V reakci na to byly provedeny zm\u011bny, kter\u00e9 vy\u017eaduj\u00ed od podnikatel\u016f rychlej\u0161\u00ed a transparentn\u011bj\u0161\u00ed \u0159e\u0161en\u00ed situac\u00ed spojen\u00fdch s pomluvami a ur\u00e1\u017ekami.<\/p>\n\n\n\n<p>Zde podrobn\u011b vysv\u011btl\u00edme zm\u011bny v z\u00e1kon\u011b o omezen\u00ed odpov\u011bdnosti poskytovatel\u016f slu\u017eeb, kter\u00e9 byly schv\u00e1leny a vyhl\u00e1\u0161eny b\u011bhem b\u011b\u017en\u00e9ho zased\u00e1n\u00ed japonsk\u00e9ho parlamentu v roce Reiwa 6 (2024).<\/p>\n\n\n\n<div id=\"ez-toc-container\" odpov\u011bdnosti poskytovatel\u016f&#8221; (ofici\u00e1ln\u00ed n\u00e1zev: Z\u00e1kon o omezen\u00ed odpov\u011bdnosti za \u0161kodu poskytovatel\u016f ur\u010dit\u00fdch telekomunika\u010dn\u00edch slu\u017eeb a o zve\u0159ejn\u011bn\u00ed informac\u00ed o odes\u00edlatel\u00edch), ale v kv\u011btnu roku Reiwa 6 (2024) byl vyhl\u00e1\u0161en nov\u00fd z\u00e1kon. T\u00edm je &#8220;Z\u00e1kon o \u0159e\u0161en\u00ed poru\u0161en\u00ed pr\u00e1v atd. prost\u0159ednictv\u00edm ur\u010dit\u00fdch telekomunika\u010dn\u00edch informac\u00ed&#8221;, zn\u00e1m\u00fd tak\u00e9 jako &#8220;Z\u00e1kon o \u0159e\u0161en\u00ed probl\u00e9m\u016f s informa\u010dn\u00edmi distribu\u010dn\u00edmi platformami (Z\u00e1kon o IDP)&#8221;.<\/p>\n\n\n\n<p>Podle statistik &#8220;Centra pro konzultace neleg\u00e1ln\u00edch a \u0161kodliv\u00fdch informac\u00ed&#8221;, kter\u00e9 je provozov\u00e1no na z\u00e1klad\u011b smlouvy s Ministerstvem vnitra a komunikac\u00ed, p\u0159es\u00e1hl po\u010det konzultac\u00ed ka\u017ed\u00fd rok od roku 2015 do roku 2022 v\u00edce ne\u017e 5000 p\u0159\u00edpad\u016f. Kl\u00ed\u010dov\u00fdm bodem t\u00e9to novely je, \u017ee velk\u00fdm platformn\u00edm podnik\u016fm ukl\u00e1d\u00e1 povinnost &#8220;urychlit reakci&#8221; a &#8220;zv\u00fd\u0161it transparentnost provozu&#8221;.<\/p>\n\n\n\n<p>Velk\u00e9 platformn\u00ed podniky, kter\u00e9 podl\u00e9haj\u00ed nov\u00e9 regulaci, jsou &#8220;velc\u00ed ur\u010den\u00ed poskytovatel\u00e9 elektronick\u00fdch komunika\u010dn\u00edch slu\u017eeb&#8221;, co\u017e jsou podniky ur\u010den\u00e9 ministrem ve\u0159ejn\u00e9 spr\u00e1vy jako poskytovatel\u00e9 velk\u00fdch ur\u010den\u00fdch elektronick\u00fdch komunika\u010dn\u00edch slu\u017eeb (\u010dl\u00e1nek 2 odstavec 14 a \u010dl\u00e1nek 20 odstavec 1 z\u00e1kona o informa\u010dn\u00edch platform\u00e1ch).