Na druh\u00e9 stran\u011b v\u0161ak \u010del\u00edme n\u00e1r\u016fstu pracovn\u00edch probl\u00e9m\u016f v Japonsku, jako je masov\u00e9 propou\u0161t\u011bn\u00ed v\u00fdzkumn\u00edk\u016f v b\u0159eznu roku Reiwa 5 (2023), p\u0159\u00edpady sebevra\u017ed l\u00e9ka\u0159\u016f z p\u0159epracov\u00e1n\u00ed a probl\u00e9my s cizinci na trhu pr\u00e1ce.<\/p>\n\n\n\n<p>V tomto kontextu dojde v dubnu roku Reiwa 6 (2024) k revizi &#8216;Japonsk\u00fdch prov\u00e1d\u011bc\u00edch p\u0159edpis\u016f k z\u00e1konu o pracovn\u00edch standardech (R\u014dd\u014d Kijun-h\u014d Shik\u014d Kisoku)&#8217; a &#8216;Standard\u016f pro uzav\u00edr\u00e1n\u00ed, obnovu a ukon\u010den\u00ed do\u010dasn\u00fdch pracovn\u00edch smluv (Koyame ni kansuru Kijun)&#8217;. Tato revize zahrnuje zm\u011bny v ustanoven\u00edch t\u00fdkaj\u00edc\u00edch se explicitn\u00edho vyj\u00e1d\u0159en\u00ed pracovn\u00edch podm\u00ednek. zam\u011bstnanci na z\u00e1klad\u011b \u010dl\u00e1nku 15 Japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech (\u52b4\u50cd\u57fa\u6e96\u6cd5), aby jasn\u011b stanovil pracovn\u00ed podm\u00ednky. Pracovn\u00ed podm\u00ednky zahrnuj\u00ed r\u016fzn\u00e9 aspekty pr\u00e1ce, jako jsou mzda, pracovn\u00ed doba, p\u0159est\u00e1vky, voln\u00e9 dny, soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed a zam\u011bstnaneck\u00e9 v\u00fdhody.<\/p>\n\n\n\n<p>Toto &#8220;ozn\u00e1men\u00ed o pracovn\u00edch podm\u00ednk\u00e1ch&#8221; je dokument, kter\u00fd zam\u011bstnavatel\u00e9 mus\u00ed podle z\u00e1kona ozn\u00e1mit zam\u011bstnanc\u016fm, a nen\u00ed to dokument zalo\u017een\u00fd na dohod\u011b. Na druh\u00e9 stran\u011b pracovn\u00ed smlouva je dokument uzav\u0159en\u00fd na z\u00e1klad\u011b dohody mezi zam\u011bstnavatelem a zam\u011bstnancem, ale nen\u00ed to dokument vy\u017eadovan\u00fd z\u00e1konem.<\/p>\n\n\n\n<p>N\u00e1sleduj\u00edc\u00edch \u0161est bod\u016f, jako jsou velmi d\u016fle\u017eit\u00e9 podm\u00ednky a z\u00e1le\u017eitosti p\u0159i zah\u00e1jen\u00ed pr\u00e1ce, jsou pova\u017eov\u00e1ny za &#8220;absolutn\u011b vy\u017eadovan\u00e9 polo\u017eky k vyj\u00e1d\u0159en\u00ed&#8221; a vy\u017eaduj\u00ed se k jejich vyj\u00e1d\u0159en\u00ed prost\u0159ednictv\u00edm p\u00edsemn\u00e9ho dokumentu. Tento dokument se naz\u00fdv\u00e1 &#8220;ozn\u00e1men\u00ed o pracovn\u00edch podm\u00ednk\u00e1ch&#8221;. Tyto revidovan\u00e9 polo\u017eky jsou povinn\u00e9 i p\u0159i n\u00e1boru nov\u00fdch zam\u011bstnanc\u016f.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tri_nove_polozky_a_povinnost_vysvetleni_pridane_k_zalezitostem_ktere_je_nutne_uvest_v_pracovnich_podminkach\"><\/span>T\u0159i nov\u00e9 polo\u017eky a povinnost vysv\u011btlen\u00ed p\u0159idan\u00e9 k z\u00e1le\u017eitostem, kter\u00e9 je nutn\u00e9 uv\u00e9st v pracovn\u00edch podm\u00ednk\u00e1ch<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>V d\u016fsledku zm\u011bn v povinnosti uv\u00e1d\u011bt a vysv\u011btlovat pracovn\u00ed podm\u00ednky byly p\u0159id\u00e1ny t\u0159i nov\u00e9 polo\u017eky do &#8220;absolutn\u00edch z\u00e1le\u017eitost\u00ed, kter\u00e9 je nutn\u00e9 uv\u00e9st&#8221;. Poj\u010fme je probrat jednotliv\u011b.