Tato zm\u011bna zavazuje zam\u011bstnavatele k p\u0159ijet\u00ed konkr\u00e9tn\u00edch opat\u0159en\u00ed k ochran\u011b zdrav\u00ed pracovn\u00edk\u016f pracuj\u00edc\u00edch v hork\u00e9m prost\u0159ed\u00ed a k prevenci vzniku \u010di zhor\u0161en\u00ed \u00fapalu. Jeliko\u017e je tato novela stanovena jako &#8220;povinnost s trestn\u00edmi sankcemi&#8221;, je od firem vy\u017eadov\u00e1no, aby rychle p\u0159ijaly odpov\u00eddaj\u00edc\u00ed opat\u0159en\u00ed.<\/p>\n\n\n\n<p>V tomto \u010dl\u00e1nku vysv\u011btl\u00edme povinnost prov\u00e1d\u011bn\u00ed opat\u0159en\u00ed proti \u00fapalu podle novely Japonsk\u00e9ho z\u00e1kona o opat\u0159en\u00ed proti \u00fapalu podle japonsk\u00e9ho pr\u00e1va<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Dosavadn\u00ed opat\u0159en\u00ed proti \u00fapalu na pracovi\u0161t\u00edch byla stanovena pouze v n\u011bkolika ustanoven\u00edch &#8220;Pravidel pro bezpe\u010dnost a ochranu zdrav\u00ed p\u0159i pr\u00e1ci&#8221;, kter\u00e1 jsou prov\u00e1d\u011bc\u00edmi p\u0159edpisy k z\u00e1konu zaji\u0161\u0165uj\u00edc\u00edmu bezpe\u010dnost pracovn\u00edk\u016f na pracovi\u0161ti, zn\u00e1m\u00e9mu jako &#8220;Z\u00e1kon o bezpe\u010dnosti a ochran\u011b zdrav\u00ed p\u0159i pr\u00e1ci&#8221;.<\/p>\n\n\n\n<p>Konkr\u00e9tn\u011b byla stanovena n\u00e1sleduj\u00edc\u00ed opat\u0159en\u00ed:<\/p>\n\n\n\n<ul>\n<li>Pravidlo pro bezpe\u010dnost a ochranu zdrav\u00ed p\u0159i pr\u00e1ci \u010dl\u00e1nek 606: Povinnost p\u0159ijmout opat\u0159en\u00ed pro regulaci teploty a vlhkosti v p\u0159\u00edpad\u011b, \u017ee pr\u00e1ce ve vnit\u0159n\u00edch prostor\u00e1ch za horka, chladu nebo vysok\u00e9 vlhkosti p\u0159edstavuje riziko.<\/li>\n\n\n\n<li>Pravidlo pro bezpe\u010dnost a ochranu zdrav\u00ed p\u0159i pr\u00e1ci \u010dl\u00e1nek 607: Povinnost pravideln\u011b ka\u017ed\u00fdch \u0161est m\u011bs\u00edc\u016f m\u011b\u0159it teplotu, vlhkost a radia\u010dn\u00ed teplo v t\u011bchto vnit\u0159n\u00edch pracovn\u00edch prostor\u00e1ch.<\/li>\n\n\n\n<li>Pravidlo pro bezpe\u010dnost a ochranu zdrav\u00ed p\u0159i pr\u00e1ci \u010dl\u00e1nek 617: Povinnost zajistit dostatek soli a pitn\u00e9 vody na pracovi\u0161t\u00edch, kde pr\u00e1ce zahrnuje intenzivn\u00ed pocen\u00ed.<\/li>\n<\/ul>\n\n\n\n<p>Reference: <a z\u00e1klad\u011b zvy\u0161uj\u00edc\u00edho se po\u010dtu pracovn\u00edch \u00faraz\u016f zp\u016fsoben\u00fdch ned\u00e1vn\u00fdmi vlnami veder.<\/p>\n\n\n\n<p>Zejm\u00e9na pro pracovn\u00edky pracuj\u00edc\u00ed venku nebo v interi\u00e9rech s nedostate\u010dn\u00fdm klimatiza\u010dn\u00edm za\u0159\u00edzen\u00edm p\u0159edstavuje \u00fapal v\u00e1\u017en\u00e9 a \u017eivot ohro\u017euj\u00edc\u00ed riziko. Podle zpr\u00e1vy Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed s n\u00e1zvem &#8220;Situace t\u00fdkaj\u00edc\u00ed se pracovn\u00edch \u00faraz\u016f zp\u016fsoben\u00fdch \u00fapalem v roce Reiwa 6 (2024)&#8221; do\u0161lo v roce 2023 k v\u00edce ne\u017e 1 257 p\u0159\u00edpad\u016fm \u00faraz\u016f zp\u016fsoben\u00fdch \u00fapalem na pracovi\u0161ti a k 31 \u00famrt\u00edm. Bylo konstatov\u00e1no, \u017ee st\u00e1vaj\u00edc\u00ed opat\u0159en\u00ed proti \u00fapalu nejsou dostate\u010dn\u00e1 kv\u016fli &#8220;zpo\u017ed\u011bn\u00e9mu odhalen\u00ed&#8221; a &#8220;nedostate\u010dn\u00fdm opat\u0159en\u00edm v p\u0159\u00edpad\u011b abnormalit&#8221;.