Jsou mapy pova\u017eov\u00e1ny za d\u00edlo v r\u00e1mci autorsk\u00e9ho pr\u00e1va? A\u010dkoli autorsk\u00fd z\u00e1kon explicitn\u011b uv\u00e1d\u00ed, co se pova\u017euje za d\u00edlo, na z\u00e1klad\u011b minul\u00fdch soudn\u00edch rozhodnut\u00ed, kter\u00e1 ukazuj\u00ed, \u017ee &#8220;prostor pro individu\u00e1ln\u00ed vyj\u00e1d\u0159en\u00ed je omezen\u00fd a v porovn\u00e1n\u00ed s liter\u00e1rn\u00edmi, hudebn\u00edmi nebo v\u00fdtvarn\u00fdmi d\u00edly je zde m\u00e9n\u011b prostoru pro uzn\u00e1n\u00ed kreativity&#8221;, m\u016f\u017ee b\u00fdt posouzen\u00ed obt\u00ed\u017en\u00e9.<\/p>\n\n\n\n<p>V roce 2022 (Reiwa 4) tokijsk\u00fd okresn\u00ed soud rozhodl, \u017ee reziden\u010dn\u00ed mapy spole\u010dnosti Zenrin Co., Ltd., kter\u00e1 se zab\u00fdv\u00e1 pr\u016fzkumem, tvorbou a prodejem mapov\u00fdch informac\u00ed, jsou &#8220;d\u00edlem&#8221; v souladu s autorsk\u00fdm pr\u00e1vem. Tato spole\u010dnost shroma\u017e\u010fuje mapov\u00e9 informace z cel\u00e9ho Japonska a vytv\u00e1\u0159\u00ed a prod\u00e1v\u00e1 pap\u00edrov\u00e9 mapy nemovitost\u00ed &#8220;Zenrin J\u016btaku Chizu&#8221; a elektronick\u00e9 mapy nemovitost\u00ed &#8220;Digital Town&#8221; ulo\u017een\u00e9 na CD-ROMech a dal\u0161\u00edch m\u00e9di\u00edch.<\/p>\n\n\n\n<p>Ob\u017ealovan\u00e1 po\u0161tovn\u00ed spole\u010dnost je spole\u010dnost s ru\u010den\u00edm omezen\u00fdm, kter\u00e1 se specializuje na doru\u010dov\u00e1n\u00ed reklamn\u00edch materi\u00e1l\u016f do dom\u00e1cnost\u00ed, p\u0159edev\u0161\u00edm v prefektu\u0159e Nagano.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prehled_pripadu_Zenrin_Jutaku_Chizu\"><\/span>P\u0159ehled p\u0159\u00edpadu Zenrin J\u016btaku Chizu<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Ob\u017ealovan\u00e1 spole\u010dnost zakoupila mapy nemovitost\u00ed od Zenrinu pro sv\u00e9 podnik\u00e1n\u00ed. Pro oblasti, kde jej\u00ed doru\u010dovatel\u00e9 prov\u00e1d\u011bli po\u0161tovn\u00ed roznos, vytvo\u0159ila z t\u011bchto zakoupen\u00fdch map origin\u00e1ln\u00ed mapy t\u00edm, \u017ee je zmen\u0161ila, zkop\u00edrovala a slepila dohromady. Na tyto mapy pot\u00e9 zapsala informace nezbytn\u00e9 pro po\u0161tovn\u00ed roznos, jako jsou n\u00e1zvy bytov\u00fdch komplex\u016f, po\u010det po\u0161tovn\u00edch schr\u00e1nek, po\u010det doru\u010den\u00fdch kus\u016f, n\u00e1zvy k\u0159i\u017eovatek, stav silnic a domy, kde je roznos zak\u00e1z\u00e1n. Tyto origin\u00e1ln\u00ed mapy byly n\u00e1sledn\u011b kop\u00edrov\u00e1ny a p\u0159ed\u00e1ny doru\u010dovatel\u016fm pro jejich pr\u00e1ci.