Tento z\u00e1kon byl zaveden v roce 2000 (Heisei 12) a je pravideln\u011b ka\u017ed\u00e9 t\u0159i roky revidov\u00e1n, aby odpov\u00eddal pot\u0159eb\u00e1m spole\u010dnosti.<\/p>\n\n\n\n<p>K zaveden\u00ed z\u00e1kona o d\u016fchodov\u00e9m poji\u0161t\u011bn\u00ed do\u0161lo z n\u00e1sleduj\u00edc\u00edch d\u016fvod\u016f:<\/p>\n\n\n\n<ul>\n<li>Zv\u00fd\u0161en\u00ed po\u010dtu star\u0161\u00edch osob vy\u017eaduj\u00edc\u00edch p\u00e9\u010di a prodlou\u017een\u00ed doby p\u00e9\u010de v d\u016fsledku st\u00e1rnut\u00ed japonsk\u00e9 populace<\/li>\n\n\n\n<li>Probl\u00e9my s p\u00e9\u010d\u00ed o rodinn\u00e9 p\u0159\u00edslu\u0161n\u00edky v d\u016fsledku pokra\u010duj\u00edc\u00edho trendu sm\u011brem k jadern\u00fdm rodin\u00e1m<\/li>\n\n\n\n<li>Omezen\u00ed p\u0159edchoz\u00edch syst\u00e9m\u016f soci\u00e1ln\u00ed p\u00e9\u010de a zdravotn\u00ed p\u00e9\u010de pro seniory<\/li>\n<\/ul>\n\n\n\n<p>Podle zpr\u00e1vy Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed Japonska &#8220;<a href=\"https:\/\/www.mhlw.go.jp\/content\/12300000\/001099975.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">O ned\u00e1vn\u00fdch trendech v oblasti p\u00e9\u010de[ja]<\/a>&#8220;, po\u010det osob s uzn\u00e1n\u00edm pot\u0159eby p\u00e9\u010de (podpora pot\u0159ebn\u00e1) vzrostl z 2,18 milionu v dubnu 2000 (Heisei 12) na 6,9 milionu v b\u0159eznu 2012 (Heisei 24), co\u017e je 3,2n\u00e1sobn\u00fd n\u00e1r\u016fst.<\/p>\n\n\n\n<p>Podle zpr\u00e1vy Ministerstva vnitra a komunikac\u00ed &#8220;<a href=\"https:\/\/www.soumu.go.jp\/main_content\/000452791.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">O zm\u011bn\u00e1ch ve spole\u010densk\u00e9 struktu\u0159e, demografii a rodinn\u00fdch vzorc\u00edch[ja]<\/a>&#8220;, se pod\u00edl jadern\u00fdch rodin zv\u00fd\u0161il z 77,6 % v roce 1990 (Heisei 2) na 86,7 % v roce 2020 (Reiwa 2). P\u00e9\u010de o rodi\u010de, kter\u00e1 byla tradi\u010dn\u011b pova\u017eov\u00e1na za \u00fakol d\u011bt\u00ed nebo rodiny, se st\u00e1v\u00e1 \u010d\u00edm d\u00e1l t\u00edm obt\u00ed\u017en\u011bj\u0161\u00ed kv\u016fli n\u00e1r\u016fstu po\u010dtu jadern\u00fdch rodin.<\/p>\n\n\n\n<p>Z t\u011bchto d\u016fvod\u016f ji\u017e nebylo mo\u017en\u00e9 adekv\u00e1tn\u011b reagovat pouze prost\u0159ednictv\u00edm p\u0159edchoz\u00edch z\u00e1kon\u016f o soci\u00e1ln\u00ed p\u00e9\u010di pro seniory a zdravotn\u00edm poji\u0161t\u011bn\u00ed pro seniory, a proto byl zaveden z\u00e1kon o d\u016fchodov\u00e9m poji\u0161t\u011bn\u00ed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pozadi_reformy_zakona_o_duchodovem_pojisteni_v_roce_Reiwa_6_2024\"><\/span>Pozad\u00ed reformy z\u00e1kona o d\u016fchodov\u00e9m poji\u0161t\u011bn\u00ed v roce Reiwa 6 (2024)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2024\/06\/image-14.jpeg\" alt=\"Star\u0161\u00ed p\u00e1r\" class=\"wp-image-87971\" \/><\/figure>\n\n\n\n<p>Jedn\u00edm z probl\u00e9m\u016f, kter\u00e9 se t\u00fdkaj\u00ed p\u00e9\u010de o seniory, je takzvan\u00fd probl\u00e9m roku 2025. Tento probl\u00e9m spo\u010d\u00edv\u00e1 v tom, \u017ee generace baby boomu dos\u00e1hne v\u011bku pozdn\u00edch senior\u016f a Japonsko se tak stane &#8220;super st\u00e1rnouc\u00ed spole\u010dnost\u00ed&#8221;, co\u017e bude m\u00edt dopad na r\u016fzn\u00e9 oblasti, v\u010detn\u011b zam\u011bstnanosti, zdravotn\u00ed p\u00e9\u010de a soci\u00e1ln\u00edch slu\u017eeb.