Nen\u00ed neobvykl\u00e9, \u017ee firmy se rozhodnou pro propou\u0161t\u011bn\u00ed zam\u011bstnanc\u016f, zastaven\u00ed zam\u011bstn\u00e1n\u00ed nebo zru\u0161en\u00ed nab\u00eddek pro nov\u00e9 absolventy.<\/p>\n\n\n\n<p>N\u011bkte\u0159\u00ed mana\u017ee\u0159i n\u00e1boru mohou m\u00edt pocit, \u017ee mohou svobodn\u011b zru\u0161it nab\u00eddky pro &#8220;nab\u00edzen\u00e9 osoby&#8221;, proto\u017ee je\u0161t\u011b neza\u010dali pracovat. Pracovn\u00ed smlouva je uzav\u0159ena, kdy\u017e student p\u0159edlo\u017e\u00ed firm\u011b &#8220;prohl\u00e1\u0161en\u00ed&#8221; nebo &#8220;souhlas s n\u00e1stupem do pr\u00e1ce&#8221;.<\/p>\n\n\n\n<p>Form\u00e1ln\u011b se jedn\u00e1 o &#8220;pracovn\u00ed smlouvu s v\u00fdpov\u011bdn\u00ed lh\u016ftou od po\u010d\u00e1tku&#8221;, kter\u00e1 obsahuje datum n\u00e1stupu do pr\u00e1ce (za\u010d\u00e1tek zam\u011bstn\u00e1n\u00ed) a pr\u00e1vo na v\u00fdpov\u011b\u010f. V\u00fdpov\u011b\u010f (zru\u0161en\u00ed p\u0159ijet\u00ed) je neplatn\u00e1, pokud nejsou spln\u011bny ur\u010dit\u00e9 podm\u00ednky.<\/p>\n\n\n\n<p>D\u00e1le, p\u0159ed &#8220;p\u0159ijet\u00edm&#8221; m\u016f\u017ee firma vyd\u00e1vat &#8220;p\u0159edb\u011b\u017en\u00e9 p\u0159ijet\u00ed&#8221;. Toto nen\u00ed form\u00e1ln\u00ed dokument, ale zp\u016fsob, jak firma sd\u011bluje studentovi sv\u016fj z\u00e1m\u011br p\u0159ijmout ho, nap\u0159\u00edklad \u00fastn\u011b nebo e-mailem. Jeliko\u017e pracovn\u00ed smlouva nen\u00ed uzav\u0159ena jako v p\u0159\u00edpad\u011b &#8220;p\u0159ijet\u00ed&#8221;, zru\u0161en\u00ed je v z\u00e1sad\u011b voln\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Dva_typy_zruseni_pracovni_smlouvy_a_posouzeni_jejich_nezakonnosti\"><\/span>Dva typy zru\u0161en\u00ed pracovn\u00ed smlouvy a posouzen\u00ed jejich nez\u00e1konnosti<br><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Po uzav\u0159en\u00ed pracovn\u00ed smlouvy existuj\u00ed dva typy &#8220;zru\u0161en\u00ed pracovn\u00ed smlouvy&#8221;: &#8220;v\u00fdpov\u011b\u010f&#8221; z d\u016fvodu, kter\u00fd nastal u zam\u011bstnance, a &#8220;propu\u0161t\u011bn\u00ed&#8221; z d\u016fvodu podnikov\u00fdch okolnost\u00ed, jako je pokles v\u00fdkonnosti, kter\u00fd je hlavn\u00edm t\u00e9matem tohoto \u010dl\u00e1nku.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Typ_1_Vykon_prava_na_ukonceni_v_%E2%80%9EPracovni_smlouve_s_pocatecnim_pravem_na_ukonceni%E2%80%9C\"><\/span>Typ 1. V\u00fdkon pr\u00e1va na ukon\u010den\u00ed v \u201ePracovn\u00ed smlouv\u011b s po\u010d\u00e1te\u010dn\u00edm pr\u00e1vem na ukon\u010den\u00ed\u201c<br><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>V\u00fdkon pr\u00e1va na ukon\u010den\u00ed b\u011bhem obdob\u00ed potvrzen\u00ed zam\u011bstn\u00e1n\u00ed po uzav\u0159en\u00ed \u201ePracovn\u00ed smlouvy s po\u010d\u00e1te\u010dn\u00edm pr\u00e1vem na ukon\u010den\u00ed\u201c je interpretov\u00e1n stejn\u011b jako \u201epr\u00e1vo na ukon\u010den\u00ed b\u011bhem zku\u0161ebn\u00ed doby\u201c p\u0159ed definitivn\u00edm zam\u011bstn\u00e1n\u00edm.