M\u016f\u017ee se zd\u00e1t, \u017ee jde o &#8220;syst\u00e9m d\u016fchodov\u00e9ho v\u011bku 65 let&#8221;, ale je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee se jedn\u00e1 o odli\u0161n\u00fd syst\u00e9m.<\/p>\n\n\n\n<p>V d\u016fsledku zm\u011bn tohoto z\u00e1kona bude tak\u00e9 v podnic\u00edch nutn\u00e9 p\u0159ehodnotit mnoho syst\u00e9m\u016f, v\u010detn\u011b pracovn\u00edch smluv a zaji\u0161t\u011bn\u00ed p\u0159\u00edle\u017eitost\u00ed pro zam\u011bstn\u00e1n\u00ed a podpora zam\u011bstn\u00e1n\u00ed star\u0161\u00edch osob) je japonsk\u00fd z\u00e1kon, kter\u00fd byl p\u0159ijat s c\u00edlem zajistit pracovn\u00ed p\u0159\u00edle\u017eitosti pro star\u0161\u00ed osoby a vytvo\u0159it pro n\u011b vhodn\u00e9 pracovn\u00ed prost\u0159ed\u00ed, \u010d\u00edm\u017e podporuje jejich zam\u011bstn\u00e1v\u00e1n\u00ed. V reakci na pokra\u010duj\u00edc\u00ed demografick\u00e9 st\u00e1rnut\u00ed a pokles populace v produktivn\u00edm v\u011bku (15\u201364 let), kter\u00fd se stal spole\u010densk\u00fdm probl\u00e9mem, byl tento z\u00e1kon zaveden s c\u00edlem stabiln\u011b zam\u011bstn\u00e1vat star\u0161\u00ed osoby s pracovn\u00ed motivac\u00ed a t\u00edm zajistit pracovn\u00ed s\u00edlu.<\/p>\n\n\n\n<p>V roce 1971 (\u0160\u00f3wa 46) byl p\u0159ijat \u201eZvl\u00e1\u0161tn\u00ed z\u00e1kon o podpo\u0159e zam\u011bstn\u00e1n\u00ed st\u0159edn\u011b star\u00fdch a star\u0161\u00edch osob\u201c, kter\u00fd byl v roce 1986 (\u0160\u00f3wa 61) p\u0159ejmenov\u00e1n na sou\u010dasn\u00fd n\u00e1zev z\u00e1kona.<\/p>\n\n\n\n<p>V d\u016fsledku zvy\u0161ov\u00e1n\u00ed v\u011bku pro zah\u00e1jen\u00ed p\u0159\u00edjmu starobn\u00edho d\u016fchodu na 65 let, kter\u00e9 za\u010dalo v roce 2013 (Heisei 25), byl v dubnu t\u00e9ho\u017e roku zaveden novelizovan\u00fd z\u00e1kon, jeho\u017e c\u00edlem bylo zav\u00e9st povinnost \u201ezaji\u0161t\u011bn\u00ed zam\u011bstn\u00e1n\u00ed do 65 let\u201c pro star\u0161\u00ed osoby, aby mohly pracovat a\u017e do zah\u00e1jen\u00ed d\u016fchodu.<\/p>\n\n\n\n<p>Tato novela umo\u017e\u0148ovala zam\u011bstnavatel\u016fm jako p\u0159echodn\u00e9 opat\u0159en\u00ed stanovit krit\u00e9ria pro omezen\u00ed osob zahrnut\u00fdch do syst\u00e9mu prodlou\u017een\u00e9ho zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<p>Dal\u0161\u00ed novela z\u00e1kona, kter\u00e1 vstoupila v platnost v dubnu 2021 (Reiwa 3), zavedla \u201eopat\u0159en\u00ed pro zaji\u0161t\u011bn\u00ed zam\u011bstn\u00e1n\u00ed do 70 let\u201c jako povinnost, kterou je t\u0159eba se sna\u017eit splnit.