Japonsk\u00e9 spole\u010dnosti poskytuj\u00edc\u00ed slu\u017eby v r\u00e1mci EU se tak\u00e9 stanou p\u0159edm\u011btem tohoto na\u0159\u00edzen\u00ed, a proto by o n\u011bm m\u011bly b\u00fdt class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Evropsk\u00fd z\u00e1kon o digit\u00e1ln\u00edch slu\u017eb\u00e1ch (DSA = Digital Services Act) je komplexn\u00ed soubor pravidel pro elektronick\u00fd obchod v EU, kter\u00fd nabyl \u00fa\u010dinnosti 16. listopadu 2022 (2022) a byl pln\u011b implementov\u00e1n 17. \u00fanora 2024 (2024).<\/p>\n\n\n\n<p>V EU byla v roce 2000 zavedena sm\u011brnice o elektronick\u00e9m obchodu, ale vzhledem k tomu, \u017ee se st\u00e1le v\u00edce komplikovalo jej\u00ed uplat\u0148ov\u00e1n\u00ed v d\u016fsledku v\u00fdvoje internetu a online platforem, byl vytvo\u0159en DSA (z\u00e1kon o digit\u00e1ln\u00edch slu\u017eb\u00e1ch) s p\u0159\u00edmou pr\u00e1vn\u00ed z\u00e1vaznost\u00ed jako sjednocen\u00e9 pravidlo EU, kter\u00e9 nahrazuje a aktualizuje tuto sm\u011brnici.<\/p>\n\n\n\n<p>Tento z\u00e1kon je aplikov\u00e1n jako sou\u010d\u00e1st digit\u00e1ln\u00ed strategie EU zn\u00e1m\u00e9 jako &#8220;Evropa p\u0159ipraven\u00e1 pro digit\u00e1ln\u00ed v\u011bk&#8221;.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cile_Digital_Services_Act_DSA\"><\/span>C\u00edle Digital Services Act (DSA)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2024\/02\/Shutterstock_2298684713.jpg\" alt=\"C\u00edle Digital Services Act (DSA)\" class=\"wp-image-64330\" \/><\/figure>\n\n\n\n<p>Dne 15. prosince 2020 byl spole\u010dn\u011b s DMA (Digital Markets Act &#8211; Japonsk\u00fd z\u00e1kon o digit\u00e1ln\u00edch trz\u00edch) zve\u0159ejn\u011bn DSA (Digital Services Act &#8211; Japonsk\u00fd z\u00e1kon o digit\u00e1ln\u00edch slu\u017eb\u00e1ch), jeho\u017e c\u00edle jsou v \u010dl\u00e1nku 1 pops\u00e1ny jako: \u201e\u2460vytvo\u0159en\u00ed bezpe\u010dn\u011bj\u0161\u00edho a spolehliv\u011bj\u0161\u00edho digit\u00e1ln\u00edho prostoru, kde jsou chr\u00e1n\u011bna z\u00e1kladn\u00ed pr\u00e1va v\u0161ech u\u017eivatel\u016f digit\u00e1ln\u00edch slu\u017eeb, jak jsou zaru\u010dena Listinou z\u00e1kladn\u00edch pr\u00e1v Evropsk\u00e9 unie, a \u2461zaji\u0161t\u011bn\u00ed spravedliv\u00fdch podm\u00ednek pro sout\u011b\u017e, kter\u00e9 podporuj\u00ed inovace na trhu EU i na glob\u00e1ln\u00ed \u00farovni.\u201c<\/p>\n\n\n\n<p>Hlavn\u00ed zam\u011b\u0159en\u00ed je pova\u017eov\u00e1no za \u0159e\u0161en\u00ed neleg\u00e1ln\u00edho obsahu. Jin\u00fdmi slovy, z\u00e1sada \u201eco je neleg\u00e1ln\u00ed offline, je neleg\u00e1ln\u00ed i online\u201c m\u00e1 b\u00fdt realizov\u00e1na nap\u0159\u00edklad t\u00edm, \u017ee se spole\u010dnostem ukl\u00e1d\u00e1 povinnost \u0159e\u0161it neleg\u00e1ln\u00ed obsah, jako je online projev nen\u00e1visti