Ale bez ohledu na to, jak moc se zam\u011b\u0159\u00edme na pl\u00e1nov\u00e1n\u00ed, existuj\u00ed n\u00e1hl\u00e9 probl\u00e9my, kter\u00e9 nelze p\u0159edv\u00eddat, zejm\u00e9na ty, kter\u00e9 souvis\u00ed s &#8216;lidmi&#8217;. syst\u00e9mov\u00e9ho v\u00fdvoje o\u010dek\u00e1v\u00e1, \u017ee dodavatel bude m\u00edt komplexn\u00ed povinnosti sm\u011b\u0159uj\u00edc\u00ed k hladk\u00e9mu pr\u016fb\u011bhu projektu. Dodavatel m\u00e1 povinnost odhadnout pot\u0159ebn\u00fd person\u00e1l, dobu trv\u00e1n\u00ed, rozpo\u010det a pracovn\u00ed n\u00e1klady pro hladk\u00fd pr\u016fb\u011bh projektu, vy\u017e\u00e1dat si od u\u017eivatele pot\u0159ebnou spolupr\u00e1ci a \u0159\u00eddit pr\u016fb\u011bh projektu. Tyto povinnosti se naz\u00fdvaj\u00ed &#8220;povinnosti projektov\u00e9ho managementu&#8221; a jejich existence byla opakovan\u011b pouk\u00e1z\u00e1na v minul\u00fdch soudn\u00edch p\u0159\u00edpadech.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/project-management-duties\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/project-management-duties[ja]<\/a><\/p>\n\n\n\n<p>N\u00e1hl\u00fd odchod \u010dlen\u016f t\u00fdmu na stran\u011b dodavatele lze pova\u017eovat za jeden z probl\u00e9m\u016f povinnost\u00ed projektov\u00e9ho managementu dodavatele.<br><\/p>\n\n\n\n<ul>\n<li>Fyzick\u00e9 pot\u00ed\u017ee zp\u016fsoben\u00e9 p\u0159epracov\u00e1n\u00edm, jako je nadm\u011brn\u00fd p\u0159es\u010das a pr\u00e1ce o v\u00edkendech<\/li>\n\n\n\n<li>Psychick\u00fd stres zp\u016fsoben\u00fd neshodami ve vztaz\u00edch mezi lidmi<\/li>\n<\/ul>\n\n\n\n<p>Existuje mnoho p\u0159edpokl\u00e1dan\u00fdch d\u016fvod\u016f pro n\u00e1hl\u00fd odchod \u010dlen\u016f z projektu. Av\u0161ak tyto jsou z\u00e1kladn\u011b ot\u00e1zkou \u0159\u00edzen\u00ed pracovn\u00edch sil na stran\u011b dodavatele. Proto byste m\u011bli m\u00edt na pam\u011bti, \u017ee i kdyby tyto okolnosti vedly k zpo\u017ed\u011bn\u00ed dod\u00e1n\u00ed, pravd\u011bpodobnost osvobozen\u00ed od poru\u0161en\u00ed povinnosti je n\u00edzk\u00e1. Jin\u00fdmi slovy, od dodavatel\u016f se o\u010dek\u00e1v\u00e1, \u017ee budou m\u00edt proaktivn\u00ed p\u0159\u00edstup k \u0159\u00edzen\u00ed pr\u016fb\u011bhu projektu, a to i v p\u0159\u00edpad\u011b n\u00e1hl\u00e9ho vzniku t\u011bchto vakanc\u00ed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Dulezite_precedenty_tykajici_se_odchodu_clenu\"><\/span>D\u016fle\u017eit\u00e9 precedenty t\u00fdkaj\u00edc\u00ed se odchodu \u010dlen\u016f<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2019\/09\/shutterstock_744004378-1024x683.jpg\" alt=\"\" class=\"wp-image-4741\" \/><figcaption class=\"wp-element-caption\">P\u0159\u00edklady situac\u00ed, kter\u00e9 m\u016f\u017ee p\u0159in\u00e9st odchod \u010dlen\u016f z projektov\u00e9ho v\u00fdvoje.<\/figcaption><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pripad_kdy_odchod_clena_tymu_zpusobil_zpozdeni_dodani\"><\/span>P\u0159\u00edpad, kdy odchod \u010dlena t\u00fdmu zp\u016fsobil zpo\u017ed\u011bn\u00ed dod\u00e1n\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>N\u00e1sleduj\u00edc\u00ed p\u0159\u00edpad z judikatury se t\u00fdk\u00e1 situace, kdy po n\u00e1hl\u00e9m odchodu \u010dlena t\u00fdmu projekt nepokra\u010doval podle pl\u00e1nu a do\u0161lo k zpo\u017ed\u011bn\u00ed dod\u00e1n\u00ed. V tomto p\u0159\u00edpad\u011b byl na stran\u011b dodavatele vyv\u00edjen tlak ze strany z\u00e1stupce u\u017eivatele, co\u017e zp\u016fsobilo psychickou z\u00e1t\u011b\u017e.