Aceste sanc\u021biuni administrative au ca scop asigurarea calit\u0103\u021bii serviciilor de \u00eengrijire \u0219i protec\u021bia drepturilor utilizatorilor.<\/p>\n\n\n\n<p>Pentru locurile de afaceri care ofer\u0103 servicii de \u00eengrijire, anularea sau suspendarea desemn\u0103rii conform Legii Asigur\u0103rilor de \u00cengrijire reprezint\u0103 o form\u0103 de sanc\u021biune administrativ\u0103.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Diferenta_dintre_indrumarea_si_sanctiunea_administrativa\"><\/span>Diferen\u021ba dintre \u00eendrumarea \u0219i sanc\u021biunea administrativ\u0103<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>\u00cendrumarea administrativ\u0103 reprezint\u0103 sfaturile \u0219i \u00eendrum\u0103rile pe care agen\u021biile administrative le ofer\u0103 operatorilor de afaceri atunci c\u00e2nd exist\u0103 suspiciuni de \u00eenc\u0103lcare a legii. Pe de alt\u0103 parte, sanc\u021biunea administrativ\u0103 are for\u021b\u0103 juridic\u0103 obligatorie \u0219i impune operatorilor de afaceri anumite obliga\u021bii sau restric\u021bioneaz\u0103 drepturile acestora.<\/p>\n\n\n\n<p>\u00cendrumarea administrativ\u0103 este definit\u0103 \u00een articolul 32 \u0219i \u00een alineatul 2 al articolului 32 al Legii Procedurilor Administrative astfel:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>\u00cen cazul \u00eendrum\u0103rii administrative, persoanele implicate \u00een \u00eendrumare trebuie s\u0103 fie atente s\u0103 nu dep\u0103\u0219easc\u0103 domeniul de activitate sau sarcinile administrative ale respectivei agen\u021bii \u0219i s\u0103 \u021bin\u0103 cont de faptul c\u0103 con\u021binutul \u00eendrum\u0103rii se bazeaz\u0103 exclusiv pe cooperarea voluntar\u0103 a celeilalte p\u0103r\u021bi.<br>2. Centrele de \u00eengrijire opereaz\u0103 afacerile conform Legii Asigur\u0103rilor de \u00cengrijire, pe baza unei desemn\u0103ri primite de la autorit\u0103\u021bile administrative. Dac\u0103 desemnarea este anulat\u0103, centrul de \u00eengrijire nu mai poate primi compensa\u021bii pentru \u00eengrijire \u0219i nu poate continua afacerea.<\/p>\n\n\n\n<p>De asemenea, dac\u0103 un centru de \u00eengrijire prime\u0219te o sanc\u021biune administrativ\u0103 de anulare a desemn\u0103rii, nu poate ob\u021bine o nou\u0103 desemnare timp de 5 ani de la data anul\u0103rii.
