This issue is referred to in legal terms as &#8220;jurisdiction&#8221;.<\/p>\n\n\n\n<p>For example, our firm is a law firm located in Tokyo. We can easily reach the Tokyo District Court by train, but if the case is handled in courts in Osaka or Nagoya, we inevitably incur travel expenses. Furthermore, many law firms, including ours, charge a &#8220;daily rate&#8221; to cover the time spent traveling when handling cases in distant courts. It is better for both the lawyer and the client if the proceedings can be conducted in the Tokyo District Court as much as possible.<\/p>\n\n\n\n<p>Can lawsuits and provisional measures related to online reputation damage, such as deletion, and requests for disclosure of IP addresses and personal information, be handled in the Tokyo District Court? We will explain the concept of &#8220;jurisdiction&#8221;.<\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_53 counter-hierarchy ez-toc-counter ez-toc-grey courts can handle the trial or provisional measures in the first place (International Jurisdiction)<\/li>\n\n\n\n<li>If Japanese courts can handle it, the question arises as to whether it would be, for example, the Tokyo District Court or the Osaka District Court (Territorial Jurisdiction within Domestic Jurisdiction)<\/li>\n<\/ol>\n\n\n\n<p>This article will explain the latter. We will explain each of these in order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jurisdiction_for_Post_Deletion_and_Damage_Compensation_Claims\"><\/span>Jurisdiction for Post Deletion and Damage Compensation Claims<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Firstly, in the case of post deletion or damage compensation claims, you can choose between the jurisdiction of the &#8220;plaintiff (creditor)&#8221; and the &#8220;defendant (debtor)&#8221;. This might be a bit confusing, but in a lawsuit, the &#8220;plaintiff&#8221; is referred to as the &#8220;creditor&#8221; in provisional disposition procedures, and the &#8220;defendant&#8221; is referred to as the &#8220;debtor&#8221;. In essence, it&#8217;s about the party filing the lawsuit and the party being sued.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jurisdiction_of_the_Plaintiff_Creditor\"><\/span>Jurisdiction of the Plaintiff (Creditor)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>This refers to the jurisdiction based on the circumstances of the party filing the lawsuit, i.e., the party requesting the deletion of the post or claiming damages.<\/p>\n\n\n\n<p>This simply corresponds to the domicile of the party requesting the deletion of the post or claiming damages. For example,<\/p>\n\n\n\n<ul>\n<li>If an individual lives (or more precisely, has their registered address) in Tokyo, it would be the Tokyo District Court<\/li>\n\n\n\n<li>If a corporation has its head office in Tokyo, it would be the Tokyo District Court<\/li>\n\n\n\n<li>If a corporation has its head office in Yokohama, it would be the Yokohama District Court<\/li>\n<\/ul>\n\n\n\n<p>And so on.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jurisdiction_of_the_Defendant_Debtor\"><\/span>Jurisdiction of the Defendant (Debtor)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>This refers to the jurisdiction based on the circumstances of the party being sued, i.e., the party from whom the deletion of the post or damages is being claimed. In the case of a damage compensation claim, it is usually the &#8220;person who wrote the article&#8221;. In the case of post deletion, it would be the person who has the right and obligation to delete the article, for example,<\/p>\n\n\n\n<ul>\n<li>The person who wrote the article<\/li>\n\n\n\n<li>If the article is a comment on a bulletin board, the bulletin board administrator<\/li>\n\n\n\n<li>If the article is on a site on a rental server, the server administrator<\/li>\n<\/ul>\n\n\n\n<p>And so on.<\/p>\n\n\n\n<p>If these are domestic individuals or domestic corporations, the court of their domicile, as mentioned above, will have jurisdiction.<\/p>\n\n\n\n<p>For foreign corporations, it&#8217;s a bit complicated, but<\/p>\n\n\n\n<ul>\n<li>If they have a main office or business office in Japan \u2192 The court of the location of the main office or business office in Japan<\/li>\n\n\n\n<li>If they have a representative or other main business person in Japan \u2192 The court of the domicile of the representative or other main business person in Japan<\/li>\n<\/ul>\n\n\n\n<p>Would have jurisdiction.<\/p>\n\n\n\n<p>If neither of these exist, there is no jurisdiction on the defendant (debtor) side, and the lawsuit can only be conducted in the jurisdiction of the plaintiff (creditor).