<\/p>\n\n\n\n<p>Reference: <a href=\"https:\/\/www.mhlw.go.jp\/stf\/newpage_58389.html#:~:text=%E5%8E%9A%E7%94%9F%E5%8A%B4%E5%83%8D%E7%9C%81%E3%81%A7%E3%81%AF%E3%80%81%E4%BB%A4%E5%92%8C,%E3%81%A7%E7%99%BA%E7%94%9F%E3%81%97%E3%81%A6%E3%81%84%E3%81%BE%E3%81%99%E3%80%82\" target=\"_blank\" rel=\"noreferrer noopener\">Ministerstvo zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed | &#8220;Situace t\u00fdkaj\u00edc\u00ed se pracovn\u00edch \u00faraz\u016f zp\u016fsoben\u00fdch \u00fapalem v roce Reiwa 6 (2024)&#8221;[ja]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Nutnost_zavedeni_povinnych_opatreni_proti_upalu_1_Zpozdene_odhaleni\"><\/span>Nutnost zaveden\u00ed povinn\u00fdch opat\u0159en\u00ed proti \u00fapalu 1: Zpo\u017ed\u011bn\u00e9 odhalen\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Ministerstvo zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed shrnulo ned\u00e1vnou novelu z\u00e1kona o bezpe\u010dnosti a ochran\u011b zdrav\u00ed p\u0159i pr\u00e1ci do dokumentu nazvan\u00e9ho &#8220;Pos\u00edlen\u00ed opat\u0159en\u00ed proti \u00fapalu na pracovi\u0161ti&#8221;.<\/p>\n\n\n\n<p>Podle tohoto dokumentu bylo z 103 \u00famrt\u00ed zp\u016fsoben\u00fdch \u00fapalem, kter\u00e1 se stala mezi roky Reiwa 2 (2020) a Reiwa 5 (2023), 78 p\u0159\u00edpad\u016f objeveno ji\u017e ve v\u00e1\u017en\u00e9m stavu, co\u017e zp\u016fsobilo probl\u00e9my s pozdn\u00edm odhalen\u00edm.<\/p>\n\n\n\n<p>Na pracovi\u0161t\u00edch \u010dasto doch\u00e1z\u00ed k tomu, \u017ee po\u010d\u00e1te\u010dn\u00ed p\u0159\u00edznaky jako z\u00e1vrat\u011b nebo nevolnost jsou pova\u017eov\u00e1ny za &#8220;do\u010dasn\u00e9 zhor\u0161en\u00ed zdravotn\u00edho stavu&#8221; a nejsou \u0159\u00e1dn\u011b \u0159e\u0161eny, co\u017e m\u016f\u017ee v\u00e9st k rychl\u00e9mu zhor\u0161en\u00ed stavu. To m\u016f\u017ee v\u00e9st k nutnosti nouzov\u00e9ho transportu nebo dokonce k \u00famrt\u00ed. Podle zpr\u00e1vy ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed &#8220;O pos\u00edlen\u00ed opat\u0159en\u00ed proti \u00fapalu na pracovi\u0161ti&#8221; bylo mezi lety Reiwa 2 (2020) a Reiwa 5 (2023) zaznamen\u00e1no 103 \u00famrt\u00ed zp\u016fsoben\u00fdch \u00fapalem, p\u0159i\u010dem\u017e u 41 p\u0159\u00edpad\u016f byla jednou z p\u0159\u00ed\u010din nedostate\u010dn\u00e1 nebo \u017e\u00e1dn\u00e1 p\u0159eprava do zdravotnick\u00e9ho za\u0159\u00edzen\u00ed.<\/p>\n\n\n\n<p>Nap\u0159\u00edklad, pokud se neprov\u00e1d\u00ed chladic\u00ed opat\u0159en\u00ed a nech\u00e1 se posti\u017een\u00fd odpo\u010d\u00edvat, pokud je kontaktov\u00e1n\u00ed zdravotnick\u00e9ho za\u0159\u00edzen\u00ed zpo\u017ed\u011bno, nebo pokud znalosti prvn\u00ed pomoci nejsou na pracovi\u0161ti sd\u00edleny, m\u016f\u017ee to v\u00e9st k roz\u0161\u00ed\u0159en\u00ed \u0161kod. Podle \u010dl\u00e1nku 5 z\u00e1kona o pracovn\u00edch smlouv\u00e1ch m\u00e1 spole\u010dnost povinnost zajistit bezpe\u010dnost \u017eivota a t\u011bla zam\u011bstnanc\u016f tak, aby mohli pracovat v bezpe\u010dn\u00e9m prost\u0159ed\u00ed (povinnost zajistit bezpe\u010dnost).
