z\u00e1kona jsou velk\u00fdm platform\u00e1m ur\u010deny povinnosti, jako je stanoven\u00ed krit\u00e9ri\u00ed pro odstran\u011bn\u00ed p\u0159\u00edsp\u011bvk\u016f a zaveden\u00ed syst\u00e9mu pro telekomunikac\u00ed)&#8221; je druhou velkou novelizac\u00ed od zaveden\u00ed &#8220;Z\u00e1kona o omezen\u00ed odpov\u011bdnosti poskytovatel\u016f (Z\u00e1kon o omezen\u00ed odpov\u011bdnosti za \u0161kody poskytovatel\u016f ur\u010dit\u00fdch telekomunika\u010dn\u00edch slu\u017eeb a o zve\u0159ej\u0148ov\u00e1n\u00ed informac\u00ed o odes\u00edlatel\u00edch)&#8221; v roce Heisei 13 (2001). V reakci na soci\u00e1ln\u00ed probl\u00e9my spojen\u00e9 s poru\u0161ov\u00e1n\u00edm pr\u00e1v na internetu byl zaveden nov\u00fd syst\u00e9m pro &#8220;velk\u00e9 platformn\u00ed podniky&#8221;, aby se zajistilo \u00fa\u010dinn\u00e9 n\u00e1pravy \u0161kod, a do\u0161lo ke zm\u011bn\u011b n\u00e1zvu z\u00e1kona.<\/p>\n\n\n\n<p>V roce Reiwa 3 (2021) se zv\u00fd\u0161il po\u010det ob\u011bt\u00ed, kter\u00e9 pod\u00e1valy &#8220;\u017e\u00e1dosti o zve\u0159ejn\u011bn\u00ed informac\u00ed o odes\u00edlatel\u00edch&#8221;, co\u017e vedlo k probl\u00e9m\u016fm s velkou z\u00e1t\u011b\u017e\u00ed soudn\u00edch \u0159\u00edzen\u00ed. Aby se urychlila n\u00e1prava \u0161kod pro ob\u011bti, bylo zavedeno nekontenciozn\u00ed \u0159\u00edzen\u00ed, kter\u00e9 umo\u017e\u0148uje zve\u0159ejn\u011bn\u00ed informac\u00ed o odes\u00edlatel\u00edch v jednom kroku, a do\u0161lo k dal\u0161\u00ed novelizaci. Nicm\u00e9n\u011b byly identifikov\u00e1ny probl\u00e9my, jako je &#8220;po\u017eadavek na zjevn\u00e9 poru\u0161en\u00ed pr\u00e1v&#8221; nebo to, \u017ee smluvn\u00ed podm\u00ednky zahrani\u010dn\u00edch spole\u010dnost\u00ed neberou v \u00favahu japonsk\u00e9 z\u00e1kony nebo skute\u010dn\u00fd stav \u0161kod, a syst\u00e9m nebyl v\u017edy pln\u011b funk\u010dn\u00ed.<\/p>\n\n\n\n<p>Novelizace v roce Reiwa 6 (2024) byla navr\u017eena tak, aby poskytovatel\u00e9 slu\u017eeb byli sami motivov\u00e1ni k zaji\u0161t\u011bn\u00ed spr\u00e1vn\u00e9ho provozu syst\u00e9mu, a byly zavedeny povinnosti pro ur\u010den\u00e9 &#8220;velk\u00e9 platformn\u00ed podniky&#8221;, jako je stanoven\u00ed krit\u00e9ri\u00ed pro odstran\u011bn\u00ed a zve\u0159ej\u0148ov\u00e1n\u00ed informac\u00ed o reakc\u00edch, a byly stanoveny tak\u00e9 sankce.<\/p>\n\n\n\n<p>Zm\u011bny jsou n\u00e1sleduj\u00edc\u00ed:<\/p>\n\n\n\n<ol>\n<li>Zm\u011bna n\u00e1zvu z\u00e1kona<\/li>\n\n\n\n<li>Ur\u010den\u00ed a ozn\u00e1men\u00ed &#8220;velk\u00fdch platformn\u00edch podnik\u016f&#8221; (\u010dl\u00e1nky 20, 21)<\/li>\n\n\n\n<li>Povinnost urychlit reakci na poru\u0161en\u00ed pr\u00e1v (\u010dl\u00e1nky 22\u201325)<\/li>\n\n\n\n<li>Povinnost transparentnosti provozu (\u010dl\u00e1nky 21\u201329)<\/li>\n\n\n\n<li>Zaveden\u00ed doporu\u010den\u00ed a sankc\u00ed (\u010dl\u00e1nky 