Tato definice je v\u00fdchoz\u00edm bodem pro ve\u0161kerou ochranu autorsk\u00fdch pr\u00e1v a z\u00e1kladn\u00edm p\u0159edpokladem pro ochranu d\u011bl v jednotliv\u00fdch kategori\u00edch, o kter\u00fdch bude \u0159e\u010d pozd\u011bji.<\/p>\n\n\n\n<p>Podle \u010dl\u00e1nku 2 odstavec 1 bod 1 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona se &#8220;d\u00edlo&#8221; definuje jako &#8220;n\u011bco, co tvo\u0159iv\u011b vyjad\u0159uje my\u0161lenky nebo city a pat\u0159\u00ed do oblasti literatury, v\u011bdy, um\u011bn\u00ed nebo hudby&#8221;. Tuto definici lze rozd\u011blit na \u010dty\u0159i kl\u00ed\u010dov\u00e9 prvky.<\/p>\n\n\n\n<p>Zaprv\u00e9 mus\u00ed obsahovat &#8220;my\u0161lenky nebo city&#8221;. To znamen\u00e1, \u017ee samotn\u00e9 fakty nebo data jsou z definice d\u00edla vylou\u010deny. Zadruh\u00e9 mus\u00ed b\u00fdt vyj\u00e1d\u0159eno &#8220;tvo\u0159iv\u011b&#8221;. &#8220;Tvo\u0159ivost&#8221; zde znamen\u00e1, \u017ee sta\u010d\u00ed, pokud je v d\u00edle n\u011bjak\u00fdm zp\u016fsobem reflektov\u00e1na osobnost autora, a nen\u00ed nutn\u011b vy\u017eadov\u00e1na novost nebo um\u011bleck\u00e1 vysp\u011blost. Zat\u0159et\u00ed mus\u00ed b\u00fdt &#8220;vyj\u00e1d\u0159eno&#8221;. To odr\u00e1\u017e\u00ed z\u00e1kladn\u00ed princip autorsk\u00e9ho pr\u00e1va, tzv. &#8220;dichotomii idea-v\u00fdraz&#8221;, kde je chr\u00e1n\u011bn konkr\u00e9tn\u00ed v\u00fdraz, zat\u00edmco samotn\u00e1 idea nebo koncept je mimo ochranu. Za\u010dtvrt\u00e9 mus\u00ed pat\u0159it do &#8220;oblasti literatury, v\u011bdy, um\u011bn\u00ed nebo hudby&#8221;. Tento rozsah je \u0161iroce interpretov\u00e1n a \u010dl\u00e1nek 10 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona uv\u00e1d\u00ed jako p\u0159\u00edklady d\u011bl rom\u00e1ny, hudbu, malby, architektonick\u00e1 d\u00edla atd.<\/p>\n\n\n\n<p>Definice &#8220;d\u00edla&#8221; nen\u00ed pouze form\u00e1ln\u00ed z\u00e1le\u017eitost\u00ed. Tvo\u0159ivost uspo\u0159\u00e1d\u00e1n\u00ed v redak\u010dn\u00edch d\u00edlech nebo tvo\u0159ivost adaptace v sekund\u00e1rn\u00edch d\u00edlech je tak\u00e9 posuzov\u00e1na podle tohoto krit\u00e9ria &#8220;n\u011bco, co tvo\u0159iv\u011b vyjad\u0159uje my\u0161lenky nebo city&#8221;. Nap\u0159\u00edklad seznam informac\u00ed se\u0159azen\u00fdch abecedn\u011b nen\u00ed chr\u00e1n\u011bn jako redak\u010dn\u00ed d\u00edlo, proto\u017ee v n\u011bm neexistuje &#8220;tvo\u0159iv\u00e9&#8221; uspo\u0159\u00e1d\u00e1n\u00ed, kter\u00e9 by odr\u00e1\u017eelo osobnost autora. Porozum\u011bn\u00ed tomuto z\u00e1kladn\u00edmu pojmu je prvn\u00edm krokem k p\u0159esn\u00e9mu pochopen\u00ed pr\u00e1vn\u00ed povahy odvozen\u00fdch d\u011bl.