<\/p>\n\n\n\n<p>Krit\u00e9ria velikosti podniku, kter\u00e1 umo\u017e\u0148uj\u00ed ur\u010den\u00ed jako velk\u00e9ho ur\u010den\u00e9ho poskytovatele elektronick\u00fdch komunika\u010dn\u00edch slu\u017eeb, jsou stanovena na\u0159\u00edzen\u00edm ministerstva ve\u0159ejn\u00e9 spr\u00e1vy a jsou ur\u010dena &#8220;pr\u016fm\u011brn\u00fdm po\u010dtem m\u011bs\u00ed\u010dn\u00edch odes\u00edlatel\u016f&#8221; nebo &#8220;celkov\u00fdm pr\u016fm\u011brn\u00fdm po\u010dtem m\u011bs\u00ed\u010dn\u00edch odes\u00edlatel\u016f&#8221; (\u010dl\u00e1nek 21 odstavec 1 bod 1 z\u00e1kona o informa\u010dn\u00edch platform\u00e1ch).<\/p>\n\n\n\n<p>Av\u0161ak, i kdy\u017e podnik spl\u0148uje po\u017eadavky na po\u010det odes\u00edlatel\u016f, automaticky se nest\u00e1v\u00e1 ur\u010den\u00fdm velk\u00fdm poskytovatelem elektronick\u00fdch komunika\u010dn\u00edch slu\u017eeb. To vypl\u00fdv\u00e1 z na\u0159\u00edzen\u00ed Ministerstva vnit\u0159n\u00edch v\u011bc\u00ed a komunikac\u00ed podle z\u00e1kona o ochran\u011b osobn\u00edch informac\u00ed (\u010dl\u00e1nek 23 odstavec 1).<\/p>\n\n\n\n<p>Tyto zp\u016fsoby mus\u00ed spl\u0148ovat n\u00e1sleduj\u00edc\u00ed podm\u00ednky: umo\u017e\u0148ovat pod\u00e1n\u00ed \u017e\u00e1dosti prost\u0159ednictv\u00edm elektronick\u00e9ho zpracov\u00e1n\u00ed informac\u00ed, nesm\u00ed ukl\u00e1dat p\u0159\u00edli\u0161nou z\u00e1t\u011b\u017e osob\u011b, kter\u00e1 \u017e\u00e1dost pod\u00e1v\u00e1, a mus\u00ed b\u00fdt z\u0159ejm\u00e9, kdy byla \u017e\u00e1dost p\u0159ijata od osoby, kter\u00e1 ji podala (z\u00e1kon o ochran\u011b osobn\u00edch informac\u00ed, \u010dl\u00e1nek 23 odstavec 2).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Provadeni_setreni_tykajiciho_se_informaci_o_poruseni_prav\"><\/span>Prov\u00e1d\u011bn\u00ed \u0161et\u0159en\u00ed t\u00fdkaj\u00edc\u00edho se informac\u00ed o poru\u0161en\u00ed pr\u00e1v<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Poskytovatel\u00e9 ur\u010dit\u00fdch rozs\u00e1hl\u00fdch elektronick\u00fdch komunika\u010dn\u00edch slu\u017eeb mus\u00ed, pokud od po\u0161kozen\u00e9 osoby obdr\u017e\u00ed \u017e\u00e1dost o zaveden\u00ed opat\u0159en\u00ed proti \u0161\u00ed\u0159en\u00ed poru\u0161uj\u00edc\u00edch informac\u00ed, bez zbyte\u010dn\u00e9ho odkladu prov\u00e9st nezbytn\u00e9 \u0161et\u0159en\u00ed, zda do\u0161lo k neopr\u00e1vn\u011bn\u00e9mu poru\u0161en\u00ed pr\u00e1v dot\u010den\u00e9 po\u0161kozen\u00e9 osoby v d\u016fsledku \u0161\u00ed\u0159en\u00ed t\u011bchto informac\u00ed (\u010dl\u00e1nek 24 Japonsk\u00e9ho z\u00e1kona o ochran\u011b osobn\u00edch informac\u00ed).