Zejm\u00e9na kv\u016fli historick\u00e9mu v\u00fdvoji, kter\u00fd p\u0159edpokl\u00e1dal do\u017eivotn\u00ed zam\u011bstn\u00e1n\u00ed, je zde siln\u011b zako\u0159en\u011bn\u00e1 my\u0161lenka ochrany zam\u011bstnance, a proto je v\u00fdkon pr\u00e1va zam\u011bstnavatele na propu\u0161t\u011bn\u00ed podroben vysok\u00fdm n\u00e1rok\u016fm. Porozum\u011bn\u00ed tomuto pr\u00e1vn\u00edmu r\u00e1mci je nezbytnou sou\u010d\u00e1st\u00ed \u0159\u00edzen\u00ed rizik p\u0159i podnik\u00e1n\u00ed v Japonsku. Japonsk\u00fd z\u00e1kon o pracovn\u00edch smlouv\u00e1ch stanov\u00ed, \u017ee propu\u0161t\u011bn\u00ed je neplatn\u00e9, pokud &#8220;chyb\u00ed objektivn\u011b rozumn\u00fd d\u016fvod a nen\u00ed pova\u017eov\u00e1no za p\u0159im\u011b\u0159en\u00e9 podle spole\u010densk\u00fdch norem&#8221;. Toto je zn\u00e1m\u00e9 jako &#8220;pr\u00e1vn\u00ed princip zneu\u017eit\u00ed pr\u00e1va na propu\u0161t\u011bn\u00ed&#8221; a p\u0159edstavuje kl\u00ed\u010dov\u00fd princip p\u0159i posuzov\u00e1n\u00ed platnosti propu\u0161t\u011bn\u00ed. Tento princip zkoum\u00e1 opr\u00e1vn\u011bnost d\u016fvod\u016f pro propu\u0161t\u011bn\u00ed samotn\u00e9ho (substantivn\u00ed omezen\u00ed). Krom\u011b toho, japonsk\u00fd z\u00e1kon o pracovn\u00edch standardech stanovuje konkr\u00e9tn\u00ed regulace t\u00fdkaj\u00edc\u00ed se postupu p\u0159i propu\u0161t\u011bn\u00ed (procedur\u00e1ln\u00ed omezen\u00ed), zejm\u00e9na povinnost 30denn\u00edho p\u0159edchoz\u00edho upozorn\u011bn\u00ed nebo platby n\u00e1hrady m\u00edsto toho. V japonsk\u00e9m pracovn\u00edm pr\u00e1vu se term\u00ednem \u201epropu\u0161t\u011bn\u00ed\u201c rozum\u00ed akt ukon\u010den\u00ed pracovn\u00ed smlouvy jednostrann\u00fdm prohl\u00e1\u0161en\u00edm zam\u011bstnavatele<sup><\/sup>. To je jasn\u011b odli\u0161n\u00e9 od \u201edohodnut\u00e9ho ukon\u010den\u00ed pracovn\u00edho pom\u011bru\u201c, kdy je smlouva ukon\u010dena dohodou mezi zam\u011bstnancem a zam\u011bstnavatelem, nebo od \u201edobrovoln\u00e9ho odchodu\u201c, kdy zam\u011bstnanec odch\u00e1z\u00ed ze zam\u011bstn\u00e1n\u00ed z vlastn\u00ed v\u016fle.<\/p>\n\n\n\n<p>V praxi se propou\u0161t\u011bn\u00ed klasifikuje do t\u0159\u00ed hlavn\u00edch kategori\u00ed podle d\u016fvod\u016f.<\/p>\n\n\n\n<p>Prvn\u00ed kategori\u00ed je \u201eb\u011b\u017en\u00e9 propou\u0161t\u011bn\u00ed\u201c. To se t\u00fdk\u00e1 propou\u0161t\u011bn\u00ed z d\u016fvod\u016f na stran\u011b zam\u011bstnance, jako je nedostate\u010dn\u00e1 kvalifikace, \u0161patn\u00e9 pracovn\u00ed v\u00fdsledky, nedostatek t\u00fdmov\u00e9ho ducha nebo sn\u00ed\u017een\u00ed pracovn\u00ed schopnosti v d\u016fsledku nemoci \u010di zran\u011bn\u00ed<sup><\/sup>. Tento \u010dl\u00e1nek se prim\u00e1rn\u011b zam\u011b\u0159uje na pr\u00e1vn\u00ed omezen\u00ed t\u00fdkaj\u00edc\u00ed se pr\u00e1v\u011b b\u011b\u017en\u00e9ho propou\u0161t\u011bn\u00ed.