informac\u00edm (CI), kter\u00e9 jsou pova\u017eov\u00e1ny za d\u016fle\u017eit\u00e9 z hlediska n\u00e1rodn\u00ed bezpe\u010dnosti, po proveden\u00ed &#8216;vhodn\u00e9ho hodnocen\u00ed a kontroly&#8217;.<\/p>\n\n\n\n<p>Pro z\u00edsk\u00e1n\u00ed bezpe\u010dnostn\u00ed prov\u011brky se v r\u016fzn\u00fdch zem\u00edch li\u0161\u00ed krit\u00e9ria pro ur\u010den\u00ed CI (tajn\u00fdch informac\u00ed) a standardy pro jejich posouzen\u00ed, ale obvykle se prov\u00e1d\u00ed prov\u011brka za\u0159\u00edzen\u00ed (FCL) a osobn\u00ed prov\u011brka (PCL), a povolen\u00ed je ud\u011bleno pouze v p\u0159\u00edpad\u011b, \u017ee se usoud\u00ed, \u017ee nehroz\u00ed riziko \u00faniku informac\u00ed.<\/p>\n\n\n\n<p>V Japonsku je syst\u00e9m bezpe\u010dnostn\u00ed prov\u011brky stanoven &#8216;Z\u00e1konem o ochran\u011b specifick\u00fdch tajemstv\u00ed&#8217;, kter\u00fd se vztahuje na administrativn\u00ed org\u00e1ny a soukrom\u00e9 subjekty, je\u017e se zab\u00fdvaj\u00ed &#8216;specifick\u00fdmi tajn\u00fdmi informacemi&#8217;.<\/p>\n\n\n\n<p>V roce Reiwa 6 (2024) byl v Japonsku p\u0159ijat &#8216;Z\u00e1kon o ochran\u011b a vyu\u017e\u00edv\u00e1n\u00ed d\u016fle\u017eit\u00fdch informac\u00ed pro ekonomickou bezpe\u010dnost (Z\u00e1kon o ochran\u011b a vyu\u017e\u00edv\u00e1n\u00ed d\u016fle\u017eit\u00fdch informac\u00ed pro ekonomickou bezpe\u010dnost)&#8217;, kter\u00fd zavedl nov\u00fd syst\u00e9m bezpe\u010dnostn\u00ed prov\u011brky, zam\u011b\u0159en\u00fd p\u0159edev\u0161\u00edm na soukrom\u00e9 podniky, kter\u00e9 se zab\u00fdvaj\u00ed &#8216;d\u016fle\u017eit\u00fdmi informacemi pro ekonomickou bezpe\u010dnost&#8217;, kter\u00e9 nespadaj\u00ed pod &#8216;specifick\u00e1 tajemstv\u00ed&#8217; nebo &#8216;speci\u00e1ln\u00ed obrann\u00e1 tajemstv\u00ed&#8217; (nabyt\u00ed \u00fa\u010dinnosti dne 17. kv\u011btna Reiwa 7 (2025)).<\/p>\n\n\n\n<p>Rozsah informac\u00ed (typy informac\u00ed), kter\u00e9 vl\u00e1da ur\u010d\u00ed v z\u00e1vislosti na stupni citlivosti CI (tajn\u00fdch informac\u00ed), lze mezin\u00e1rodn\u011b porovnat a graficky zn\u00e1zornit n\u00e1sledovn\u011b.<\/p>\n\n\n\n<p>Informace t\u0159\u00eddy &#8216;Top Secret&#8217; odpov\u00eddaj\u00ed \u00faniku, kter\u00fd by &#8216;zp\u016fsobil zna\u010dn\u011b v\u00e1\u017en\u00e9 \u0161kody (citliv\u00e9)&#8217;, informace t\u0159\u00eddy &#8216;Secret&#8217; &#8216;v\u00e1\u017en\u00e9 \u0161kody (vysoce tajn\u00e9)&#8217;, a informace t\u0159\u00eddy &#8216;Confidential&#8217; jsou takov\u00e9, u kter\u00fdch &#8216;lze rozumn\u011b p\u0159edpokl\u00e1dat, \u017ee zp\u016fsob\u00ed \u0161kody (tajn\u00e9)&#8217;. Informace, kter\u00e9 spadaj\u00ed