<\/p>\n\n\n\n<p>D\u00e1le se p\u0159edpokl\u00e1d\u00e1, \u017ee v roce 2042 dos\u00e1hne po\u010det star\u0161\u00edch lid\u00ed sv\u00e9ho vrcholu, a je z\u0159ejm\u00e9, \u017ee sou\u010dasn\u00fd syst\u00e9m d\u016fchodov\u00e9ho poji\u0161t\u011bn\u00ed nebude schopen fungovat. Z tohoto d\u016fvodu doch\u00e1z\u00ed ka\u017ed\u00e9 t\u0159i roky k p\u0159ezkumu a reform\u011b syst\u00e9mu.<\/p>\n\n\n\n<p>V roce Reiwa 6 (2024) se reforma prov\u00e1d\u00ed s ohledem na zm\u011bny v popula\u010dn\u00ed struktu\u0159e a socioekonomick\u00fdch podm\u00ednk\u00e1ch a z\u00e1kladn\u00edmi body jsou n\u00e1sleduj\u00edc\u00ed \u010dty\u0159i (\u010dl\u00e1nek 115, odstavec 44-2, body 1 a 2)<\/p>\n\n\n\n<p>C\u00edlem t\u00e9to zm\u011bny je zv\u00fd\u0161it transparentnost finan\u010dn\u00ed situace a usnadnit u\u017eivatel\u016fm p\u00e9\u010di pochopen\u00ed sou\u010dasn\u00e9ho stavu a skute\u010dnost\u00ed, stejn\u011b jako umo\u017enit zva\u017eov\u00e1n\u00ed podp\u016frn\u00fdch opat\u0159en\u00ed na z\u00e1klad\u011b anal\u00fdzy a pr\u016fzkumu informac\u00ed. I p\u0159edt\u00edm byla povinnost publikovat finan\u010dn\u00ed v\u00fdkazy uvalena na soci\u00e1ln\u00ed slu\u017eby a poskytovatele slu\u017eeb pro osoby se zdravotn\u00edm posti\u017een\u00edm, ale n\u00edzk\u00e1 m\u00edra dodr\u017eov\u00e1n\u00ed byla probl\u00e9mem. Zm\u011bny v roce Reiwa 6 (2024) nejen\u017ee roz\u0161\u00ed\u0159ily povinnost na poskytovatele p\u00e9\u010di, ale tak\u00e9 zavedly sankce.<\/p>\n\n\n\n<p>Nepod\u00e1n\u00ed finan\u010dn\u00edch v\u00fdkaz\u016f nebo pod\u00e1n\u00ed nepravdiv\u00e9 zpr\u00e1vy m\u016f\u017ee v\u00e9st k na\u0159\u00edzen\u00ed ur\u010den\u00ed lh\u016fty pro pod\u00e1n\u00ed zpr\u00e1vy nebo proveden\u00ed opravy. (Podle standardu \u010dl\u00e1nku 8, odstavec 23)<\/p>\n\n\n\n<p>Co se t\u00fd\u010de nov\u011b pl\u00e1novan\u00fdch kombinovan\u00fdch slu\u017eeb spojuj\u00edc\u00edch n\u00e1v\u0161t\u011bvn\u00ed p\u00e9\u010di a denn\u00ed p\u00e9\u010di, kter\u00e9 byly p\u0159edpokl\u00e1d\u00e1ny v pr\u00e1vn\u00edch zm\u011bn\u00e1ch v roce Reiwa 6 (2024), rozhodlo se odlo\u017eit jejich zaveden\u00ed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rozsireni_sluzeb_stacionarnich_pecovatelskych_podpurnych_center\"><\/span>Roz\u0161\u00ed\u0159en\u00ed slu\u017eeb stacion\u00e1rn\u00edch pe\u010dovatelsk\u00fdch podp\u016frn\u00fdch center<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Dosud jsme prov\u00e1d\u011bli podporu prevence p\u00e9\u010de (nap\u0159\u00edklad tvorbu pl\u00e1n\u016f preventivn\u00edch pe\u010dovatelsk\u00fdch slu\u017eeb) na z\u00e1klad\u011b zak\u00e1zky od komunitn\u00edch integra\u010dn\u00edch center. Nyn\u00ed mohou stacion\u00e1rn\u00ed pe\u010dovatelsk\u00e1 podp\u016frn\u00e1 centra poskytovat tyto slu\u017eby tak\u00e9 samostatn\u011b (\u010dl\u00e1nek 115, odstavec 22, bod 1). To umo\u017e\u0148uje centrum, kter\u00e9 obdr\u017eelo pov\u011b\u0159en\u00ed od obce, uzav\u0159\u00edt p\u0159\u00edmou smlouvu s u\u017eivateli a poskytovat jim slu\u017eby.