<\/p>\n\n\n\n<p>Druhou kategori\u00ed je \u201edisciplin\u00e1rn\u00ed propou\u0161t\u011bn\u00ed\u201c. To nast\u00e1v\u00e1, kdy\u017e zam\u011bstnanec sp\u00e1ch\u00e1 v\u00e1\u017en\u00e9 poru\u0161en\u00ed discipl\u00edny, kter\u00e9 v\u00fdrazn\u011b naru\u0161uje po\u0159\u00e1dek ve firm\u011b (nap\u0159\u00edklad zpronev\u011bra v pracovn\u00edch z\u00e1le\u017eitostech nebo v\u00e1\u017en\u00e9 p\u0159\u00edpady obt\u011b\u017eov\u00e1n\u00ed)<sup><\/sup>. Disciplin\u00e1rn\u00ed propou\u0161t\u011bn\u00ed je, vzhledem ke sv\u00e9 povaze, podrobeno je\u0161t\u011b p\u0159\u00edsn\u011bj\u0161\u00edmu posouzen\u00ed platnosti ne\u017e b\u011b\u017en\u00e9 propou\u0161t\u011bn\u00ed.<\/p>\n\n\n\n<p>T\u0159et\u00ed kategori\u00ed je \u201epropou\u0161t\u011bn\u00ed z organiza\u010dn\u00edch d\u016fvod\u016f\u201c. To se vztahuje na propou\u0161t\u011bn\u00ed z d\u016fvodu nutnosti sn\u00ed\u017een\u00ed po\u010dtu zam\u011bstnanc\u016f, kter\u00e9 je zp\u016fsobeno nap\u0159\u00edklad ekonomick\u00fdmi pot\u00ed\u017eemi podniku<sup><\/sup>. Vzhledem k tomu, \u017ee za propou\u0161t\u011bn\u00ed z organiza\u010dn\u00edch d\u016fvod\u016f nem\u016f\u017ee zam\u011bstnanec, je posouzen\u00ed jeho platnosti podm\u00edn\u011bno zvl\u00e1\u0161tn\u00edmi a p\u0159\u00edsn\u00fdmi krit\u00e9rii, av\u0161ak toto nebude p\u0159edm\u011btem tohoto \u010dl\u00e1nku.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Substantivni_omezeni_propousteni_Pravni_princip_zneuziti_prava_na_propusteni\"><\/span>Substantivn\u00ed omezen\u00ed propou\u0161t\u011bn\u00ed: Pr\u00e1vn\u00ed princip zneu\u017eit\u00ed pr\u00e1va na propu\u0161t\u011bn\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>J\u00e1drem japonsk\u00e9 regulace propou\u0161t\u011bn\u00ed je &#8220;pr\u00e1vn\u00ed princip zneu\u017eit\u00ed pr\u00e1va na propu\u0161t\u011bn\u00ed&#8221;. Tento princip byl vytvo\u0159en na z\u00e1klad\u011b dlouholet\u00e9 akumulace soudn\u00edch rozhodnut\u00ed a je nyn\u00ed kodifikov\u00e1n v \u010dl\u00e1nku 16 japonsk\u00e9ho z\u00e1kona o pracovn\u00edch smlouv\u00e1ch (Labor Contract Act). Tento \u010dl\u00e1nek stanov\u00ed, \u017ee &#8220;propu\u0161t\u011bn\u00ed je neplatn\u00e9, pokud objektivn\u011b postr\u00e1d\u00e1 rozumn\u00fd d\u016fvod a nen\u00ed pova\u017eov\u00e1no za p\u0159im\u011b\u0159en\u00e9 podle spole\u010densk\u00fdch norem, a t\u00edm doch\u00e1z\u00ed k zneu\u017eit\u00ed pr\u00e1va&#8221;. Tento ustanoven\u00ed ukazuje, \u017ee aby bylo propu\u0161t\u011bn\u00ed uzn\u00e1no za platn\u00e9, mus\u00ed spl\u0148ovat ob\u011b krit\u00e9ria: &#8220;objektivn\u011b rozumn\u00fd d\u016fvod&#8221; a &#8220;p\u0159im\u011b\u0159enost podle spole\u010densk\u00fdch norem&#8221;.