pod &#8216;d\u016fle\u017eit\u00e9 informace pro ekonomickou bezpe\u010dnost&#8217;, odpov\u00eddaj\u00ed &#8216;Confidential&#8217; t\u0159\u00edd\u011b a jsou pro ekonomickou bezpe\u010dnost&#8221; jsou ozna\u010deny konkr\u00e9tn\u00edm administrativn\u00edm org\u00e1nem, a proto je pro z\u00edsk\u00e1n\u00ed t\u011bchto informac\u00ed pot\u0159eba souhlas od jin\u00fdch administrativn\u00edch org\u00e1n\u016f, kter\u00e9 tyto informace pot\u0159ebuj\u00ed.<\/p>\n\n\n\n<p>Pro ozna\u010den\u00ed &#8220;d\u016fle\u017eit\u00fdch informac\u00ed pro po\u017eadavky (nap\u0159\u00edklad zahrani\u010dn\u00ed pod\u00edl a jeho vliv na bezpe\u010dnost) a z\u00edskal pozitivn\u00ed hodnocen\u00ed za\u0159\u00edzen\u00ed (FCL) od agentury.<\/p>\n\n\n\n<p>Proto je nutn\u00e9 uzav\u0159\u00edt smlouvu s administrativn\u00ed agenturou, kter\u00e1 vlastn\u00ed &#8220;d\u016fle\u017eit\u00e9 informace pro ochranu kl\u00ed\u010dov\u00e9 ekonomick\u00e9 infrastruktury&#8221;, pokud je nevlastn\u00ed administrativn\u00ed agentura, s n\u00ed\u017e byla smlouva uzav\u0159ena.<\/p>\n\n\n\n<p>Tento proces certifikace byl zaveden za \u00fa\u010delem minimalizace rizika \u00faniku informac\u00ed a je zalo\u017een na &#8220;Z\u00e1konu o ochran\u011b specifick\u00fdch tajemstv\u00ed&#8221; (Act on the Protection of Specially Designated Secrets).<\/p>\n\n\n\n<p>Subjekt, kter\u00fd spl\u0148uje po\u017eadavky, nesm\u00ed poskytovat &#8220;d\u016fle\u017eit\u00e9 informace pro ekonomickou bezpe\u010dnost&#8221; t\u0159et\u00edm stran\u00e1m, pokud to nen\u00ed nezbytn\u00e9 z d\u016fvod\u016f ve\u0159ejn\u00e9ho z\u00e1jmu (\u010dl\u00e1nek 10, odstavec 6).<\/p>\n\n\n\n<p>Na druh\u00e9 stran\u011b, pokud je t\u0159eba p\u0159istupovat k CI (Confidential Information) zahrani\u010dn\u00ed vl\u00e1dy nebo poskytovat &#8220;d\u016fle\u017eit\u00e9 informace pro ekonomickou bezpe\u010dnost&#8221; zahrani\u010dn\u00ed vl\u00e1d\u011b, instituci nebo soukrom\u00e9 spole\u010dnosti, je nutn\u00e9 to prov\u00e9st prost\u0159ednictv\u00edm vlastn\u00ed vl\u00e1dy.<\/p>\n\n\n\n<p>Platnost osobn\u00ed bezpe\u010dnostn\u00ed prov\u011brky (PCL) v r\u00e1mci &#8220;d\u016fle\u017eit\u00fdch informac\u00ed pro ekonomickou bezpe\u010dnost&#8221; je 10 let, a proto je nutn\u00e9 prov\u00e9st nov\u00e9 hodnocen\u00ed vhodnosti u osob, u kter\u00fdch se p\u0159edpokl\u00e1d\u00e1, \u017ee budou po dobu del\u0161\u00ed ne\u017e 10 let vykon\u00e1vat \u010dinnosti spojen\u00e9 s manipulac\u00ed s &#8220;d\u016fle\u017eit\u00fdmi informacemi pro ekonomickou bezpe\u010dnost&#8221;.