kte\u0159\u00ed si p\u0159ivyd\u011bl\u00e1vaj\u00ed, roste tak\u00e9 popt\u00e1vka po webov\u00fdch str\u00e1nk\u00e1ch pro shodu nab\u00eddky a popt\u00e1vky prost\u0159ednictv\u00edm pracovn\u00ed smlouvy, a slu\u017eby, kter\u00e9 je spojuj\u00ed prost\u0159ednictv\u00edm smlouvy o poskytnut\u00ed slu\u017eeb, nikoli pracovn\u00ed smlouvy.<\/p>\n\n\n\n<p>V tomto \u010dl\u00e1nku se zam\u011b\u0159\u00edme na vedlej\u0161\u00ed pracovn\u00ed m\u00edsta, kter\u00e1 spojuj\u00ed lidi, kte\u0159\u00ed cht\u011bj\u00ed pracovat na Obvykle provozovatel vedlej\u0161\u00edho pracovn\u00edho m\u00edsta p\u0159edstav\u00ed firmu podle p\u0159\u00e1n\u00ed osoby, kter\u00e1 chce pracovat na vedlej\u0161\u00ed pr\u00e1ci.<\/p>\n\n\n\n<p>Jako zp\u016fsob z\u00edsk\u00e1n\u00ed p\u0159\u00edjm\u016f z vedlej\u0161\u00edho pracovn\u00edho m\u00edsta lze uva\u017eovat o tom, \u017ee provozovatel vedlej\u0161\u00edho pracovn\u00edho m\u00edsta vyb\u00edr\u00e1 registraci a poplatky za zve\u0159ejn\u011bn\u00ed od firem. M\u016f\u017ee se tak\u00e9 uva\u017eovat o tom, \u017ee kdy\u017e dojde k shod\u011b, provozovatel vyb\u00edr\u00e1 poplatek za zprost\u0159edkov\u00e1n\u00ed od firmy ve form\u011b procenta z odm\u011bny, kterou firma nab\u00edz\u00ed.<\/p>\n\n\n\n<p>N\u00ed\u017ee vysv\u011btl\u00edme body, na kter\u00e9 by m\u011bl provozovatel vedlej\u0161\u00edho pracovn\u00edho m\u00edsta db\u00e1t z pr\u00e1vn\u00edho hlediska.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Vztah_k_profesnimu_zprostredkovani_podle_Japonskeho_zakona_o_stabilizaci_zamestnanosti\"><\/span>Vztah k profesn\u00edmu zprost\u0159edkov\u00e1n\u00ed podle Japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Jako provozovatel webu pro shodu vedlej\u0161\u00edch prac\u00ed, je t\u0159eba nejprve zv\u00e1\u017eit vztah k profesn\u00edmu zprost\u0159edkov\u00e1n\u00ed podle Japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pro_provozovani_placeneho_personalniho_zprostredkovani_je_potreba_povoleni\"><\/span>Pro provozov\u00e1n\u00ed placen\u00e9ho person\u00e1ln\u00edho zprost\u0159edkov\u00e1n\u00ed je pot\u0159eba povolen\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Podle \u00a7 30 odst. 1 Japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti (\u0160\u00fagy\u00f3 Antei H\u014d) je stanoveno n\u00e1sleduj\u00edc\u00ed:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>(Povolen\u00ed pro placen\u00e9 person\u00e1ln\u00ed zprost\u0159edkov\u00e1n\u00ed)<br>\u00a7 30 Kdo chce provozovat placen\u00e9 person\u00e1ln\u00ed zprost\u0159edkov\u00e1n\u00ed, mus\u00ed z\u00edskat povolen\u00ed od japonsk\u00e9ho ministra zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed.<\/p>\n<\/blockquote>\n\n\n\n<p>Z v\u00fd\u0161e uveden\u00e9ho ustanoven\u00ed vypl\u00fdv\u00e1, \u017ee v p\u0159\u00edpad\u011b, \u017ee se jedn\u00e1 o placen\u00e9 person\u00e1ln\u00ed zprost\u0159edkov\u00e1n\u00ed, je nutn\u00e9 z\u00edskat povolen\u00ed od japonsk\u00e9ho ministra zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed. Pokud toto povolen\u00ed nez\u00edsk\u00e1te, dojde k poru\u0161en\u00ed \u00a7 30 odst. 1 Japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti.<\/p>\n\n\n\n<p>Pokud dojde k poru\u0161en\u00ed \u00a7 30 odst. 1 Japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti, m\u016f\u017ee b\u00fdt ulo\u017een trest odn\u011bt\u00ed svobody na dobu do jednoho roku nebo pokuta do v\u00fd\u0161e 1 milionu jen\u016f (\u00a7 64 odst. 1 Japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kriteria_pro_posouzeni_zda_se_vedlejsi_pracovni_mista_na_webovych_strankach_pro_parovani_odpovidaji_zprostredkovani_zamestnani\"><\/span>Krit\u00e9ria pro posouzen\u00ed, zda se vedlej\u0161\u00ed pracovn\u00ed m\u00edsta na webov\u00fdch str\u00e1nk\u00e1ch pro p\u00e1rov\u00e1n\u00ed odpov\u00eddaj\u00ed zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Tak\u017ee, jak\u00e9 \u010dinnosti odpov\u00eddaj\u00ed term\u00ednu &#8220;zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed&#8221;?<\/p>\n\n\n\n<p>Definice &#8220;zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed&#8221; je stanovena v \u00a7 4 odst. 1 japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti (Japanese Employment Stability Act) n\u00e1sledovn\u011b:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>(Definice)<br>\u010cl\u00e1nek 4 V tomto z\u00e1kon\u011b se pod &#8220;zprost\u0159edkov\u00e1n\u00edm zam\u011bstn\u00e1n\u00ed&#8221; rozum\u00ed p\u0159ijet\u00ed nab\u00eddek zam\u011bstn\u00e1n\u00ed a hled\u00e1n\u00ed pr\u00e1ce a usnadn\u011bn\u00ed vzniku pracovn\u00edho vztahu mezi zam\u011bstnavatelem a uchaze\u010dem o pr\u00e1ci.<\/p>\n<\/blockquote>\n\n\n\n<p>Co je d\u016fle\u017eit\u00e9 v\u00fd\u0161e uveden\u00e9 ustanoven\u00ed je formulace &#8220;usnadn\u011bn\u00ed vzniku pracovn\u00edho vztahu&#8221;.<\/p>\n\n\n\n<p>Z tohoto ustanoven\u00ed vypl\u00fdv\u00e1, \u017ee z\u00e1kon o stabilizaci zam\u011bstnanosti se t\u00fdk\u00e1 vzniku pracovn\u00edho vztahu a smlouvy o poskytnut\u00ed slu\u017eeb atd. nejsou p\u0159edm\u011btem regulace tohoto z\u00e1kona.<\/p>\n\n\n\n<p>Av\u0161ak, i kdy\u017e form\u00e1ln\u011b nespad\u00e1 pod zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed, m\u016f\u017ee se st\u00e1t, \u017ee p\u0159i podrobn\u011bj\u0161\u00edm pohledu na to odpov\u00edd\u00e1 zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>Proto je t\u0159eba pe\u010dliv\u011b zv\u00e1\u017eit, zda slu\u017eby webov\u00fdch str\u00e1nek pro p\u00e1rov\u00e1n\u00ed vedlej\u0161\u00edch pracovn\u00edch m\u00edst odpov\u00eddaj\u00ed zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>Ministerstvo zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed (Japanese Ministry of Health, Labour and Welfare) zve\u0159ejnilo krit\u00e9ria pro posouzen\u00ed, zda poskytov\u00e1n\u00ed informac\u00ed o nab\u00eddk\u00e1ch pr\u00e1ce a uchaze\u010d\u00edch o pr\u00e1ci prost\u0159ednictv\u00edm internetu soukrom\u00fdmi spole\u010dnostmi odpov\u00edd\u00e1 zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed, a stanovilo n\u00e1sleduj\u00edc\u00ed:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>III Poskytov\u00e1n\u00ed