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Objektivne_racionalni_duvody\"><\/span>Objektivn\u011b racion\u00e1ln\u00ed d\u016fvody<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>&#8220;Objektivn\u011b racion\u00e1ln\u00ed d\u016fvody&#8221; znamenaj\u00ed, \u017ee i z pohledu t\u0159et\u00ed strany je mo\u017en\u00e9 uznat, \u017ee dan\u00e9 propu\u0161t\u011bn\u00ed je opr\u00e1vn\u011bn\u00e9 a m\u00e1 platn\u00fd d\u016fvod <sup><\/sup>. Konkr\u00e9tn\u011b m\u016f\u017ee j\u00edt o nedostate\u010dn\u00e9 schopnosti nebo \u0161patn\u00e9 v\u00fdsledky pracovn\u00edka, \u0161patn\u00fd pracovn\u00ed postoj nebo poru\u0161en\u00ed povinnost\u00ed stanoven\u00fdch pracovn\u00ed smlouvou <sup><\/sup>. Existence t\u011bchto skute\u010dnost\u00ed v\u0161ak sama o sob\u011b neznamen\u00e1, \u017ee je propu\u0161t\u011bn\u00ed automaticky pova\u017eov\u00e1no za racion\u00e1ln\u00ed. Soudy pe\u010dliv\u011b zkoumaj\u00ed, zda zam\u011bstnavatel vyvinul dostate\u010dn\u00e9 \u00fasil\u00ed p\u0159edt\u00edm, ne\u017e p\u0159istoupil k propu\u0161t\u011bn\u00ed jako k posledn\u00edmu \u0159e\u0161en\u00ed.<\/p>\n\n\n\n<p>Jako p\u0159\u00edklad m\u016f\u017eeme uv\u00e9st p\u0159\u00edpad spole\u010dnosti IBM Japonsko (rozsudek Tokijsk\u00e9ho okresn\u00edho soudu ze dne 28. b\u0159ezna 2016) <sup><\/sup>. V tomto p\u0159\u00edpad\u011b byl dlouholet\u00fd zam\u011bstnanec propu\u0161t\u011bn z d\u016fvodu nedostate\u010dn\u00fdch schopnost\u00ed, ale soud rozhodl, \u017ee propu\u0161t\u011bn\u00ed je neplatn\u00e9. Jako d\u016fvod uvedl, \u017ee spole\u010dnost nedala zam\u011bstnanci dostate\u010dnou p\u0159\u00edle\u017eitost k zlep\u0161en\u00ed a nezv\u00e1\u017eila jin\u00e1 opat\u0159en\u00ed, jako je p\u0159e\u0159azen\u00ed do jin\u00e9ho odd\u011blen\u00ed, kter\u00e1 by propu\u0161t\u011bn\u00ed mohla p\u0159edej\u00edt <sup><\/sup>.<\/p>\n\n\n\n<p>Podobn\u011b p\u0159\u00edpad spole\u010dnosti Bloomberg L.P. (rozsudek Tokijsk\u00e9ho okresn\u00edho soudu ze dne 5. \u0159\u00edjna 2012) poskytuje d\u016fle\u017eit\u00e9 n\u00e1hledy <sup><\/sup>. V tomto p\u0159\u00edpad\u011b byl zam\u011bstnanec propu\u0161t\u011bn, proto\u017ee nedos\u00e1hl c\u00edl\u016f stanoven\u00fdch v pl\u00e1nu zlep\u0161en\u00ed v\u00fdkonu (Performance Improvement Plan, PIP). Soud v\u0161ak rozhodl, \u017ee propu\u0161t\u011bn\u00ed je neplatn\u00e9, proto\u017ee c\u00edle a pokyny stanoven\u00e9 spole\u010dnost\u00ed byly abstraktn\u00ed a zam\u011bstnanci nebyla poskytnuta dostate\u010dn\u00e1 podpora k pochopen\u00ed, co a jak konkr\u00e9tn\u011b m\u00e1 zlep\u0161it <sup><\/sup>.