jako osobu, kter\u00e1 je zam\u011bstn\u00e1na v podniku nebo kancel\u00e1\u0159i a je j\u00ed vypl\u00e1cena mzda, bez ohledu na druh povol\u00e1n\u00ed.<br>Tak\u00e9 v \u010dl\u00e1nku 2 odstavec 1 japonsk\u00e9ho z\u00e1kona o pracovn\u00edch smlouv\u00e1ch (\u52b4\u50cd\u5951\u7d04\u6cd5) je &#8220;pracovn\u00edk&#8221; definov\u00e1n jako osoba, kter\u00e1 je zam\u011bstn\u00e1na zam\u011bstnavatelem, vykon\u00e1v\u00e1 pr\u00e1ci a je j\u00ed vypl\u00e1cena mzda.<\/p>\n\n\n\n<p>S ohledem na tyto definice, pokud se pod\u00edv\u00e1me na tradi\u010dn\u00ed profesion\u00e1ln\u00ed sporty, je obecn\u011b p\u0159ij\u00edm\u00e1no, \u017ee profesion\u00e1ln\u00ed hr\u00e1\u010di baseballu a fotbalu nespadaj\u00ed pod definici &#8220;pracovn\u00edka&#8221; podle japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech a japonsk\u00e9ho z\u00e1kona o pracovn\u00edch smlouv\u00e1ch.<br>D\u016fvody zahrnuj\u00ed specifickou odbornost profesion\u00e1ln\u00edch sportovc\u016f, omezenou dobu poskytov\u00e1n\u00ed slu\u017eeb, syst\u00e9m odm\u011b\u0148ov\u00e1n\u00ed zalo\u017een\u00fd na ro\u010dn\u00edm platu nebo v\u00fdkonu a vysok\u00e9 odm\u011bny pro \u0161pi\u010dkov\u00e9 sportovce.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Posouzeni_statusu_%E2%80%9Ezamestnance%E2%80%9C_pro_e-sportovni_hrace\"><\/span>Posouzen\u00ed statusu \u201ezam\u011bstnance\u201c pro e-sportovn\u00ed hr\u00e1\u010de<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Ot\u00e1zka, zda hr\u00e1\u010di pat\u0159\u00edc\u00ed do e-sportovn\u00edho t\u00fdmu spadaj\u00ed pod pr\u00e1vn\u00ed definici \u201ezam\u011bstnance\u201c, je kl\u00ed\u010dov\u00e1 pro organizace, kter\u00e9 by m\u011bly n\u00e9st r\u016fzn\u00e9 povinnosti jako zam\u011bstnavatel\u00e9. <br>Pokud hr\u00e1\u010di spl\u0148uj\u00ed podm\u00ednky pro status \u201ezam\u011bstnance\u201c podle japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech a japonsk\u00e9ho z\u00e1kona o pracovn\u00edch smlouv\u00e1ch, provozn\u00ed organizace t\u00fdmu mus\u00ed jako \u201ezam\u011bstnavatel\u201c dodr\u017eovat z\u00e1konn\u00e9 pracovn\u00ed hodiny a minim\u00e1ln\u00ed mzdu. <br>Nav\u00edc, pokud by organizace jednostrann\u011b ukon\u010dila smlouvu s hr\u00e1\u010dem, mohlo by to b\u00fdt pova\u017eov\u00e1no za zneu\u017eit\u00ed pr\u00e1va na v\u00fdpov\u011b\u010f.