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jmenovani_a_oznameni_specialisty_na_vysetrovani_poruseni_informaci\"><\/span>Jmenov\u00e1n\u00ed a ozn\u00e1men\u00ed specialisty na vy\u0161et\u0159ov\u00e1n\u00ed poru\u0161en\u00ed informac\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Poskytovatel\u00e9 velk\u00fdch specifick\u00fdch telekomunika\u010dn\u00edch slu\u017eeb mus\u00ed jmenovat specialistu na vy\u0161et\u0159ov\u00e1n\u00ed poru\u0161en\u00ed informac\u00ed, kter\u00fd m\u00e1 dostate\u010dn\u00e9 znalosti a zku\u0161enosti v oblasti \u0159e\u0161en\u00ed poru\u0161en\u00ed pr\u00e1v, aby \u0159\u00e1dn\u011b prov\u00e1d\u011bli vy\u0161et\u0159ov\u00e1n\u00ed vy\u017eaduj\u00edc\u00ed speci\u00e1ln\u00ed znalosti a zku\u0161enosti (\u010dl\u00e1nek 25 odstavec 1 z\u00e1kona o ochran\u011b osobn\u00edch informac\u00ed (2003)).<\/p>\n\n\n\n<p>Po\u010det t\u011bchto specialist\u016f mus\u00ed odpov\u00eddat po\u010dtu, kter\u00fd je stanoven na\u0159\u00edzen\u00edm Ministerstva vnitra a komunikac\u00ed podle pr\u016fm\u011brn\u00e9ho m\u011bs\u00ed\u010dn\u00edho po\u010dtu odes\u00edlatel\u016f nebo celkov\u00e9ho m\u011bs\u00ed\u010dn\u00edho po\u010dtu odes\u00edlatel\u016f a typu poskytovan\u00fdch velk\u00fdch specifick\u00fdch telekomunika\u010dn\u00edch slu\u017eeb (\u010dl\u00e1nek 25 odstavec 2 z\u00e1kona o ochran\u011b osobn\u00edch informac\u00ed (2003)).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Oznameni_zadateli_o_opatreni_proti_odesilani_porusujicich_informaci\"><\/span>Ozn\u00e1men\u00ed \u017eadateli o opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed poru\u0161uj\u00edc\u00edch informac\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Poskytovatel\u00e9 velk\u00fdch specifick\u00fdch telekomunika\u010dn\u00edch slu\u017eeb mus\u00ed, pokud obdr\u017e\u00ed \u017e\u00e1dost, na z\u00e1klad\u011b v\u00fdsledk\u016f vy\u0161et\u0159ov\u00e1n\u00ed rozhodnout, zda p\u0159ijmou opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed poru\u0161uj\u00edc\u00edch informac\u00ed. Pokud nen\u00ed d\u016fvodn\u00e9 od\u016fvodn\u011bn\u00ed, mus\u00ed \u017eadatele informovat do 14 dn\u016f od p\u0159ijet\u00ed \u017e\u00e1dosti, a to v souladu s obdob\u00edm stanoven\u00fdm na\u0159\u00edzen\u00edm Ministerstva vnitra a komunikac\u00ed, zda byla opat\u0159en\u00ed p\u0159ijata \u010di nikoliv (\u010dl\u00e1nek 26 Japonsk\u00e9ho z\u00e1kona o ochran\u011b osobn\u00edch informac\u00ed).<\/p>\n\n\n\n<p>Dosud byly p\u0159\u00edpady, kdy i po pod\u00e1n\u00ed \u017e\u00e1dosti o odstran\u011bn\u00ed informac\u00ed, n\u011bkter\u00e9 platformy neodeslaly potvrzen\u00ed o p\u0159ijet\u00ed \u017e\u00e1dosti, co\u017e vedlo k nejistot\u011b, zda byla \u017e\u00e1dost akceptov\u00e1na. Toto opat\u0159en\u00ed je reakc\u00ed na tyto st\u00ed\u017enosti.