Osoba, kter\u00e1 dohl\u00ed\u017e\u00ed na \u010dinnost nam\u00edsto zam\u011bstnavatele, nese tak\u00e9 odpov\u011bdnost podle p\u0159edchoz\u00edho odstavce.<\/p>\n<\/blockquote>\n\n\n\n<p>Pro\u010d by spole\u010dnost, kter\u00e1 sama nesp\u00e1chala \u017e\u00e1dn\u00fd protipr\u00e1vn\u00ed \u010din, m\u011bla n\u00e9st odpov\u011bdnost za n\u00e1hradu \u0161kody?<\/p>\n\n\n\n<p>Z\u00e1kladem tohoto je koncept zvan\u00fd &#8220;pr\u00e1vn\u00ed princip odpov\u011bdnosti za n\u00e1hradu \u0161kody&#8221;, kter\u00fd \u0159\u00edk\u00e1, \u017ee &#8220;ti, kte\u0159\u00ed z\u00edsk\u00e1vaj\u00ed zisk, by m\u011bli kompenzovat ztr\u00e1ty zp\u016fsoben\u00e9 jin\u00fdm osob\u00e1m z tohoto zisku a udr\u017eovat rovnov\u00e1hu&#8221;. Jin\u00fdmi slovy, pokud zam\u011bstnavatel z\u00edsk\u00e1v\u00e1 zisk z podnik\u00e1n\u00ed t\u00edm, \u017ee zam\u011bstn\u00e1v\u00e1 zam\u011bstnance pro sv\u00e9 podnik\u00e1n\u00ed, m\u011bl by n\u00e9st n\u00e1klady na rizika podnik\u00e1n\u00ed a ztr\u00e1ty zp\u016fsoben\u00e9 jin\u00fdm osob\u00e1m zam\u011bstnanci. Jak\u00e9 jsou tedy konkr\u00e9tn\u00ed podm\u00ednky, za kter\u00fdch je spole\u010dnosti p\u0159izn\u00e1na odpov\u011bdnost zam\u011bstnavatele a je povinna n\u00e9st odpov\u011bdnost za n\u00e1hradu \u0161kody?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pozadavky_na_odpovednost_zamestnavatele\"><\/span>Po\u017eadavky na odpov\u011bdnost zam\u011bstnavatele<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Aby byla uzn\u00e1na odpov\u011bdnost zam\u011bstnavatele a aby byl povinen n\u00e9st odpov\u011bdnost za \u0161kody, mus\u00ed b\u00fdt spln\u011bny n\u011bkter\u00e9 po\u017eadavky.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cin_zamestnance_je_protipravni\"><\/span>\u010cin zam\u011bstnance je protipr\u00e1vn\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Odpov\u011bdnost zam\u011bstnavatele je odpov\u011bdnost\u00ed za protipr\u00e1vn\u00ed \u010diny zam\u011bstnance, tak\u017ee je nutn\u00e9, aby samotn\u00fd \u010din zam\u011bstnance, kter\u00fd je p\u0159edm\u011btem sporu, spl\u0148oval po\u017eadavky protipr\u00e1vn\u00edho \u010dinu. Rozhodnut\u00ed jsou v\u0161ak v\u017edy u\u010din\u011bna na z\u00e1klad\u011b konkr\u00e9tn\u00edch p\u0159\u00edpad\u016f.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripad_sexualniho_obtezovani_zenske_zamestnankyne_nadrizenym_na_firemni_akci_po_pracovni_dobe\"><\/span>P\u0159\u00edpad sexu\u00e1ln\u00edho obt\u011b\u017eov\u00e1n\u00ed \u017eensk\u00e9 zam\u011bstnankyn\u011b nad\u0159\u00edzen\u00fdm na firemn\u00ed akci po pracovn\u00ed dob\u011b<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>I kdy\u017e se jednalo o setk\u00e1n\u00ed mimo pracovi\u0161t\u011b a nebylo povinn\u00e9, nad\u0159\u00edzen\u00fd opakovan\u011b sexu\u00e1ln\u011b obt\u011b\u017eoval, zat\u00edmco mluvil o pr\u00e1ci. Toto sexu\u00e1ln\u00ed obt\u011b\u017eov\u00e1n\u00ed bylo pova\u017eov\u00e1no za sou\u010d\u00e1st jeho povinnost\u00ed, proto\u017ee vyu\u017e\u00edval sv\u00e9 pozice nad\u0159\u00edzen\u00e9ho. Bylo tedy rozhodnuto, \u017ee se jedn\u00e1 o &#8220;prov\u00e1d\u011bn\u00ed dan\u00e9ho podnik\u00e1n\u00ed&#8221; (Rozhodnut\u00ed Nejvy\u0161\u0161\u00edho soudu ze dne 12. dubna 1968).