<\/p>\n\n\n\n<p>C\u00edlem je sn\u00ed\u017eit pracovn\u00ed z\u00e1t\u011b\u017e komunitn\u00edch integra\u010dn\u00edch center, a proto nyn\u00ed mohou n\u011bkter\u00e9 z celkov\u00fdch konzulta\u010dn\u00edch a podp\u016frn\u00fdch slu\u017eeb pov\u011b\u0159it stacion\u00e1rn\u00ed pe\u010dovatelsk\u00e1 podp\u016frn\u00e1 centra (\u010dl\u00e1nek 115, odstavec 47, bod 4).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Podpora_zavadeni_vedeckeho_informacniho_systemu_pece_LIFE\"><\/span>Podpora zav\u00e1d\u011bn\u00ed v\u011bdeck\u00e9ho informa\u010dn\u00edho syst\u00e9mu p\u00e9\u010de (LIFE)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>V r\u00e1mci t\u00e9to novely z\u00e1kona se podporuje zav\u00e1d\u011bn\u00ed v\u011bdeck\u00e9ho informa\u010dn\u00edho syst\u00e9mu p\u00e9\u010de (LIFE). V\u011bdeck\u00e1 p\u00e9\u010de znamen\u00e1 p\u00e9\u010di zalo\u017eenou na v\u011bdeck\u00fdch d\u016fkazech (evidence). S vyu\u017eit\u00edm syst\u00e9mu LIFE bude mo\u017en\u00e9 sd\u00edlet informace o stavu u\u017eivatel\u016f p\u00e9\u010di a pl\u00e1nech a obsahu p\u00e9\u010de poskytovan\u00e9 v za\u0159\u00edzen\u00edch prost\u0159ednictv\u00edm internetu s Ministerstvem zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed. D\u00edky LIFE mohou b\u00fdt informace shrom\u00e1\u017ed\u011bn\u00e9 v syst\u00e9mu LIFE analyzov\u00e1ny a poskytov\u00e1ny zp\u011btnou vazbou ministerstvem, co\u017e umo\u017e\u0148uje p\u00e9\u010di zalo\u017eenou na v\u011bdeck\u00fdch d\u016fkazech. Prefektury mus\u00ed usilovat o to, aby podporovaly iniciativy zam\u011b\u0159en\u00e9 na zefektivn\u011bn\u00ed pracovn\u00edch proces\u016f a zlep\u0161en\u00ed kvality p\u00e9\u010dovatelsk\u00fdch slu\u017eeb v za\u0159\u00edzen\u00edch a instituc\u00edch poskytuj\u00edc\u00edch tyto slu\u017eby. Existuje p\u011bt \u00farovn\u00ed p\u00e9\u010de, p\u0159i\u010dem\u017e ka\u017ed\u00e1 \u00farove\u0148 m\u00e1 sv\u016fj stanoven\u00fd limit pro vyu\u017eit\u00ed p\u00e9\u010dovatelsk\u00fdch slu\u017eeb. Komplexn\u00ed projekty se t\u00fdkaj\u00ed program\u016f zam\u011b\u0159en\u00fdch na prevenci pot\u0159eby p\u00e9\u010de a podporu ka\u017edodenn\u00edho \u017eivota.<\/p>\n\n\n\n<p>Kdyby se slu\u017eby dom\u00e1c\u00ed a denn\u00ed p\u00e9\u010de pro \u00farove\u0148 1 a 2 staly sou\u010d\u00e1st\u00ed komplexn\u00edch projekt\u016f, umo\u017enilo by to jednotliv\u00fdm samospr\u00e1v\u00e1m stanovit vlastn\u00ed sazby odm\u011bn, co\u017e by mohlo v\u00e9st ke sn\u00ed\u017een\u00ed n\u00e1klad\u016f pro u\u017eivatele. Av\u0161ak kv\u016fli obav\u00e1m, \u017ee by se mohla li\u0161it kvalita slu\u017eeb v z\u00e1vislosti na obci a \u017ee by mohlo doj\u00edt k odchodu poskytovatel\u016f slu\u017eeb, bylo rozhodnuto tuto zm\u011bnu v aktu\u00e1ln\u00ed reform\u011b odlo\u017eit.<\/p>\n\n\n\n<p>Tak\u00e9 zpoplatn\u011bn\u00ed pl\u00e1n\u016f p\u00e9\u010de bylo odlo\u017eeno. Pl\u00e1n p\u00e9\u010de je dokument, kter\u00fd shrnuje c\u00edle a obsah poskytovan\u00fdch slu\u017eeb na z\u00e1klad\u011b situace a p\u0159\u00e1n\u00ed u\u017eivatele a jeho rodiny. Zat\u00edmco vytvo\u0159en\u00ed pl\u00e1nu p\u00e9\u010de je u slu\u017eeb poskytovan\u00fdch v dom\u00e1c\u00edm prost\u0159ed\u00ed hrazeno ze 100% poji\u0161t\u011bn\u00ed, u slu\u017eeb poskytovan\u00fdch ve za\u0159\u00edzen\u00edch si n\u00e1klady hrad\u00ed u\u017eivatel\u00e9 sami.
