Jakmile jsou fotografie nebo videa z pracovn\u00edho terorismu nahr\u00e1ny na internet, mohou z\u016fstat na internetu a vyvolat kontroverzi, i kdy\u017e je p\u016fvodn\u00ed autor sma\u017ee. V \u010dervnu 2021 (Roku Reiwa 3) nap\u0159\u00edklad do\u0161lo k incidentu, kdy zam\u011bstnanec na dohodu v Domino&#8217;s Pizza zve\u0159ejnil na Instagramu video, na kter\u00e9m l\u00ed\u017ee shake p\u0159\u00edmo z lopatky, co\u017e vyvolalo velkou kontroverzi. Tento incident je jen jedn\u00edm z mnoha p\u0159\u00edpad\u016f pracovn\u00edho terorismu.<\/p>\n\n\n\n<p>V tomto \u010dl\u00e1nku vysv\u011btl\u00edme, jak\u00e9 sankce m\u016f\u017ee terorismus&#8221; je situace, kdy do\u010dasn\u00ed pracovn\u00edci prov\u00e1d\u011bj\u00ed nezodpov\u011bdn\u00e9 \u017eerty s v\u00fdrobky nebo vybaven\u00edm obchodu, fotografi\u00ed nebo videem zaznamen\u00e1vaj\u00ed sv\u00e9 \u010diny a n\u00e1sledn\u011b je zve\u0159ej\u0148uj\u00ed na soci\u00e1ln\u00edch s\u00edt\u00edch jako je Twitter. Tyto \u017eerty \u010dasto zahrnuj\u00ed nehygienick\u00e9 \u010diny, jako je h\u00e1zen\u00ed j\u00eddla do ko\u0161e nebo olizov\u00e1n\u00ed v\u00fdrobk\u016f, co\u017e m\u016f\u017ee odradit potenci\u00e1ln\u00ed z\u00e1kazn\u00edky od n\u00e1kupu. Pokud se video s &#8220;pracovn\u00edm terorismem&#8221; \u0161\u00ed\u0159\u00ed a vyvol\u00e1v\u00e1 kontroverzi, m\u016f\u017ee to nejen po\u0161kodit image firmy, ale tak\u00e9 m\u016f\u017ee m\u00edt velk\u00fd negativn\u00ed dopad na prodej a akciov\u00e9 ceny. V n\u011bkter\u00fdch p\u0159\u00edpadech m\u016f\u017ee dokonce v\u00e9st k bankrotu obchodu, co\u017e ukazuje na v\u00e1\u017enost t\u011bchto \u0161kod.<\/p>\n\n\n\n<p>Abychom p\u0159ede\u0161li &#8220;pracovn\u00edmu terorismu&#8221;, je nezbytn\u00e9 prov\u00e1d\u011bt d\u016fkladnou \u0161kolen\u00ed a vzd\u011bl\u00e1v\u00e1n\u00ed. Efektivn\u00ed mohou b\u00fdt tak\u00e9 opat\u0159en\u00ed jako instrukt\u00e1\u017ee o pou\u017e\u00edv\u00e1n\u00ed soci\u00e1ln\u00edch s\u00edt\u00ed nebo z\u00e1kaz p\u0159in\u00e1\u0161en\u00ed mobiln\u00edch telefon\u016f do obchodu. Nicm\u00e9n\u011b, v\u011bt\u0161ina p\u0159\u00edpad\u016f &#8220;pracovn\u00edho terorismu&#8221; je prov\u00e1d\u011bna s lehk\u00fdm srdcem, tak\u017ee jejich \u00fapln\u00e9 p\u0159edch\u00e1zen\u00ed m\u016f\u017ee b\u00fdt obt\u00ed\u017en\u00e9.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2021\/07\/sns-parttimejob-measures-3.jpg\" alt=\"\" class=\"wp-image-35144\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jake_sankce_jsou_mozne_vuci_brigadnikum_kteri_spachali_%E2%80%9Cbrigadnicky_teror%E2%80%9D\"><\/span>Jak\u00e9 sankce jsou mo\u017en\u00e9 v\u016f\u010di brig\u00e1dn\u00edk\u016fm, kte\u0159\u00ed sp\u00e1chali &#8220;brig\u00e1dnick\u00fd teror&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Pokud dojde k &#8220;brig\u00e1dnick\u00e9mu teroru&#8221;, je mo\u017en\u00e9 uplatnit n\u011bjak\u00e9 sankce v\u016f\u010di brig\u00e1dn\u00edk\u016fm, kte\u0159\u00ed jej sp\u00e1chali?