nebo podn\u011bcov\u00e1n\u00ed k terorismu, a neleg\u00e1ln\u00ed zbo\u017e\u00ed, v\u010detn\u011b jeho odstran\u011bn\u00ed. Japonsk\u00e9 spole\u010dnosti, kter\u00e9 maj\u00ed u\u017eivatele v r\u00e1mci EU, budou v\u00fdznamn\u011b ovlivn\u011bny, proto\u017ee se od nich bude vy\u017eadovat, aby se t\u011bmito po\u017eadavky zab\u00fdvaly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cilove_skupiny_DSA\"><\/span>C\u00edlov\u00e9 skupiny DSA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Regulace DSA se vztahuje na n\u00e1sleduj\u00edc\u00ed \u010dty\u0159i typy poskytovatel\u016f (prost\u0159edn\u00edk\u016f slu\u017eeb):<\/p>\n\n\n\n<ol>\n<li>Prost\u0159ednick\u00e9 slu\u017eby<\/li>\n\n\n\n<li>Hosting<\/li>\n\n\n\n<li>Online platformy<\/li>\n\n\n\n<li>Velk\u00e9 platformy (VLOP) a velk\u00e9 vyhled\u00e1va\u010de (VLOSE)<\/li>\n<\/ol>\n\n\n\n<p>DSA se zam\u011b\u0159uje na digit\u00e1ln\u00ed slu\u017eby poskytovan\u00e9 u\u017eivatel\u016fm v r\u00e1mci EU, p\u0159i\u010dem\u017e nerozhoduje o um\u00edst\u011bn\u00ed poskytovatele (zem\u011b). Pokud japonsk\u00e9 spole\u010dnosti poskytuj\u00ed digit\u00e1ln\u00ed slu\u017eby sm\u011b\u0159uj\u00edc\u00ed do EU, mus\u00ed se \u0159\u00eddit p\u0159edpisy DSA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sest_povinnosti_poskytovatelu_sluzeb_podle_DSA_a_ustanoveni_o_osvobozeni_od_odpovednosti\"><\/span>\u0160est povinnost\u00ed poskytovatel\u016f slu\u017eeb podle DSA a ustanoven\u00ed o osvobozen\u00ed od odpov\u011bdnosti<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>DSA (Digital Services Act) stanovuje povinnosti poskytovatel\u016f slu\u017eeb podle charakteristik a velikosti jejich podnik\u00e1n\u00ed a tak\u00e9 se li\u0161\u00ed po\u017eadavky na osvobozen\u00ed od odpov\u011bdnosti.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Povinnosti_poskytovatelu_sluzeb\"><\/span>Povinnosti poskytovatel\u016f slu\u017eeb<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Povinnosti poskytovatel\u016f slu\u017eeb definovan\u00e9 DSA jsou rozd\u011bleny do \u0161esti kategori\u00ed: &#8220;ochrana u\u017eivatel\u016f&#8221;, &#8220;podm\u00ednky u\u017e\u00edv\u00e1n\u00ed&#8221;, &#8220;zpracov\u00e1n\u00ed obsahu a podobn\u011b&#8221;, &#8220;online reklama&#8221;, &#8220;odpov\u011bdnost a transparentnost&#8221; a &#8220;ostatn\u00ed\/v\u0161eobecn\u00e9&#8221;.<\/p>\n\n\n\n<p>D\u00e1le pro &#8220;velmi velk\u00e9 online platformy&#8221; (VLOP) a &#8220;velmi velk\u00e9 online vyhled\u00e1va\u010de&#8221; (VLOSE), kter\u00e9 dosahuj\u00ed m\u011bs\u00ed\u010dn\u00edho pr\u016fm\u011bru v\u00edce ne\u017e 45 milion\u016f u\u017eivatel\u016f v EU (10 % z 450 milion\u016f obyvatel EU), jsou stanoveny p\u0159\u00edsn\u011bj\u0161\u00ed pravidla.