Sou\u010dasn\u011b se v\u0161ak st\u00e1v\u00e1 p\u0159edm\u011btem z\u00e1jmu i problematika mezin\u00e1rodn\u00ed regulace AI.<\/p>\n\n\n\n<p>V Japonsku Ministerstvo hospod\u00e1\u0159stv\u00ed, obchodu a pr\u016fmyslu zve\u0159ejnilo <a href=\"https:\/\/www.meti.go.jp\/press\/2021\/01\/20220125001\/20220124003.html\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;Sm\u011brnice pro spr\u00e1vu AI princip\u016f Ver. 1.1&#8243;[ja]<\/a> (k datu psan\u00ed tohoto \u010dl\u00e1nku). Dne 14. \u010dervna 2023 (2023) byl v Evropsk\u00e9m parlamentu p\u0159ijat prvn\u00ed mezin\u00e1rodn\u00ed &#8220;Z\u00e1kon o regulaci AI&#8221;, kter\u00fd si z\u00edskal pozornost i v Japonsku.<\/p>\n\n\n\n<p>Tento \u010dl\u00e1nek p\u0159edstav\u00ed sou\u010dasn\u00fd stav a vyhl\u00eddky z\u00e1kona o regulaci AI a vysv\u011btl\u00ed jeho dopad na japonsk\u00e9 spole\u010dnosti.<\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_53 counter-hierarchy ez-toc-counter ez-toc-grey ez-toc-container-direction\">\n<div id=\"Co_je_AI_Act_Zakon_o_AI\"><\/span>Co je AI Act (Z\u00e1kon o AI)?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Dne 14. \u010dervna 2023 byl v Evropsk\u00e9m parlamentu EU p\u0159ijat komplexn\u00ed &#8220;N\u00e1vrh pravidel pro AI&#8221;, kter\u00fd se vztahuje na vyu\u017eit\u00ed AI jako celku. Jedn\u00e1 se o prvn\u00ed mezin\u00e1rodn\u00ed &#8220;Z\u00e1kon o AI (AI Act)&#8221; na sv\u011bt\u011b, kter\u00fd se skl\u00e1d\u00e1 z 85 \u010dl\u00e1nk\u016f a je jednotn\u00fdm pravidlem EU (sekund\u00e1rn\u00ed legislativa).<\/p>\n\n\n\n<p>V pr\u016fb\u011bhu roku 2023 se o\u010dek\u00e1v\u00e1, \u017ee dojde k neform\u00e1ln\u00edm jedn\u00e1n\u00edm (trilog\u016fm) mezi t\u0159emi stranami (Evropskou komis\u00ed, Evropsk\u00fdm parlamentem a Radou Evropy) s c\u00edlem dos\u00e1hnout dohody. Po schv\u00e1len\u00ed legislativn\u00edmi org\u00e1ny, Evropsk\u00fdm parlamentem a Radou Evropy, se p\u0159edpokl\u00e1d\u00e1, \u017ee z\u00e1kon vstoup\u00ed v platnost v roce 2024.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pravni_system_EU\"><\/span>Pr\u00e1vn\u00ed syst\u00e9m EU<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Pr\u00e1vn\u00ed syst\u00e9m EU se skl\u00e1d\u00e1 ze t\u0159\u00ed druh\u016f pr\u00e1va: prim\u00e1rn\u00edho pr\u00e1va (smlouvy), sekund\u00e1rn\u00edho pr\u00e1va (komunit\u00e1rn\u00ed legislativa) a judikatury.