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Vypovedi_a_ukonceni_smluv\"><\/span>V\u00fdpov\u011bdi a ukon\u010den\u00ed smluv<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"V_pripade_pracovni_smlouvy_Vypoved\"><\/span>V p\u0159\u00edpad\u011b pracovn\u00ed smlouvy: V\u00fdpov\u011b\u010f<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Pokud zam\u011bstnanec poru\u0161\u00ed pravidla stanoven\u00e1 v pracovn\u00edm \u0159\u00e1du, m\u016f\u017ee b\u00fdt propu\u0161t\u011bn.<\/p>\n\n\n\n<p>Nap\u0159\u00edklad,<\/p>\n\n\n\n<ul>\n<li>p\u0159\u00edpad v tokijsk\u00e9 steakov\u00e9 restauraci, kde do\u010dasn\u00fd zam\u011bstnanec zve\u0159ejnil na Twitteru fotografii z lednice,<\/li>\n\n\n\n<li>p\u0159\u00edpad v konbini v prefektu\u0159e Kanagawa, kde do\u010dasn\u00fd zam\u011bstnanec zve\u0159ejnil na Twitteru video, jak vyplivuje &#8220;oden&#8221;.<\/li>\n<\/ul>\n\n\n\n<p>V obou p\u0159\u00edpadech bylo ozn\u00e1meno, \u017ee doty\u010dn\u00fd zam\u011bstnanec byl propu\u0161t\u011bn.<\/p>\n\n\n\n<p>V modelov\u00e9m pracovn\u00edm \u0159\u00e1du Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed je uvedeno:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>(Povinnosti dodr\u017eov\u00e1n\u00ed)<br> \u010cl\u00e1nek 11 Zam\u011bstnanci mus\u00ed dodr\u017eovat n\u00e1sleduj\u00edc\u00ed:<\/p>\n\n\n\n<p>Neprov\u00e1d\u011bt \u010dinnosti, kter\u00e9 by po\u0161kodily \u010dest nebo d\u016fv\u011bryhodnost spole\u010dnosti.<br><\/p>\n<cite><a href=\"https:\/\/www.mhlw.go.jp\/stf\/seisakunitsuite\/bunya\/koyou_roudou\/roudoukijun\/zigyonushi\/model\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">Modelov\u00fd pracovn\u00ed \u0159\u00e1d | Ministerstvo zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed[ja]<\/a><\/cite><\/blockquote>\n\n\n\n<p>Je mo\u017en\u00e9 prov\u00e9st disciplin\u00e1rn\u00ed opat\u0159en\u00ed, pokud dojde k poru\u0161en\u00ed t\u011bchto ustanoven\u00ed. V p\u0159\u00edpad\u011b odv\u011btv\u00ed nebo spole\u010dnost\u00ed, kde je re\u00e1ln\u00e1 obava z &#8220;pracovn\u00edho terorismu&#8221;, by bylo vhodn\u00e9 do pracovn\u00edho \u0159\u00e1du zahrnout jasn\u00e9 ustanoven\u00ed ji\u017e od za\u010d\u00e1tku.<\/p>\n\n\n\n<p>Av\u0161ak v p\u0159\u00edpad\u011b do\u010dasn\u00fdch pracovn\u00edk\u016f nemus\u00ed b\u00fdt \u0161koda zp\u016fsoben\u00e1 propu\u0161t\u011bn\u00edm tak velk\u00e1. Proto se m\u016f\u017ee st\u00e1t nutn\u00e9 uplatnit civiln\u00ed nebo trestn\u00ed odpov\u011bdnost.