informac\u00ed o nab\u00eddk\u00e1ch pr\u00e1ce a uchaze\u010d\u00edch o pr\u00e1ci prost\u0159ednictv\u00edm internetu odpov\u00edd\u00e1 zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed, pokud spl\u0148uje jedno z n\u00e1sleduj\u00edc\u00edch krit\u00e9ri\u00ed:<br>1. V\u00fdb\u011br a zpracov\u00e1n\u00ed informac\u00ed na z\u00e1klad\u011b rozhodnut\u00ed poskytovatele informac\u00ed, ani\u017e by byly stanoveny p\u0159edem explicitn\u00ed objektivn\u00ed vyhled\u00e1vac\u00ed krit\u00e9ria pro obsah poskytovan\u00fdch informac\u00ed nebo pro p\u0159\u00edjemce.<br>2. Poskytovatel informac\u00ed komunikuje s uchaze\u010di o pr\u00e1ci o nab\u00eddk\u00e1ch pr\u00e1ce nebo s nab\u00eddkami pr\u00e1ce o informac\u00edch o uchaze\u010d\u00edch o pr\u00e1ci.<br>3. Pokud poskytovatel informac\u00ed zprost\u0159edkov\u00e1v\u00e1 komunikaci mezi uchaze\u010dem o pr\u00e1ci a nab\u00eddkou pr\u00e1ce prost\u0159ednictv\u00edm sv\u00e9 webov\u00e9 str\u00e1nky, zpracov\u00e1v\u00e1 obsah komunikace pro tuto komunikaci.<br>IV Krom\u011b III, pokud je na z\u00e1klad\u011b obsahu reklamy poskytovatele informac\u00ed, smluvn\u00edch podm\u00ednek mezi zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>Av\u0161ak, s rozvojem internetu se zvy\u0161uje po\u010det slu\u017eeb, u kter\u00fdch nen\u00ed mo\u017en\u00e9 jasn\u011b rozli\u0161it obsah slu\u017eeb webov\u00fdch str\u00e1nek pro p\u00e1rov\u00e1n\u00ed vedlej\u0161\u00edch pracovn\u00edch m\u00edst.<\/p>\n\n\n\n<p>Jin\u00fdmi slovy, i kdy\u017e explicitn\u011b neusnad\u0148uj\u00ed vznik pracovn\u00edho vztahu, pokud poskytuj\u00ed informace o nab\u00eddk\u00e1ch pr\u00e1ce a uchaze\u010d\u00edch o pr\u00e1ci a spl\u0148uj\u00ed krit\u00e9ria, kter\u00e1 zve\u0159ejnilo Ministerstvo zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed, mohou b\u00fdt pova\u017eov\u00e1ny za zprost\u0159edkov\u00e1n\u00ed zam\u011bstn\u00e1n\u00ed, a je t\u0159eba b\u00fdt poskytov\u00e1n\u00ed pracovn\u00edk\u016f jasn\u011b uv\u00e9st pracovn\u00ed podm\u00ednky, jako je obsah pr\u00e1ce, kterou m\u00e1 dan\u00e1 osoba vykon\u00e1vat, mzda, pracovn\u00ed doba a dal\u0161\u00ed pracovn\u00ed podm\u00ednky, pro osoby hledaj\u00edc\u00ed pr\u00e1ci, osoby, kter\u00e9 se cht\u011bj\u00ed st\u00e1t pracovn\u00edky v reakci na n\u00e1bor, nebo pro poskytovan\u00e9 pracovn\u00edky.<\/p>\n<\/blockquote>\n\n\n\n<p>V souvislosti s paragrafem 5, odstavec 3, \u010dl\u00e1nek 1 japonsk\u00e9ho z\u00e1kona o stabilizaci zam\u011bstnanosti, pokud webov\u00e9 str\u00e1nky pro shodu vedlej\u0161\u00edch prac\u00ed nepat\u0159\u00ed do kategorie zprost\u0159edkov\u00e1n\u00ed pr\u00e1ce nebo n\u00e1boru pracovn\u00edk\u016f, nebudou pova\u017eov\u00e1ny za poru\u0161en\u00ed z\u00e1kona.<\/p>\n\n\n\n<p>Av\u0161ak, jak bylo uvedeno v\u00fd\u0161e, v z\u00e1vislosti na obsahu slu\u017eeb webov\u00fdch str\u00e1nek pro shodu vedlej\u0161\u00edch prac\u00ed, i kdy\u017e form\u00e1ln\u011b poskytuj\u00ed slu\u017eby zam\u011b\u0159en\u00e9 na freelancery, mohou b\u00fdt v podstat\u011b pova\u017eov\u00e1ny za zprost\u0159edkov\u00e1n\u00ed