<\/p>\n\n\n\n<p>Designovan\u00e9 VLOP a VLOSE mus\u00ed do \u010dty\u0159 m\u011bs\u00edc\u016f od ozn\u00e1men\u00ed rozhodnut\u00ed p\u0159izp\u016fsobit sv\u00e9 syst\u00e9my, zdroje a procesy DSA, zav\u00e9st opat\u0159en\u00ed pro zm\u00edrn\u011bn\u00ed rizik a z\u0159\u00eddit nez\u00e1visl\u00e9 syst\u00e9my pro dodr\u017eov\u00e1n\u00ed pr\u00e1vn\u00edch p\u0159edpis\u016f. Pot\u00e9 mus\u00ed prov\u00e9st audit a prvn\u00ed ro\u010dn\u00ed hodnocen\u00ed rizik a o v\u00fdsledc\u00edch informovat Evropskou komisi. Jsou tak\u00e9 povinni poskytovat p\u0159\u00edstup k dat\u016fm. V p\u0159\u00edpad\u011b VLOP a VLOSE je p\u0159\u00edmo Evropsk\u00e1 komise (na \u00farovni EU) odpov\u011bdn\u00e1 za dohled a m\u00e1 pravomoc vykon\u00e1vat sankce.<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b poru\u0161en\u00ed z\u00e1kona mohou b\u00fdt VLOP a VLOSE posti\u017eeny sank\u010dn\u00edmi pokutami a\u017e do v\u00fd\u0161e 6 % z celosv\u011btov\u00e9ho ro\u010dn\u00edho obratu z p\u0159edchoz\u00edho roku. K lednu 2024 bylo ur\u010deno celkem p\u011bt podnikatel\u016f, t\u0159i provozovatel\u00e9 v\u0161eobecn\u00fdch online obchodn\u00edch center a dva provozovatel\u00e9 aplikac\u00ed.<\/p>\n\n\n\n<p>D\u00e1le tento z\u00e1kon stanov\u00ed, \u017ee u\u017eivatel\u00e9 mohou poskytovat informace ministrovi hospod\u00e1\u0159stv\u00ed, pr\u016fmyslu a obchodu, spolupr\u00e1ci s \u00da\u0159adem pro spravedliv\u00fd obchod, postupy pro ve\u0159ejn\u00e9 doru\u010dov\u00e1n\u00ed pro aplikaci na zahrani\u010dn\u00ed podnikatele a dal\u0161\u00ed. Po t\u0159ech letech od uveden\u00ed do provozu se p\u0159edpokl\u00e1d\u00e1, \u017ee se bude prov\u00e1d\u011bt p\u0159ezkum prov\u00e1d\u011bn\u00ed z\u00e1kona a zm\u011bn v ekonomick\u00fdch a soci\u00e1ln\u00edch podm\u00ednk\u00e1ch a budou p\u0159ijata pot\u0159ebn\u00e1 opat\u0159en\u00ed.<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b poru\u0161en\u00ed z\u00e1kona jsou stanoveny pokuty a\u017e do v\u00fd\u0161e 500 000 jen\u016f a v p\u0159\u00edpad\u011b poru\u0161en\u00ed doporu\u010den\u00ed ministerstva hospod\u00e1\u0159stv\u00ed, pr\u016fmyslu a obchodu a\u017e do v\u00fd\u0161e 1 000 000 jen\u016f.<\/p>\n\n\n\n<p>Rozd\u00edly mezi DSA a japonsk\u00fdm pr\u00e1vem spo\u010d\u00edvaj\u00ed v omezen\u00ed regulovan\u00fdch subjekt\u016f na ur\u010dit\u00e9 digit\u00e1ln\u00ed platformy, rozd\u00edlech ve v\u00fd\u0161i pokut a rozd\u00edlech v syst\u00e9mu vynucov\u00e1n\u00ed. Zat\u00edmco DSA m\u00e1 nez\u00e1visl\u00fd v\u00fdkonn\u00fd org\u00e1n, tento z\u00e1kon se spol\u00e9h\u00e1 na inspekce ministerstva hospod\u00e1\u0159stv\u00ed, pr\u016fmyslu a obchodu ve spolupr\u00e1ci s \u00da\u0159adem pro spravedliv\u00fd obchod.