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"V_pripade_smlouvy_o_poskytnuti_sluzeb_Ukonceni_smlouvy\"><\/span>V p\u0159\u00edpad\u011b smlouvy o poskytnut\u00ed slu\u017eeb: Ukon\u010den\u00ed smlouvy<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Pokud se nejedn\u00e1 o pracovn\u00ed smlouvu, ale o smlouvu o poskytnut\u00ed slu\u017eeb, nejde o &#8220;v\u00fdpov\u011b\u010f&#8221;, ale o ukon\u010den\u00ed smlouvy na z\u00e1klad\u011b poru\u0161en\u00ed t\u00e9to smlouvy.<\/p>\n\n\n\n<p>Obecn\u011b plat\u00ed, \u017ee zam\u011bstnanci na z\u00e1klad\u011b smlouvy o poskytnut\u00ed slu\u017eeb jsou pr\u00e1vn\u011b povinni plnit sv\u00e9 povinnosti s &#8220;\u0159\u00e1dnou p\u00e9\u010d\u00ed&#8221;. M\u016f\u017ee se tvrdit, \u017ee v\u011bt\u0161ina p\u0159\u00edpad\u016f &#8220;pracovn\u00edho terorismu&#8221; poru\u0161uje tuto &#8220;\u0159\u00e1dnou p\u00e9\u010di&#8221;. Av\u0161ak, stejn\u011b jako v p\u0159\u00edpad\u011b pracovn\u00ed smlouvy, je lep\u0161\u00ed m\u00edt jasn\u00e9 ustanoven\u00ed v smlouv\u011b ji\u017e od za\u010d\u00e1tku.<\/p>\n\n\n\n<p>V p\u0159edchoz\u00edm p\u0159\u00edpad\u011b,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>v tokijsk\u00e9 steakov\u00e9 restauraci, kde do\u010dasn\u00fd zam\u011bstnanec zve\u0159ejnil na Twitteru fotografii z lednice,<\/p>\n<\/blockquote>\n\n\n\n<p>se po propu\u0161t\u011bn\u00ed zam\u011bstnanec, kter\u00fd \u010delil kritice, br\u00e1nil na internetu, co\u017e vedlo k je\u0161t\u011b v\u011bt\u0161\u00edmu &#8220;ho\u0159en\u00ed&#8221; obchodu. Je nutn\u00e9 rozhodnout o kone\u010dn\u00fdch opat\u0159en\u00edch, aby se takov\u00e9 chov\u00e1n\u00ed neopakovalo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zadost_o_nahradu_skody\"><\/span>\u017d\u00e1dost o n\u00e1hradu \u0161kody<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>M\u016f\u017eete zv\u00e1\u017eit \u017e\u00e1dost o n\u00e1hradu \u0161kody v\u016f\u010di zam\u011bstnanci, kter\u00fd provedl tzv. &#8220;part-time terorismus&#8221; (\u0161kodliv\u00e9 jedn\u00e1n\u00ed zam\u011bstnance na \u010d\u00e1ste\u010dn\u00fd \u00favazek). Obecn\u011b plat\u00ed, \u017ee pokud jde o \u017e\u00e1dosti o n\u00e1hradu \u0161kody v\u016f\u010di zam\u011bstnanc\u016fm, zam\u011bstnanci maj\u00ed oproti podnik\u016fm omezen\u00e9 finan\u010dn\u00ed prost\u0159edky a uzn\u00e1n\u00ed stejn\u00e9 n\u00e1hrady \u0161kody, jako je tomu u rovnocenn\u00fdch partner\u016f, by bylo p\u0159\u00edli\u0161 tvrd\u00e9. Proto se zva\u017euje princip omezen\u00ed odpov\u011bdnosti zalo\u017een\u00fd na pravidle dobr\u00e9 v\u00edry.