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ochrana_souboru_materialu_jako_dusevniho_vlastnictvi_Redakcni_dilo\"><\/span><a><\/a>Ochrana souboru materi\u00e1l\u016f jako du\u0161evn\u00edho vlastnictv\u00ed: Redak\u010dn\u00ed d\u00edlo<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Mnoho spole\u010dnost\u00ed shroma\u017e\u010fuje a organizuje obrovsk\u00e9 mno\u017estv\u00ed informac\u00ed b\u011bhem sv\u00e9ho podnik\u00e1n\u00ed. I kdy\u017e tyto informace samy o sob\u011b nemus\u00ed b\u00fdt autorsk\u00fdmi d\u00edly, jejich uspo\u0159\u00e1d\u00e1n\u00ed do ur\u010dit\u00e9ho celku s konkr\u00e9tn\u00edm \u00fa\u010delem m\u016f\u017ee vytvo\u0159it pr\u00e1vn\u011b chr\u00e1n\u011bn\u00e9 du\u0161evn\u00ed vlastnictv\u00ed. Toto je koncept &#8220;redak\u010dn\u00edho d\u00edla&#8221;.<\/p>\n\n\n\n<p>\u010cl\u00e1nek 12 odstavec 1 Japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona (Japanese Copyright Law) stanov\u00ed, \u017ee redak\u010dn\u00ed d\u00edla jsou &#8220;d\u00edla, kter\u00e1 maj\u00ed tv\u016fr\u010d\u00ed charakter d\u00edky v\u00fdb\u011bru nebo uspo\u0159\u00e1d\u00e1n\u00ed materi\u00e1lu (s v\u00fdjimkou t\u011bch, kter\u00e1 odpov\u00eddaj\u00ed datab\u00e1z\u00edm), a jsou chr\u00e1n\u011bna jako autorsk\u00e1 d\u00edla&#8221;. Kl\u00ed\u010dov\u00fdm bodem zde je, \u017ee p\u0159edm\u011btem ochrany nen\u00ed jednotliv\u00fd &#8220;materi\u00e1l&#8221;, ale &#8220;tv\u016fr\u010d\u00ed charakter v\u00fdb\u011bru nebo uspo\u0159\u00e1d\u00e1n\u00ed&#8221; materi\u00e1lu. Proto materi\u00e1l tvo\u0159\u00edc\u00ed redak\u010dn\u00ed d\u00edlo nemus\u00ed s\u00e1m o sob\u011b b\u00fdt autorsk\u00fdm d\u00edlem; m\u016f\u017ee se jednat o pouh\u00e1 fakta, data nebo dokonce o d\u00edla, kter\u00e1 js\u00ed ji\u017e ve ve\u0159ejn\u00e9m vlastnictv\u00ed po vypr\u0161en\u00ed doby ochrany autorsk\u00fdm pr\u00e1vem.<\/p>\n\n\n\n<p>V soudn\u00ed praxi je nesm\u00edrn\u011b d\u016fle\u017eit\u00e9, jak je tento &#8220;tv\u016fr\u010d\u00ed charakter v\u00fdb\u011bru nebo uspo\u0159\u00e1d\u00e1n\u00ed&#8221; materi\u00e1lu posuzov\u00e1n. Jako v\u016fd\u010d\u00ed p\u0159\u00edpad, kter\u00fd poskytuje sm\u011brnice, lze uv\u00e9st &#8220;P\u0159\u00edpad NTT Town Pages&#8221;. V tomto p\u0159\u00edpad\u011b soud uznal telefonn\u00ed seznam &#8220;Town Pages&#8221;, kter\u00fd je klasifikov\u00e1n podle povol\u00e1n\u00ed, jako redak\u010dn\u00ed d\u00edlo. Soud uznal tv\u016fr\u010d\u00ed charakter ne na z\u00e1klad\u011b jednotliv\u00fdch dat, jako jsou telefonn\u00ed \u010d\u00edsla nebo jm\u00e9na, ale na z\u00e1klad\u011b unik\u00e1tn\u00edho hierarchick\u00e9ho syst\u00e9mu klasifikace povol\u00e1n\u00ed, kter\u00fd byl navr\u017een s ohledem na pohodl\u00ed u\u017eivatel\u016f p\u0159i vyhled\u00e1v\u00e1n\u00ed. Tento syst\u00e9m klasifikace nebyl pouh\u00fdm mechanick\u00fdm uspo\u0159\u00e1d\u00e1n\u00edm, ale obsahoval &#8220;origin\u00e1ln\u00ed n\u00e1pad&#8221; zalo\u017een\u00fd na redak\u010dn\u00ed politice, a proto byl uzn\u00e1n jako maj\u00edc\u00ed tv\u016fr\u010d\u00ed charakter. Naopak telefonn\u00ed seznam &#8220;Hello Pages&#8221;, kter\u00fd byl se\u0159azen pouze podle abecedy, nebyl pova\u017eov\u00e1n za redak\u010dn\u00ed d\u00edlo, proto\u017ee jeho uspo\u0159\u00e1d\u00e1n\u00ed nevykazovalo tv\u016fr\u010d\u00ed charakter.