Av\u0161ak jeho uplat\u0148ov\u00e1n\u00ed m\u016f\u017ee b\u00fdt slo\u017eit\u00e9 v oblastech, kde se prol\u00ednaj\u00ed um\u011bn\u00ed, obchod a ve\u0159ejn\u00e9 informace. Pro spole\u010dnosti zapojen\u00e9 do designu produkt\u016f, budov\u00e1n\u00ed zna\u010dek a tvorby obsahu je z\u00e1sadn\u00ed porozum\u011bt t\u011bmto specifick\u00fdm &#8216;\u0161ed\u00fdm z\u00f3n\u00e1m&#8217; v r\u00e1mci japonsk\u00e9ho autorsk\u00e9ho pr\u00e1va, aby mohly chr\u00e1nit sv\u016fj intelektu\u00e1ln\u00ed majetek a z\u00e1rove\u0148 se vyhnout pr\u00e1vn\u00edm rizik\u016fm. Za druh\u00e9 je to ochrana &#8216;postav&#8217;, kter\u00e9 maj\u00ed v Japonsku jedine\u010dn\u00fd pr\u00e1vn\u00ed r\u00e1mec odli\u0161n\u00fd od mezin\u00e1rodn\u00edho ch\u00e1p\u00e1n\u00ed. T\u0159et\u00edm bodem je ot\u00e1zka &#8216;p\u00edsma&#8217; (font design), kter\u00e9 je obvykle vylou\u010deno z ochrany autorsk\u00fdm pr\u00e1vem. V japonsk\u00e9m pr\u00e1vu du\u0161evn\u00edho vlastnictv\u00ed to vytv\u00e1\u0159\u00ed z\u00e1kladn\u00ed nap\u011bt\u00ed, proto\u017ee tyto p\u0159edm\u011bty mohou b\u00fdt chr\u00e1n\u011bny jak japonsk\u00fdm autorsk\u00fdm pr\u00e1vem, tak japonsk\u00fdm z\u00e1konem o designu. Japonsk\u00fd z\u00e1kon o designu m\u00e1 za c\u00edl chr\u00e1nit estetick\u00fd vzhled pr\u016fmyslov\u011b vyr\u00e1b\u011bn\u00fdch produkt\u016f a vy\u017eaduje registraci pro ochranu, p\u0159i\u010dem\u017e doba trv\u00e1n\u00ed ochrany je krat\u0161\u00ed ne\u017e u autorsk\u00fdch pr\u00e1v. Pr\u00e1v\u011b prol\u00edn\u00e1n\u00ed t\u011bchto dvou z\u00e1kon\u016f bylo v centru diskuse o autorsk\u00e9 ochran\u011b u\u017eit\u00e9ho um\u011bn\u00ed.<\/p>\n\n\n\n<p>Historicky japonsk\u00e9 soudy aplikovaly na autorskou ochranu u\u017eit\u00e9ho um\u011bn\u00ed p\u0159\u00edsn\u00e1 krit\u00e9ria, \u010dasto ozna\u010dovan\u00e1 jako &#8220;teorie rovnocennosti s \u010dist\u00fdm um\u011bn\u00edm&#8221;. Podle tohoto krit\u00e9ria mus\u00ed m\u00edt u\u017eit\u00e9 um\u011bleck\u00e9 p\u0159edm\u011bty, aby byly chr\u00e1n\u011bny jako &#8220;um\u011bleck\u00e1 d\u00edla&#8221; podle \u010dl\u00e1nku 2 odstavce 1 bodu 1 japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona, vysokou m\u00edru estetick\u00e9 kreativity, kter\u00e1 je nez\u00e1visl\u00e1 na jejich praktick\u00e9 funkci a umo\u017e\u0148uje je pova\u017eovat za objekty estetick\u00e9ho ocen\u011bn\u00ed jako \u010dist\u00e1 um\u011bleck\u00e1 d\u00edla. Tato vysok\u00e1 la\u0165ka znamenala, \u017ee v\u011bt\u0161ina pr\u016fmyslov\u00fdch design\u016f byla vylou\u010dena z ochrany autorsk\u00fdm pr\u00e1vem.