<\/p>\n\n\n\n<p>Kdykoliv ob\u017ealovan\u00ed z\u00edskali dal\u0161\u00ed informace, jako je po\u010det mo\u017en\u00fdch doru\u010den\u00ed, rozli\u0161en\u00ed mezi pr\u00e1zdn\u00fdmi a opu\u0161t\u011bn\u00fdmi domy, novostavby, nov\u011b z\u0159\u00edzen\u00e9 cesty, polohy vchod\u016f a po\u0161tovn\u00edch schr\u00e1nek, okam\u017eit\u011b tyto informace p\u0159idali do origin\u00e1ln\u00edch map pro po\u0161tovn\u00ed roznos a poskytli aktualizovan\u00e9 kopie doru\u010dovatel\u016fm.<\/p>\n\n\n\n<p>Na to Zenrin reagoval tvrzen\u00edm, \u017ee kop\u00edrov\u00e1n\u00ed, \u00faprava a pou\u017eit\u00ed jeho map nemovitost\u00ed pro po\u0161tovn\u00ed roznos, stejn\u011b jako jejich kop\u00edrov\u00e1n\u00ed, p\u0159ed\u00e1v\u00e1n\u00ed nebo p\u016fj\u010dov\u00e1n\u00ed ve\u0159ejnosti, nebo zve\u0159ejn\u011bn\u00ed obrazov\u00fdch dat map na webov\u00fdch str\u00e1nk\u00e1ch, poru\u0161uje autorsk\u00e1 pr\u00e1va spojen\u00e1 s mapami nemovitost\u00ed (v\u010detn\u011b pr\u00e1va na reprodukci, distribuci, p\u016fj\u010dov\u00e1n\u00ed a ve\u0159ejn\u00e9 p\u0159enosy). Zenrin po\u017eadoval po po\u0161tovn\u00ed spole\u010dnosti a jej\u00edm z\u00e1stupc\u00edch \u010d\u00e1ste\u010dn\u00e9 od\u0161kodn\u011bn\u00ed a na z\u00e1klad\u011b \u010dl\u00e1nk\u016f 112 odst. 1 a 2 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona tak\u00e9 z\u00e1kaz kop\u00edrov\u00e1n\u00ed, distribuce nebo p\u016fj\u010dov\u00e1n\u00ed reprodukc\u00ed ve\u0159ejnosti a z\u00e1kaz ve\u0159ejn\u00e9ho p\u0159enosu nebo umo\u017en\u011bn\u00ed p\u0159enosu, a po\u017eadoval zni\u010den\u00ed v\u0161ech kopi\u00ed map.<\/p>\n\n\n\n<p>Souvisej\u00edc\u00ed \u010dl\u00e1nek: <a href=\"https:\/\/monolith.law\/reputation\/image-copyright-infringement-compensation-for-damages\" target=\"_blank\" rel=\"noreferrer noopener\">Vysv\u011btlen\u00ed autorsk\u00fdch pr\u00e1v k obr\u00e1zk\u016fm a &#8216;b\u011b\u017en\u00e9 v\u00fd\u0161e od\u0161kodn\u011bn\u00ed&#8217; s dv\u011bma p\u0159\u00edklady rozhodnut\u00ed[ja]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kriteria_pro_urceni_zda_mapa_je_autorskym_dilem\"><\/span>Krit\u00e9ria pro ur\u010den\u00ed, zda mapa je autorsk\u00fdm d\u00edlem<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Podle \u010dl\u00e1nku 10 odst. 1 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona, kter\u00fd uv\u00e1d\u00ed p\u0159\u00edklady autorsk\u00fdch d\u00edl, bod 6 zahrnuje &#8220;mapy nebo v\u011bdeck\u00e9 kresby, grafy, modely a jin\u00e1 grafick\u00e1 d\u00edla&#8221;, co\u017e stanovuje, \u017ee mapy jsou autorsk\u00fdmi d\u00edly.