<\/p>\n\n\n\n<p>Proto, aby bylo mo\u017en\u00e9 zru\u0161it potvrzen\u00ed zam\u011bstn\u00e1n\u00ed, je nutn\u00e9 prok\u00e1zat konkr\u00e9tn\u00ed d\u016fvody pro nedostate\u010dnou kvalifikaci jako zam\u011bstnanec.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Obecn\u011b plat\u00ed, \u017ee studenti, kte\u0159\u00ed z\u00edskali potvrzen\u00ed o zam\u011bstn\u00e1n\u00ed, o\u010dek\u00e1vaj\u00ed zam\u011bstn\u00e1n\u00ed v dan\u00e9 spole\u010dnosti a vzd\u00e1vaj\u00ed se mo\u017enosti a p\u0159\u00edle\u017eitosti zam\u011bstnat se v jin\u00fdch spole\u010dnostech. Proto je postaven\u00ed student\u016f, kte\u0159\u00ed z\u00edskali potvrzen\u00ed o zam\u011bstn\u00e1n\u00ed, i p\u0159es rozd\u00edl v zam\u011bstn\u00e1n\u00ed, z\u00e1sadn\u011b odli\u0161n\u00e9 od pracovn\u00edk\u016f b\u011bhem zku\u0161ebn\u00ed doby. Proto je spr\u00e1vn\u00e9 ch\u00e1pat v\u00fdkon pr\u00e1va na ukon\u010den\u00ed b\u011bhem obdob\u00ed potvrzen\u00ed zam\u011bstn\u00e1n\u00ed stejn\u011b jako v\u00fdkon pr\u00e1va na ukon\u010den\u00ed b\u011bhem zku\u0161ebn\u00ed doby. Skute\u010dnost, \u017ee bylo prakticky nemo\u017en\u00e9 prov\u00e9st \u00fasil\u00ed o zabr\u00e1n\u011bn\u00ed propu\u0161t\u011bn\u00ed v kr\u00e1tk\u00e9m obdob\u00ed mezi potvrzen\u00edm nab\u00eddky a n\u00e1stupem do pr\u00e1ce, by m\u011bla b\u00fdt br\u00e1na v \u00favahu.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Racionalita_vyberu_propustenych_osob\"><\/span>Racionalita v\u00fdb\u011bru propu\u0161t\u011bn\u00fdch osob<br><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>St\u00e1vaj\u00edc\u00ed zam\u011bstnanci a osoby s p\u0159ij\u00edmac\u00edm rozhodnut\u00edm se li\u0161\u00ed v oblastech jako je schopnost plnit \u00fakoly a mo\u017enost znovu se zam\u011bstnat. Bez ohledu na to, zda je d\u016fvodem \u0161patn\u00fd v\u00fdkon v d\u016fsledku pandemie koronaviru, pokud nejsou spln\u011bny v\u0161echny \u010dty\u0159i po\u017eadavky, m\u016f\u017ee to b\u00fdt pova\u017eov\u00e1no za zneu\u017eit\u00ed pr\u00e1va na v\u00fdpov\u011b\u010f.<\/p>\n\n\n\n<p>P\u0159ed zru\u0161en\u00edm nab\u00eddky zam\u011bstn\u00e1n\u00ed je t\u0159eba zkontrolovat nejen Z\u00e1kon o pracovn\u00edch smlouv\u00e1ch (Japonsk\u00fd Z\u00e1kon o pracovn\u00edch smlouv\u00e1ch) a Z\u00e1kon o pracovn\u00edch norm\u00e1ch (Japonsk\u00fd Z\u00e1kon o pracovn\u00edch norm\u00e1ch), ale tak\u00e9 p\u0159edchoz\u00ed soudn\u00ed rozhodnut\u00ed.