<\/p>\n\n\n\n<p>Sekund\u00e1rn\u00ed pr\u00e1vo je zalo\u017eeno na prim\u00e1rn\u00edm pr\u00e1vu (smlouv\u00e1ch) a p\u0159edstavuje pr\u00e1vn\u00ed p\u0159edpisy, kter\u00e9 p\u0159\u00edmo \u010di nep\u0159\u00edmo reguluj\u00ed \u010dlensk\u00e9 st\u00e1ty EU a jsou zn\u00e1my jako pr\u00e1vo EU nebo odvozen\u00e9 pr\u00e1vo.<\/p>\n\n\n\n<p>Existuje p\u011bt hlavn\u00edch typ\u016f, ale &#8220;EU AI Regulation&#8221; spad\u00e1 pod na\u0159\u00edzen\u00ed (Regulation), co\u017e znamen\u00e1, \u017ee se jedn\u00e1 o jednotn\u00e1 pravidla, kter\u00e1 p\u0159\u00edmo zavazuj\u00ed \u010dlensk\u00e9 st\u00e1ty EU.<\/p>\n\n\n\n<p>Mezi sekund\u00e1rn\u00ed pr\u00e1vn\u00ed p\u0159edpisy EU pat\u0159\u00ed n\u00e1sleduj\u00edc\u00edch p\u011bt typ\u016f:<\/p>\n\n\n\n<ul>\n<li>Na\u0159\u00edzen\u00ed (Regulation): M\u00e1 z\u00e1vaznou s\u00edlu pro v\u0161echny \u010dlensk\u00e9 st\u00e1ty a po p\u0159ijet\u00ed se st\u00e1v\u00e1 p\u0159\u00edmo aplikovateln\u00fdm (st\u00e1v\u00e1 se sou\u010d\u00e1st\u00ed vnitrost\u00e1tn\u00edho pr\u00e1vn\u00edho syst\u00e9mu bez nutnosti ratifika\u010dn\u00edho procesu).<\/li>\n\n\n\n<li>Sm\u011brnice (Directive): \u010clensk\u00e9 st\u00e1ty jsou povinny p\u0159ijmout novou nebo zm\u011bnit st\u00e1vaj\u00edc\u00ed vnitrost\u00e1tn\u00ed legislativu, aby dos\u00e1hly stanoven\u00fdch c\u00edl\u016f, a nesou pr\u00e1vn\u00ed z\u00e1vazky.<\/li>\n\n\n\n<li>Rozhodnut\u00ed (Decision): Jeden z forem pr\u00e1va s pr\u00e1vn\u00ed z\u00e1vaznost\u00ed, kter\u00e9 se vztahuje ne na obecn\u00e9, ale na konkr\u00e9tn\u00ed subjekty, jako jsou ur\u010dit\u00e9 \u010dlensk\u00e9 st\u00e1ty, podniky nebo jednotlivci.<\/li>\n\n\n\n<li>Doporu\u010den\u00ed (Recommendation): Evropsk\u00e1 komise doporu\u010duje vl\u00e1d\u00e1m \u010dlensk\u00fdch st\u00e1t\u016f, podnik\u016fm nebo jednotlivc\u016fm ur\u010dit\u00e9 akce nebo opat\u0159en\u00ed. Nem\u00e1 pr\u00e1vn\u00ed z\u00e1vaznost ani vynutitelnost, ale je pova\u017eov\u00e1no za n\u00e1stroj, kter\u00fd podporuje legislativn\u00ed zm\u011bny nebo reformy v \u010dlensk\u00fdch st\u00e1tech EU.<\/li>\n\n\n\n<li>N\u00e1zor (Opinion): N\u011bkdy ozna\u010dov\u00e1n jako &#8220;stanovisko&#8221;, p\u0159edstavuje vyj\u00e1d\u0159en\u00ed Evropsk\u00e9 komise k ur\u010dit\u00e9mu t\u00e9matu, ale nem\u00e1 pr\u00e1vn\u00ed z\u00e1vaznost ani vynutitelnost.