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rozsah_zmen_pracoviste_a_povinnosti\"><\/span>Rozsah zm\u011bn pracovi\u0161t\u011b a povinnost\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Podle revidovan\u00e9ho z\u00e1kona je nyn\u00ed povinnost\u00ed uv\u00e9st nejenom st\u00e1vaj\u00edc\u00ed pracovi\u0161t\u011b a povinnosti, ale tak\u00e9 rozsah jejich mo\u017en\u00fdch zm\u011bn (revidovan\u00fd \u010dl\u00e1nek 5, odstavec 1, bod 1 \u010d\u00edslo 3 Pracovn\u00edho standardn\u00edho na\u0159\u00edzen\u00ed).<\/p>\n\n\n\n<p>&#8220;Pracovi\u0161t\u011b a povinnosti&#8221; ozna\u010duj\u00ed m\u00edsto a \u010dinnosti, kter\u00fdm se zam\u011bstnanec v\u011bnuje bezprost\u0159edn\u011b po n\u00e1stupu do zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>&#8220;Rozsah zm\u011bn&#8221; se vztahuje na rozsah zm\u011bn pracovi\u0161t\u011b a povinnost\u00ed, kter\u00e9 mohou nastat b\u011bhem trv\u00e1n\u00ed pracovn\u00ed smlouvy. Zahrnuje to i zm\u011bny v d\u016fsledku p\u0159esun\u016f nebo v\u00fdpomoci v r\u00e1mci firmy, ale do\u010dasn\u00e9 zm\u011bny, jako je nap\u0159\u00edklad v\u00fdpomoc v jin\u00fdch odd\u011blen\u00edch, nejsou zahrnuty.<\/p>\n\n\n\n<p>Pokud nedojde k \u017e\u00e1dn\u00fdm zm\u011bn\u00e1m oproti p\u016fvodn\u00edmu pracovi\u0161ti a povinnostem, je nutn\u00e9 toto uv\u00e9st v &#8220;rozsahu zm\u011bn&#8221;.<\/p>\n\n\n\n<p>Nap\u0159\u00edklad, pokud zam\u011bstnanec za\u010dne pracovat z domova ihned po n\u00e1stupu, je nutn\u00e9 uv\u00e9st jako &#8220;pracovi\u0161t\u011b&#8221; domov zam\u011bstnance nebo satelitn\u00ed kancel\u00e1\u0159, kde je mo\u017en\u00e9 pracovat na d\u00e1lku. Pokud se p\u0159edpokl\u00e1d\u00e1, \u017ee b\u011bhem trv\u00e1n\u00ed pracovn\u00ed smlouvy bude zam\u011bstnanec pracovat na d\u00e1lku, je nutn\u00e9 tyto mo\u017enosti uv\u00e9st v &#8220;rozsahu zm\u011bn&#8221;.<\/p>\n\n\n\n<p>Na druhou stranu, pokud neexistuj\u00ed \u017e\u00e1dn\u00e1 omezen\u00ed pracovi\u0161t\u011b a povinnost\u00ed (nap\u0159\u00edklad u mana\u017eersk\u00fdch pozic), je nutn\u00e9 uv\u00e9st v\u0161echna mo\u017en\u00e1 pracovi\u0161t\u011b a povinnosti. Z\u00e1sadn\u011b je maxim\u00e1ln\u00ed doba jedn\u00e9 smlouvy omezena na 3 roky. C\u00edlem je &#8220;omezit zneu\u017e\u00edv\u00e1n\u00ed do\u010dasn\u00fdch pracovn\u00edch smluv zam\u011bstnavateli (nap\u0159\u00edklad p\u0159ed\u010dasn\u00e9 ukon\u010den\u00ed zam\u011bstn\u00e1n\u00ed) a zajistit stabilitu zam\u011bstn\u00e1n\u00ed&#8221;.<\/p>\n\n\n\n<p>Konkr\u00e9tn\u011b, pokud do\u010dasn\u00fd zam\u011bstnanec, kter\u00fd m\u00e1 smlouvu se stejn\u00fdm zam\u011bstnavatelem, spl\u0148uje dva po\u017eadavky: &#8220;smlouva byla obnovena alespo\u0148 jednou&#8221; a &#8220;celkov\u00e1 doba smlouvy p\u0159esahuje p\u011bt let&#8221;, m\u016f\u017ee po\u017e\u00e1dat o p\u0159em\u011bnu na dobu neur\u010ditou (\u010dl\u00e1nek 18 Z\u00e1kona o pracovn\u00edch smlouv\u00e1ch).<\/p>\n\n\n\n<p>Platnost pr\u00e1va na \u017e\u00e1dost o p\u0159em\u011bnu na dobu neur\u010ditou je omezena na dobu platnosti do\u010dasn\u00e9 smlouvy, ve kter\u00e9 toto pr\u00e1vo vzniklo (jeden rok), a proto je nutn\u00e1 opatrnost.<\/p>\n\n\n\n<p>Okam\u017eik p\u0159em\u011bny na dobu neur\u010ditou nast\u00e1v\u00e1 n\u00e1sleduj\u00edc\u00ed den po skon\u010den\u00ed do\u010dasn\u00e9 pracovn\u00ed smlouvy, na kterou byla pod\u00e1na \u017e\u00e1dost (za\u010d\u00e1tek sedm\u00e9ho roku).