<\/p>\n\n\n\n<p>Jin\u00fdmi slovy, p\u0159i roz\u0161i\u0159ov\u00e1n\u00ed digit\u00e1ln\u00edch slu\u017eeb do EU je t\u0159eba si b\u00fdt v\u011bdom, \u017ee DSA reguluje v\u0161echny digit\u00e1ln\u00ed slu\u017eby.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zakon_o_omezeni_odpovednosti_poskytovatelu\"><\/span>Z\u00e1kon o omezen\u00ed odpov\u011bdnosti poskytovatel\u016f<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Z\u00e1kon o omezen\u00ed odpov\u011bdnosti poskytovatel\u016f (z\u00e1kon o omezen\u00ed odpov\u011bdnosti za \u0161kody poskytovatel\u016f ur\u010dit\u00fdch telekomunika\u010dn\u00edch slu\u017eeb a o zve\u0159ejn\u011bn\u00ed informac\u00ed o odes\u00edlatel\u00edch) stanov\u00ed sn\u00ed\u017een\u00ed odpov\u011bdnosti poskytovatel\u016f za \u0161kody a soudn\u00ed \u0159\u00edzen\u00ed o zve\u0159ejn\u011bn\u00ed informac\u00ed o odes\u00edlatel\u00edch v p\u0159\u00edpad\u011b poru\u0161en\u00ed pr\u00e1v prost\u0159ednictv\u00edm informac\u00ed na internetu.<\/p>\n\n\n\n<p>Novela z\u00e1kona, kter\u00e1 vstoupila v platnost 1. \u0159\u00edjna 2022, umo\u017enila sjednotit dva soudn\u00ed procesy, kter\u00e9 byly d\u0159\u00edve pot\u0159ebn\u00e9 k identifikaci anonymn\u00edch odes\u00edlatel\u016f a k uplatn\u011bn\u00ed civiln\u00ed odpov\u011bdnosti, do jednoho procesu konan\u00e9ho v r\u00e1mci nekontroverzn\u00edch \u0159\u00edzen\u00ed, \u010d\u00edm\u017e se sn\u00ed\u017eila \u010dasov\u00e1 a finan\u010dn\u00ed z\u00e1t\u011b\u017e.<\/p>\n\n\n\n<p>Z\u00e1kon o omezen\u00ed odpov\u011bdnosti poskytovatel\u016f se vztahuje na v\u0161echny poskytovatele bez ohledu na velikost podniku.<\/p>\n\n\n\n<p>P\u0159i srovn\u00e1n\u00ed s DSA oba p\u0159edpisy stanovuj\u00ed odpov\u011bdnost a reakci na informace na internetu, ale jejich rozsah a obsah se li\u0161\u00ed.<\/p>\n\n\n\n<p>DSA se vztahuje na v\u0161echny online zprost\u0159edkovatele (nap\u0159\u00edklad poskytovatele platform), zat\u00edmco stanovuje odpov\u011bdnost za \u0161\u00ed\u0159en\u00ed neleg\u00e1ln\u00edho obsahu v z\u00e1vislosti na charakteristik\u00e1ch podniku (typ slu\u017eby) a velikosti. Nap\u0159\u00edklad DSA ukl\u00e1d\u00e1 poskytovatel\u016fm hostingu povinnost z\u0159\u00eddit syst\u00e9m, kter\u00fd umo\u017e\u0148uje u\u017eivatel\u016fm nahl\u00e1sit informace, kter\u00e9 pova\u017euj\u00ed za neleg\u00e1ln\u00ed, zat\u00edmco japonsk\u00fd &#8220;Z\u00e1kon o omezen\u00ed odpov\u011bdnosti poskytovatel\u016f&#8221; takovou povinnost nem\u00e1.<\/p>\n\n\n\n<p>D\u00e1le DSA stanov\u00ed povinnost prioritn\u011b reagovat na ozn\u00e1men\u00ed od d\u016fv\u011bryhodn\u00fdch hl\u00e1\u0161en\u00ed a povinnost reagovat na p\u0159\u00edkazy k opat\u0159en\u00edm proti neleg\u00e1ln\u00edm informac\u00edm nebo p\u0159\u00edkazy k poskytnut\u00ed informac\u00ed o u\u017eivatel\u00edch od org\u00e1n\u016f EU a \u010dlensk\u00fdch st\u00e1t\u016f.