<\/p>\n\n\n\n<p>Z t\u011bchto p\u0159\u00edpad\u016f vypl\u00fdv\u00e1, \u017ee japonsk\u00e9 soudy fakticky ukl\u00e1daj\u00ed zam\u011bstnavatel\u016fm povinnost nejen pouk\u00e1zat na probl\u00e9my, ale tak\u00e9 aktivn\u011b podporovat zlep\u0161en\u00ed a hledat alternativn\u00ed \u0159e\u0161en\u00ed. O\u010dek\u00e1v\u00e1 se, \u017ee zam\u011bstnavatel\u00e9, kte\u0159\u00ed maj\u00ed \u0161irokou diskre\u010dn\u00ed pravomoc ohledn\u011b um\u00edst\u011bn\u00ed a povahy pr\u00e1ce zam\u011bstnanc\u016f, vynalo\u017e\u00ed \u00fasil\u00ed k vyhnut\u00ed se propu\u0161t\u011bn\u00edm. Propu\u0161t\u011bn\u00ed, kter\u00e9 prob\u011bhne bez zv\u00e1\u017een\u00ed alternativn\u00edch opat\u0159en\u00ed, jako je p\u0159e\u0159azen\u00ed nebo rekvalifikace, i kdy\u017e existuje fakt nedostate\u010dn\u00fdch schopnost\u00ed, m\u016f\u017ee b\u00fdt velmi pravd\u011bpodobn\u011b posouzeno jako postr\u00e1daj\u00edc\u00ed &#8220;objektivn\u011b racion\u00e1ln\u00ed d\u016fvody&#8221;.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Spolecenska_primerenost_podle_obecnych_nazoru\"><\/span>Spole\u010densk\u00e1 p\u0159im\u011b\u0159enost podle obecn\u00fdch n\u00e1zor\u016f<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>I kdy\u017e m\u016f\u017ee b\u00fdt uzn\u00e1no, \u017ee existuje objektivn\u011b racion\u00e1ln\u00ed d\u016fvod pro propu\u0161t\u011bn\u00ed, pokud toto propu\u0161t\u011bn\u00ed nen\u00ed &#8220;spole\u010densky p\u0159im\u011b\u0159en\u00e9&#8221;, je st\u00e1le pova\u017eov\u00e1no za neplatn\u00e9. Jde o to, zda je propu\u0161t\u011bn\u00ed, jako opat\u0159en\u00ed, vyv\u00e1\u017een\u00e9 ve srovn\u00e1n\u00ed s v\u00e1\u017enost\u00ed sporn\u00e9ho jedn\u00e1n\u00ed nebo ud\u00e1losti, tedy zda nen\u00ed jako trest p\u0159\u00edli\u0161 tvrd\u00e9.<\/p>\n\n\n\n<p>Soudy p\u0159i posuzov\u00e1n\u00ed spole\u010densk\u00e9 p\u0159im\u011b\u0159enosti zohled\u0148uj\u00ed r\u016fzn\u00e9 okolnosti v jejich celkov\u00e9m kontextu. Konkr\u00e9tn\u011b se jedn\u00e1 o povahu a zp\u016fsob sporn\u00e9ho jedn\u00e1n\u00ed, m\u00edru \u0161kody zp\u016fsoben\u00e9 spole\u010dnosti, p\u0159edchoz\u00ed pracovn\u00ed postoj a p\u0159\u00ednos zam\u011bstnance, p\u0159\u00edtomnost nebo absenci l\u00edtosti a rovn\u011b\u017e o vyv\u00e1\u017eenost s tresty ud\u011blen\u00fdmi ostatn\u00edm zam\u011bstnanc\u016fm v minulosti.<\/p>\n\n\n\n<p>Tento r\u00e1mec posouzen\u00ed byl stanoven v p\u0159\u00edpadu vys\u00edl\u00e1n\u00ed spole\u010dnosti Kochi (rozsudek Nejvy\u0161\u0161\u00edho soudu ze dne 31. ledna 1977 (1977)). V tomto p\u0159\u00edpad\u011b byl hlasatel propu\u0161t\u011bn za to, \u017ee zaspal a zp\u016fsobil tak vys\u00edlac\u00ed nehodu. A\u010dkoliv vys\u00edlac\u00ed nehoda m\u016f\u017ee b\u00fdt objektivn\u00edm d\u016fvodem pro propu\u0161t\u011bn\u00ed, Nejvy\u0161\u0161\u00ed soud zv\u00e1\u017eil, \u017ee 1) nehoda byla zp\u016fsobena nedbalost\u00ed a ne zl\u00fdm \u00famyslem, 