Je velmi riskantn\u00ed spol\u00e9hat se pouze na uji\u0161t\u011bn\u00ed vys\u00edlaj\u00edc\u00ed firmy, \u017ee &#8220;v\u0161echny procedury jsou v po\u0159\u00e1dku&#8221;.<\/p>\n\n\n\n<p>\u010cl\u00e1nek 73-2 japonsk\u00e9ho imigra\u010dn\u00edho z\u00e1kona stanov\u00ed trestn\u00fd \u010din &#8220;podpory neleg\u00e1ln\u00ed pr\u00e1ce&#8221;. Tento trestn\u00fd \u010din se nevztahuje pouze na zam\u011bstnavatele, kte\u0159\u00ed zam\u011bstn\u00e1vaj\u00ed neleg\u00e1ln\u00ed pracovn\u00edky, ale tak\u00e9 na ty, kte\u0159\u00ed &#8220;pod svou kontrolou&#8221; umo\u017e\u0148uj\u00ed neleg\u00e1ln\u00ed pracovn\u00ed aktivity. V r\u00e1mci vys\u00edlac\u00edho kontraktu vykon\u00e1vaj\u00ed zahrani\u010dn\u00ed pracovn\u00edci pr\u00e1ci pod veden\u00edm a pokyny p\u0159ij\u00edmaj\u00edc\u00ed firmy, co\u017e znamen\u00e1, \u017ee p\u0159ij\u00edmaj\u00edc\u00ed firma m\u016f\u017ee b\u00fdt pova\u017eov\u00e1na za toho, kdo pracovn\u00edky &#8220;m\u00e1 pod kontrolou&#8221;, a st\u00e1v\u00e1 se tak subjektem trestn\u00e9ho \u010dinu podpory neleg\u00e1ln\u00ed pr\u00e1ce. Pokud vyslan\u00fd pracovn\u00edk nem\u00e1 platn\u00e9 povolen\u00ed k pobytu nebo se v\u011bnuje \u010dinnostem, kter\u00e9 p\u0159esahuj\u00ed povolen\u00fd rozsah, m\u016f\u017ee b\u00fdt p\u0159ij\u00edmaj\u00edc\u00ed firma potrest\u00e1na, a to i v p\u0159\u00edpad\u011b, \u017ee o situaci nev\u011bd\u011bla.<\/p>\n\n\n\n<p>Pro eliminaci tohoto rizika by p\u0159ij\u00edmaj\u00edc\u00ed firma m\u011bla p\u0159ijmout n\u00e1sleduj\u00edc\u00ed opat\u0159en\u00ed:<\/p>\n\n\n\n<p>Zaprv\u00e9, je nezbytn\u00e9 p\u0159ed uzav\u0159en\u00edm vys\u00edlac\u00edho kontraktu a p\u0159ed zah\u00e1jen\u00edm pr\u00e1ce zahrani\u010dn\u00edho pracovn\u00edka v\u017edy ov\u011b\u0159it origin\u00e1l jeho pobytov\u00e9 karty a uchovat jej\u00ed kopii.
