To je jeho podstatnou \u010d\u00e1st\u00ed.<\/p>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">\u010cl\u00e1nek \u25cf (Ud\u011blen\u00ed provozovac\u00edch pr\u00e1v)<br>Pronaj\u00edmatel se zavazuje, \u017ee umo\u017en\u00ed n\u00e1jemci vyu\u017e\u00edvat \u010d\u00e1st dom\u00e9ny, kterou spravuje (d\u00e1le jen &#8220;p\u0159edm\u011btn\u00e1 oblast&#8221;), pro vytv\u00e1\u0159en\u00ed a provozov\u00e1n\u00ed informa\u010dn\u00edch m\u00e9di\u00ed (\u010dl\u00e1nky a jin\u00fd obsah na webu tvo\u0159en\u00fd textem, obr\u00e1zky, videi a jin\u00fdmi informacemi, a jejich soubory) t\u00fdkaj\u00edc\u00edch se p\u0159edm\u011btn\u00e9 kategorie v r\u00e1mci p\u0159edm\u011btn\u00e9 oblasti (d\u00e1le jen &#8220;p\u0159edm\u011btn\u00e9 vyu\u017eit\u00ed&#8221;) (d\u00e1le jen &#8220;ud\u011blen\u00ed provozovac\u00edch pr\u00e1v&#8221;). N\u00e1jemce se zavazuje zaplatit pronaj\u00edmateli za toto ud\u011blen\u00ed provozovac\u00edch pr\u00e1v. &#8220;Pod \u00farovn\u00ed URL&#8221; se rozum\u00ed v\u0161echny URL, kter\u00e9 obsahuj\u00ed libovoln\u00fd po\u010det \u00farovn\u00ed odd\u011blen\u00fdch lom\u00edtky &#8220;\/&#8221; na konci p\u0159edm\u011btn\u00e9ho URL a libovoln\u00e9 \u0159et\u011bzce p\u0159idan\u00e9 k p\u0159edm\u011btn\u00e9mu URL.<br>P\u0159edm\u011btn\u00e1 dom\u00e9na: \u25cf\u25cf\u25cf\u25cf<br>P\u0159edm\u011btn\u00e9 URL: \u25cf\u25cf\u25cf\u25cf<br>P\u0159edm\u011btn\u00e1 kategorie: Kosmetika<\/p>\n\n\n\n<p>&#8220;P\u0159edm\u011btn\u00e9 URL&#8221; m\u016f\u017ee b\u00fdt jak subdom\u00e9na, tak subadres\u00e1\u0159, jak je uvedeno v\u00fd\u0161e. A\u010dkoli je &#8220;pod \u00farovn\u00ed URL&#8221; z technick\u00e9ho hlediska nadbyte\u010dn\u00e9, je p\u0159id\u00e1no z hlediska p\u0159\u00e1n\u00ed, aby bylo v p\u0159\u00edpad\u011b sporu z tohoto smluvn\u00edho vztahu a n\u00e1sledn\u00e9ho soudn\u00edho \u0159\u00edzen\u00ed zaji\u0161t\u011bno, \u017ee z\u00e1pis nebude pro soudce nejasn\u00fd.<\/p>\n\n\n\n<p>D\u00e1le je vhodn\u00e9 definovat &#8220;p\u0159edm\u011btnou kategorii&#8221; v souvislosti s &#8220;povinnostmi n\u00e1jemce&#8221;, kter\u00e9 budou pops\u00e1ny n\u00ed\u017ee. Pokud zde nebudeme definovat, m\u016f\u017eeme \u0159\u00edci, \u017ee klauzule o &#8220;povinnostech n\u00e1jemce&#8221; se snadno komplikuje, jak je uvedeno n\u00ed\u017ee.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ustanoveni_o_povinnostech_pronajimatele\"><\/span>Ustanoven\u00ed o povinnostech pronaj\u00edmatele<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2022\/10\/shutterstock_688688758.png\" alt=\"Smlouva: Ustanoven\u00ed o povinnostech pronaj\u00edmatele\" class=\"wp-image-52801\" \/><\/figure>\n\n\n\n<p>Spory souvisej\u00edc\u00ed s pron\u00e1jmem subdom\u00e9n a adres\u00e1\u0159\u016f \u010dasto vznikaj\u00ed z pohledu n\u00e1jemce, kdy\u017e nejsou \u0159\u00e1dn\u011b p\u0159ed\u00e1ny nebo p\u0159estanou b\u00fdt p\u0159ed\u00e1v\u00e1ny nezbytn\u00e9 informace o \u00fa\u010dtech pot\u0159ebn\u00fdch pro provozov\u00e1n\u00ed m\u00e9di\u00ed.