<\/p>\n\n\n\n<p>Mezi u\u017eivatelem, kter\u00fd cht\u011bl uplatnit odpov\u011bdnost za nepln\u011bn\u00ed z\u00e1vazk\u016f v d\u016fsledku zpo\u017ed\u011bn\u00ed pln\u011bn\u00ed, a dodavatelem, kter\u00fd cht\u011bl uplatnit poru\u0161en\u00ed povinnosti spolupr\u00e1ce ze strany u\u017eivatele, kter\u00fd se choval agresivn\u011b a autoritativn\u011b, do\u0161lo k prudk\u00e9mu sporu.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/user-obligatory-cooporation\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/user-obligatory-cooporation[ja]<\/a><\/p>\n\n\n\n<p>Soud v\u0161ak rozhodl, \u017ee r\u016fzn\u00e9 okolnosti neosvobozuj\u00ed dodavatele od jeho povinnosti \u0159\u00eddit projekt a podpo\u0159il n\u00e1zor u\u017eivatele (podtr\u017een\u00e9 a tu\u010dn\u00e9 \u010d\u00e1sti jsou dopln\u011bn\u00e9 autorem).<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Dodavatel tvrd\u00ed, \u017ee z\u00e1stupce u\u017eivatele se k dodavateli choval agresivn\u011b a autoritativn\u011b, co\u017e vedlo k tomu, \u017ee se dodavatel nemohl vyhnout odchodu z projektu.<\/p>\n\n\n\n<p>Je pravda, \u017ee z\u00e1stupce u\u017eivatele na sch\u016fzce v listopadu 2003 (Heisei 15) \u0159ekl v\u00fdrazn\u00fdm t\u00f3nem &#8220;Nem\u00e1\u0161 chu\u0165 to d\u011blat?&#8221; a &#8220;Co to je, tato smlouva je u konce. Jakmile odejdu z t\u00e9to m\u00edstnosti, je to konec.&#8221; Ale to bylo zp\u016fsobeno zpo\u017ed\u011bn\u00edm pr\u00e1ce dodavatele a jeho reakc\u00ed na to, \u017ee navzdory tomu, \u017ee bylo dohodnuto, \u017ee \u0159\u00edjen 2003 (Heisei 15) je obdob\u00ed prototypu v z\u00e1kladn\u00ed dohod\u011b, dodate\u010dn\u00e9 funkce c\u00edle v\u00fdvoje nebyly v\u016fbec zahrnuty do n\u00e1vrhu specifikace a i kdy\u017e byly p\u0159id\u00e1ny koment\u00e1\u0159e k p\u0159edlo\u017een\u00e9mu n\u00e1vrhu specifikace, nebyla \u017e\u00e1dn\u00e1 odpov\u011b\u010f. To nelze pova\u017eovat za &#8220;p\u0159ekro\u010den\u00ed hranic&#8221;.<\/p>\n\n\n\n<p>Co se t\u00fd\u010de skute\u010dnosti, \u017ee C odstoupil od pr\u00e1ce na tomto kontraktu kv\u016fli nemoci, p\u0159\u00ed\u010dina nen\u00ed jasn\u00e1, ale i kdyby stres z t\u00e9to pr\u00e1ce byl p\u0159\u00ed\u010dinou, z\u00e1kladn\u00edm probl\u00e9mem by m\u011bla b\u00fdt spr\u00e1va pr\u00e1ce na stran\u011b dodavatele, a to nelze p\u0159i\u010d\u00edtat na vrub u\u017eivatele.<\/p>\n<cite>Rozhodnut\u00ed tokijsk\u00e9ho okresn\u00edho soudu ze dne 4. prosince 2007 (Heisei 19)<\/cite><\/blockquote>\n\n\n\n<p>V uveden\u00e9m p\u0159\u00edpadu soud zv\u00e1\u017eil skute\u010dnost, \u017ee z\u00e1stupce u\u017eivatele se k dodavateli choval &#8220;v\u00fdrazn\u00fdm t\u00f3nem&#8221;, ale nakonec neosvobodil dodavatele od odpov\u011bdnosti. Za t\u00edmto rozhodnut\u00edm stoj\u00ed pravd\u011bpodobn\u011b skute\u010dnost, \u017ee by bylo nespravedliv\u00e9 svalovat vinu na u\u017eivatele, kter\u00fd se k dodavateli choval &#8220;v\u00fdrazn\u00fdm t\u00f3nem&#8221;, pokud by se zv\u00e1\u017eila \u0161patn\u00e1 reakce dodavatele. Soud p\u0159ijal sch\u00e9ma, podle kter\u00e9ho se projekt v\u00fdvoje syst\u00e9mu uskute\u010d\u0148uje na z\u00e1klad\u011b pln\u011bn\u00ed povinnosti \u0159\u00edzen\u00ed projektu dodavatelem a pln\u011bn\u00ed povinnosti spolupr\u00e1ce u\u017eivatelem, a rozhodl, \u017ee by se nem\u011blo uznat poru\u0161en\u00ed povinnosti spolupr\u00e1ce ze strany u\u017eivatele. Tento v\u00fdznam je pravd\u011bpodobn\u011b vyj\u00e1d\u0159en v\u00fdrazem &#8220;to nelze pova\u017eovat za &#8216;p\u0159ekro\u010den\u00ed hranic'&#8221;.