35\u201338)<\/li>\n<\/ol>\n\n\n\n<p>Informace, kter\u00e9 podl\u00e9haj\u00ed opat\u0159en\u00edm proti p\u0159enosu (odstran\u011bn\u00ed), zahrnuj\u00ed informace poru\u0161uj\u00edc\u00ed pr\u00e1va a informace poru\u0161uj\u00edc\u00ed z\u00e1kony, ale s ohledem na to, \u017ee by bylo nevhodn\u00e9, aby se do toho zapojila vl\u00e1da (ekvivalent cenzury, probl\u00e9my s neutralitou), je p\u0159edpokladem, \u017ee hodnocen\u00ed podle hmotn\u00e9ho pr\u00e1va bude prov\u00e1d\u011bt &#8220;velk\u00fd platformn\u00ed podnik&#8221; Body, kter\u00e9 je t\u0159eba zv\u00e1\u017eit, jsou n\u00e1sleduj\u00edc\u00ed (\u010dl\u00e1nek 22).<\/p>\n\n\n\n<ul>\n<li>Mo\u017enost pod\u00e1n\u00ed \u017e\u00e1dosti online (mo\u017enost pod\u00e1n\u00ed \u017e\u00e1dosti v japon\u0161tin\u011b)<\/li>\n\n\n\n<li>\u017de pod\u00e1n\u00ed \u017e\u00e1dosti nep\u0159edstavuje nadm\u011brnou z\u00e1t\u011b\u017e pro \u017eadatele<\/li>\n\n\n\n<li>\u017de \u017eadatel je informov\u00e1n o datu a \u010dase p\u0159ijet\u00ed \u017e\u00e1dosti<\/li>\n<\/ul>\n\n\n\n<p>&#8220;Nadm\u011brn\u00e1 z\u00e1t\u011b\u017e pro \u017eadatele&#8221; znamen\u00e1 nap\u0159\u00edklad, \u017ee formul\u00e1\u0159 pro pod\u00e1n\u00ed \u017e\u00e1dosti je snadno nalezen, \u017ee i osoby, kter\u00e9 nemohou z\u00edskat \u00fa\u010det kv\u016fli v\u011bkov\u00fdm omezen\u00edm, mohou podat \u017e\u00e1dost o odstran\u011bn\u00ed, a \u017ee je br\u00e1n ohled na ochranu soukrom\u00ed a dal\u0161\u00edch pr\u00e1v.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jmenovani_a_oznameni_%E2%80%9Cspecialisty_na_vysetrovani_informaci_o_poruseni_prav%E2%80%9D\"><\/span>Jmenov\u00e1n\u00ed a ozn\u00e1men\u00ed &#8220;specialisty na vy\u0161et\u0159ov\u00e1n\u00ed informac\u00ed o poru\u0161en\u00ed pr\u00e1v&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>&#8220;Velk\u00e9 platformn\u00ed oper\u00e1tory&#8221; mus\u00ed, kdy\u017e obdr\u017e\u00ed \u017e\u00e1dost o odstran\u011bn\u00ed informac\u00ed poru\u0161uj\u00edc\u00edch pr\u00e1va od po\u0161kozen\u00e9 strany, bez zbyte\u010dn\u00e9ho odkladu prov\u00e9st pot\u0159ebn\u00e9 vy\u0161et\u0159ov\u00e1n\u00ed t\u011bchto informac\u00ed (\u010dl\u00e1nek 23).<\/p>\n\n\n\n<p>Pro \u0159\u00e1dn\u00e9 proveden\u00ed pr\u00e1vn\u00edch \u00fakon\u016f souvisej\u00edc\u00edch s vy\u0161et\u0159ov\u00e1n\u00edm je t\u0159eba jmenovat &#8220;specialistu na vy\u0161et\u0159ov\u00e1n\u00ed informac\u00ed o poru\u0161en\u00ed pr\u00e1v&#8221;, kter\u00fd m\u00e1 dostate\u010dn\u00e9 znalosti a zku\u0161enosti s \u0159e\u0161en\u00edm poru\u0161en\u00ed pr\u00e1v na internetu.<\/p>\n\n\n\n<p>Co se t\u00fd\u010de po\u017eadavk\u016f na &#8220;specialistu na vy\u0161et\u0159ov\u00e1n\u00ed informac\u00ed o poru\u0161en\u00ed pr\u00e1v&#8221;, konkr\u00e9tn\u011b se pova\u017euje za vhodn\u00e9, aby to byl pr\u00e1vn\u00ed odborn\u00edk, jako je advok\u00e1t, s dostate\u010dn\u00fdmi znalostmi a zku\u0161enostmi s japonskou kulturou a soci\u00e1ln\u00edmi probl\u00e9my (pouze fyzick\u00e9 osoby).