<\/p>\n\n\n\n<p>Situace se v\u0161ak v\u00fdrazn\u011b zm\u011bnila po rozhodnut\u00ed Nejvy\u0161\u0161\u00edho soudu pro du\u0161evn\u00ed vlastnictv\u00ed z roku 2015 ve zn\u00e1m\u00e9m p\u0159\u00edpadu d\u011btsk\u00e9 \u017eidle &#8220;TRIPP TRAPP&#8221;. Soud rozhodl, \u017ee by se nem\u011bla automaticky aplikovat vysok\u00e1 kreativn\u00ed krit\u00e9ria na u\u017eit\u00e9 um\u011bn\u00ed. M\u00edsto toho by m\u011blo b\u00fdt pou\u017eito obecn\u00e9 krit\u00e9rium pro posouzen\u00ed autorsk\u00e9ho d\u00edla, tedy zda je v n\u011bm vyj\u00e1d\u0159ena &#8220;individualita&#8221; tv\u016frce. Nav\u00edc soud jasn\u011b uvedl, \u017ee mo\u017enost ochrany podle japonsk\u00e9ho z\u00e1kona o designu nen\u00ed racion\u00e1ln\u00edm d\u016fvodem pro aplikaci p\u0159\u00edsn\u011bj\u0161\u00edch krit\u00e9ri\u00ed podle japonsk\u00e9ho autorsk\u00e9ho z\u00e1kona. D\u016fvodem je, \u017ee oba z\u00e1kony maj\u00ed r\u016fzn\u00e9 \u00fa\u010dely. Toto rozhodnut\u00ed nazna\u010duje, \u017ee tradi\u010dn\u00ed role soudnictv\u00ed se posunula od &#8220;str\u00e1\u017ece&#8221; p\u0159\u00edsn\u011b odd\u011bluj\u00edc\u00edho oblasti designov\u00e9ho a autorsk\u00e9ho pr\u00e1va k v\u00edce praktick\u00e9 anal\u00fdze konkr\u00e9tn\u00edch p\u0159\u00edpad\u016f. To znamen\u00e1, \u017ee funk\u010dn\u00ed produkty ji\u017e nejsou automaticky vylou\u010deny z ochrany autorsk\u00fdm pr\u00e1vem.<\/p>\n\n\n\n<p>V sou\u010dasn\u00e9 interpretaci se \u010dasto zva\u017euje, zda lze estetick\u00e9 vlastnosti &#8220;odd\u011blit&#8221; od funk\u010dn\u00edch aspekt\u016f. Pokud jsou designov\u00e9 volby zcela d\u00e1ny funk\u010dn\u00edmi po\u017eadavky, kreativita nen\u00ed uzn\u00e1na. Pokud v\u0161ak estetick\u00e9 volby a individualita tv\u016frce p\u0159esahuj\u00ed funk\u010dn\u00ed nutnost, m\u016f\u017ee b\u00fdt d\u00edlu p\u0159izn\u00e1na autorsk\u00e1 ochrana. Tento p\u0159\u00edstup umo\u017e\u0148uje spole\u010dnostem realisti\u010dt\u011bj\u0161\u00ed mo\u017enost strategie dvoj\u00ed ochrany pomoc\u00ed designov\u00e9 registrace a autorsk\u00fdch pr\u00e1v, ale z\u00e1rove\u0148 p\u0159in\u00e1\u0161\u00ed i slo\u017eitost. V p\u0159\u00edpadu TRIPP TRAPP byla autorsk\u00e1 ochrana \u017eidle uzn\u00e1na, ale n\u00e1rok na poru\u0161en\u00ed pr\u00e1v byl zam\u00edtnut kv\u016fli v\u00fdrazn\u00fdm struktur\u00e1ln\u00edm rozd\u00edl\u016fm mezi \u017eidl\u00ed a ob\u017ealovan\u00fdm produktem. To ukazuje, \u017ee i kdy\u017e je autorsk\u00e1 ochrana snadn\u011bji uzn\u00e1v\u00e1na, jej\u00ed rozsah m\u016f\u017ee b\u00fdt omezen na konkr\u00e9tn\u00ed kreativn\u00ed vyj\u00e1d\u0159en\u00ed a interpretov\u00e1n u\u017e\u0161\u00edm zp\u016fsobem. Kl\u00ed\u010dov\u00fdm pr\u00e1vn\u00edm principem je, \u017ee &#8220;postava&#8221; sama o sob\u011b nen\u00ed d\u00edlem chr\u00e1n\u011bn\u00fdm autorsk\u00fdm pr\u00e1vem. Pr\u00e1vo chr\u00e1n\u00ed konkr\u00e9tn\u00ed a um\u011bleck\u00e9 &#8220;vyj\u00e1d\u0159en\u00ed&#8221; t\u00e9to postavy. Nap\u0159\u00edklad soubor charakteristick\u00fdch rys\u016f, n\u00e1zv\u016f a konceptu\u00e1ln\u00edch obraz\u016f postavy, jako je &#8220;state\u010dn\u00e1 my\u0161 s velk\u00fdmi u\u0161ima&#8221;, je pova\u017eov\u00e1n za abstraktn\u00ed my\u0161lenku. Japonsk\u00e9 autorsk\u00e9 pr\u00e1vo chr\u00e1n\u00ed &#8220;vyj\u00e1d\u0159en\u00ed&#8221; my\u0161lenky, nikoli samotnou my\u0161lenku.