V p\u0159\u00edpad\u011b zam\u011bstn\u00e1v\u00e1n\u00ed cizinc\u016f v\u0161ak existuj\u00ed zvl\u00e1\u0161t\u011b p\u0159\u00edsn\u00e9 ov\u011b\u0159ovac\u00ed povinnosti podle japonsk\u00e9ho z\u00e1kona o imigraci. V\u0161echny firmy mus\u00ed p\u0159ed uzav\u0159en\u00edm pracovn\u00ed smlouvy a zah\u00e1jen\u00edm pr\u00e1ce ov\u011b\u0159it cizineckou kartu nebo pas doty\u010dn\u00e9 osoby a ujistit se, \u017ee m\u00e1 povolen\u00fd pobytov\u00fd status pro pr\u00e1ci a \u017ee je doba pobytu platn\u00e1. Pokud firma zanedb\u00e1 tuto ov\u011b\u0159ovac\u00ed povinnost a zam\u011bstn\u00e1 cizince, kter\u00fd nem\u00e1 povolen\u00ed k pr\u00e1ci, m\u016f\u017ee b\u00fdt vystavena v\u00e1\u017en\u00e9 pr\u00e1vn\u00ed odpov\u011bdnosti.<\/p>\n\n\n\n<p>\u010cl\u00e1nek 73-2 japonsk\u00e9ho z\u00e1kona o imigraci stanov\u00ed trestn\u00fd \u010din podpory neleg\u00e1ln\u00ed pr\u00e1ce. Tento z\u00e1kon trest\u00e1 ty, kte\u0159\u00ed umo\u017enili nebo um\u00edstili pod svou kontrolu osoby k vykon\u00e1v\u00e1n\u00ed neleg\u00e1ln\u00ed pr\u00e1ce v r\u00e1mci podnik\u00e1n\u00ed. V p\u0159\u00edpad\u011b poru\u0161en\u00ed tohoto z\u00e1kona m\u016f\u017ee b\u00fdt jednotlivci ulo\u017een trest odn\u011bt\u00ed svobody a\u017e na t\u0159i roky nebo pokuta a\u017e do v\u00fd\u0161e 3 miliony jen\u016f, nebo oboj\u00ed, zat\u00edmco pr\u00e1vnick\u00e9 osoby mohou \u010delit pokut\u011b a\u017e do v\u00fd\u0161e 3 miliony jen\u016f. Nejd\u016fle\u017eit\u011bj\u0161\u00ed aspekt tohoto z\u00e1kona je, \u017ee tvrzen\u00ed firmy, \u017ee &#8220;o tom nev\u011bd\u011bla&#8221;, obvykle nen\u00ed p\u0159ijateln\u00e9. I v p\u0159\u00edpad\u011b &#8220;nedbalosti&#8221;, jako je nap\u0159\u00edklad nedostate\u010dn\u00e1 kontrola cizineck\u00e9 karty, m\u016f\u017ee b\u00fdt firma potrest\u00e1na. Z\u00e1kon tedy od firem vy\u017eaduje, aby aktivn\u011b a spolehliv\u011b zavedly syst\u00e9m kontroly. Tento typ pobytu tedy p\u016fvodn\u011b neumo\u017e\u0148uje pracovn\u00ed \u010dinnost. Nicm\u00e9n\u011b, na z\u00e1klad\u011b \u010dl\u00e1nku 19 japonsk\u00e9ho z\u00e1kona o imigraci je mo\u017en\u00e9 z\u00edskat &#8220;povolen\u00ed k \u010dinnosti mimo kvalifikaci&#8221;, kter\u00e9 umo\u017e\u0148uje pracovat jako v\u00fdjimku. Toto povolen\u00ed je v\u0161ak v z\u00e1sad\u011b omezeno na pr\u00e1ci do 28 hodin t\u00fddn\u011b a p\u0159edpokl\u00e1d\u00e1 se, \u017ee se jedn\u00e1 o pr\u00e1ci na \u010d\u00e1ste\u010dn\u00fd \u00favazek nebo brig\u00e1du. Proto nen\u00ed mo\u017en\u00e9 zam\u011bstnat cizince s v\u00edzem pro rodinn\u00fd pobyt jako st\u00e1l\u00e9ho zam\u011bstnance, pokud p\u0159ekro\u010d\u00ed rozsah povolen\u00e9 \u010dinnosti mimo kvalifikaci.<\/p>\n\n\n\n<p>Pro p\u0159ijet\u00ed jako st\u00e1l\u00fd zam\u011bstnanec je nezbytn\u00e9 zm\u011bnit st\u00e1vaj\u00edc\u00ed &#8220;rodinn\u00fd pobyt&#8221; na pobytov\u00fd status, kter\u00fd umo\u017e\u0148uje pracovat v dan\u00e9 oblasti, nap\u0159\u00edklad &#8220;technika, humanitn\u00ed v\u011bdy, mezin\u00e1rodn\u00ed slu\u017eby&#8221;. Tento proces je definov\u00e1n v \u010dl\u00e1nku 20 japonsk\u00e9ho z\u00e1kona o imigraci jako &#8220;\u017e\u00e1dost o zm\u011bnu pobytov\u00e9ho statusu&#8221;. Tato \u017e\u00e1dost nep\u0159edstavuje pouhou aktualizaci typu pobytov\u00e9ho statusu, ale podl\u00e9h\u00e1 p\u0159\u00edsn\u00e9mu posouzen\u00ed, kter\u00e9 je srovnateln\u00e9 s \u017e\u00e1dost\u00ed o z\u00edsk\u00e1n\u00ed zcela nov\u00e9ho pracovn\u00edho v\u00edza. Imigra\u010dn\u00ed \u00fa\u0159ad pe\u010dliv\u011b posuzuje, zda \u017eadatel spl\u0148uje po\u017eadavky pro nov\u00fd pobytov\u00fd status. Zvl\u00e1\u0161t\u011b d\u016fle\u017eit\u00fdm krit\u00e9riem je souvislost mezi vzd\u011bl\u00e1n\u00edm a pracovn\u00edmi zku\u0161enostmi \u017eadatele a povahou pr\u00e1ce, kterou m\u00e1 v podniku vykon\u00e1vat. Proces obvykle vy\u017eaduje 1 a\u017e 2 m\u011bs\u00edce pro posouzen\u00ed. Tyto &#8220;neodvratn\u00e9 zvl\u00e1\u0161tn\u00ed okolnosti&#8221; zahrnuj\u00ed p\u0159\u00edpady, kdy je nutn\u00e9 zohlednit humanit\u00e1rn\u00ed aspekty (nap\u0159\u00edklad kdy\u017e dojde k uzav\u0159en\u00ed man\u017eelstv\u00ed s Japoncem nebo kdy\u017e je osoba v\u00e1\u017en\u011b nemocn\u00e1 a nem\u016f\u017ee se vr\u00e1tit do sv\u00e9 zem\u011b), ale d\u016fvod &#8220;obdr\u017een\u00ed pracovn\u00ed nab\u00eddky od japonsk\u00e9 spole\u010dnosti&#8221; sem nepat\u0159\u00ed.