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zvlastnosti_pravniho_postaveni_e-sportovnich_hracu\"><\/span>Zvl\u00e1\u0161tnosti pr\u00e1vn\u00edho postaven\u00ed e-sportovn\u00edch hr\u00e1\u010d\u016f<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Aktivity e-sportovn\u00edch hr\u00e1\u010d\u016f maj\u00ed odli\u0161n\u00e9 charakteristiky ve srovn\u00e1n\u00ed s tradi\u010dn\u00edmi sportovci. <br>Vzhledem k tomu, \u017ee jejich \u010dinnost prob\u00edh\u00e1 p\u0159ev\u00e1\u017en\u011b online, fyzick\u00fd pohyb a omezen\u00ed jsou relativn\u011b men\u0161\u00ed. Na druhou stranu \u010dasto nesou povinnosti, kter\u00e9 u tradi\u010dn\u00edch sportovc\u016f nejsou b\u011b\u017en\u00e9, jako je internetov\u00e9 vys\u00edl\u00e1n\u00ed a aktivita na soci\u00e1ln\u00edch s\u00edt\u00edch. <br>Existuj\u00ed tak\u00e9 hr\u00e1\u010di, kte\u0159\u00ed se v\u011bnuj\u00ed v\u00edce hern\u00edm titul\u016fm, nebo ti, kte\u0159\u00ed sou\u010dasn\u011b p\u016fsob\u00ed jako streame\u0159i, co\u017e vede k je\u0161t\u011b v\u011bt\u0161\u00ed diverzifikaci jejich pracovn\u00edch forem ne\u017e u tradi\u010dn\u00edch sport\u016f.<\/p>\n\n\n\n<p>Konkr\u00e9tn\u00ed formy \u010dinnosti zahrnuj\u00ed hr\u00e1\u010de, kte\u0159\u00ed jsou \u010dleny t\u00fdmu a dost\u00e1vaj\u00ed fixn\u00ed plat 25 000 jen\u016f m\u011bs\u00ed\u010dn\u011b za \u00fa\u010dast na turnaj\u00edch, hr\u00e1\u010de, kte\u0159\u00ed jsou zam\u011bstn\u00e1ni hern\u00edmi v\u00fdrobci a p\u016fsob\u00ed jako sou\u010d\u00e1st firemn\u00edch aktivit, a nez\u00e1visl\u00e9 hr\u00e1\u010de, kte\u0159\u00ed uzav\u00edraj\u00ed sponzorsk\u00e9 smlouvy. <br>U hr\u00e1\u010d\u016f, kte\u0159\u00ed jsou \u010dleny t\u00fdmu, se obsah a rozsah p\u0159\u00edkaz\u016f od t\u00fdmu, \u010dasov\u00e1 a m\u00edstn\u00ed omezen\u00ed a zp\u016fsob stanoven\u00ed odm\u011bn li\u0161\u00ed podle jednotliv\u00fdch p\u0159\u00edpad\u016f.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kriteria_pro_posouzeni_statusu_pracovnika_z_pohledu_judikatury\"><\/span>Krit\u00e9ria pro posouzen\u00ed statusu pracovn\u00edka z pohledu judikatury<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>P\u0159i pohledu na judikaturu, v p\u0159\u00edpad\u011b Japonsk\u00e9 sumo asociace (rozhodnut\u00ed Tokijsk\u00e9ho okresn\u00edho soudu z 25. b\u0159ezna Heisei 25 (2013), \u010d. 1079, str. 152), bylo rozhodnuto, \u017ee smluvn\u00ed vztah mezi z\u00e1pasn\u00edky a Japonskou sumo asociac\u00ed m\u00e1 povahu nepojmenovan\u00e9 smlouvy v r\u00e1mci soukrom\u00e9ho pr\u00e1va, kter\u00e1 nen\u00ed pracovn\u00edm pom\u011brem, ale \u00faplatnou dvoustrannou smlouvou. Proto se na doporu\u010den\u00ed k odchodu do d\u016fchodu pro z\u00e1pasn\u00edky nevztahuje pr\u00e1vn\u00ed princip zneu\u017eit\u00ed pr\u00e1va na v\u00fdpov\u011b\u010f.<\/p>\n\n\n\n<p>Na druhou stranu, ve vztahu k japonsk\u00e9mu z\u00e1konu o odborech bylo u\u010din\u011bno jin\u00e9 rozhodnut\u00ed.