u010dov\u00e9 programy<\/li>\n<\/ul>\n\n\n\n<p>&#8220;Autor&#8221; je obecn\u011b osoba, kter\u00e1 skute\u010dn\u011b vytvo\u0159ila d\u00edlo. A autorsk\u00e9 pr\u00e1vo je p\u0159izn\u00e1no autorovi, kter\u00fd vytvo\u0159il d\u00edlo. Tak\u017ee osoba, kter\u00e1 napsala rom\u00e1n nebo namalovala obraz, se st\u00e1v\u00e1 autorem a dr\u017eitelem autorsk\u00fdch pr\u00e1v.<\/p>\n\n\n\n<p>Av\u0161ak, pokud by spole\u010dnost musela z\u00edskat povolen\u00ed od zam\u011bstnance poka\u017ed\u00e9, kdy\u017e chce vyu\u017e\u00edt d\u00edlo, kter\u00e9 zam\u011bstnanec vytvo\u0159il b\u011bhem sv\u00e9 pr\u00e1ce, bylo by to \u010dasov\u011b n\u00e1ro\u010dn\u00e9 a komplikovan\u00e9, a to by mohlo naru\u0161it hladk\u00fd chod pr\u00e1ce. Nav\u00edc, po odchodu zam\u011bstnance by mohlo doj\u00edt k p\u0159evodu autorsk\u00fdch pr\u00e1v na konkuren\u010dn\u00ed spole\u010dnost.<\/p>\n\n\n\n<p>Proto Japonsk\u00fd z\u00e1kon o autorsk\u00e9m pr\u00e1vu (Japanese Copyright Law) stanov\u00ed syst\u00e9m, podle kter\u00e9ho, pokud jsou spln\u011bny ur\u010dit\u00e9 podm\u00ednky, je za autora pova\u017eov\u00e1na spole\u010dnost, kter\u00e1 zam\u011bstn\u00e1v\u00e1 zam\u011bstnance, kter\u00fd skute\u010dn\u011b vytvo\u0159il d\u00edlo, a ne zam\u011bstnanec. Toto se naz\u00fdv\u00e1 &#8220;slu\u017eebn\u00ed d\u00edlo&#8221;. A proto\u017ee spole\u010dnost je pova\u017eov\u00e1na za autora, m\u00e1 v\u0161echna autorsk\u00e1 pr\u00e1va (a pr\u00e1va osobnosti autora) k d\u00edlu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"po\u017eadavky-na-d\u00edlo-vytvo\u0159en\u00e9-v-ramci-pracovn\u00edch-povinnost\u00ed\"><span class=\"ez-toc-section\" id=\"Pozadavky_na_dilo_vytvorene_v_ramci_pracovnich_povinnosti\"><\/span>Po\u017eadavky na d\u00edlo vytvo\u0159en\u00e9 v r\u00e1mci pracovn\u00edch povinnost\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2020\/03\/shutterstock_1041678625-1024x684.jpg\" alt=\"\" class=\"wp-image-8031\" \/><figcaption class=\"wp-element-caption\"> Vysv\u011btl\u00edme po\u017eadavky na d\u00edlo vytvo\u0159en\u00e9 v r\u00e1mci pracovn\u00edch povinnost\u00ed.<\/figcaption><\/figure>\n\n\n\n<p>Podle \u010dl\u00e1nku 15 odstavec 1 Japonsk\u00e9ho z\u00e1kona o autorsk\u00fdch pr\u00e1vech (Copyright Law) jsou pro d\u00edlo vytvo\u0159en\u00e9 v r\u00e1mci pracovn\u00edch povinnost\u00ed stanoveny n\u00e1sleduj\u00edc\u00ed po\u017eadavky:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u010cl\u00e1nek 15 odstavec 1: Pokud osoba pracuj\u00edc\u00ed pro pr\u00e1vnickou osobu nebo jin\u00e9ho zam\u011bstnavatele (d\u00e1le jen &#8220;pr\u00e1vnick\u00e1 osoba atd.