<\/p>\n\n\n\n<p>Na druh\u00e9 stran\u011b, jak bylo uvedeno v rozhodnut\u00ed z roku Heisei 13 (2001), &#8220;mapy objektivn\u011b vyjad\u0159uj\u00ed topografii a vyu\u017eit\u00ed p\u016fdy pomoc\u00ed ur\u010dit\u00fdch symbol\u016f a maj\u00ed m\u00e1lo prostoru pro individu\u00e1ln\u00ed vyj\u00e1d\u0159en\u00ed, a proto oproti liter\u00e1rn\u00edm, hudebn\u00edm nebo v\u00fdtvarn\u00fdm d\u00edl\u016fm je m\u00e9n\u011b prostoru pro uzn\u00e1n\u00ed kreativity&#8221; (Rozhodnut\u00ed tokijsk\u00e9ho okresn\u00edho soudu z 23. ledna Heisei 13 (2001)).<\/p>\n\n\n\n<p>P\u0159esto toto rozhodnut\u00ed uzn\u00e1v\u00e1, \u017ee &#8220;v\u00fdb\u011br informac\u00ed, kter\u00e9 maj\u00ed b\u00fdt zaznamen\u00e1ny, a zp\u016fsob jejich prezentace mohou odr\u00e1\u017eet individualitu, vzd\u011bl\u00e1n\u00ed, zku\u0161enosti a rozsah ter\u00e9nn\u00edho pr\u016fzkumu tv\u016frce mapy, a proto m\u016f\u017ee b\u00fdt kreativita st\u00e1le p\u0159\u00edtomna&#8221; (tamt\u00e9\u017e).<\/p>\n\n\n\n<p>Z\u00e1v\u011brem, co se t\u00fd\u010de autorsk\u00e9 povahy map, je rozhodnut\u00ed, \u017ee &#8220;je t\u0159eba posuzovat na z\u00e1klad\u011b celkov\u00e9ho v\u00fdb\u011bru informac\u00ed, kter\u00e9 maj\u00ed b\u00fdt zaznamen\u00e1ny, a zp\u016fsobu jejich prezentace&#8221;.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Je_mozne_uznat_kreativitu_jako_autorske_dilo_v_pripade_rezidencnich_map\"><\/span>Je mo\u017en\u00e9 uznat kreativitu jako autorsk\u00e9 d\u00edlo v p\u0159\u00edpad\u011b reziden\u010dn\u00edch map?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2023\/05\/Shutterstock_131620121.jpg\" alt=\"Argumenty obou stran, v\u00fdsledek soudn\u00edho \u0159\u00edzen\u00ed\" class=\"wp-image-61026\" \/><\/figure>\n\n\n\n<p>V tomto p\u0159\u00edpad\u011b bylo sporn\u00e9, zda lze u reziden\u010dn\u00edch map uznat kreativitu a t\u00edm je pova\u017eovat za autorsk\u00e9 d\u00edlo.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Hlavni_argumenty_spolecnosti_Zenrin\"><\/span>Hlavn\u00ed argumenty spole\u010dnosti Zenrin<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>\u017dalobce, spole\u010dnost Zenrin, tvrdil, \u017ee jeho reziden\u010dn\u00ed mapy jsou d\u00edlem tv\u016fr\u010d\u00edho charakteru a odpov\u00eddaj\u00ed d\u00edlu chr\u00e1n\u011bn\u00e9mu autorsk\u00fdm pr\u00e1vem z n\u00e1sleduj\u00edc\u00edch d\u016fvod\u016f:<\/p>\n\n\n\n<ul>\n<li>Reziden\u010dn\u00ed mapy spole\u010dnosti Zenrin jsou v\u00fdsledkem pe\u010dliv\u00e9ho v\u00fdb\u011bru p\u0159esn\u00fdch a detailn\u00edch informac\u00ed z\u00edskan\u00fdch rozs\u00e1hl\u00fdm ter\u00e9nn\u00edm