2) \u010d\u00e1st zodpov\u011bdnosti nesli i jin\u00ed z\u00fa\u010dastn\u011bn\u00ed, 3) b\u011b\u017en\u00fd pracovn\u00ed postoj hlasatele byl dobr\u00fd, 4) byly zji\u0161t\u011bny nedostatky v \u0159\u00edd\u00edc\u00edm syst\u00e9mu spole\u010dnosti a 5) ve srovn\u00e1n\u00ed s podobn\u00fdmi p\u0159\u00edpady v minulosti bylo propu\u0161t\u011bn\u00ed ne\u00fam\u011brn\u011b tvrd\u00e9. Soud tedy rozhodl, \u017ee toto propu\u0161t\u011bn\u00ed bylo p\u0159\u00edli\u0161 krut\u00e9 a nebylo spole\u010densky p\u0159im\u011b\u0159en\u00e9, a proto ho ozna\u010dil za neplatn\u00e9.<\/p>\n\n\n\n<p>Na druh\u00e9 stran\u011b m\u016f\u017ee b\u00fdt posouzen\u00ed spole\u010densk\u00e9 p\u0159im\u011b\u0159enosti ovlivn\u011bno i velikost\u00ed podniku. V p\u0159\u00edpadu Negishi (rozsudek Tokijsk\u00e9ho vrchn\u00edho soudu ze dne 24. listopadu 2016 (2016)) byl zam\u011bstnanec propu\u0161t\u011bn, proto\u017ee jeho nespolupracuj\u00edc\u00ed chov\u00e1n\u00ed vedlo k tomu, \u017ee n\u011bkolik dal\u0161\u00edch zam\u011bstnanc\u016f na \u010d\u00e1ste\u010dn\u00fd \u00favazek dalo v\u00fdpov\u011b\u010f. Vrchn\u00ed soud rozhodl, \u017ee toto propu\u0161t\u011bn\u00ed bylo platn\u00e9. P\u0159i sv\u00e9m rozhodnut\u00ed soud kladl d\u016fraz na skute\u010dnost, \u017ee spole\u010dnost byla mal\u00fdm podnikem s pouh\u00fdmi n\u011bkolika zam\u011bstnanci a \u017ee \u0159e\u0161en\u00ed probl\u00e9mu prost\u0159ednictv\u00edm zm\u011bny pracovn\u00edho za\u0159azen\u00ed bylo v praxi obt\u00ed\u017en\u00e9. Tento p\u0159\u00edpad ukazuje, \u017ee i kdy\u017e by velk\u00e1 spole\u010dnost mohla b\u00fdt povinna se vyhnout propu\u0161t\u011bn\u00ed t\u00edm, \u017ee zam\u011bstnance p\u0159e\u0159ad\u00ed, u mal\u00fdch podnik\u016f mohou b\u00fdt alternativn\u00ed mo\u017enosti omezen\u00e9, a proto m\u016f\u017ee b\u00fdt propu\u0161t\u011bn\u00ed pova\u017eov\u00e1no za nevyhnuteln\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Porovnani_bezneho_a_disciplinarniho_propusteni_podle_japonskeho_pracovniho_prava\"><\/span>Porovn\u00e1n\u00ed b\u011b\u017en\u00e9ho a disciplin\u00e1rn\u00edho propu\u0161t\u011bn\u00ed podle japonsk\u00e9ho pracovn\u00edho pr\u00e1va<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Pro pochopen\u00ed pr\u00e1vn\u00edch omezen\u00ed b\u011b\u017en\u00e9ho propu\u0161t\u011bn\u00ed je z\u00e1sadn\u00ed rozli\u0161it ho od disciplin\u00e1rn\u00edho propu\u0161t\u011bn\u00ed. Ob\u011b situace vedou k ukon\u010den\u00ed pracovn\u00ed smlouvy, ale li\u0161\u00ed se v pr\u00e1vn\u00ed povaze, po\u017eadavc\u00edch a d\u016fsledc\u00edch.