<\/p>\n\n\n\n<p>Po\u010det &#8220;specialist\u016f na vy\u0161et\u0159ov\u00e1n\u00ed informac\u00ed o poru\u0161en\u00ed pr\u00e1v&#8221; mus\u00ed b\u00fdt alespo\u0148 jeden na ka\u017ed\u00fdch 10 milion\u016f pr\u016fm\u011brn\u00fdch m\u011bs\u00ed\u010dn\u00edch odes\u00edlatel\u016f nebo jeden na ka\u017ed\u00fdch 2 miliony pr\u016fm\u011brn\u00fdch m\u011bs\u00ed\u010dn\u00edch prohl\u00ed\u017ee\u010d\u016f. Syst\u00e9m tedy nefungoval v\u017edy dostate\u010dn\u011b efektivn\u011b.<\/p>\n\n\n\n<p>Pro p\u0159edch\u00e1zen\u00ed t\u011bmto probl\u00e9m\u016fm je kl\u00ed\u010dov\u00e9, aby poskytovatel\u00e9 stanovili transparentn\u00ed krit\u00e9ria pro odstra\u0148ov\u00e1n\u00ed obsahu a postupovali spravedliv\u011b a konzistentn\u011b. Bylo po\u017eadov\u00e1no z\u00e1konn\u00e9 na\u0159\u00edzen\u00ed, kter\u00e9 by zajistilo, \u017ee dobrovoln\u00e9 odstra\u0148ov\u00e1n\u00ed obsahu poskytovateli slu\u017eeb na z\u00e1klad\u011b smluvn\u00edch podm\u00ednek bude prov\u00e1d\u011bno rychle a adekv\u00e1tn\u011b.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Kriteria_a_dalsi_podminky_pro_provadeni_odstraneni_informaci\"><\/span>Krit\u00e9ria a dal\u0161\u00ed podm\u00ednky pro prov\u00e1d\u011bn\u00ed odstran\u011bn\u00ed informac\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Jak ji\u017e bylo uvedeno, informace, kter\u00e9 maj\u00ed b\u00fdt odstran\u011bny, jsou informace poru\u0161uj\u00edc\u00ed pr\u00e1va a informace poru\u0161uj\u00edc\u00ed z\u00e1kony, ale skute\u010dn\u00e9 rozhodnut\u00ed o tom, jak\u00e9 informace (vyj\u00e1d\u0159en\u00ed) by m\u011bly b\u00fdt odstran\u011bny, je ponech\u00e1no na autonomii &#8220;velk\u00fdch platformn\u00edch podnikatel\u016f&#8221;.<\/p>\n\n\n\n<p>Informace poru\u0161uj\u00edc\u00ed pr\u00e1va a informace poru\u0161uj\u00edc\u00ed z\u00e1kony odpov\u00eddaj\u00ed trestn\u00fdm \u010din\u016fm podle trestn\u00edho z\u00e1kon\u00edku, ale vyj\u00e1d\u0159en\u00ed se li\u0161\u00ed. Proto byly &#8220;velk\u00e9 platformn\u00ed podnikatele&#8221; povinny stanovit konkr\u00e9tn\u00ed krit\u00e9ria pro odstran\u011bn\u00ed informac\u00ed, kter\u00e9 se stanou p\u0159edm\u011btem odstran\u011bn\u00ed. Obsah &#8220;krit\u00e9ri\u00ed pro prov\u00e1d\u011bn\u00ed odstran\u011bn\u00ed&#8221; mus\u00ed odpov\u00eddat n\u00e1sleduj\u00edc\u00edm bod\u016fm:<\/p>\n\n\n\n<ul>\n<li>Specificky ur\u010dit typy informac\u00ed, kter\u00e9 maj\u00ed b\u00fdt odstran\u011bny, v z\u00e1vislosti na p\u0159\u00ed\u010din\u011b, kter\u00e1 vedla &#8220;velk\u00e9 platformn\u00ed podnikatele&#8221; k pozn\u00e1n\u00ed distribuce t\u011bchto informac\u00ed<\/li>\n\n\n\n<li>Specificky stanovit krit\u00e9ria pro prov\u00e1d\u011bn\u00ed &#8220;opat\u0159en\u00ed k zastaven\u00ed poskytov\u00e1n\u00ed slu\u017eeb&#8221; v p\u0159\u00edpad\u011b, \u017ee k takov\u00fdm opat\u0159en\u00edm dojde<\/li>\n\n\n\n<li>Pou\u017e\u00edt vyj\u00e1d\u0159en\u00ed, kter\u00e9 jsou snadno pochopiteln\u00e1 pro odes\u00edlatele a dal\u0161\u00ed z\u00fa\u010dastn\u011bn\u00e9 strany<\/li>\n\n\n\n<li>Zohlednit soulad s pr\u00e1vn\u00edmi p\u0159edpisy, kter\u00e9 stanovuj\u00ed povinnost usilovat o prov\u00e1d\u011bn\u00ed odstran\u011bn\u00ed<\/li>\n<\/ul>\n\n\n\n<p>&#8220;Velk\u00e9 platformn\u00ed podnikatele&#8221; mohou prov\u00e1d\u011bt odstran\u011bn\u00ed informac\u00ed na z\u00e1klad\u011b vlastn\u00edch krit\u00e9ri\u00ed, ale v n\u00e1sleduj\u00edc\u00edch v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech mohou odstranit informace i bez toho, aby byly explicitn\u011b uvedeny v krit\u00e9ri\u00edch pro odstran\u011bn\u00ed:<\/p>\n\n\n\n<ul>\n<li>Kdy\u017e &#8220;velk\u00fd platformn\u00ed podnikatel&#8221; je odes\u00edlatelem informac\u00ed, kter\u00e9 se chyst\u00e1 odstranit<\/li>\n\n\n\n<li>V p\u0159\u00edpad\u011b, \u017ee existuje povinnost odstranit neopr\u00e1vn\u011bn\u00e9 informace poru\u0161uj\u00edc\u00ed pr\u00e1va nebo kdy\u017e existuje pr\u00e1vn\u00ed povinnost<\/li>\n\n\n\n<li>V p\u0159\u00edpad\u011b nal\u00e9hav\u00e9 pot\u0159eby odstran\u011bn\u00ed, kdy typ informac\u00ed, kter\u00e9 maj\u00ed b\u00fdt odstran\u011bny, nen\u00ed mo\u017en\u00e9 obvykle p\u0159edv\u00eddat, a proto nejsou explicitn\u011b uvedeny v krit\u00e9ri\u00edch pro odstran\u011bn\u00ed<\/li>\n<\/ul>\n\n\n\n<p>Obdob\u00ed p\u0159edb\u011b\u017en\u00e9ho informov\u00e1n\u00ed o &#8220;krit\u00e9ri\u00edch pro prov\u00e1d\u011bn\u00ed odstran\u011bn\u00ed&#8221; je do dvou t\u00fddn\u016f p\u0159ed proveden\u00edm odstran\u011bn\u00ed.<\/p>\n\n\n\n<p>D\u00e1le je nutn\u00e9 jednou ro\u010dn\u011b vytvo\u0159it a zve\u0159ejnit materi\u00e1ly, kter\u00e9 systematizuj\u00ed p\u0159\u00edklady informac\u00ed, u kter\u00fdch byla podle t\u011bchto krit\u00e9ri\u00ed zavedena opat\u0159en\u00ed k zabr\u00e1n\u011bn\u00ed jejich \u0161\u00ed\u0159en\u00ed, a to tak, aby byly u\u017eite\u010dn\u00e9 pro odes\u00edlatele a dal\u0161\u00ed z\u00fa\u010dastn\u011bn\u00e9 strany, a to podle typu informac\u00ed.<\/p>\n\n\n\n<p>Na druh\u00e9 stran\u011b, v p\u0159\u00edpad\u011b \u017e\u00e1dosti o odstran\u011bn\u00ed prost\u0159ednictv\u00edm soudn\u00edho \u0159\u00edzen\u00ed je nutn\u00e9 prok\u00e1zat &#8220;zjevn\u00e9 poru\u0161en\u00ed pr\u00e1v (\u010dl\u00e1nek 5 odstavec 1)&#8221;, co\u017e je z\u00e1t\u011b\u017e pro \u017eadatele.