Dne 11. b\u0159ezna Reiwa 7 (2025) byl p\u0159edlo\u017een n\u00e1vrh z\u00e1kona, kter\u00fd m\u00e1 pos\u00edlit opat\u0159en\u00ed proti z\u00e1kaznick\u00e9mu obt\u011b\u017eov\u00e1n\u00ed, a trendem je, \u017ee opat\u0159en\u00ed proti tomuto jevu se stanou povinn\u00fdmi pro podniky. O\u010dek\u00e1v\u00e1 se, \u017ee podniky budou muset p\u0159ijmout vhodn\u011bj\u0161\u00ed opat\u0159en\u00ed proti z\u00e1kaznick\u00e9mu obt\u011b\u017eov\u00e1n\u00ed.<\/p>\n\n\n\n<p>Av\u0161ak mnoho podnik\u016f m\u016f\u017ee c\u00edtit nejistotu ohledn\u011b toho, jak se vypo\u0159\u00e1dat s opat\u0159en\u00edmi proti z\u00e1kaznick\u00e9mu obt\u011b\u017eov\u00e1n\u00ed, kter\u00e9 jsou povinn\u00e9 podle na\u0159\u00edzen\u00ed a z\u00e1kon\u016f.<\/p>\n\n\n\n<p>V tomto \u010dl\u00e1nku proto vysv\u011btl\u00edme obsah na\u0159\u00edzen\u00ed Tokijsk\u00e9 prefektury, kter\u00e9 jako prvn\u00ed v cel\u00e9m Japonsku zak\u00e1zalo z\u00e1kaznick\u00e9 obt\u011b\u017eov\u00e1n\u00ed, a spole\u010dn\u011b s t\u00edm p\u0159edstav\u00edme opat\u0159en\u00ed, kter\u00e1 by podniky m\u011bly p\u0159ijmout s ohledem na nadch\u00e1zej\u00edc\u00ed zm\u011bny v legislativ\u011b. Informace o opat\u0159en\u00edch proti z\u00e1kaznick\u00e9mu obt\u011b\u017eov\u00e1n\u00ed v\u00e1m mohou slou\u017eit jako u\u017eite\u010dn\u00fd zdroj.<\/p>\n\n\n\n<div id=\"ez-toc-container\" obt\u011b\u017eov\u00e1n\u00ed, zn\u00e1m\u00e9 jako &#8220;kasuhara&#8221; z japonsk\u00e9ho v\u00fdrazu &#8220;kasut\u0101maharasumento&#8221;, je druh obt\u011b\u017eov\u00e1n\u00ed, kter\u00e9 po\u0161kozuje pracovn\u00ed prost\u0159ed\u00ed zam\u011bstnanc\u016f. V japonsk\u00e9m pr\u00e1vu neexistuje jasn\u00e1 definice z\u00e1kaznick\u00e9ho obt\u011b\u017eov\u00e1n\u00ed. Nicm\u00e9n\u011b, na z\u00e1klad\u011b informac\u00ed z pr\u016fzkum\u016f proveden\u00fdch mezi podniky, japonsk\u00e9 ministerstvo zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed uv\u00e1d\u00ed, \u017ee z\u00e1kaznick\u00e9 obt\u011b\u017eov\u00e1n\u00ed na pracovi\u0161ti m\u016f\u017ee b\u00fdt charakterizov\u00e1no n\u00e1sledovn\u011b:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>St\u00ed\u017enosti nebo chov\u00e1n\u00ed z\u00e1kazn\u00edk\u016f, kter\u00e9, i kdy\u017e jsou posuzov\u00e1ny v kontextu opr\u00e1vn\u011bnosti po\u017eadavk\u016f, pou\u017e\u00edvaj\u00ed prost\u0159edky nebo zp\u016fsoby, kter\u00e9 jsou podle spole\u010densk\u00fdch norem nevhodn\u00e9 a tyto prost\u0159edky nebo zp\u016fsoby po\u0161kozuj\u00ed pracovn\u00ed prost\u0159ed\u00ed zam\u011bstnanc\u016f<\/p>\n<cite><a href=\"https:\/\/www.mhlw.go.jp\/content\/11900000\/000915233.