<\/p>\n\n\n\n<p>Tento p\u0159\u00edpad poskytuje spole\u010dnostem d\u016fle\u017eit\u00e9 strategick\u00e9 n\u00e1hledy. I kdy\u017e shroma\u017e\u010fujete ve\u0159ejn\u011b dostupn\u00e1 data, jako jsou tr\u017en\u00ed statistiky nebo informace o z\u00e1kazn\u00edc\u00edch, kter\u00e1 sama o sob\u011b nejsou chr\u00e1n\u011bna, pokud je uspo\u0159\u00e1d\u00e1te a klasifikujete pomoc\u00ed origin\u00e1ln\u00edho pohledu nebo klasifika\u010dn\u00ed osy a vytvo\u0159\u00edte z nich u\u017eite\u010dn\u00fd soubor informac\u00ed, m\u016f\u017ee se tento soubor s\u00e1m o sob\u011b st\u00e1t &#8220;redak\u010dn\u00edm d\u00edlem&#8221; a t\u00edm nov\u00fdm chr\u00e1n\u011bn\u00fdm du\u0161evn\u00edm vlastnictv\u00edm. To znamen\u00e1, \u017ee nejen dr\u017een\u00ed dat, ale tak\u00e9 intelektu\u00e1ln\u00ed investice do jejich strukturov\u00e1n\u00ed m\u016f\u017ee vytvo\u0159it jedine\u010dn\u00fd majetek s konkuren\u010dn\u00ed v\u00fdhodou.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Informacni_akumulace_v_digitalni_ere_Databazova_dila_podle_japonskeho_autorskeho_prava\"><\/span><a><\/a>Informa\u010dn\u00ed akumulace v digit\u00e1ln\u00ed \u00e9\u0159e: Datab\u00e1zov\u00e1 d\u00edla podle japonsk\u00e9ho autorsk\u00e9ho pr\u00e1va<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Koncept redak\u010dn\u00edch d\u011bl adaptovan\u00fd pro digit\u00e1ln\u00ed \u00e9ru je &#8220;datab\u00e1zov\u00e9 d\u00edlo&#8221;. V dob\u011b, kdy se vyhled\u00e1v\u00e1n\u00ed a vyu\u017e\u00edv\u00e1n\u00ed informac\u00ed pomoc\u00ed po\u010d\u00edta\u010d\u016f stalo b\u011b\u017en\u00e9, japonsk\u00e9 autorsk\u00e9 pr\u00e1vo zavedlo speci\u00e1ln\u00ed ustanoven\u00ed na ochranu datab\u00e1z\u00ed.<\/p>\n\n\n\n<p>\u010cl\u00e1nek 12 odstavec 2 bod 1 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona stanov\u00ed, \u017ee &#8220;datab\u00e1ze, kter\u00e1 m\u00e1 tv\u016fr\u010d\u00ed charakter d\u00edky v\u00fdb\u011bru informac\u00ed nebo jejich systematick\u00e9mu uspo\u0159\u00e1d\u00e1n\u00ed, je chr\u00e1n\u011bna jako autorsk\u00e9 d\u00edlo&#8221;. D\u00e1le \u010dl\u00e1nek 2 odstavec 1 bod 10 \u010d\u00edslo 3 definuje &#8220;datab\u00e1zi&#8221; jako &#8220;soubor informac\u00ed, jako jsou texty, \u010d\u00edsla, grafy a dal\u0161\u00ed, kter\u00e9 jsou systematicky uspo\u0159\u00e1d\u00e1ny tak, aby bylo mo\u017en\u00e9 je vyhled\u00e1vat pomoc\u00ed elektronick\u00e9ho po\u010d\u00edta\u010de&#8221;. Stejn\u011b jako u redak\u010dn\u00edch d\u011bl nen\u00ed p\u0159edm\u011btem ochrany jednotliv\u00e1 informace, ale struktura jako celek. U datab\u00e1zov\u00fdch d\u011bl v\u0161ak zvl\u00e1\u0161t\u011b p\u0159i po\u010d\u00edta\u010dov\u00e9m vyhled\u00e1v\u00e1n\u00ed z\u00e1le\u017e\u00ed na &#8220;systematick\u00e9m uspo\u0159\u00e1d\u00e1n\u00ed&#8221; a jeho tv\u016fr\u010d\u00edm charakteru.