<\/p>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">\u010cl\u00e1nek \u25cf (Povinnosti pronaj\u00edmatele)<br>Pronaj\u00edmatel provede v\u0161echny \u010dinnosti nezbytn\u00e9 pro ud\u011blen\u00ed provozovac\u00edch pr\u00e1v (v\u010detn\u011b n\u00e1sleduj\u00edc\u00edch bod\u016f, ale neomezen\u011b na n\u011b).<br>(1) Ud\u011blen\u00ed \u00fa\u010dtu, o kter\u00e9m se dohodlo mezi pronaj\u00edmatelem a n\u00e1jemcem, jako\u017eto nezbytn\u00e9 pro v\u00fdrobu informa\u010dn\u00edch m\u00e9di\u00ed v dan\u00e9 oblasti<br>(2) Poskytnut\u00ed informac\u00ed o webov\u00e9m serveru a dal\u0161\u00edch souvisej\u00edc\u00edch informac\u00edch, kter\u00e9 vyu\u017e\u00edv\u00e1 dan\u00e1 dom\u00e9na<br>(3) Jin\u00e9 \u010dinnosti, na kter\u00fdch se dohodlo mezi smluvn\u00edmi stranami<\/p>\n\n\n\n<p>V prvn\u00edm bod\u011b je tedy vhodn\u00e9, pokud je to mo\u017en\u00e9, uv\u00e9st konkr\u00e9tn\u00ed informace, nap\u0159\u00edklad &#8220;informace o \u00fa\u010dtu WordPress&#8221;. To usnadn\u00ed argumentaci, \u017ee &#8220;je t\u0159eba poskytnout \u00fa\u010det, na kter\u00e9m jsme se dohodli v smlouv\u011b&#8221;, v situac\u00edch, jak\u00e9 jsme uvedli v\u00fd\u0161e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ustanoveni_o_povinnostech_dluznika\"><\/span>Ustanoven\u00ed o povinnostech dlu\u017en\u00edka<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>V t\u011bchto obchodech m\u016f\u017ee vztah mezi v\u011b\u0159itelem a dlu\u017en\u00edkem z\u00e1viset na tom, jak\u00fd druh m\u00e9di\u00ed dlu\u017en\u00edk provozuje. Nap\u0159\u00edklad, pokud dlu\u017en\u00edk publikuje \u010dl\u00e1nky s ur\u010dit\u00fdm pr\u00e1vn\u00edm rizikem, kter\u00e9 by mohly poru\u0161ovat administrativn\u00ed pr\u00e1vo, jako je Japonsk\u00fd z\u00e1kon o l\u00e9\u010divech (Yakkih\u014d), s argumentem, \u017ee &#8220;je to nezbytn\u00e9 pro zisk&#8221;, m\u016f\u017ee to v\u011b\u0159itel pova\u017eovat za probl\u00e9m.<\/p>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">\u010cl\u00e1nek \u25cf (Povinnosti dlu\u017en\u00edka)<br>Dlu\u017en\u00edk se zavazuje dodr\u017eovat n\u00e1sleduj\u00edc\u00ed povinnosti p\u0159i vyu\u017e\u00edv\u00e1n\u00ed tohoto p\u0159edm\u011btu na z\u00e1klad\u011b ud\u011blen\u00ed opr\u00e1vn\u011bn\u00ed k provozu:<br>(1) Nezat\u011b\u017eovat webov\u00fd server, kter\u00fd tento p\u0159edm\u011bt dom\u00e9ny vyu\u017e\u00edv\u00e1, nadm\u011brnou z\u00e1t\u011b\u017e\u00ed<br>(2) Neporu\u0161ovat