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripad_kdy_zamestnanec_bez_povoleni_pouzil_firemni_auto_pro_soukrome_ucely_a_zpusobil_dopravni_nehodu\"><\/span>P\u0159\u00edpad, kdy zam\u011bstnanec bez povolen\u00ed pou\u017eil firemn\u00ed auto pro soukrom\u00e9 \u00fa\u010dely a zp\u016fsobil dopravn\u00ed nehodu<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Pou\u017eit\u00ed firemn\u00edho auta zam\u011bstnancem pro soukrom\u00e9 \u00fa\u010dely bez povolen\u00ed firmy nelze pova\u017eovat za \u0159\u00e1dn\u00e9 prov\u00e1d\u011bn\u00ed firemn\u00edch \u010dinnost\u00ed. Nicm\u00e9n\u011b, firemn\u00ed auto je obvykle \u0159\u00edzeno v r\u00e1mci sf\u00e9ry kontroly firmy a i kdy\u017e firma zak\u00e1zala jeho soukrom\u00e9 pou\u017eit\u00ed bez povolen\u00ed, je to pouze intern\u00ed z\u00e1le\u017eitost firmy. Z vn\u011bj\u0161\u00edho hlediska bylo rozhodnuto, \u017ee se jedn\u00e1 o &#8220;prov\u00e1d\u011bn\u00ed dan\u00e9ho podnik\u00e1n\u00ed&#8221; (Rozhodnut\u00ed Nejvy\u0161\u0161\u00edho soudu ze dne 21. prosince 1971).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripad_kdy_zamestnanec_behem_pracovni_doby_na_pracovisti_zpusobil_treti_osobe_zraneni_utokem\"><\/span>P\u0159\u00edpad, kdy zam\u011bstnanec b\u011bhem pracovn\u00ed doby na pracovi\u0161ti zp\u016fsobil t\u0159et\u00ed osob\u011b zran\u011bn\u00ed \u00fatokem<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>V p\u0159\u00edpad\u011b firmy, kter\u00e1 prov\u00e1d\u00ed obecn\u00e9 manipulace s mo\u0159sk\u00fdmi produkty na tr\u017ei\u0161ti Tsukiji, do\u0161lo k h\u00e1dce mezi ob\u017ealovan\u00fdm, kter\u00fd pracoval jako p\u0159epravce zvan\u00fd &#8220;koyan&#8221;, a doru\u010dovatelem ohledn\u011b toho, zda pom\u016f\u017ee s doru\u010dovac\u00edmi pracemi, co\u017e vedlo k bitce a zran\u011bn\u00ed doru\u010dovatele. Bylo rozhodnuto, \u017ee &#8220;\u00fatok ob\u017ealovan\u00e9ho byl proveden v procesu pln\u011bn\u00ed povinnost\u00ed firmy p\u0159i p\u0159ed\u00e1v\u00e1n\u00ed ryb velkoobchodn\u00edk\u016fm jako koyan, a proto by m\u011bl b\u00fdt pova\u017eov\u00e1n za proveden\u00fd v r\u00e1mci pln\u011bn\u00ed povinnost\u00ed zam\u011bstnance firmy&#8221; (Rozhodnut\u00ed Tokijsk\u00e9ho okresn\u00edho soudu ze dne 27. ledna 1994).