<\/p>\n\n\n\n<p>Z\u00e1kladn\u00edm precedensem pro tuto problematiku je rozhodnut\u00ed Nejvy\u0161\u0161\u00edho soudu z roku 1997 (Heisei 9) ve v\u011bci &#8220;Popeye kravaty&#8221;. Tento p\u0159\u00edpad se t\u00fdkal prodeje kravat s nepovolen\u00fdm pou\u017eit\u00edm postavy Popeye. Nejvy\u0161\u0161\u00ed soud u\u010dinil jasn\u00e9 rozli\u0161en\u00ed. Za prv\u00e9, abstraktn\u00ed koncept postavy &#8220;Popeye&#8221; nen\u00ed d\u00edlem chr\u00e1n\u011bn\u00fdm autorsk\u00fdm pr\u00e1vem. Za druh\u00e9, ale konkr\u00e9tn\u00ed obr\u00e1zky Popeye, jak jsou zobrazeny v p\u016fvodn\u00edm komiksu (jednotliv\u00e9 r\u00e1me\u010dky), byly uzn\u00e1ny jako &#8220;d\u00edla v\u00fdtvarn\u00e9ho um\u011bn\u00ed&#8221; chr\u00e1n\u011bn\u00e1 autorsk\u00fdm pr\u00e1vem.<\/p>\n\n\n\n<p>Toto rozhodnut\u00ed tak\u00e9 stanovilo krit\u00e9ria pro posouzen\u00ed poru\u0161en\u00ed pr\u00e1v. Pro prok\u00e1z\u00e1n\u00ed poru\u0161en\u00ed pr\u00e1v nen\u00ed nutn\u00e9, aby ob\u017ealovan\u00fd replikoval konkr\u00e9tn\u00ed identifikovateln\u00fd obr\u00e1zek. Poru\u0161en\u00ed pr\u00e1v nast\u00e1v\u00e1, kdy\u017e ob\u017ealovan\u00fdm vytvo\u0159en\u00e9 zobrazen\u00ed z\u00e1vis\u00ed na p\u016fvodn\u00edm d\u00edle a div\u00e1k m\u016f\u017ee z tohoto zobrazen\u00ed p\u0159\u00edmo vn\u00edmat &#8220;podstatn\u00e9 rysy&#8221; vyj\u00e1d\u0159en\u00ed p\u016fvodn\u00edho d\u00edla. Jin\u00fdmi slovy, pokud n\u011bkdo vid\u00ed poru\u0161uj\u00edc\u00ed produkt a rozpozn\u00e1 v n\u011bm jedine\u010dn\u00e9 vizu\u00e1ln\u00ed rysy p\u016fvodn\u00edho obr\u00e1zku, kter\u00e9 mu umo\u017e\u0148uj\u00ed poznat &#8220;tu postavu&#8221;, pak to tvo\u0159\u00ed poru\u0161en\u00ed autorsk\u00fdch pr\u00e1v.<\/p>\n\n\n\n<p>Tento pr\u00e1vn\u00ed r\u00e1mec m\u00e1 p\u0159\u00edm\u00fd dopad na komercializaci postav a licen\u010dn\u00ed obchod. Kdy\u017e spole\u010dnost pr\u00e1vn\u011b &#8220;licencuje postavu&#8221;, ve skute\u010dnosti ud\u011bluje povolen\u00ed k replikaci portfolia konkr\u00e9tn\u00edch vizu\u00e1ln\u00edch vyj\u00e1d\u0159en\u00ed postavy chr\u00e1n\u011bn\u00fdch autorsk\u00fdm pr\u00e1vem (nap\u0159\u00edklad styl\u016f nebo kl\u00ed\u010dov\u00fdch um\u011bleck\u00fdch d\u011bl) nebo k vytv\u00e1\u0159en\u00ed sekund\u00e1rn\u00edch d\u011bl. Tato pr\u00e1vn\u00ed struktura znamen\u00e1, \u017ee spr\u00e1va du\u0161evn\u00edho vlastnictv\u00ed postavy nen\u00ed ochranou jednotn\u00e9ho abstraktn\u00edho &#8220;pr\u00e1va na postavu&#8221;, ale spr\u00e1vou portfolia slo\u017een\u00e9ho z mnoha d\u00edl\u016f chr\u00e1n\u011bn\u00fdch autorsk\u00fdm pr\u00e1vem (konkr\u00e9tn\u00edch obr\u00e1zk\u016f).