<\/p>\n\n\n\n<p>B\u011b\u017en\u00e9 propu\u0161t\u011bn\u00ed je ukon\u010den\u00ed smlouvy z d\u016fvodu nedostate\u010dn\u00e9 kvalifikace nebo \u0161patn\u00e9ho pracovn\u00edho chov\u00e1n\u00ed, co\u017e jsou p\u0159\u00edklady ne\u00fapln\u00e9ho pln\u011bn\u00ed povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch z pracovn\u00ed smlouvy (nedodr\u017een\u00ed smluvn\u00edch z\u00e1vazk\u016f). Na druh\u00e9 stran\u011b m\u00e1 disciplin\u00e1rn\u00ed propu\u0161t\u011bn\u00ed charakter sankce za v\u00e1\u017en\u00e9 poru\u0161en\u00ed firemn\u00edho \u0159\u00e1du.<\/p>\n\n\n\n<p>Z t\u011bchto rozd\u00edl\u016f vypl\u00fdv\u00e1 n\u011bkolik d\u016fle\u017eit\u00fdch odli\u0161nost\u00ed. Prvn\u00ed se t\u00fdk\u00e1 nutnosti m\u00edt z\u00e1klad v pracovn\u00edm \u0159\u00e1du. Disciplin\u00e1rn\u00ed propu\u0161t\u011bn\u00ed je sankce, a proto mus\u00ed b\u00fdt d\u016fvody pro disciplin\u00e1rn\u00ed opat\u0159en\u00ed a typy trest\u016f jasn\u011b stanoveny v pracovn\u00edm \u0159\u00e1du, aby bylo mo\u017en\u00e9 je uplatnit. Naopak u b\u011b\u017en\u00e9ho propu\u0161t\u011bn\u00ed teoreticky posta\u010d\u00ed, pokud pracovn\u00ed \u0159\u00e1d obsahuje obecn\u00e9 ustanoven\u00ed o d\u016fvodech pro propu\u0161t\u011bn\u00ed.<\/p>\n\n\n\n<p>Druh\u00fdm rozd\u00edlem je p\u0159\u00edsnost soudn\u00edho p\u0159ezkumu. Vzhledem k velk\u00e9 nev\u00fdhod\u011b, kterou disciplin\u00e1rn\u00ed propu\u0161t\u011bn\u00ed pro pracovn\u00edka p\u0159edstavuje, soudy aplikuj\u00ed teorii zneu\u017eit\u00ed pr\u00e1va na propu\u0161t\u011bn\u00ed je\u0161t\u011b p\u0159\u00edsn\u011bji ne\u017e v p\u0159\u00edpad\u011b b\u011b\u017en\u00e9ho propu\u0161t\u011bn\u00ed.<\/p>\n\n\n\n<p>T\u0159et\u00edm rozd\u00edlem je vliv na odstupn\u00e9. Podle tohoto \u010dl\u00e1nku mus\u00ed zam\u011bstnavatel v p\u0159\u00edpad\u011b, \u017ee se chyst\u00e1 zam\u011bstnance propustit, u\u010dinit ozn\u00e1men\u00ed alespo\u0148 30 dn\u00ed p\u0159edem.<\/p>\n\n\n\n<p>Pokud zam\u011bstnavatel neozn\u00e1m\u00ed propu\u0161t\u011bn\u00ed 30 dn\u00ed p\u0159edem, je povinen vyplatit odstupn\u00e9 ve v\u00fd\u0161i alespo\u0148 30denn\u00edho pr\u016fm\u011brn\u00e9ho platu (tzv. odstupn\u00e9 p\u0159i propu\u0161t\u011bn\u00ed). Je tak\u00e9 mo\u017en\u00e9 zkr\u00e1tit dobu ozn\u00e1men\u00ed, v takov\u00e9m p\u0159\u00edpad\u011b mus\u00ed zam\u011bstnavatel vyplatit odstupn\u00e9 za po\u010det dn\u00ed, kter\u00e9 chyb\u00ed do 30 dn\u016f. Nap\u0159\u00edklad, pokud bylo ozn\u00e1meno 10 dn\u00ed p\u0159edem, je nutn\u00e9 vyplatit odstupn\u00e9 za 20 dn\u00ed.<\/p>\n\n\n\n<p>Tato 30denn\u00ed lh\u016fta za\u010d\u00edn\u00e1 b\u011b\u017eet n\u00e1sleduj\u00edc\u00ed den po dni ozn\u00e1men\u00ed a zahrnuje i sv\u00e1tky. Krom\u011b toho je z praktick\u00fdch d\u016fvod\u016f a pro p\u0159edejit\u00ed probl\u00e9m\u016fm siln\u011b doporu\u010deno prov\u00e1d\u011bt ozn\u00e1men\u00ed o propu\u0161t\u011bn\u00ed formou p\u00edsemn\u00e9ho dokumentu (ozn\u00e1men\u00ed o propu\u0161t\u011bn\u00ed), kter\u00fd jasn\u011b uv\u00e1d\u00ed datum propu\u0161t\u011bn\u00ed a d\u016fvod propu\u0161t\u011bn\u00ed.