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Co_lze_vycist_z_vyse_uvedeneho_soudniho_pripadu\"><\/span>Co lze vy\u010d\u00edst z v\u00fd\u0161e uveden\u00e9ho soudn\u00edho p\u0159\u00edpadu<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Mimo jin\u00e9 m\u016f\u017eeme z\u00edskat n\u00e1sleduj\u00edc\u00ed d\u016fle\u017eit\u00e9 ponau\u010den\u00ed:<br><\/p>\n\n\n\n<ul>\n<li>P\u0159i odchodu \u010dlena projektu kv\u016fli nemoci, pokud se uva\u017euje o p\u0159i\u010d\u00edt\u00e1n\u00ed viny na stranu u\u017eivatele, je po\u017eadov\u00e1no, aby strana dodavatele prok\u00e1zala kauz\u00e1ln\u00ed vztah k tomu, \u017ee odchod byl zp\u016fsoben u\u017eivatelem \u2192 Av\u0161ak prok\u00e1z\u00e1n\u00ed existence kauz\u00e1ln\u00edho vztahu obvykle nen\u00ed snadn\u00e9.<\/li>\n\n\n\n<li>Dokonce i kdyby se prok\u00e1zalo, \u017ee kv\u016fli vin\u011b u\u017eivatele do\u0161lo k velk\u00e9 pracovn\u00ed z\u00e1t\u011b\u017ei a \u010dlen t\u00fdmu onemocn\u011bl, obvykle se to nakonec pova\u017euje za probl\u00e9m \u0159\u00edzen\u00ed pracovn\u00edch sil na stran\u011b dodavatele \u2192 Pokud se zam\u011b\u0159\u00edme na silnou formulaci &#8220;p\u0159ehnan\u00e9 chov\u00e1n\u00ed&#8221;, kter\u00e1 je pou\u017eita v rozsudku, m\u011bli bychom p\u0159edpokl\u00e1dat, \u017ee situace, kter\u00e9 by osvobodily dodavatele od odpov\u011bdnosti za \u0159\u00edzen\u00ed pracovn\u00edch sil, jsou velmi omezen\u00e9.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jak_se_pripravit_na_riziko_odchodu_clenu_tymu\"><\/span>Jak se p\u0159ipravit na riziko odchodu \u010dlen\u016f t\u00fdmu<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2019\/09\/shutterstock_1387110839-1024x576.jpg\" alt=\"\" class=\"wp-image-4742\" \/><figcaption class=\"wp-element-caption\">Jak\u00e9 opat\u0159en\u00ed lze p\u0159ijmout k p\u0159edch\u00e1zen\u00ed probl\u00e9m\u016fm s odchodem \u010dlen\u016f projektov\u00e9ho t\u00fdmu?<\/figcaption><\/figure>\n\n\n\n<p>Jak ji\u017e bylo uvedeno, i kdy\u017e dojde k n\u00e1hl\u00e9mu vzniku pracovn\u00edch m\u00edst, je velmi obt\u00ed\u017en\u00e9 p\u0159i\u010d\u00edtat to na stranu u\u017eivatele. M\u016f\u017ee se st\u00e1t, \u017ee budete nuceni prov\u00e9st obrovsk\u00fd dodate\u010dn\u00fd v\u00fdvoj nebo budete nuceni prov\u00e9st n\u00e1siln\u00e9 zm\u011bny specifikac\u00ed, ale nen\u00ed snadn\u00e9 prok\u00e1zat p\u0159\u00ed\u010dinnou souvislost mezi fyzick\u00fdmi a psychick\u00fdmi zm\u011bnami a r\u016fzn\u00fdmi pracovn\u00edmi z\u00e1t\u011b\u017eemi. S ohledem na tyto okolnosti je d\u016fle\u017eit\u00e9 pokra\u010dovat v p\u0159\u00edprav\u011b person\u00e1ln\u00edho syst\u00e9mu na z\u00e1klad\u011b p\u0159edpokladu, \u017ee dojde k probl\u00e9m\u016fm, jako je nemoc \u010dlen\u016f projektov\u00e9ho t\u00fdmu nebo \u0161patn\u00fd zdravotn\u00ed stav.<\/p>\n\n\n\n<p>Pokud by se tato ot\u00e1zka m\u011bla \u0159e\u0161it u soudu, je z\u0159ejm\u00e9, \u017ee by se strana dodavatele ocitla v velmi nep\u0159\u00edzniv\u00e9 situaci. Proto je d\u016fle\u017eit\u00e9 sp\u00ed\u0161e p\u0159ijmout opat\u0159en\u00ed k p\u0159edch\u00e1zen\u00ed takov\u00fdm spor\u016fm.