<\/p>\n\n\n\n<p>V tomto ohledu je velmi d\u016fle\u017eit\u00fdm precedensem v historii japonsk\u00fdch soud\u016f &#8220;p\u0159\u00edpad datab\u00e1ze syst\u00e9mu Tsubasa&#8221;. Tento p\u0159\u00edpad p\u0159inesl pozoruhodn\u00e1 rozhodnut\u00ed ve dvou aspektech. Za prv\u00e9, byla to negace ochrany podle autorsk\u00e9ho pr\u00e1va. Tokijsk\u00fd okresn\u00ed soud ve sv\u00e9m rozhodnut\u00ed z roku 2002 (Heisei 14) uvedl, \u017ee v\u00fdb\u011br informac\u00ed a jejich systematick\u00e9 uspo\u0159\u00e1d\u00e1n\u00ed v datab\u00e1zi \u017ealobce, kter\u00e1 obsahovala \u00fadaje o d\u00edlech a specifikac\u00edch automobil\u016f, bylo b\u011b\u017en\u00e9 a vypl\u00fdvalo z pot\u0159eb pr\u016fmyslu, a proto postr\u00e1dalo tv\u016fr\u010d\u00ed charakter vy\u017eadovan\u00fd autorsk\u00fdm pr\u00e1vem, a zam\u00edtl tak autorskopr\u00e1vn\u00ed povahu datab\u00e1ze.<\/p>\n\n\n\n<p>Av\u0161ak soudn\u00ed rozhodnut\u00ed t\u00edm neskon\u010dilo. Za druh\u00e9, byla to ustanoven\u00ed ochrany na z\u00e1klad\u011b deliktu podle japonsk\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku. I kdy\u017e soud neuznal poru\u0161en\u00ed autorsk\u00fdch pr\u00e1v, rozhodl, \u017ee \u010dinnost \u017ealovan\u00e9ho, kter\u00fd kompletn\u011b kop\u00edroval (tzv. dead copy) datab\u00e1zi \u017ealobce, p\u0159edstavuje delikt podle \u010dl\u00e1nku 709 japonsk\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku. Jako d\u016fvod soud uvedl, \u017ee \u017ealobce investoval do vytvo\u0159en\u00ed a udr\u017eov\u00e1n\u00ed datab\u00e1ze v\u00edce ne\u017e 500 milion\u016f jen\u016f a velk\u00e9 \u00fasil\u00ed, a i kdy\u017e datab\u00e1ze nen\u00ed autorsk\u00fdm d\u00edlem, p\u0159edstavuje &#8220;obchodn\u00ed z\u00e1jem hodn\u00fd pr\u00e1vn\u00ed ochrany&#8221;. Soud d\u00e1le uvedl, \u017ee kdy\u017e \u017ealovan\u00fd, kter\u00fd byl v konkuren\u010dn\u00edm vztahu, kop\u00edroval datab\u00e1zi a vyu\u017e\u00edval ji pro sv\u00e9 podnik\u00e1n\u00ed bez investice, jednalo se o &#8220;v\u00fdrazn\u011b nespravedliv\u00fd zp\u016fsob&#8221;, kter\u00fd po\u0161kozuje principy spravedliv\u00e9 sout\u011b\u017ee a zasahuje do z\u00e1jm\u016f \u017ealobce.<\/p>\n\n\n\n<p>Toto rozhodnut\u00ed je pr\u016flomov\u00e9 v tom, \u017ee ukazuje, \u017ee japonsk\u00fd pr\u00e1vn\u00ed syst\u00e9m poskytuje jak\u00fdsi bezpe\u010dnostn\u00ed s\u00ed\u0165 v podob\u011b z\u00e1kona o deliktech pro datab\u00e1ze, kter\u00e9 nemaj\u00ed autorskopr\u00e1vn\u00ed ochranu kv\u016fli nedostatku tv\u016fr\u010d\u00edho charakteru, ale maj\u00ed komer\u010dn\u00ed hodnotu. Filmov\u00e9 adaptace rom\u00e1n\u016f, p\u0159eklady cizojazy\u010dn\u00e9 literatury nebo aran\u017em\u00e1 hudebn\u00edch skladeb jsou typick\u00fdmi p\u0159\u00edklady, jak na z\u00e1klad\u011b existuj\u00edc\u00edch autorsk\u00fdch d\u011bl vytv\u00e1\u0159et nov\u00e9 hodnoty. Japonsk\u00fd autorsk\u00fd z\u00e1kon chr\u00e1n\u00ed takov\u00e1 d\u00edla jako &#8220;sekund\u00e1rn\u00ed autorsk\u00e1 d\u00edla&#8221;.