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Summary\"><\/span>Summary<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Based on the above, the following examples can be given:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_an_individual_in_Tokyo_demands_the_deletion_of_a_posted_article_from_a_server_company_in_Osaka\"><\/span>If an individual in Tokyo demands the deletion of a posted article from a server company in Osaka<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol>\n<li>From the perspective of the plaintiff (creditor), the Tokyo District Court<\/li>\n\n\n\n<li>From the perspective of the defendant (debtor), the Osaka District Court<\/li>\n\n\n\n<li>Therefore, either the Tokyo District Court or the Osaka District Court would be acceptable<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_a_corporation_in_Saitama_Prefecture_makes_a_damage_compensation_claim_against_an_individual_in_Nagoya\"><\/span>If a corporation in Saitama Prefecture makes a damage compensation claim against an individual in Nagoya<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol>\n<li>From the perspective of the plaintiff (creditor), the Saitama District Court<\/li>\n\n\n\n<li>From the perspective of the defendant (debtor), the Nagoya District Court<\/li>\n\n\n\n<li>Therefore, either the Saitama District Court or the Nagoya District Court would be acceptable<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_a_corporation_in_Saitama_Prefecture_demands_the_deletion_of_a_posted_article_from_a_foreign_corporation_that_does_not_have_an_office_business_office_representative_or_business_person_in_Japan\"><\/span>If a corporation in Saitama Prefecture demands the deletion of a posted article from a foreign corporation that does not have an office, business office, representative, or business person in Japan<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol>\n<li>From the perspective of the plaintiff (creditor), the Saitama District Court<\/li>\n\n\n\n<li>From the perspective of the defendant (debtor), no jurisdiction<\/li>\n\n\n\n<li>Therefore, only the Saitama District Court would be acceptable<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Jurisdiction_for_Disclosure_Requests_of_Sender_Information\"><\/span>Jurisdiction for Disclosure Requests of Sender Information<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In cases where you are requesting the disclosure of a poster&#8217;s IP address, name, and address from a server or provider, you cannot use the &#8216;plaintiff (creditor) jurisdiction&#8217;. In other words, you can only use the court that corresponds to the &#8216;defendant (debtor) jurisdiction&#8217;.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/reputation\/provider-liability-limitation-law\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/reputation\/provider-liability-limitation-law[ja]<\/a><\/p>\n\n\n\n<p>If the defendant (debtor) is a domestic individual or corporation, the court of the defendant&#8217;s domicile will be used, as mentioned above.<\/p>\n\n\n\n<p>For foreign corporations, the basic principle is the same, but there are slight differences.<\/p>\n\n\n\n<ul>\n<li>If the main office or business office is located in Japan \u2192 The court of the location of the main office or business office in Japan<\/li>\n\n\n\n<li>If there is a representative or other main business person in Japan \u2192 The court of the domicile of the representative or other main business person in Japan<\/li>\n\n\n\n<li>If neither exists \u2192 The Tokyo District Court, as a case of &#8216;undefined jurisdiction&#8217;<\/li>\n<\/ul>\n\n\n\n<p>There is a rule that &#8216;if neither exists, it is okay to use the Tokyo District Court&#8217;.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Simultaneously_Requesting_Post_Deletion_Damages_and_Disclosure_of_Sender_Information\"><\/span>Simultaneously Requesting Post Deletion, Damages, and Disclosure of Sender Information<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img decoding=\"async\" loading=\"lazy\" width=\"735\" height=\"490\" src=\"https:\/\/monolith.law\/en\/wp-content\/uploads\/sites\/6\/2026\/01\/jurisdiction-of-judgement-3.jpg\" alt=\"\" class=\"wp-image-69283\" style=\"aspect-ratio:1.5;width:840px;height:auto\" srcset=\"https:\/\/monolith.law\/en\/wp-content\/uploads\/sites\/6\/2026\/01\/jurisdiction-of-judgement-3.jpg 735w, https:\/\/monolith.law\/en\/wp-content\/uploads\/sites\/6\/2026\/01\/jurisdiction-of-judgement-3-300x200.jpg 300w, https:\/\/monolith.law\/en\/wp-content\/uploads\/sites\/6\/2026\/01\/jurisdiction-of-judgement-3-250x167.jpg 250w\" sizes=\"(max-width: 735px) 100vw, 735px\" \/><figcaption class=\"wp-element-caption\">If a claim for damages is involved, it will be a lawsuit, not a provisional disposition.<\/figcaption><\/figure>\n\n\n\n<p>In addition to the rules mentioned above, what happens when you simultaneously request post deletion, damages, and disclosure of sender information?<\/p>\n\n\n\n<p>This involves the rules of &#8220;provisional disposition&#8221;. Firstly, you cannot request damages in a provisional disposition.