&#8221;) vytvo\u0159\u00ed d\u00edlo v r\u00e1mci sv\u00fdch pracovn\u00edch povinnost\u00ed na z\u00e1klad\u011b iniciativy t\u00e9to pr\u00e1vnick\u00e9 osoby atd. (s v\u00fdjimkou d\u011bl programov\u00e9ho charakteru), a pokud toto d\u00edlo je publikov\u00e1no pod jm\u00e9nem t\u00e9to pr\u00e1vnick\u00e9 osoby atd. jako jej\u00ed vlastn\u00ed d\u00edlo, autorem tohoto d\u00edla je, pokud smlouva, pracovn\u00ed \u0159\u00e1d nebo jin\u00e9 ustanoven\u00ed nestanov\u00ed jinak, tato pr\u00e1vnick\u00e1 osoba atd.<\/p>\n<\/blockquote>\n\n\n\n<p>Shrnut\u00ed, d\u00edlo vytvo\u0159en\u00e9 v r\u00e1mci pracovn\u00edch povinnost\u00ed je uzn\u00e1no, pokud jsou spln\u011bny n\u00e1sleduj\u00edc\u00ed po\u017eadavky:<\/p>\n\n\n\n<ol>\n<li>D\u00edlo bylo vytvo\u0159eno na z\u00e1klad\u011b iniciativy pr\u00e1vnick\u00e9 osoby atd.<\/li>\n\n\n\n<li>D\u00edlo bylo vytvo\u0159eno osobou, kter\u00e1 pracuje pro pr\u00e1vnickou osobu atd. v r\u00e1mci sv\u00fdch pracovn\u00edch povinnost\u00ed<\/li>\n\n\n\n<li>D\u00edlo je publikov\u00e1no pod jm\u00e9nem pr\u00e1vnick\u00e9 osoby atd. jako jej\u00ed vlastn\u00ed d\u00edlo<\/li>\n\n\n\n<li>Neexistuje \u017e\u00e1dn\u00e9 speci\u00e1ln\u00ed ustanoven\u00ed v smlouv\u011b, pracovn\u00edm \u0159\u00e1du nebo jin\u00e9m dokumentu<\/li>\n<\/ol>\n\n\n\n<p>N\u00ed\u017ee vysv\u011btl\u00edme detaily jednotliv\u00fdch po\u017eadavk\u016f.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/work-for-hire-copyright-disputes\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/work-for-hire-copyright-disputes[ja]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"\u6cd5\u4eba\u7b49\u306e\u767a\u610f\u306b\u57fa\u3065\u304f-\u3068\u306f\"><span class=\"ez-toc-section\" id=\"1_Co_znamena_%E2%80%9Cna_zaklade_rozhodnuti_pravnicke_osoby_atd%E2%80%9D\"><\/span>1. Co znamen\u00e1 &#8220;na z\u00e1klad\u011b rozhodnut\u00ed pr\u00e1vnick\u00e9 osoby atd.&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Nejprve je t\u0159eba, aby d\u00edlo bylo vytvo\u0159eno &#8220;na z\u00e1klad\u011b rozhodnut\u00ed pr\u00e1vnick\u00e9 osoby atd.&#8221;<\/p>\n\n\n\n<p>&#8220;Na z\u00e1klad\u011b rozhodnut\u00ed pr\u00e1vnick\u00e9 osoby atd.&#8221; se rozum\u00ed, \u017ee v\u016fle vytvo\u0159it d\u00edlo p\u0159\u00edmo nebo nep\u0159\u00edmo z\u00e1vis\u00ed na rozhodnut\u00ed u\u017eivatele. Typicky se p\u0159edpokl\u00e1d\u00e1, \u017ee u\u017eivatel pl\u00e1nuje a \u0159\u00edd\u00ed vytv\u00e1\u0159en\u00ed d\u00edla a nech\u00e1v\u00e1 sv\u00e9 zam\u011bstnance prov\u00e1d\u011bt tuto \u010dinnost.