<br>V p\u0159\u00edpad\u011b Japonsk\u00e9 profesion\u00e1ln\u00ed baseballov\u00e9 organizace (rozhodnut\u00ed Tokijsk\u00e9ho vrchn\u00edho soudu z 3. z\u00e1\u0159\u00ed Heisei 16 (2004), \u010d. 879, str. 90) bylo uzn\u00e1no, \u017ee profesion\u00e1ln\u00ed baseballov\u00ed hr\u00e1\u010di spl\u0148uj\u00ed definici &#8220;pracovn\u00edka&#8221; podle japonsk\u00e9ho z\u00e1kona o odborech, a hr\u00e1\u010dsk\u00e1 asociace byla pova\u017eov\u00e1na za &#8220;odborovou organizaci&#8221; podle t\u00e9ho\u017e z\u00e1kona.<br>V d\u016fsledku toho jsou pr\u00e1va podle japonsk\u00e9ho z\u00e1kona o odborech, jako je pr\u00e1vo na sdru\u017eov\u00e1n\u00ed a pr\u00e1vo na kolektivn\u00ed vyjedn\u00e1v\u00e1n\u00ed, zaru\u010dena i profesion\u00e1ln\u00edm sportovc\u016fm, a p\u0159\u00edslu\u0161n\u00e9 organizace nemohou odm\u00edtnout kolektivn\u00ed vyjedn\u00e1v\u00e1n\u00ed s hr\u00e1\u010di ohledn\u011b pracovn\u00edch podm\u00ednek a dal\u0161\u00edch z\u00e1le\u017eitost\u00ed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Prakticke_pokyny_pro_posouzeni_statusu_pracovnika\"><\/span>Praktick\u00e9 pokyny pro posouzen\u00ed statusu pracovn\u00edka<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Obecn\u00e1 krit\u00e9ria posouzen\u00ed zahrnuj\u00ed situace, kdy je obsah hry ponech\u00e1n na dovednostech a uv\u00e1\u017een\u00ed hr\u00e1\u010de, kdy je \u010dasov\u00e9 a m\u00edstn\u00ed omezen\u00ed mimo z\u00e1pasy a tr\u00e9ninky minim\u00e1ln\u00ed, kdy je zavedena odm\u011b\u0148ovac\u00ed struktura na b\u00e1zi ro\u010dn\u00edho platu nebo v\u00fdkonnostn\u00ed odm\u011bny, a kdy jsou \u0161pi\u010dkov\u00fdm hr\u00e1\u010d\u016fm vypl\u00e1ceny vysok\u00e9 odm\u011bny. V takov\u00fdch p\u0159\u00edpadech je pravd\u011bpodobn\u00e9, \u017ee stejn\u011b jako u jin\u00fdch profesion\u00e1ln\u00edch sportovc\u016f, nebudou tito hr\u00e1\u010di pova\u017eov\u00e1ni za &#8220;pracovn\u00edky&#8221; podle japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech a japonsk\u00e9ho z\u00e1kona o pracovn\u00edch smlouv\u00e1ch.<\/p>\n\n\n\n<p>Naopak, pokud existuj\u00ed podrobn\u00e9 pokyny a p\u0159\u00edkazy t\u00fdkaj\u00edc\u00ed se obsahu hry a souvisej\u00edc\u00edch \u010dinnost\u00ed, pokud jsou pracovn\u00ed doba a m\u00edsto p\u0159\u00edsn\u011b kontrolov\u00e1ny a pokud je vypl\u00e1cena pevn\u00e1 \u010d\u00e1stka odm\u011bny bez ohledu na v\u00fdsledky, zvy\u0161uje se pravd\u011bpodobnost, \u017ee budou pova\u017eov\u00e1ni za &#8220;pracovn\u00edky&#8221; podle japonsk\u00e9ho z\u00e1kona o pracovn\u00edch standardech a japonsk\u00e9ho z\u00e1kona o pracovn\u00edch smlouv\u00e1ch.