pr\u016fzkumem. P\u0159i jejich tvorb\u011b byl kladen d\u016fraz na to, jak p\u0159esn\u011b a vhodn\u011b uspo\u0159\u00e1dat a vyj\u00e1d\u0159it mapov\u00e9 informace, a z\u00e1rove\u0148 na to, jak je u\u010dinit pro u\u017eivatele co nejp\u0159ehledn\u011bj\u0161\u00ed a nejsrozumiteln\u011bj\u0161\u00ed. Tento proces vy\u017eadoval inovativn\u00ed a tv\u016fr\u010d\u00ed p\u0159\u00edstup a jednotnou redakci.<\/li>\n\n\n\n<li>Obrysy dom\u016f na map\u00e1ch, kter\u00e9 zn\u00e1zor\u0148uj\u00ed p\u016fdorys budov z pta\u010d\u00ed perspektivy, jsou v\u00fdsledkem odhad\u016f a m\u011b\u0159en\u00ed prov\u00e1d\u011bn\u00fdch pr\u016fzkumn\u00edky na m\u00edst\u011b, kte\u0159\u00ed zohled\u0148uj\u00ed polohu okoln\u00edch budov. Vzhledem k tomu, \u017ee ka\u017ed\u00fd pr\u016fzkumn\u00edk prov\u00e1d\u00ed tyto odhady individu\u00e1ln\u011b, v\u00fdsledn\u00e9 obrysy odr\u00e1\u017eej\u00ed osobit\u00fd charakter ka\u017ed\u00e9ho z nich a nikdy nejsou zcela identick\u00e9.<\/li>\n\n\n\n<li>Existuje mnoho r\u016fzn\u00fdch zp\u016fsob\u016f, jak mohou b\u00fdt obrysy dom\u016f na map\u00e1ch zn\u00e1zorn\u011bny, a ka\u017ed\u00e1 spole\u010dnost vytv\u00e1\u0159ej\u00edc\u00ed reziden\u010dn\u00ed mapy m\u00e1 sv\u016fj vlastn\u00ed styl. \u017dalobce si pro sv\u00e9 mapy vybral konkr\u00e9tn\u00ed zp\u016fsob vyj\u00e1d\u0159en\u00ed z r\u016fzn\u00fdch mo\u017enost\u00ed, jako je tlou\u0161\u0165ka a d\u00e9lka lini\u00ed obrys\u016f dom\u016f a fonty pou\u017eit\u00e9 pro jm\u00e9na obyvatel uveden\u00e1 uvnit\u0159 obrys\u016f.<\/li>\n\n\n\n<li>P\u0159i tvorb\u011b ka\u017ed\u00e9 mapy sice m\u016f\u017ee b\u00fdt pou\u017eita jako reference z\u00e1kladn\u00ed mapa m\u011bstsk\u00e9ho pl\u00e1nov\u00e1n\u00ed od Japonsk\u00e9ho geografick\u00e9ho \u00fastavu (Geospatial Information Authority of Japan), ale vzhled a dojem z ka\u017ed\u00e9 mapy se od t\u00e9to z\u00e1kladn\u00ed mapy z\u00e1sadn\u011b li\u0161\u00ed. Byly provedeny inovace, kter\u00e9 usnad\u0148uj\u00ed vyhled\u00e1v\u00e1n\u00ed po\u017eadovan\u00fdch map, a pou\u017eit\u00edm ilustrac\u00ed jsou za\u0159\u00edzen\u00ed snadno rozpoznateln\u00e1, jsou uvedeny n\u00e1zvy silnic a jm\u00e9na obyvatel budov, adresy a obrysy budov, kter\u00e9 p\u0159edstavuj\u00ed pohled shora. Mapy, kter\u00e9 \u017ealobce vytv\u00e1\u0159el a prod\u00e1val po mnoho let, odr\u00e1\u017eej\u00ed pe\u010dliv\u00fd v\u00fdb\u011br informac\u00ed, kter\u00e9 pova\u017eoval za nezbytn\u00e9 pro reziden\u010dn\u00ed mapy, a jsou prezentov\u00e1ny zp\u016fsobem, kter\u00fd pova\u017eoval za nej\u010diteln\u011bj\u0161\u00ed.