<\/li>\n<\/ul>\n\n\n\n<p>&#8220;Na\u0159\u00edzen\u00ed&#8221; je pova\u017eov\u00e1no za nejsiln\u011bj\u0161\u00ed formu sekund\u00e1rn\u00edho pr\u00e1va, nap\u0159\u00edklad GDPR (General Data Protection Regulation) = &#8220;Obecn\u00e9 na\u0159\u00edzen\u00ed o ochran\u011b osobn\u00edch \u00fadaj\u016f&#8221; je p\u0159\u00edkladem na\u0159\u00edzen\u00ed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rozsah_pusobnosti_zakona_o_regulaci_AI\"><\/span>Rozsah p\u016fsobnosti z\u00e1kona o regulaci AI<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Evropsk\u00fd z\u00e1kon o regulaci AI (Japanese: AI\u898f\u5236\u6cd5) se p\u0159\u00edmo uplat\u0148uje v r\u00e1mci EU a m\u00e1 pr\u00e1vn\u00ed z\u00e1vaznost i ve t\u0159et\u00edch zem\u00edch, kter\u00e9 jsou obchodn\u00edmi partnery, a tedy i mimo \u00fazem\u00ed EU. Regulace se t\u00fdk\u00e1 podnikatel\u016f, kte\u0159\u00ed uv\u00e1d\u011bj\u00ed na evropsk\u00fd trh AI syst\u00e9my a slu\u017eby, a to v\u010detn\u011b v\u00fdvoj\u00e1\u0159\u016f, nasazovatel\u016f, poskytovatel\u016f, dovozc\u016f, distributor\u016f a u\u017eivatel\u016f AI.<\/p>\n\n\n\n<p>Z\u00e1kon o regulaci AI stanovuje konkr\u00e9tn\u00ed po\u017eadavky na ur\u010dit\u00e9 syst\u00e9my AI a povinnosti podnikatel\u016f, ale z\u00e1rove\u0148 usiluje o sn\u00ed\u017een\u00ed administrativn\u00edho a finan\u010dn\u00edho zat\u00ed\u017een\u00ed mal\u00fdch a st\u0159edn\u00edch podnik\u016f (SME).<\/p>\n\n\n\n<p>Tento n\u00e1vrh z\u00e1kona je sou\u010d\u00e1st\u00ed \u0161irok\u00e9ho bal\u00ed\u010dku opat\u0159en\u00ed pro AI, kter\u00fd si klade za c\u00edl zajistit bezpe\u010dnost AI a z\u00e1kladn\u00ed pr\u00e1va a pos\u00edlit p\u0159\u00edstup k AI, investice a inovace v cel\u00e9 EU.<\/p>\n\n\n\n<p>Evropsk\u00e1 regulace mus\u00ed b\u00fdt v souladu se z\u00e1kladn\u00edmi principy Evropsk\u00e9 unie, jak jsou stanoveny ve Smlouv\u011b o fungov\u00e1n\u00ed Evropsk\u00e9 unie. To znamen\u00e1, \u017ee i v oblasti AI technologi\u00ed mus\u00ed b\u00fdt zaru\u010dena lidsk\u00e1 pr\u00e1va a svobody v r\u00e1mci EU, a je tedy nezbytn\u00e9 m\u00edt pro toto zaji\u0161t\u011bn\u00ed p\u0159\u00edslu\u0161n\u00e9 ochrann\u00e9 mechanismy.<\/p>\n\n\n\n<p>V n\u00e1vrhu z\u00e1kona je \u00fa\u010del regulace vysv\u011btlen jako &#8220;podpora d\u016fv\u011bryhodn\u00e9ho vyu\u017e\u00edv\u00e1n\u00ed AI pod lidsk\u00fdm dohledem a zaji\u0161t\u011bn\u00ed ochrany zdrav\u00ed, bezpe\u010dnosti, z\u00e1kladn\u00edch pr\u00e1v, demokracie a pr\u00e1vn\u00edho st\u00e1tu a \u017eivotn\u00edho prost\u0159ed\u00ed p\u0159ed riziky spojen\u00fdmi s AI.