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zamestnavatelska_odpovednost_pecovatelskych_spolecnosti_zamestnavajicich_pecovatele\"><\/span>Zam\u011bstnavatelsk\u00e1 odpov\u011bdnost pe\u010dovatelsk\u00fdch spole\u010dnost\u00ed zam\u011bstn\u00e1vaj\u00edc\u00edch pe\u010dovatele<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Poj\u010fme se podrobn\u011b pod\u00edvat na p\u0159\u00edpady, kdy byla po\u017eadov\u00e1na n\u00e1hrada \u0161kody nejen od \u017ealovan\u00e9ho, ale tak\u00e9 od spole\u010dnosti, kter\u00e1 \u017ealovan\u00e9ho zam\u011bstn\u00e1v\u00e1, a to jak v p\u0159\u00edpadech, kdy byla uzn\u00e1na, tak i v p\u0159\u00edpadech, kdy nebyla uzn\u00e1na. V\u011bnujte pozornost tomu, na jak\u00e9 aspekty se zam\u011b\u0159uje, kdy\u017e je uzn\u00e1na zam\u011bstnavatelsk\u00e1 odpov\u011bdnost. Na na\u0161em webu je \u010dl\u00e1nek s n\u00e1zvem &#8220;Informace o nemoci a poru\u0161en\u00ed soukrom\u00ed&#8221;, kde jsme p\u0159edstavili p\u0159\u00edpad t\u00fdkaj\u00edc\u00ed se &#8220;star\u0161\u00edho kulturn\u00edho pracovn\u00edka s demenc\u00ed&#8221;.<\/p>\n\n\n\n<p>Devades\u00e1tilet\u00fd re\u017eis\u00e9r a jeho rodina podali \u017ealobu na pe\u010dovatelku a pe\u010dovatelskou spole\u010dnost, kter\u00e1 ji zam\u011bstn\u00e1vala, po\u017eaduj\u00edc n\u00e1hradu \u0161kody za poru\u0161en\u00ed soukrom\u00ed a po\u0161kozen\u00ed dobr\u00e9 pov\u011bsti, proto\u017ee pe\u010dovatelka se vysm\u00edvala stavu, v jak\u00e9m byl mu\u017e o\u0161et\u0159ov\u00e1n, na sv\u00e9m blogu.<\/p>\n\n\n\n<p>Soud rozhodl, \u017ee blogov\u00fd p\u0159\u00edsp\u011bvek \u017ealovan\u00e9 &#8220;zve\u0159ejnil soukrom\u00ed \u017ealobce a sn\u00ed\u017eil jeho soci\u00e1ln\u00ed hodnocen\u00ed, co\u017e zp\u016fsobilo \u017ealobci du\u0161evn\u00ed utrpen\u00ed&#8221;, a uznal poru\u0161en\u00ed soukrom\u00ed a po\u0161kozen\u00ed dobr\u00e9 pov\u011bsti, a na\u0159\u00eddil pe\u010dovatelce zaplatit od\u0161kodn\u00e9 ve v\u00fd\u0161i 1,5 milionu jen\u016f.<\/p>\n\n\n\n<p>Co se t\u00fd\u010de pe\u010dovatelsk\u00e9 spole\u010dnosti, kter\u00e1 \u017eenu zam\u011bstn\u00e1vala, soud rozhodl, \u017ee prvn\u00ed \u010dl\u00e1nek byl &#8220;publikov\u00e1n b\u011bhem doby, kdy byla \u017ealovan\u00e1 zam\u011bstnankyn\u00ed \u017ealovan\u00e9 spole\u010dnosti&#8221;, a \u017ee &#8220;obsah se t\u00fdkal skute\u010dnost\u00ed, kter\u00e9 byly zji\u0161t\u011bny b\u011bhem pe\u010dovatelsk\u00e9 \u010dinnosti \u017ealovan\u00e9&#8221;, a \u017ee \u010diny \u017ealovan\u00e9 byly &#8220;\u00fazce spojeny s prov\u00e1d\u011bn\u00edm podnik\u00e1n\u00ed \u017ealovan\u00e9 spole\u010dnosti&#8221;, a proto by m\u011bly b\u00fdt pova\u017eov\u00e1ny za &#8220;proveden\u00e9 v souvislosti s prov\u00e1d\u011bn\u00edm podnik\u00e1n\u00ed&#8221;. Spole\u010dnost by m\u011bla nad\u00e1le n\u00e9st stejnou povinnost v\u016f\u010di \u017ealobci, i po ukon\u010den\u00ed smlouvy, vzhledem k povaze povinnosti zachov\u00e1vat ml\u010denlivost, a tak,<\/p>\n\n\n\n<ul>\n<li>nesla odpov\u011bdnost za protipr\u00e1vn\u00ed jedn\u00e1n\u00ed (zam\u011bstnavatelskou odpov\u011bdnost) za poru\u0161en\u00ed soukrom\u00ed a po\u0161kozen\u00ed dobr\u00e9 pov\u011bsti v d\u016fsledku \u010dl\u00e1nk\u016f publikovan\u00fdch b\u011bhem smlouvy a<\/li>\n\n\n\n<li>nesla odpov\u011bdnost za nespln\u011bn\u00ed povinnosti v d\u016fsledku \u00faniku tajemstv\u00ed v \u010dl\u00e1nc\u00edch publikovan\u00fdch po propu\u0161t\u011bn\u00ed.