autorsk\u00e1 pr\u00e1va, pr\u00e1va na obraz a jin\u00e1 pr\u00e1va, kter\u00e1 vlastn\u00ed t\u0159et\u00ed strany<br>(3) Neporu\u0161ovat Japonsk\u00fd z\u00e1kon o l\u00e9\u010divech (Yakkih\u014d), sm\u011brnice pro l\u00e9ka\u0159skou reklamu a jin\u00e9 z\u00e1kony a na\u0159\u00edzen\u00ed<br>(4) Nepublikovat \u010dl\u00e1nky mimo tuto kategorii<\/p>\n\n\n\n<p>\u010ctvrt\u00fd bod je ustanoven\u00ed pro p\u0159\u00edpady, kdy nap\u0159\u00edklad &#8220;i kdy\u017e byla p\u016fj\u010dka poskytnuta pro m\u00e9dia kosmetick\u00fdch v\u00fdrobk\u016f, za\u010daly se objevovat p\u0159edstaven\u00ed produkt\u016f pro dosp\u011bl\u00e9&#8221;.<\/p>\n\n\n\n<p>Pokud je &#8220;tato kategorie&#8221; definov\u00e1na \u00fazce, je mo\u017en\u00e9 se dotazovat na poru\u0161en\u00ed povinnost\u00ed v p\u0159\u00edpad\u011b &#8220;\u010dl\u00e1nk\u016f mimo o\u010dek\u00e1van\u00fd \u017e\u00e1nr&#8221;.<\/p>\n\n\n\n<p>Pokud je &#8220;tato kategorie&#8221; definov\u00e1na \u0161iroce, \u010dtvrt\u00fd bod tohoto ustanoven\u00ed se stane v\u00fd\u010dtem &#8220;zak\u00e1zan\u00fdch kategori\u00ed&#8221;, kter\u00e9 &#8220;nemohou b\u00fdt publikov\u00e1ny&#8221;. N\u00e1jemce mus\u00ed pronaj\u00edmateli ozn\u00e1mit podrobnosti o v\u0161ech tr\u017eb\u00e1ch vznikl\u00fdch na z\u00e1klad\u011b pou\u017eit\u00ed (d\u00e1le jen &#8220;p\u0159\u00edjmy&#8221;) v\u010detn\u011b URL \u010dl\u00e1nk\u016f, kter\u00e9 generovaly tyto tr\u017eby, \u010d\u00e1stky a data vzniku, a to do 10. dne n\u00e1sleduj\u00edc\u00edho m\u011bs\u00edce. N\u00e1sleduj\u00edc\u00ed polo\u017eky jsou pova\u017eov\u00e1ny za sou\u010d\u00e1st p\u0159\u00edjm\u016f:<br>(1) Affiliate odm\u011bny vznikl\u00e9 z \u010dl\u00e1nk\u016f v dan\u00e9 oblasti nebo z p\u0159esm\u011brov\u00e1n\u00ed nebo odkaz\u016f na tyto \u010dl\u00e1nky<br>(2) Odm\u011bny za reklamy, jako jsou Google AdSense, pay-per-click reklamy, display reklamy atd., um\u00edst\u011bn\u00e9 v \u010dl\u00e1nc\u00edch v dan\u00e9 oblasti<br>2. Pokud m\u00e1 pronaj\u00edmatel pochybnosti o hl\u00e1\u0161en\u00ed podle p\u0159edchoz\u00edho odstavce, mus\u00ed o tom n\u00e1jemce informovat p\u00edsemn\u011b (v\u010detn\u011b elektronick\u00e9 po\u0161ty nebo jin\u00fdch elektronick\u00fdch m\u00e9di\u00ed) do 10 dn\u016f od hl\u00e1\u0161en\u00ed. Pokud takov\u00e9 ozn\u00e1men\u00ed nen\u00ed provedeno, pova\u017euje se hl\u00e1\u0161en\u00ed n\u00e1jemce za p\u0159esn\u00e9.<br>3. N\u00e1jemce mus\u00ed pronaj\u00edmateli zaplatit \u010d\u00e1stku rovnaj\u00edc\u00ed se 10% p\u0159\u00edjm\u016f za dan\u00fd m\u011bs\u00edc plus spot\u0159ebn\u00ed da\u0148 do konce n\u00e1sleduj\u00edc\u00edho m\u011bs\u00edce na bankovn\u00ed \u00fa\u010det ur\u010den\u00fd pronaj\u00edmatelem.