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Ministerstvo zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed | Manu\u00e1l pro \u0159e\u0161en\u00ed z\u00e1kaznick\u00e9ho obt\u011b\u017eov\u00e1n\u00ed[ja]<\/a><\/cite><\/blockquote>\n\n\n\n<p>Ne v\u0161echny st\u00ed\u017enosti od z\u00e1kazn\u00edk\u016f nebo obchodn\u00edch partner\u016f v Japonsku se nutn\u011b t\u00fdkaj\u00ed z\u00e1kaznick\u00e9ho obt\u011b\u017eov\u00e1n\u00ed. Je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee n\u011bkter\u00e9 st\u00ed\u017enosti mohou b\u00fdt legitimn\u00ed a mohou sm\u011b\u0159ovat k vylep\u0161en\u00ed produkt\u016f nebo slu\u017eeb.<\/p>\n\n\n\n<p>Existuj\u00ed v\u0161ak i p\u0159\u00edpady, kdy jsou vzneseny nadm\u011brn\u00e9 po\u017eadavky nebo kdy jsou produkty nebo slu\u017eby neopr\u00e1vn\u011bn\u011b kritizov\u00e1ny. R\u00e1mec pro opat\u0159en\u00ed proti kasuhara je vypracov\u00e1v\u00e1n s pomoc\u00ed manu\u00e1l\u016f Ministerstva zdravotnictv\u00ed, pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed. Nicm\u00e9n\u011b je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee japonsk\u00e1 vl\u00e1da se pohybuje sm\u011brem k legislativn\u00edm zm\u011bn\u00e1m, aby firmy mohly prov\u00e1d\u011bt \u00fa\u010dinn\u011bj\u0161\u00ed opat\u0159en\u00ed.<\/p>\n\n\n\n<p>N\u00e1vrh z\u00e1kona, kter\u00fd zahrnuje pos\u00edlen\u00ed opat\u0159en\u00ed proti kasuhara, byl p\u0159edlo\u017een japonsk\u00e9mu parlamentu dne 11. b\u0159ezna Reiwa 7 (2025). Toto na\u0159\u00edzen\u00ed je \u00fa\u010dinn\u00e9 od 1. dubna Reiwa 7 (2025). A\u010dkoli na\u0159\u00edzen\u00ed neobsahuje \u017e\u00e1dn\u00e9 sankce pro pachatele z\u00e1kaznick\u00e9ho obt\u011b\u017eov\u00e1n\u00ed, o\u010dek\u00e1v\u00e1 se, \u017ee jeho ustanoven\u00ed, kter\u00e1 jasn\u011b definuj\u00ed nez\u00e1konnost z\u00e1kaznick\u00e9ho obt\u011b\u017eov\u00e1n\u00ed, p\u0159isp\u011bj\u00ed k jeho zm\u00edrn\u011bn\u00ed.<\/p>\n\n\n\n<p>I p\u0159edt\u00edm existovaly z\u00e1kony, jako je ob\u010dansk\u00fd z\u00e1kon\u00edk nebo trestn\u00ed z\u00e1kon\u00edk, kter\u00e9 umo\u017e\u0148ovaly st\u00edhat nekal\u00e9 reklama\u010dn\u00ed praktiky jako nez\u00e1konn\u00e9. Toto opat\u0159en\u00ed vych\u00e1z\u00ed z hlavn\u00edho principu, \u017ee customer harassment po\u0161kozuje pracovn\u00ed prost\u0159ed\u00ed zam\u011bstnanc\u016f a m\u016f\u017ee m\u00edt vliv na kontinuitu podnik\u00e1n\u00ed, a proto by se m\u011blo usilovat o jeho prevenci ve spole\u010dnosti jako celku.<\/p>\n\n\n\n<p>A\u010dkoli bylo jasn\u011b stanoveno, \u017ee customer harassment je nez\u00e1konn\u00fdm jedn\u00e1n\u00edm, nebyly stanoveny \u017e\u00e1dn\u00e9 sankce pro ty, kte\u0159\u00ed se ho dopust\u00ed. Lze \u0159\u00edci, \u017ee se jedn\u00e1 o ustanoven\u00ed, jeho\u017e c\u00edlem je nejprve zv\u00fd\u0161it pov\u011bdom\u00ed obyvatel Tokia o nez\u00e1konnosti customer harassment.<\/p>\n\n\n\n<p>Je v\u0161ak nutn\u00e9 d\u00e1vat pozor, aby nedo\u0161lo k neopr\u00e1vn\u011bn\u00e9mu poru\u0161en\u00ed pr\u00e1v z\u00e1kazn\u00edk\u016f. Nen\u00ed mo\u017en\u00e9 neopr\u00e1vn\u011bn\u00e9 po\u017eadavky nebo st\u00ed\u017enosti z\u00e1kazn\u00edk\u016f odm\u00edtat jako customer harassment.