<\/p>\n\n\n\n<p>P\u0159echodn\u00e1 opat\u0159en\u00ed pro podniky skon\u010d\u00ed v b\u0159eznu 2025 (Reiwa 7) a od dubna t\u00e9ho\u017e roku se stane povinnost\u00ed prodlou\u017een\u00e9ho zam\u011bstn\u00e1n\u00ed do 65 let pln\u011b z\u00e1vaznou. Na prvn\u00ed pohled se to m\u016f\u017ee zd\u00e1t jako \u201ezv\u00fd\u0161en\u00ed d\u016fchodov\u00e9ho v\u011bku na 65 let\u201c, ale je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee to nen\u00ed p\u0159esn\u011b to sam\u00e9.<\/p>\n\n\n\n<p>To znamen\u00e1, \u017ee firmy, kter\u00e9 omezovaly po\u010det osob zahrnut\u00fdch do syst\u00e9mu prodlou\u017een\u00e9ho zam\u011bstn\u00e1n\u00ed po dosa\u017een\u00ed d\u016fchodov\u00e9ho v\u011bku, nyn\u00ed mus\u00ed tento syst\u00e9m nab\u00eddnout v\u0161em z\u00e1jemc\u016fm. Jin\u00fdmi slovy, pro firmy, kter\u00e9 ji\u017e nem\u011bly omezen\u00ed pro prodlou\u017een\u00e9 zam\u011bstn\u00e1n\u00ed, se nic nem\u011bn\u00ed.<\/p>\n\n\n\n<p>D\u00e1le je d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee opat\u0159en\u00ed pro zaji\u0161t\u011bn\u00ed zam\u011bstn\u00e1n\u00ed star\u0161\u00edch osob jsou \u201eopat\u0159en\u00edmi pro z\u00e1jemce\u201c a neexistuje povinnost zam\u011bstn\u00e1vat osoby, kter\u00e9 si nep\u0159ej\u00ed sv\u00e9 zam\u011bstn\u00e1n\u00ed po dosa\u017een\u00ed d\u016fchodov\u00e9ho v\u011bku prodlou\u017eit. Jednodu\u0161e \u0159e\u010deno, \u201ev\u0161echny zam\u011bstnance, kte\u0159\u00ed si p\u0159ej\u00ed pracovat i po dosa\u017een\u00ed 60 let, je nutn\u00e9 nad\u00e1le zam\u011bstn\u00e1vat.\u201c<\/p>\n\n\n\n<p>Na stran\u011b zam\u011bstnavatel\u016f je nutn\u00e9 p\u0159ijmout jedno z n\u00e1sleduj\u00edc\u00edch opat\u0159en\u00ed jako zaji\u0161t\u011bn\u00ed zam\u011bstn\u00e1n\u00ed star\u0161\u00edch osob podle \u010dl\u00e1nku 9 Z\u00e1kona o stabilizaci zam\u011bstn\u00e1n\u00ed star\u0161\u00edch osob:<\/p>\n\n\n\n<ol>\n<li>Zru\u0161en\u00ed syst\u00e9mu dosa\u017een\u00ed d\u016fchodov\u00e9ho v\u011bku<\/li>\n\n\n\n<li>Zv\u00fd\u0161en\u00ed d\u016fchodov\u00e9ho v\u011bku na 65 let<\/li>\n\n\n\n<li>Syst\u00e9m prodlou\u017een\u00e9ho zam\u011bstn\u00e1n\u00ed pro v\u0161echny z\u00e1jemce do 65 let (syst\u00e9m op\u011btovn\u00e9ho zam\u011bstn\u00e1n\u00ed, syst\u00e9m prodlou\u017een\u00ed pracovn\u00ed doby)<\/li>\n<\/ol>\n\n\n\n<p>Z t\u011bchto opat\u0159en\u00ed v\u011bt\u0161ina firem zavedla syst\u00e9m op\u011btovn\u00e9ho zam\u011bstn\u00e1n\u00ed jako \u010d\u00e1st syst\u00e9mu prodlou\u017een\u00e9ho zam\u011bstn\u00e1n\u00ed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tresty_podle_zakona_o_zajisteni_zamestnanosti_starsich_osob_v_Japonsku\"><\/span>Tresty podle z\u00e1kona o zaji\u0161t\u011bn\u00ed zam\u011bstnanosti star\u0161\u00edch osob v Japonsku<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>S ukon\u010den\u00edm p\u0159echodn\u00fdch opat\u0159en\u00ed se na zam\u011bstnavatele, kte\u0159\u00ed poru\u0161ili p\u0159edpisy, za\u010dnou vztahovat st\u00e1vaj\u00edc\u00ed sank\u010dn\u00ed ustanoven\u00ed.