<\/p>\n\n\n\n<p>Velmi d\u016fle\u017eit\u00e9 je, \u017ee dodr\u017een\u00ed tohoto postupu ozn\u00e1men\u00ed o propu\u0161t\u011bn\u00ed samo o sob\u011b neznamen\u00e1, \u017ee je propu\u0161t\u011bn\u00ed platn\u00e9. Syst\u00e9m ozn\u00e1men\u00ed o propu\u0161t\u011bn\u00ed m\u00e1 za c\u00edl poskytnout propou\u0161t\u011bn\u00e9mu zam\u011bstnanci \u010dasov\u00fd a finan\u010dn\u00ed prostor pro hled\u00e1n\u00ed nov\u00e9ho zam\u011bstn\u00e1n\u00ed a jedn\u00e1 se pouze o procedur\u00e1ln\u00ed regulaci. Platnost propu\u0161t\u011bn\u00ed samotn\u00e9ho je posuzov\u00e1na na z\u00e1klad\u011b podstatn\u00fdch po\u017eadavk\u016f uveden\u00fdch v \u010dl\u00e1nku 16 Japonsk\u00e9ho z\u00e1kona o pracovn\u00edch smlouv\u00e1ch, kter\u00e9 zahrnuj\u00ed &#8220;objektivn\u011b rozumn\u00fd d\u016fvod&#8221; a &#8220;p\u0159im\u011b\u0159enost podle spole\u010densk\u00fdch norem&#8221;. Proto i v p\u0159\u00edpad\u011b, \u017ee by zam\u011bstnavatel vyplatil cel\u00e9 odstupn\u00e9 a provedl okam\u017eit\u00e9 propu\u0161t\u011bn\u00ed, pokud propu\u0161t\u011bn\u00ed nem\u00e1 rozumn\u00fd d\u016fvod a p\u0159im\u011b\u0159enost, bude pova\u017eov\u00e1no za neplatn\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Poskytnuti_prilezitosti_k_vyjadreni\"><\/span>Poskytnut\u00ed p\u0159\u00edle\u017eitosti k vyj\u00e1d\u0159en\u00ed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>P\u0159i prov\u00e1d\u011bn\u00ed b\u011b\u017en\u00e9ho propu\u0161t\u011bn\u00ed nen\u00ed zam\u011bstnavatel z\u00e1konn\u011b povinen poskytnout dot\u010den\u00e9mu zam\u011bstnanci p\u0159\u00edle\u017eitost k vyj\u00e1d\u0159en\u00ed nebo obhajob\u011b (tzv. p\u0159\u00edle\u017eitost k vyj\u00e1d\u0159en\u00ed). V p\u0159\u00edpad\u011b disciplin\u00e1rn\u00edho propu\u0161t\u011bn\u00ed je nutn\u00e9 dodr\u017eet p\u0159edpisy uveden\u00e9 v pracovn\u00edm \u0159\u00e1du, pokud takov\u00e9 existuj\u00ed, a z hlediska spr\u00e1vn\u00e9ho postupu je p\u0159\u00edle\u017eitost k vyj\u00e1d\u0159en\u00ed pova\u017eov\u00e1na za d\u016fle\u017eitou, ale pro b\u011b\u017en\u00e9 propu\u0161t\u011bn\u00ed neexistuj\u00ed \u017e\u00e1dn\u00e9 p\u0159\u00edm\u00e9 z\u00e1konn\u00e9 p\u0159edpisy.<\/p>\n\n\n\n<p>Av\u0161ak ignorov\u00e1n\u00ed tohoto postupu kv\u016fli absenci z\u00e1konn\u00e9 povinnosti je velmi riskantn\u00ed. Soudy p\u0159i posuzov\u00e1n\u00ed &#8220;p\u0159im\u011b\u0159enosti podle spole\u010densk\u00fdch norem&#8221; propu\u0161t\u011bn\u00ed klade d\u016fraz na to, jak pe\u010dliv\u00fd proces zam\u011bstnavatel p\u0159i rozhodov\u00e1n\u00ed o tak z\u00e1va\u017en\u00e9 z\u00e1le\u017eitosti, jakou je propu\u0161t\u011bn\u00ed, dodr\u017eel. Pokud zam\u011bstnavatel rozhodne o propu\u0161t\u011bn\u00ed jednostrann\u011b bez poskytnut\u00ed p\u0159\u00edle\u017eitosti k vyj\u00e1d\u0159en\u00ed zam\u011bstnanci, m\u016f\u017ee to vytvo\u0159it dojem, \u017ee jednal nespravedliv\u011b a sv\u00e9voln\u011b.