<\/p>\n\n\n\n<p>\u017d\u00e1dost o odstran\u011bn\u00ed nen\u00ed sice tak n\u00e1ro\u010dn\u00e1 jako \u017e\u00e1dost o zve\u0159ejn\u011bn\u00ed informac\u00ed o odes\u00edlateli, ale v p\u0159\u00edpad\u011b &#8220;zjevn\u00e9ho poru\u0161en\u00ed pr\u00e1v&#8221; se nevy\u017eaduje od strany \u017e\u00e1daj\u00edc\u00ed o zve\u0159ejn\u011bn\u00ed d\u016fkaz, kter\u00fd by byl t\u00e9m\u011b\u0159 nemo\u017en\u00fd. &#8220;Zjevn\u00e9 poru\u0161en\u00ed pr\u00e1v&#8221; nen\u00ed zcela toto\u017en\u00e9 s posuzov\u00e1n\u00edm d\u016fvod\u016f vylu\u010duj\u00edc\u00edch nez\u00e1konnost v &#8220;\u017ealob\u00e1ch na n\u00e1hradu \u0161kody&#8221;. V tomto ohledu potvrdil Tokijsk\u00fd vrchn\u00ed soud (rozsudek ze dne 9. prosince (2020) Reiwa 2) po\u017eadavek na zjevn\u00e9 poru\u0161en\u00ed pr\u00e1v a zvr\u00e1til rozhodnut\u00ed prvn\u00ed instance.<\/p>\n\n\n\n<p>Tento soudn\u00ed p\u0159\u00edpad je rozhodnut\u00edm, kter\u00e9 stanov\u00ed, \u017ee interpretace po\u017eadavku na &#8220;zjevn\u00e9 poru\u0161en\u00ed pr\u00e1v&#8221; v r\u00e1mci &#8220;syst\u00e9mu \u017e\u00e1dost\u00ed o zve\u0159ejn\u011bn\u00ed informac\u00ed o odes\u00edlateli&#8221; nesm\u00ed vy\u017eadovat zru\u0161en\u00ed \u00fa\u010delu syst\u00e9mu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Oznameni_odesilateli_po_provedeni_odstraneni_obsahu\"><\/span>Ozn\u00e1men\u00ed odes\u00edlateli po proveden\u00ed odstran\u011bn\u00ed obsahu<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Pokud dojde k dobrovoln\u00e9mu nebo povinn\u00e9mu odstran\u011bn\u00ed informac\u00ed odes\u00edlatele, je nutn\u00e9 bez zbyte\u010dn\u00e9ho odkladu ozn\u00e1mit odes\u00edlateli tento fakt a d\u016fvody (vztah mezi odstran\u011bn\u00edm a krit\u00e9rii pro odstran\u011bn\u00ed) a z\u00e1rove\u0148 zajistit, aby byl odes\u00edlatel schopen se o tomto odstran\u011bn\u00ed snadno dozv\u011bd\u011bt (obsah by m\u011bl b\u00fdt odes\u00edlateli rozpoznateln\u00fd rozumn\u00fdm a vhodn\u00fdm zp\u016fsobem).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zverejneni_stavu_provadeni_odstraneni\"><\/span>Zve\u0159ejn\u011bn\u00ed stavu prov\u00e1d\u011bn\u00ed odstran\u011bn\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>&#8220;Velk\u00fdm platformn\u00edm oper\u00e1tor\u016fm&#8221; poru\u0161\u00ed povinnosti (\u010dl\u00e1nky 22, 24 a\u017e 28), m\u016f\u017ee ministr pro ve\u0159ejnou spr\u00e1vu a telekomunikace doporu\u010dit, aby byla p\u0159ijata nezbytn\u00e1 opat\u0159en\u00ed k n\u00e1prav\u011b tohoto poru\u0161en\u00ed.<\/p>\n\n\n\n<p>Pokud nejsou opat\u0159en\u00ed souvisej\u00edc\u00ed s doporu\u010den\u00edm p\u0159ijata, ministr m\u016f\u017ee vyd\u00e1t p\u0159\u00edkaz k jejich proveden\u00ed (\u010dl\u00e1nky 30 a 31).<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b poru\u0161en\u00ed tohoto p\u0159\u00edkazu k opat\u0159en\u00ed m\u016f\u017ee b\u00fdt ulo\u017een trest odn\u011bt\u00ed svobody a\u017e na jeden rok nebo pokuta do v\u00fd\u0161e 1 milionu jen\u016f (\u010dl\u00e1nek 35).<\/p>\n\n\n\n<p>Nav\u00edc, &#8220;velk\u00fd provozovatel platformy&#8221;