&#8221;<\/p>\n\n\n\n<p>Konkr\u00e9tn\u011b jsou stanoveny n\u00e1sleduj\u00edc\u00ed &#8220;v\u0161eobecn\u00e9 principy platn\u00e9 pro v\u0161echny AI syst\u00e9my&#8221;:<\/p>\n\n\n\n<ul>\n<li>Lidsk\u00e1 autonomie a dohled (human agency and oversight)<\/li>\n\n\n\n<li>Technick\u00e1 robustnost a bezpe\u010dnost (technical robustness and safety)<\/li>\n\n\n\n<li>Soukrom\u00ed a spr\u00e1va dat (privacy and data governance)<\/li>\n\n\n\n<li>Transparentnost (transparency)<\/li>\n\n\n\n<li>Rozmanitost, nediskriminace a spravedlnost (diversity, non-discrimination and fairness)<\/li>\n\n\n\n<li>Spole\u010densk\u00e9 a environment\u00e1ln\u00ed blaho (social and environmental well-being)<\/li>\n<\/ul>\n\n\n\n<p>V r\u00e1mci tohoto z\u00e1kona o regulaci je jasn\u011b zd\u016frazn\u011bno, \u017ee pro dosa\u017een\u00ed princip\u016f AI je nezbytn\u00e9 zajistit AI gramotnost v\u00fdvoj\u00e1\u0159\u016f, u\u017eivatel\u016f a poskytovatel\u016f AI.<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b poru\u0161en\u00ed mohou b\u00fdt ulo\u017eeny vysok\u00e9 sankce zalo\u017een\u00e9 na celosv\u011btov\u00e9m obratu (a\u017e do v\u00fd\u0161e 30 milion\u016f eur, co\u017e je p\u0159ibli\u017en\u011b 4,7 miliardy jen\u016f, nebo 6 % z celosv\u011btov\u00e9ho obratu, podle toho, kter\u00e1 \u010d\u00e1stka je vy\u0161\u0161\u00ed), co\u017e m\u016f\u017ee v\u00e9st k tomu, \u017ee podnik\u00e1n\u00ed v oblasti AI v EU nebude mo\u017en\u00e9.<\/p>\n\n\n\n<p>Proto se od podnik\u016f, v\u010detn\u011b t\u011bch z Japonska, kter\u00e9 ji\u017e provozuj\u00ed AI podnik\u00e1n\u00ed na evropsk\u00e9m trhu nebo uva\u017euj\u00ed o vstupu na evropsk\u00fd trh v budoucnu, vy\u017eaduje, aby se p\u0159izp\u016fsobily nov\u00e9 regulaci AI EU.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pozadi_vzniku_zakona_o_regulaci_AI\"><\/span>Pozad\u00ed vzniku z\u00e1kona o regulaci AI<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2023\/11\/Shutterstock_2284290979.jpg\" alt=\"Pozad\u00ed vzniku z\u00e1kona o regulaci AI\" class=\"wp-image-63224\" \/><\/figure>\n\n\n\n<p>Generativn\u00ed AI je sice u\u017eite\u010dn\u00fdm n\u00e1strojem, ale z\u00e1rove\u0148 p\u0159in\u00e1\u0161\u00ed rizika, jako je podpora kriminality nebo ohro\u017een\u00ed demokracie. S rozvojem a \u0161\u00ed\u0159en\u00edm AI technologi\u00ed se tyto probl\u00e9my st\u00e1vaj\u00ed nevyhnuteln\u00fdmi v\u00fdzvami.