<\/p>\n\n\n\n<p>V d\u016fsledku toho m\u016f\u017ee nedostatek procedur\u00e1ln\u00edho zv\u00e1\u017een\u00ed, i kdy\u017e jsou d\u016fvody pro propu\u0161t\u011bn\u00ed do ur\u010dit\u00e9 m\u00edry objektivn\u00ed, v\u00e9st k tomu, \u017ee propu\u0161t\u011bn\u00ed bude pova\u017eov\u00e1no za neplatn\u00e9 kv\u016fli &#8220;nedostatku p\u0159im\u011b\u0159enosti podle spole\u010densk\u00fdch norem&#8221;. Proto je poskytnut\u00ed p\u0159\u00edle\u017eitosti k vyj\u00e1d\u0159en\u00ed, i kdy\u017e nen\u00ed z\u00e1konn\u011b explicitn\u011b vy\u017eadov\u00e1no, faktick\u00fdm po\u017eadavkem pro zaji\u0161t\u011bn\u00ed platnosti propu\u0161t\u011bn\u00ed, tedy &#8220;de facto po\u017eadavkem&#8221;, a je moudr\u00e9 prov\u00e1d\u011bt jej pe\u010dliv\u011b.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zaver\"><\/span>Z\u00e1v\u011br<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Jak bylo podrobn\u011b pops\u00e1no v tomto \u010dl\u00e1nku, propou\u0161t\u011bn\u00ed podle japonsk\u00e9ho pracovn\u00edho pr\u00e1va je p\u0159\u00edsn\u011b regulov\u00e1no jak z hlediska obsahu, tak z hlediska postupu. Aby zam\u011bstnavatel mohl zam\u011bstnance propustit, mus\u00ed dle \u010dl\u00e1nku 16 Japonsk\u00e9ho z\u00e1kon\u00edku pracovn\u00edch smluv prok\u00e1zat, \u017ee d\u016fvod je \u201eobjektivn\u011b rozumn\u00fd\u201c a \u017ee takov\u00e9 rozhodnut\u00ed je \u201espole\u010densky p\u0159ijateln\u00e9\u201c. Jak ukazuje anal\u00fdza soudn\u00edch p\u0159\u00edpad\u016f, tyto po\u017eadavky jsou velmi vysok\u00e9 a propou\u0161t\u011bn\u00ed je pova\u017eov\u00e1no za posledn\u00ed mo\u017enost. Krom\u011b toho je nutn\u00e9 dodr\u017eet procedur\u00e1ln\u00ed po\u017eadavky stanoven\u00e9 \u010dl\u00e1nkem 20 Japonsk\u00e9ho z\u00e1kon\u00edku pracovn\u00edch norem, kter\u00fd vy\u017eaduje ozn\u00e1men\u00ed o propu\u0161t\u011bn\u00ed nebo vyplacen\u00ed odstupn\u00e9ho. P\u0159esn\u00e9 porozum\u011bn\u00ed t\u011bmto pr\u00e1vn\u00edm r\u00e1m\u016fm a pe\u010dliv\u00e9 zv\u00e1\u017een\u00ed a reakce na jednotliv\u00e9 p\u0159\u00edpady je nezbytn\u00e9 pro vyhnut\u00ed se zbyte\u010dn\u00fdm pr\u00e1vn\u00edm spor\u016fm a pro dosa\u017een\u00ed stabiln\u00edho \u0159\u00edzen\u00ed pracovn\u00edch vztah\u016f.<\/p>\n\n\n\n<p>Pr\u00e1vnick\u00e1 kancel\u00e1\u0159 Monolith m\u00e1 hlubok\u00e9 odborn\u00e9 znalosti a bohat\u00e9 praktick\u00e9 zku\u0161enosti s japonsk\u00fdm pracovn\u00edm pr\u00e1vem.