<\/li>\n<\/ul>\n\n\n\n<p>Soud na\u0159\u00eddil spole\u010dnosti zaplatit 1 milion jen\u016f (zam\u011bstnavatelsk\u00e1 odpov\u011bdnost) + 300 tis\u00edc jen\u016f (odpov\u011bdnost za nespln\u011bn\u00ed povinnosti), celkem 1,3 milionu jen\u016f.<\/p>\n\n\n\n<p>Soud uvedl:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Vzhledem k tomu, \u017ee v dne\u0161n\u00ed dob\u011b je snadn\u00e9 pro jednotlivce publikovat informace na internetu, pe\u010dovatelsk\u00e9 spole\u010dnosti by m\u011bly pe\u010dliv\u011b dohl\u00ed\u017eet a instruovat sv\u00e9 zam\u011bstnance p\u0159i jejich v\u00fdb\u011bru a dohledu, aby nedo\u0161lo k poru\u0161en\u00ed soukrom\u00ed a dobr\u00e9 pov\u011bsti klient\u016f. V \u017ealovan\u00e9 spole\u010dnosti v\u0161ak nebyla v\u011bnov\u00e1na \u017e\u00e1dn\u00e1 pozornost tomuto aspektu v p\u0159\u00edpad\u011b \u017ealovan\u00e9. Proto nelze uznat, \u017ee \u017ealovan\u00e1 spole\u010dnost v\u011bnovala dostate\u010dnou pozornost v\u00fdb\u011bru a dohledu nad \u017ealovanou.<\/p>\n<cite>Verdikt Tokijsk\u00e9ho okresn\u00edho soudu ze dne 4. z\u00e1\u0159\u00ed 2015 (2015)<\/cite><\/blockquote>\n\n\n\n<p>Jak je uvedeno v\u00fd\u0161e.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/reputation\/disease-information-and-privacy-infringement\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/reputation\/disease-information-and-privacy-infringement[ja]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zamestnavatelska_odpovednost_spolecnosti_zamestnavajici_zamestnance\"><\/span>Zam\u011bstnavatelsk\u00e1 odpov\u011bdnost spole\u010dnosti zam\u011bstn\u00e1vaj\u00edc\u00ed zam\u011bstnance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2020\/01\/shutterstock_1549496840-1024x576.jpg\" alt=\"\" class=\"wp-image-6594\" \/><figcaption class=\"wp-element-caption\">Zam\u011bstnavatel\u00e9 mohou n\u00e9st \u0161irokou odpov\u011bdnost za \u010diny sv\u00fdch zam\u011bstnanc\u016f.<\/figcaption><\/figure>\n\n\n\n<p>Podrobn\u011b vysv\u011btl\u00edme p\u0159\u00edpad, na kter\u00fd jsme se odk\u00e1zali v jin\u00e9m \u010dl\u00e1nku na na\u0161em webu s n\u00e1zvem &#8220;Standardn\u00ed a v\u00fdpo\u010detn\u00ed metody pro n\u00e1hradu \u0161kody po\u017eadovan\u00e9 od pachatel\u016f pomluvy&#8221;. \u017dalobce je samostatn\u00fd podnikatel a syst\u00e9mov\u00fd in\u017een\u00fdr, kter\u00fd uzav\u0159el s \u017ealovanou spole\u010dnost\u00ed komplexn\u00ed smlouvu o poskytnut\u00ed slu\u017eeb a pracoval jako vedouc\u00ed syst\u00e9mu. \u017dalovan\u00e1 spole\u010dnost se zab\u00fdv\u00e1 prodejem, instalac\u00ed a \u00fadr\u017ebou telekomunika\u010dn\u00edch za\u0159\u00edzen\u00ed a \u017ealovan\u00fd byl jej\u00edm zam\u011bstnancem.