<\/p>\n\n\n\n<p>Od roku 2016 publikovaly Evropsk\u00e1 unie (EU), Spojen\u00e9 st\u00e1ty americk\u00e9 a \u010c\u00edna sm\u011brnice a n\u00e1rodn\u00ed strategick\u00e9 pl\u00e1ny t\u00fdkaj\u00edc\u00ed se AI. Existuj\u00ed tak\u00e9 z\u00e1kony, jako je &#8220;Z\u00e1kon o zv\u00fd\u0161en\u00ed transparentnosti a spravedlnosti specifick\u00fdch digit\u00e1ln\u00edch platforem&#8221; (\u00fa\u010dinn\u00fd od 1. \u00fanora 2021), kter\u00e9 byly navr\u017eeny s ohledem na pr\u00e1vn\u00ed p\u0159edpisy EU.<\/p>\n\n\n\n<p>V sou\u010dasn\u00e9 dob\u011b v Japonsku neexistuj\u00ed \u017e\u00e1dn\u00e9 p\u0159\u00edsn\u00e9 z\u00e1kony reguluj\u00edc\u00ed AI, a m\u00edsto toho se zem\u011b \u0159\u00edd\u00ed politikou samoregulace zalo\u017een\u00e9 na m\u011bkk\u00e9m pr\u00e1vu.<\/p>\n\n\n\n<p>Jak bylo uvedeno v\u00fd\u0161e, &#8220;Z\u00e1kon o regulaci AI&#8221; EU se p\u0159\u00edmo vztahuje na \u010dlensk\u00e9 st\u00e1ty EU a m\u00e1 tak\u00e9 p\u0159eshrani\u010dn\u00ed aplikaci pro podniky p\u016fsob\u00edc\u00ed v r\u00e1mci EU, co\u017e zahrnuje i podniky se s\u00eddlem mimo EU.<\/p>\n\n\n\n<p>Jak bude vysv\u011btleno pozd\u011bji, na v\u00fdvoz AI produkt\u016f v r\u00e1mci EU se mohou vztahovat r\u016fzn\u00e9 z\u00e1kony z r\u016fzn\u00fdch hledisek, a proto je nezbytn\u00e9 p\u0159ijmout odpov\u00eddaj\u00edc\u00ed opat\u0159en\u00ed. Japonsk\u00e9 spole\u010dnosti by m\u011bly pe\u010dliv\u011b sledovat budouc\u00ed v\u00fdvoj a p\u0159ijmout vhodn\u00e1 opat\u0159en\u00ed pro dodr\u017een\u00ed z\u00e1kona.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prijeti_navrhu_uprav_vcetne_generativni_AI\"><\/span>P\u0159ijet\u00ed n\u00e1vrhu \u00faprav v\u010detn\u011b generativn\u00ed AI<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2023\/11\/Shutterstock_2294823599.jpg\" alt=\"P\u0159ijet\u00ed n\u00e1vrhu \u00faprav v\u010detn\u011b generativn\u00ed AI\" class=\"wp-image-63227\" \/><\/figure>\n\n\n\n<p>Z\u00e1kon o regulaci AI je pr\u00e1vn\u00ed p\u0159edpis EU, na kter\u00fd byly aplikov\u00e1ny pozm\u011b\u0148ovac\u00ed n\u00e1vrhy od t\u0159\u00ed subjekt\u016f EU (Rady Evropy, Evropsk\u00e9ho parlamentu a Evropsk\u00e9 komise).<\/p>\n\n\n\n<p>Dne 11. kv\u011btna 2023 v\u00fdbory IMCO (V\u00fdbor pro vnit\u0159n\u00ed trh a ochranu spot\u0159ebitel\u016f) a LIBE (V\u00fdbor pro ob\u010dansk\u00e9 svobody, spravedlnost a vnit\u0159n\u00ed v\u011bci) schv\u00e1lily n\u00e1vrhy \u00faprav Z\u00e1kona o regulaci AI.<\/p>\n\n\n\n<p>Tyto pozm\u011b\u0148ovac\u00ed n\u00e1vrhy byly n\u00e1sledn\u011b p\u0159ijaty Evropsk\u00fdm parlamentem dne 14. \u010dervna 2023.