<\/p>\n\n\n\n<p>Podle \u010dl\u00e1nku 2 odstavce 1 bodu 11 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona jsou sekund\u00e1rn\u00ed autorsk\u00e1 d\u00edla definov\u00e1na jako &#8220;d\u00edla vytvo\u0159en\u00e1 p\u0159ekladem, aran\u017eov\u00e1n\u00edm, zm\u011bnou nebo dramatizac\u00ed, filmov\u00e1n\u00edm nebo jin\u00fdm zp\u016fsobem adaptace autorsk\u00e9ho d\u00edla&#8221;. P\u016fvodn\u00ed autorsk\u00e9 d\u00edlo se naz\u00fdv\u00e1 &#8220;prim\u00e1rn\u00ed autorsk\u00e9 d\u00edlo&#8221;. Aby bylo sekund\u00e1rn\u00ed autorsk\u00e9 d\u00edlo chr\u00e1n\u011bno, mus\u00ed obsahovat n\u011bco v\u00edc ne\u017e pouhou napodobeninu nebo mechanickou reprodukci prim\u00e1rn\u00edho d\u00edla; je nutn\u00e9 p\u0159idat nov\u00fd tv\u016fr\u010d\u00ed v\u00fdraz.<\/p>\n\n\n\n<p>Z pr\u00e1vn\u00edho hlediska je nejd\u016fle\u017eit\u011bj\u0161\u00ed ot\u00e1zkou krit\u00e9rium, kter\u00e9 odli\u0161uje leg\u00e1ln\u00ed sekund\u00e1rn\u00ed autorsk\u00e1 d\u00edla od neleg\u00e1ln\u00edho poru\u0161en\u00ed autorsk\u00fdch pr\u00e1v (napodobeniny bez tv\u016fr\u010d\u00edho charakteru nebo adaptace). Toto krit\u00e9rium je hluboce spojeno se z\u00e1kladn\u00edm principem, \u017ee autorsk\u00e9 pr\u00e1vo chr\u00e1n\u00ed vyj\u00e1d\u0159en\u00ed, nikoli my\u0161lenky. P\u0159itom stanovil krit\u00e9rium, \u017ee adaptace je p\u0159\u00edpad, &#8220;kdy je na z\u00e1klad\u011b existuj\u00edc\u00edho autorsk\u00e9ho d\u00edla zachov\u00e1na jeho podstatn\u00e1 v\u00fdrazov\u00e1 charakteristika&#8230; a osoba, kter\u00e1 se s n\u00edm setk\u00e1v\u00e1, m\u016f\u017ee p\u0159\u00edmo vn\u00edmat podstatn\u00e9 v\u00fdrazov\u00e9 charakteristiky existuj\u00edc\u00edho d\u00edla&#8221;.<\/p>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed soud analyzoval spole\u010dn\u00e9 prvky obou d\u011bl a dosp\u011bl k z\u00e1v\u011bru, \u017ee popisy historick\u00fdch fakt\u016f nebo my\u0161lenky a inspirace na \u00farovni &#8220;nejru\u0161n\u011bj\u0161\u00ed obdob\u00ed ve m\u011bst\u011b je ro\u010dn\u00ed festival lidov\u00fdch p\u00edsn\u00ed&#8221; nejsou &#8220;vyj\u00e1d\u0159en\u00edm&#8221;, kter\u00e9 by bylo p\u0159edm\u011btem ochrany podle autorsk\u00e9ho pr\u00e1va. Soud se zam\u011b\u0159il na konkr\u00e9tn\u00ed jazykov\u00e9 vyj\u00e1d\u0159en\u00ed pou\u017eit\u00e9 k vyj\u00e1d\u0159en\u00ed t\u011bchto spole\u010dn\u00fdch my\u0161lenek a dosp\u011bl k z\u00e1v\u011bru, \u017ee zat\u00edmco d\u00edlo spisovatele pou\u017e\u00edvalo poetick\u00e9 a liter\u00e1rn\u00ed vyj\u00e1d\u0159en\u00ed, televizn\u00ed program pou\u017e\u00edval p\u0159\u00edm\u011bj\u0161\u00ed a fakti\u010dt\u011bj\u0161\u00ed vyj\u00e1d\u0159en\u00ed, a mezi ob\u011bma neexistovala podstatn\u00e1 shoda v &#8220;podstatn\u00fdch v\u00fdrazov\u00fdch charakteristik\u00e1ch&#8221;.