<\/p>\n\n\n\n<p>\u017dalovan\u00fd napsal na internetov\u00e9 f\u00f3rum &#8220;2channel&#8221; z mobiln\u00edho telefonu, kter\u00fd si s\u00e1m smluvn\u011b zajistil, \u017ee &#8220;mal\u00fd chlap\u00edk s \u00fa\u010desem dozadu&#8221; &#8220;ve\u0161el do d\u00e1msk\u00e9 toalety s pap\u00edrov\u00fdm s\u00e1\u010dkem&#8221; a &#8220;je v po\u0159\u00e1dku, \u017ee se na internetu \u0161\u00ed\u0159\u00ed z\u00e1b\u011bry z d\u00e1msk\u00e9 toalety na\u0161\u00ed spole\u010dnosti?&#8221; a &#8220;to, co jsi ud\u011blal, je trestn\u00fd \u010din&#8221;, co\u017e jasn\u011b odkazovalo na \u017ealobce, kter\u00fd m\u011b\u0159\u00ed 164 cm a m\u00e1 \u00fa\u010des dozadu, a obvinil ho z voyeurismu.<\/p>\n\n\n\n<p>\u017dalobce byl upozorn\u011bn na tuto skute\u010dnost veden\u00edm spole\u010dnosti a bylo mu \u0159e\u010deno, \u017ee v p\u0159\u00ed\u0161t\u00edm obdob\u00ed nemus\u00ed m\u00edt smlouvu, a proto\u017ee se ob\u00e1val ztr\u00e1ty zam\u011bstn\u00e1n\u00ed, po\u017eadoval n\u00e1hradu \u0161kody za nez\u00e1konn\u00e9 jedn\u00e1n\u00ed. Sou\u010dasn\u011b tvrdil, \u017ee \u017ealovan\u00fd sp\u00e1chal v\u00fd\u0161e uveden\u00e9 nez\u00e1konn\u00e9 jedn\u00e1n\u00ed b\u011bhem pracovn\u00ed doby \u017ealovan\u00e9 spole\u010dnosti, a po\u017eadoval na \u017ealovan\u00e9 spole\u010dnosti odpov\u011bdnost zam\u011bstnavatele.<\/p>\n\n\n\n<p>Soud nejprve uznal, \u017ee &#8220;tento p\u0159\u00edsp\u011bvek nazna\u010duje, \u017ee \u017ealobce se dopustil trestn\u00e9ho \u010dinu voyeurismu, co\u017e je z\u0159ejm\u00e9 sn\u00ed\u017een\u00ed jeho soci\u00e1ln\u00edho hodnocen\u00ed&#8221;, a na\u0159\u00eddil \u017ealovan\u00e9mu zaplatit 1 milion jen\u016f jako od\u0161kodn\u011bn\u00ed, 100 tis\u00edc jen\u016f za pr\u00e1vn\u00ed n\u00e1klady a 630 tis\u00edc jen\u016f za n\u00e1klady na vy\u0161et\u0159ov\u00e1n\u00ed k identifikaci \u017ealovan\u00e9ho, celkem 1,73 milionu jen\u016f.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/reputation\/defamation-and-decline-in-social-reputation\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/reputation\/defamation-and-decline-in-social-reputation[ja]<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/reputation\/provider-liability-limitation-law\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/reputation\/provider-liability-limitation-law[ja]<\/a><\/p>\n\n\n\n<p>Na druhou stranu, co se t\u00fd\u010de odpov\u011bdnosti spole\u010dnosti, \u017ealobce tvrdil, \u017ee &#8220;\u017ealovan\u00fd napsal tento p\u0159\u00edsp\u011bvek b\u011bhem pracovn\u00ed doby \u017ealovan\u00e9 spole\u010dnosti a \u017ealovan\u00e1 spole\u010dnost m\u00e1 povinnost dohl\u00ed\u017eet na to, aby jej\u00ed zam\u011bstnanec, tedy \u017ealovan\u00fd, neporu\u0161oval pr\u00e1va a z\u00e1jmy t\u0159et\u00edch stran, a proto nese odpov\u011bdnost zam\u011bstnavatele. P\u0159\u00edsp\u011bvek \u017ealovan\u00e9ho byl naps\u00e1n b\u011bhem pracovn\u00ed doby \u017ealovan\u00e9 spole\u010dnosti a \u017ealovan\u00e1 spole\u010dnost m\u00e1 povinnost spravovat mobiln\u00ed telefon, kter\u00fd se pou\u017e\u00edv\u00e1 pro pr\u00e1ci&#8221;, ale<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Z p\u0159\u00edsp\u011bvk\u016f napsan\u00fdch \u017ealovan\u00fdm b\u011bhem pracovn\u00ed doby se nez\u00e1konn\u00e9 jedn\u00e1n\u00ed v\u016f\u010di \u017ealobci neprok\u00e1zalo pouze v p\u0159\u00edsp\u011bvc\u00edch \u010d\u00edslo 499 a 507. P\u0159i psan\u00ed p\u0159\u00edsp\u011bvk\u016f \u010d\u00edslo 503 a 504, kter\u00e9 poukazovaly na trestn\u00fd \u010din, byl \u017ealovan\u00fd na dovolen\u00e9 a neprov\u00e1d\u011bl je b\u011bhem v\u00fdkonu sv\u00fdch povinnost\u00ed u \u017ealovan\u00e9 spole\u010dnosti. Nav\u00edc, p\u0159\u00edsp\u011bvky nebyly naps\u00e1ny z mobiln\u00edho telefonu, kter\u00fd poskytla \u017ealovan\u00e1 spole\u010dnost, ale z mobiln\u00edho telefonu, kter\u00fd vlastn\u00ed \u017ealovan\u00fd, tak\u017ee \u017ealovan\u00e1 spole\u010dnost nenese odpov\u011bdnost zam\u011bstnavatele.<\/p>\n<cite>Verdikt Tokijsk\u00e9ho okresn\u00edho soudu ze dne 31. ledna 2012 (2012)<\/cite><\/blockquote>\n\n\n\n<p>Shrnut\u00ed:<\/p>\n\n\n\n<ol>\n<li>P\u0159\u00edsp\u011bvky napsan\u00e9 b\u011bhem pracovn\u00ed doby samy o sob\u011b nezakl\u00e1daj\u00ed nez\u00e1konn\u00e9 jedn\u00e1n\u00ed.<\/li>\n\n\n\n<li>P\u0159\u00edsp\u011bvky poukazuj\u00edc\u00ed na voyeurismus byly naps\u00e1ny b\u011bhem dovolen\u00e9.<\/li>\n\n\n\n<li>P\u0159\u00edsp\u011bvky byly naps\u00e1ny ne z mobiln\u00edho telefonu poskytnut\u00e9ho \u017ealovanou spole\u010dnost\u00ed, ale z mobiln\u00edho telefonu vlastn\u011bn\u00e9ho \u017ealovan\u00fdm.<\/li>\n<\/ol>\n\n\n\n<p>V takov\u00e9m p\u0159\u00edpad\u011b nen\u00ed uzn\u00e1na odpov\u011bdnost zam\u011bstnavatele a nevznik\u00e1 povinnost n\u00e1hrady \u0161kody.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/reputation\/compensation-for-defamation-damages\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/reputation\/compensation-for-defamation-damages[ja]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Shrnuti\"><\/span>Shrnut\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>U\u017eivatel\u00e9 mohou b\u00fdt \u0161iroce odpov\u011bdn\u00ed za \u010diny t\u011bch, kte\u0159\u00ed vyu\u017e\u00edvaj\u00ed jejich slu\u017eby. Aby se p\u0159ede\u0161lo ot\u00e1zk\u00e1m t\u00fdkaj\u00edc\u00edm se odpov\u011bdnosti u\u017eivatele, je t\u0159eba, aby ti, kte\u0159\u00ed vyu\u017e\u00edvaj\u00ed jejich slu\u017eby, byli neust\u00e1le sledov\u00e1ni a upozor\u0148ov\u00e1ni, aby nep\u016fsobili \u0161kodu t\u0159et\u00edm stran\u00e1m.