<\/p>\n\n\n\n<p>Av\u0161ak i b\u011bhem platn\u00e9ho obdob\u00ed, pokud existuje riziko \u00faniku &#8220;d\u016fle\u017eit\u00fdch informac\u00ed pro ekonomickou bezpe\u010dnost&#8221;, je nutn\u00e9 prov\u00e9st nov\u00e9 hodnocen\u00ed vhodnosti (\u010dl\u00e1nek 11, odstavec 1).<\/p>\n\n\n\n<p>Na druh\u00e9 stran\u011b, platnost bezpe\u010dnostn\u00ed prov\u011brky podle &#8220;Z\u00e1kona o ochran\u011b specifick\u00fdch tajemstv\u00ed&#8221; je 5 let, ale osoby, kter\u00e9 z\u00edskaly tuto prov\u011brku (osoby s ned\u00e1vn\u00fdm hodnocen\u00edm vhodnosti pro &#8220;specifick\u00e1 tajemstv\u00ed&#8221;) a neuplynulo 5 let od jej\u00edho z\u00edsk\u00e1n\u00ed, mohou prov\u00e1d\u011bt \u010dinnosti spojen\u00e9 s manipulac\u00ed s &#8220;d\u016fle\u017eit\u00fdmi informacemi pro ekonomickou bezpe\u010dnost&#8221; bez nutnosti nov\u00e9ho hodnocen\u00ed vhodnosti, pokud jsou st\u00e1le u stejn\u00e9 administrativn\u00ed agentury (\u010dl\u00e1nek 11, odstavec 2).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tresty_podle_zakona_o_ochrane_specifickych_tajemstvi_v_Japonsku\"><\/span>Tresty podle z\u00e1kona o ochran\u011b specifick\u00fdch tajemstv\u00ed v Japonsku<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Osoby, kter\u00e9 unikly &#8220;d\u016fle\u017eit\u00e9 informace o ekonomick\u00e9 bezpe\u010dnosti&#8221; (v\u010detn\u011b t\u011bch, kter\u00e9 ji\u017e nejsou zam\u011bstn\u00e1ny), nebo osoby, kter\u00e9 tyto informace z\u00edskaly neopr\u00e1vn\u011bn\u011b, mohou b\u00fdt potrest\u00e1ny odn\u011bt\u00edm svobody a\u017e na p\u011bt let nebo pokutou do 5 milion\u016f jen\u016f, p\u0159\u00edpadn\u011b kombinac\u00ed obou trest\u016f (\u010dl\u00e1nek 22, \u010dl\u00e1nek 23).<\/p>\n\n\n\n<p>Z\u00e1kon o ochran\u011b a vyu\u017e\u00edv\u00e1n\u00ed d\u016fle\u017eit\u00fdch informac\u00ed o ekonomick\u00e9 bezpe\u010dnosti zav\u00e1d\u00ed tak\u00e9 dvoj\u00ed trest\u00e1n\u00ed, kter\u00e9 nebylo stanoveno v &#8220;z\u00e1kon\u011b o ochran\u011b specifick\u00fdch tajemstv\u00ed&#8221;, a to se vztahuje i na podnikatele (\u010dl\u00e1nek 27).<\/p>\n\n\n\n<p>D\u00e1le existuj\u00ed trestn\u00ed sankce i pro pokusy o trestn\u00fd \u010din a pro trestn\u00e9 \u010diny z nedbalosti.<\/p>\n\n\n\n<p>Na druh\u00e9 stran\u011b, podniky, kter\u00e9 se \u0159\u00edd\u00ed t\u011bmito p\u0159edpisy, nesm\u011bj\u00ed zneu\u017e\u00edvat v\u00fdsledky hodnocen\u00ed zp\u016fsobilosti nebo informace o nesouhlasu s hodnocen\u00edm zp\u016fsobilosti u zam\u011bstnanc\u016f, kte\u0159\u00ed podl\u00e9haj\u00ed bezpe\u010dnostn\u00ed prov\u011brce (nap\u0159\u00edklad v person\u00e1ln\u00edm hodnocen\u00ed nebo p\u0159i nevhodn\u00fdch zm\u011bn\u00e1ch pracovn\u00edho