<\/p>\n\n\n\n<p>Av\u0161ak, i kdy\u017e neexistuje konkr\u00e9tn\u00ed pokyn nebo souhlas u\u017eivatele, pokud se od zam\u011bstnance o\u010dek\u00e1v\u00e1, \u017ee vytvo\u0159\u00ed dan\u00e9 d\u00edlo na z\u00e1klad\u011b jeho p\u0159\u00edslu\u0161nosti k odd\u011blen\u00ed nebo podnikatelsk\u00e9 \u010dinnosti, tento po\u017eadavek je pova\u017eov\u00e1n za spln\u011bn\u00fd.<\/p>\n\n\n\n<p>Je r\u016fzn\u00e9, kdy je &#8220;rozhodnut\u00ed&#8221; potvrzeno v soudn\u00ed praxi. Proto je v d\u016fle\u017eit\u00fdch p\u0159\u00edpadech nutn\u00e9 vytvo\u0159it a uchovat d\u016fkazy a dokumenty, kter\u00e9 podporuj\u00ed &#8220;rozhodnut\u00ed&#8221; pr\u00e1vnick\u00e9 osoby atd.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"\u6cd5\u4eba\u7b49\u306e\u696d\u52d9\u306b\u5f93\u4e8b\u3059\u308b\u8005\u304c\u8077\u52d9\u4e0a\u4f5c\u6210\u3059\u308b\u3082\u306e-\u3068\u306f\"><span class=\"ez-toc-section\" id=\"2_Co_znamena_%E2%80%9Cosoba_pusobici_v_ramci_cinnosti_pravnicke_osoby_ktera_vytvari_dilo_v_ramci_svych_pracovnich_povinnosti%E2%80%9D\"><\/span>2. Co znamen\u00e1 &#8220;osoba p\u016fsob\u00edc\u00ed v r\u00e1mci \u010dinnosti pr\u00e1vnick\u00e9 osoby, kter\u00e1 vytv\u00e1\u0159\u00ed d\u00edlo v r\u00e1mci sv\u00fdch pracovn\u00edch povinnost\u00ed&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>N\u00e1sledn\u011b, &#8220;osoba p\u016fsob\u00edc\u00ed v r\u00e1mci \u010dinnosti pr\u00e1vnick\u00e9 osoby&#8221; mus\u00ed vytv\u00e1\u0159et autorsk\u00e9 d\u00edlo &#8220;v r\u00e1mci sv\u00fdch pracovn\u00edch povinnost\u00ed&#8221;.<\/p>\n\n\n\n<p>Typick\u00fdm p\u0159\u00edkladem &#8220;osoby p\u016fsob\u00edc\u00ed v r\u00e1mci \u010dinnosti pr\u00e1vnick\u00e9 osoby&#8221; je zam\u011bstnanec, kter\u00fd uzav\u0159el pracovn\u00ed smlouvu s zam\u011bstnavatelem.<\/p>\n\n\n\n<p>I v p\u0159\u00edpad\u011b, \u017ee neexistuje pracovn\u00ed smlouva, pokud lze hodnotit, \u017ee zam\u011bstnavatel a zam\u011bstnanec jsou ve skute\u010dnosti v pracovn\u00edm vztahu, lze tak\u00e9 uznat po\u017eadavky &#8220;osoby p\u016fsob\u00edc\u00ed v r\u00e1mci \u010dinnosti pr\u00e1vnick\u00e9 osoby&#8221;. Nap\u0159\u00edklad, pokud je nez\u00e1visl\u00fd spisovatel zapojen do tvorby \u010dl\u00e1nk\u016f pro \u010dasopis pod veden\u00edm vydavatelstv\u00ed na stejn\u00e9m postaven\u00ed jako ostatn\u00ed zam\u011bstnanci, m\u016f\u017ee b\u00fdt spisovatel pova\u017eov\u00e1n za &#8220;osobu p\u016fsob\u00edc\u00ed v r\u00e1mci \u010dinnosti pr\u00e1vnick\u00e9 osoby&#8221;.