<\/p>\n\n\n\n<p>Zpr\u00e1va obsahuje kl\u00ed\u010dov\u00e9 \u00fapravy legislativn\u00edho n\u00e1vrhu, v\u010detn\u011b z\u00e1kazu prediktivn\u00edho policejn\u00edho dohledu, mnoha p\u0159\u00eddavk\u016f do seznamu samostatn\u00fdch AI syst\u00e9m\u016f klasifikovan\u00fdch jako vysok\u00e9 riziko a siln\u00e9 a komplexn\u00ed role nov\u00e9ho \u00fa\u0159adu pro AI (EAIB, kter\u00fd nahrad\u00ed Evropsk\u00fd v\u00fdbor pro um\u011blou inteligenci).<\/p>\n\n\n\n<p>Nav\u00edc je navrhov\u00e1na siln\u011bj\u0161\u00ed spolupr\u00e1ce s GDPR (Obecn\u00e9 na\u0159\u00edzen\u00ed o ochran\u011b osobn\u00edch \u00fadaj\u016f) a zaznamen\u00e1v\u00e1me zv\u00fd\u0161enou zapojen\u00ed stakeholder\u016f v ur\u010dit\u00fdch oblastech, stejn\u011b jako zaveden\u00ed specifick\u00fdch ustanoven\u00ed souvisej\u00edc\u00edch s generativn\u00ed a obecnou AI.<\/p>\n\n\n\n<p>Pot\u00e9, dne 24. \u0159\u00edjna 2023, byl kon\u00e1n \u010dtvrt\u00fd trialog (trojstrann\u00e1 jedn\u00e1n\u00ed) o Z\u00e1konu o regulaci AI, kde do\u0161lo k v\u00fdznamn\u00e9mu pokroku v politicky citliv\u00fdch ot\u00e1zk\u00e1ch. Tyto t\u0159i z\u00e1kony byly vytvo\u0159eny Evropskou uni\u00ed (EU) za \u00fa\u010delem ochrany osobn\u00edch \u00fadaj\u016f v digit\u00e1ln\u00edm prostoru a zaji\u0161t\u011bn\u00ed spravedliv\u00e9 sout\u011b\u017ee.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"DSA_Zakon_o_digitalnich_sluzbach\"><\/span>DSA (Z\u00e1kon o digit\u00e1ln\u00edch slu\u017eb\u00e1ch)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>\u201eZ\u00e1kon o digit\u00e1ln\u00edch slu\u017eb\u00e1ch\u201c EU (DSA = Digital Services Act), kter\u00fd byl implementov\u00e1n dne 16. listopadu 2022 (s plnou \u00fa\u010dinnost\u00ed od 17. \u00fanora 2024), je komplexn\u00edm p\u0159edpisem t\u00fdkaj\u00edc\u00edm se elektronick\u00e9ho obchodov\u00e1n\u00ed v EU.<\/p>\n\n\n\n<p>V EU byla v roce 2000 zavedena sm\u011brnice o elektronick\u00e9m obchodov\u00e1n\u00ed, ale vzhledem k tomu, \u017ee se st\u00e1le v\u00edce komplikovalo jej\u00ed uplat\u0148ov\u00e1n\u00ed v d\u016fsledku v\u00fdvoje internetu a online platforem, byl tento p\u0159edpis revidov\u00e1n a nahrazen jednotn\u00fdmi pravidly EU v podob\u011b DSA (Z\u00e1kona o digit\u00e1ln\u00edch slu\u017eb\u00e1ch).<\/p>\n\n\n\n<p>C\u00edlem tohoto z\u00e1kona je zabezpe\u010dit spr\u00e1vn\u00e9 fungov\u00e1n\u00ed zprost\u0159edkovatelsk\u00fdch slu\u017eeb na vnit\u0159n\u00edm trhu EU, chr\u00e1nit z\u00e1kladn\u00ed pr\u00e1va u\u017eivatel\u016f a udr\u017eovat bezpe\u010dn\u011bj\u0161\u00ed digit\u00e1ln\u00ed prost\u0159ed\u00ed.