<\/p>\n\n\n\n<ul>\n<li>V p\u0159\u00edpad\u011b, \u017ee zam\u011bstnavatel nepostupuje podle pokyn\u016f, rad nebo doporu\u010den\u00ed, m\u016f\u017ee b\u00fdt jeho p\u0159\u00edpad zve\u0159ejn\u011bn (podle \u010dl\u00e1nku 10 japonsk\u00e9ho z\u00e1kona o zaji\u0161t\u011bn\u00ed zam\u011bstnanosti star\u0161\u00edch osob).<\/li>\n\n\n\n<li>Za neozn\u00e1men\u00ed nebo pod\u00e1n\u00ed nepravdiv\u00e9 zpr\u00e1vy o opat\u0159en\u00edch zam\u011bstnavatele k zaji\u0161t\u011bn\u00ed zam\u011bstnanosti star\u0161\u00edch osob v souvislosti s p\u0159\u00edsp\u011bvky m\u016f\u017ee b\u00fdt ulo\u017eena pokuta a\u017e do v\u00fd\u0161e 500 000 jen\u016f, co\u017e se t\u00fdk\u00e1 jak fyzick\u00fdch, tak pr\u00e1vnick\u00fdch osob (podle \u010dl\u00e1nk\u016f 55 a 56 t\u00e9ho\u017e z\u00e1kona).<\/li>\n\n\n\n<li>Osoba (nebo v p\u0159\u00edpad\u011b pr\u00e1vnick\u00e9 osoby jej\u00ed z\u00e1stupce), kter\u00e1 neozn\u00e1m\u00ed \u0159editeli ve\u0159ejn\u00e9ho \u00fa\u0159adu pr\u00e1ce odchod v\u011bt\u0161\u00edho po\u010dtu star\u0161\u00edch zam\u011bstnanc\u016f (v\u00edce ne\u017e 5 osob b\u011bhem jednoho m\u011bs\u00edce) nebo pod\u00e1 nepravdiv\u00e9 ozn\u00e1men\u00ed, m\u016f\u017ee b\u00fdt potrest\u00e1na pokutou a\u017e do v\u00fd\u0161e 100 000 jen\u016f (podle \u010dl\u00e1nku 57 t\u00e9ho\u017e z\u00e1kona).<\/li>\n<\/ul>\n\n\n\n<p>D\u00e1le podrobn\u011b vysv\u011btl\u00edme opat\u0159en\u00ed, kter\u00e1 by m\u011bly podniky p\u0159ijmout, a na co by m\u011bly d\u00e1t pozor v souvislosti s novelizac\u00ed &#8220;japonsk\u00e9ho z\u00e1kona o zaji\u0161t\u011bn\u00ed zam\u011bstnanosti star\u0161\u00edch osob&#8221;.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Opatreni_a_dulezite_body_ktere_by_mely_podniky_v_Japonsku_zvazit\"><\/span>Opat\u0159en\u00ed a d\u016fle\u017eit\u00e9 body, kter\u00e9 by m\u011bly podniky v Japonsku zv\u00e1\u017eit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2025\/03\/5aa43bbf7179f124adfad1c28750991a.jpg\" alt=\"Opat\u0159en\u00ed a d\u016fle\u017eit\u00e9 body, kter\u00e9 by m\u011bly podniky v Japonsku zv\u00e1\u017eit\" class=\"wp-image-133297\" \/><\/figure>\n\n\n\n<p>Podniky v Japonsku jsou povinny p\u0159ijmout opat\u0159en\u00ed na zaji\u0161t\u011bn\u00ed zam\u011bstn\u00e1n\u00ed star\u0161\u00edch osob (ve v\u011bku 61 a\u017e 65 let) a opat\u0159en\u00ed na zaji\u0161t\u011bn\u00ed pracovn\u00edch m\u00edst pro star\u0161\u00ed osoby (ve v\u011bku 66 a\u017e 70 let).