<\/p>\n\n\n\n<p>Na druhou stranu, pokud jde pouze o zad\u00e1n\u00ed tvorby autorsk\u00e9ho d\u00edla osob\u011b mimo pracovn\u00ed vztah, tato osoba se nepova\u017euje za &#8220;osobu p\u016fsob\u00edc\u00ed v r\u00e1mci \u010dinnosti pr\u00e1vnick\u00e9 osoby&#8221;. Proto je nutn\u00e9, pokud zad\u00e1te tvorbu autorsk\u00e9ho d\u00edla t\u0159et\u00ed stran\u011b na z\u00e1klad\u011b smlouvy o d\u00edlo, p\u0159edem uv\u00e9st v smlouv\u011b, \u017ee autorsk\u00e1 pr\u00e1va budou p\u0159evedena.<\/p>\n\n\n\n<p>&#8220;Vytv\u00e1\u0159en\u00ed v r\u00e1mci pracovn\u00edch povinnost\u00ed&#8221; znamen\u00e1, \u017ee zam\u011bstnanec vytv\u00e1\u0159\u00ed n\u011bco jako sou\u010d\u00e1st sv\u00fdch pracovn\u00edch povinnost\u00ed, bez ohledu na pracovn\u00ed dobu.<\/p>\n\n\n\n<p>Proto, pokud zam\u011bstnanec vytvo\u0159\u00ed autorsk\u00e9 d\u00edlo bez souvislosti s jeho pracovn\u00edmi povinnostmi ve sv\u00e9m voln\u00e9m \u010dase, nebo pokud vytvo\u0159\u00ed autorsk\u00e9 d\u00edlo, kter\u00e9 nesouvis\u00ed s jeho pracovn\u00edmi povinnostmi, i kdy\u017e je v pracovn\u00ed dob\u011b, spole\u010dnost se nestane autorem takov\u00e9ho d\u00edla.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"\u305d\u306e\u6cd5\u4eba\u7b49\u306e\u8457\u4f5c\u540d\u7fa9\u3067\u516c\u8868\u3059\u308b-\u3068\u306f\"><span class=\"ez-toc-section\" id=\"3_Co_znamena_%E2%80%9Cpublikovat_pod_jmenem_teto_korporace_atd%E2%80%9D\"><\/span>3. Pracovn\u00ed \u0159\u00e1d se nevztahuje na osoby, kter\u00e9 nejsou v pracovn\u00edm pom\u011bru, tak\u017ee je t\u0159eba toto \u0159e\u0161en\u00ed.<\/p>\n\n\n\n<p>P\u0159i tomto zp\u016fsobu je t\u0159eba uzav\u0159\u00edt smlouvu individu\u00e1ln\u011b s ka\u017ed\u00fdm zam\u011bstnancem. P\u0159i tomto lze stanovit individu\u00e1ln\u00ed podm\u00ednky pro ka\u017ed\u00e9ho zam\u011bstnance. Proto, i kdy\u017e jste v pracovn\u00edm pom\u011bru, pokud chcete stanovit individu\u00e1ln\u00ed podm\u00ednky, je lep\u0161\u00ed uzav\u0159\u00edt smlouvu o p\u0159evodu autorsk\u00fdch pr\u00e1v.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pozor_na_autorske_moralni_prava\"><\/span>Pozor na autorsk\u00e9 mor\u00e1ln\u00ed pr\u00e1va!<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>&#8220;Autorsk\u00e1 pr\u00e1va&#8221; lze p\u0159ev\u00e9st, ale &#8220;autorsk\u00e9 mor\u00e1ln\u00ed pr\u00e1va&#8221;, kter\u00e1 jsou v\u00fdhradn\u011b uzn\u00e1na autorovi, nelze p\u0159ev\u00e9st.<\/p>\n\n\n\n<p>Pokud zam\u011bstnanec st\u00e1le dr\u017e\u00ed autorsk\u00e9 mor\u00e1ln\u00ed pr\u00e1va, m\u016f\u017ee b\u00fdt omezena svoboda \u00faprav d\u00edla.