<\/p>\n\n\n\n<p>Toto rozhodnut\u00ed nejvy\u0161\u0161\u00edho soudu nastavilo vysokou la\u0165ku pro zji\u0161t\u011bn\u00ed poru\u0161en\u00ed pr\u00e1va na adaptaci a z\u00e1rove\u0148 zaru\u010dilo svobodu tvorby nov\u00fdch d\u011bl na z\u00e1klad\u011b my\u0161lenek a fakt\u016f prezentovan\u00fdch v p\u0159edchoz\u00edch d\u00edlech. Tento \u010dl\u00e1nek stanov\u00ed, \u017ee &#8220;p\u016fvodn\u00ed autor d\u00edla m\u00e1 v\u00fdhradn\u00ed pr\u00e1va stejn\u00e9ho druhu jako autor sekund\u00e1rn\u00edho d\u00edla v souvislosti s vyu\u017e\u00edv\u00e1n\u00edm sekund\u00e1rn\u00edho d\u00edla&#8230;&#8221;. Praktick\u00fdm d\u016fsledkem t\u00e9to ustanoven\u00ed je, \u017ee pro vyu\u017eit\u00ed sekund\u00e1rn\u00edho d\u00edla je obvykle nutn\u00fd souhlas obou stran, tedy souhlas autora sekund\u00e1rn\u00edho d\u00edla a souhlas p\u016fvodn\u00edho autora. Nap\u0159\u00edklad p\u0159i prom\u00edt\u00e1n\u00ed filmu (sekund\u00e1rn\u00ed d\u00edlo), kter\u00fd je adaptac\u00ed rom\u00e1nu (p\u016fvodn\u00ed d\u00edlo), je t\u0159eba z\u00edskat nejen souhlas filmov\u00e9ho producenta, ale tak\u00e9 souhlas autora p\u016fvodn\u00edho rom\u00e1nu.<\/p>\n\n\n\n<p>Jak\u00fd je tedy rozsah pr\u00e1v p\u016fvodn\u00edho autora a autora sekund\u00e1rn\u00edho d\u00edla? Rozhoduj\u00edc\u00ed v\u00fdklad t\u00e9to slo\u017eit\u00e9 ot\u00e1zky pr\u00e1v poskytl Nejvy\u0161\u0161\u00ed soud v roce 1997 ve sv\u00e9m rozhodnut\u00ed ve v\u011bci &#8220;Popeye Necktie&#8221;. V t\u00e9to kauze byla p\u0159edm\u011btem sporu dlouhodob\u011b vytv\u00e1\u0159en\u00e1 s\u00e9rie komiks\u016f &#8220;Popeye&#8221; a vztah mezi pozd\u011bji nakreslen\u00fdmi komiksy a p\u016fvodn\u00edmi d\u00edly.<\/p>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed soud rozhodl, \u017ee pozd\u011bj\u0161\u00ed komiksy jsou sekund\u00e1rn\u00edmi d\u00edly p\u016fvodn\u00edch komiks\u016f a ohledn\u011b rozsahu pr\u00e1v uvedl n\u00e1sleduj\u00edc\u00ed: &#8220;Autorsk\u00e1 pr\u00e1va k sekund\u00e1rn\u00edmu d\u00edlu vznikaj\u00ed pouze v nov\u011b p\u0159idan\u00e9 kreativn\u00ed \u010d\u00e1sti sekund\u00e1rn\u00edho d\u00edla a nevznikaj\u00ed v \u010d\u00e1stech, kter\u00e9 jsou spole\u010dn\u00e9 s p\u016fvodn\u00edm d\u00edlem a maj\u00ed stejnou podstatu.&#8221;<\/p>\n\n\n\n<p>Toto rozhodnut\u00ed objasnilo, \u017ee pr\u00e1va p\u016fvodn\u00edho autora a autora sekund\u00e1rn\u00edho d\u00edla nejsou slou\u010dena, ale existuj\u00ed ve v\u00edcevrstv\u00e9m uspo\u0159\u00e1d\u00e1n\u00ed. Tento princip m\u00e1 velk\u00fd vliv na praxi licen\u010dn\u00edch smluv.