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Specificke_aspekty_smluv_v_e-sportu\"><\/span>Specifick\u00e9 aspekty smluv v e-sportu<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Na rozd\u00edl od tradi\u010dn\u00edch sport\u016f je ve smlouv\u00e1ch e-sportovc\u016f nutn\u00e9 podrobn\u011b stanovit pr\u00e1va a povinnosti souvisej\u00edc\u00ed s digit\u00e1ln\u00edm obsahem, jako jsou pr\u00e1va na streamov\u00e1n\u00ed her, nakl\u00e1d\u00e1n\u00ed s osobnostn\u00edmi pr\u00e1vy a omezen\u00ed t\u00fdkaj\u00edc\u00ed se vyj\u00e1d\u0159en\u00ed na soci\u00e1ln\u00edch s\u00edt\u00edch.<br>Vzhledem k \u010dast\u00e9 \u00fa\u010dasti na mezin\u00e1rodn\u00edch turnaj\u00edch je tak\u00e9 d\u016fle\u017eit\u00e9 v\u011bnovat pozornost volb\u011b rozhodn\u00e9ho pr\u00e1va a jurisdikce.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Reakce_na_dalsi_pravni_regulace\"><\/span>Reakce na dal\u0161\u00ed pr\u00e1vn\u00ed regulace<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>I kdy\u017e se na smlouvy s hr\u00e1\u010di nevztahuj\u00ed pracovn\u00ed z\u00e1kony, podl\u00e9haj\u00ed jin\u00fdm pr\u00e1vn\u00edm regulac\u00edm.<br>P\u0159\u00edli\u0161 p\u0159\u00edsn\u00e1 omezen\u00ed p\u0159estup\u016f nebo konkuren\u010dn\u00ed dolo\u017eky mohou b\u00fdt pova\u017eov\u00e1ny za neplatn\u00e9 z d\u016fvodu poru\u0161en\u00ed ve\u0159ejn\u00e9ho po\u0159\u00e1dku a dobr\u00fdch mrav\u016f podle japonsk\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku, \u010dl\u00e1nek 90.<br>Japonsk\u00e1 komise pro spravedliv\u00fd obchod tak\u00e9 upozor\u0148uje, \u017ee omezen\u00ed ekonomick\u00fdch aktivit hr\u00e1\u010d\u016f m\u016f\u017ee vyvolat probl\u00e9my podle japonsk\u00e9ho antimonopoln\u00edho z\u00e1kona.<\/p>\n\n\n\n<p>Na z\u00e1v\u011br, jako e-sportovn\u00ed organizace je d\u016fle\u017eit\u00e9, aby se na z\u00e1klad\u011b odborn\u00fdch n\u00e1zor\u016f pr\u00e1vn\u00edk\u016f a dal\u0161\u00edch specialist\u016f individu\u00e1ln\u011b a konkr\u00e9tn\u011b zkoumalo, jak\u00fdm pr\u00e1vn\u00edm regulac\u00edm podl\u00e9haj\u00ed smlouvy s hr\u00e1\u010di, s ohledem na skute\u010dnou povahu jejich \u010dinnosti.<br>Obzvl\u00e1\u0161t\u011b d\u016fle\u017eit\u00e9 je pe\u010dliv\u00e9 navrhov\u00e1n\u00ed smluv, kter\u00e9 zohled\u0148uje specifick\u00e9 vztahy pr\u00e1v a povinnost\u00ed v digit\u00e1ln\u00ed \u00e9\u0159e a mezin\u00e1rodn\u00ed prost\u0159ed\u00ed \u010dinnosti.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>V posledn\u00edch letech se s rychl\u00fdm rozvojem odv\u011btv\u00ed e-sport\u016f st\u00e1le v\u00edce diskutuje o pr\u00e1vn\u00edm postaven\u00ed hr\u00e1\u010d\u016f.