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zverejneni_kriterii_pro_implementaci_opatreni_proti_odesilani\"><\/span>Zve\u0159ejn\u011bn\u00ed krit\u00e9ri\u00ed pro implementaci opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Velk\u00e9 specifick\u00e9 poskytovatele telekomunika\u010dn\u00edch slu\u017eeb mohou prov\u00e1d\u011bt opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed pouze v souladu se standardy, kter\u00e9 si sami stanov\u00ed a zve\u0159ejn\u00ed. Tyto standardy mus\u00ed b\u00fdt zve\u0159ejn\u011bny ur\u010ditou dobu p\u0159ed zah\u00e1jen\u00edm opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed (\u010dl\u00e1nek 27 odstavec 1 Z\u00e1kona o ochran\u011b osobn\u00edch informac\u00ed).<\/p>\n\n\n\n<p>P\u0159i stanovov\u00e1n\u00ed t\u011bchto krit\u00e9ri\u00ed je nutn\u00e9 se sna\u017eit, aby obsah krit\u00e9ri\u00ed vyhovoval n\u00e1sleduj\u00edc\u00edm bod\u016fm (\u010dl\u00e1nek 27 odstavec 2 Z\u00e1kona o ochran\u011b osobn\u00edch informac\u00ed):<\/p>\n\n\n\n<ul>\n<li>Typy informac\u00ed, kter\u00e9 jsou p\u0159edm\u011btem opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed, mus\u00ed b\u00fdt stanoveny co nejkonkr\u00e9tn\u011bji v z\u00e1vislosti na p\u0159\u00ed\u010din\u011b, kter\u00e1 vedla velk\u00e9ho specifick\u00e9ho poskytovatele telekomunika\u010dn\u00edch slu\u017eeb k z\u00edsk\u00e1n\u00ed informac\u00ed o jejich distribuci.<\/li>\n\n\n\n<li>V p\u0159\u00edpad\u011b, \u017ee doch\u00e1z\u00ed k zastaven\u00ed poskytov\u00e1n\u00ed slu\u017eeb, mus\u00ed b\u00fdt krit\u00e9ria pro implementaci t\u011bchto opat\u0159en\u00ed stanovena co nejkonkr\u00e9tn\u011bji.<\/li>\n\n\n\n<li>Je nutn\u00e9 pou\u017e\u00edvat v\u00fdrazy, kter\u00e9 jsou snadno pochopiteln\u00e9 jak pro odes\u00edlatele, tak pro ostatn\u00ed z\u00fa\u010dastn\u011bn\u00e9 strany.<\/li>\n\n\n\n<li>Je t\u0159eba br\u00e1t v \u00favahu soulad s pr\u00e1vn\u00edmi p\u0159edpisy, kter\u00e9 stanovuj\u00ed povinnost usilovat o implementaci opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Oznameni_odesilateli_v_pripade_zavedeni_opatreni_proti_odesilani\"><\/span>Ozn\u00e1men\u00ed odes\u00edlateli v p\u0159\u00edpad\u011b zaveden\u00ed opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Velc\u00ed specifi\u010dt\u00ed poskytovatel\u00e9 elektronick\u00fdch komunika\u010dn\u00edch slu\u017eeb jsou povinni, pokud zavedou opat\u0159en\u00ed proti odes\u00edl\u00e1n\u00ed, o tomto opat\u0159en\u00ed a jeho d\u016fvodech bez zbyte\u010dn\u00e9ho odkladu informovat odes\u00edlatele dot\u010den\u00fdch informac\u00ed, kter\u00e9ho se toto opat\u0159en\u00ed t\u00fdk\u00e1, nebo zajistit, aby odes\u00edlatel mohl o opat\u0159en\u00ed snadno zjistit.
