olup, me\u015fru bir i\u015fletme faaliyetidir.<\/p>\n\n\n\n<p>Bir \u00e7al\u0131\u015fan\u0131n kendi iradesiyle i\u015f de\u011fi\u015ftirmesi, Anayasa&#8217;n\u0131n 22. maddesinde g\u00fcvence alt\u0131na al\u0131nan &#8216;meslek se\u00e7me \u00f6zg\u00fcrl\u00fc\u011f\u00fc&#8217;ne girer ve sorun te\u015fkil etmez.<\/p>\n\n\n\n<p>Ancak, &#8216;\u00e7al\u0131\u015fanlar\u0131 ba\u015fka bir \u015firketten \u00e7ekme&#8217; teklif y\u00f6ntemi veya s\u00fcrecine ba\u011fl\u0131 olarak, tazminat taleplerine yol a\u00e7abilir.<\/p>\n\n\n\n<p>Tazminat taleplerinin hedefi genellikle ger\u00e7ekten \u00e7al\u0131\u015fanlar\u0131 ba\u015fka bir \u015firketten \u00e7eken ki\u015filere y\u00f6neliktir, ancak \u015firketlere kar\u015f\u0131 tazminat talep edilebilecek durumlar da \u30101.\u3011 ki\u015fisel olarak y\u00f6netici veya \u00e7al\u0131\u015fan taraf\u0131ndan ger\u00e7ekle\u015ftirilen bir istihdam \u00e7ekme eylemi oldu\u011fu i\u00e7in, i\u015f de\u011fi\u015ftirecek olan y\u00f6netici veya \u00e7al\u0131\u015fanla birlikte istihdam \u00e7ekme eylemini ger\u00e7ekle\u015ftirdikleri durumda, i\u015f de\u011fi\u015ftirecekleri \u015firketin sorumlulu\u011fu s\u00f6z konusu olur.<\/p>\n\n\n\n<p>\u30102.\u3011 ve \u30103.\u3011 durumlar\u0131, &#8220;ba\u015fka bir \u015firket&#8221; taraf\u0131ndan ger\u00e7ekle\u015ftirilen istihdam \u00e7ekme eylemi a\u00e7\u0131s\u0131ndan ayn\u0131d\u0131r, ancak <br>\u30102.\u3011 durumunda, istihdam \u00e7ekme y\u00f6ntemi d\u0131\u015f\u0131nda, i\u015f de\u011fi\u015ftiren y\u00f6netici veya \u00e7al\u0131\u015fan\u0131n \u015firketle ne t\u00fcr bir anla\u015fma yapt\u0131\u011f\u0131 \u00f6nemli bir noktad\u0131r.<\/p>\n\n\n\n<p>Ayr\u0131ca, istihdam \u00e7ekme m\u00fczakerelerinin sonucunda, \u00e7ekilen ki\u015fi memnun kal\u0131rsa, bu ba\u015far\u0131 olarak kabul edilir. Kabul eden \u015firket i\u00e7in, m\u00fckemmel bir acil durum yetene\u011fi kazanabilir ve ki\u015fi i\u00e7in, daha iyi ko\u015fullara sahip bir \u015firkette \u00e7al\u0131\u015fma ko\u015fulu, i\u015f\u00e7i \u00e7alma eyleminin &#8216;yasad\u0131\u015f\u0131&#8217; olup olmad\u0131\u011f\u0131d\u0131r. &#8216;Yasad\u0131\u015f\u0131 i\u015f\u00e7i \u00e7alma&#8217;, toplumsal kabul edilebilirli\u011fi a\u015fan ve son derece ihanet i\u00e7eren y\u00f6ntemlerle ger\u00e7ekle\u015ftirilen i\u015f\u00e7i \u00e7alma eylemidir.<\/p>\n\n\n\n<p>Ihanet, g\u00fcvenin veya s\u00f6zlerin ihlal edilmesi anlam\u0131na gelir.<\/p>\n\n\n\n<p>Yani, toplumun genel kabul g\u00f6rm\u00fc\u015f normlar\u0131n\u0131 a\u015fan ve g\u00fcveni veya s\u00f6zleri ihlal eden y\u00f6ntemlerle ger\u00e7ekle\u015ftirilen i\u015f\u00e7i \u00e7alma eylemi yasad\u0131\u015f\u0131d\u0131r.<\/p>\n\n\n\n<p>Tazminat talebinde bulunmak i\u00e7in, i\u015f\u00e7i \u00e7alma eyleminin yasad\u0131\u015f\u0131 oldu\u011funu ve \u00e7al\u0131\u015fan\u0131n aidiyet duygusu ta\u015f\u0131d\u0131\u011f\u0131 \u015firketin haklar\u0131n\u0131n veya \u00e7\u0131karlar\u0131n\u0131n, bu i\u015f\u00e7i \u00e7alma eylemi sonucunda ihlal edildi\u011fini \u015firketin kan\u0131tlamas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Ayr\u0131ca, i\u015f kurallar\u0131nda rekabetten ka\u00e7\u0131nma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc (a\u015fa\u011f\u0131da belirtildi\u011fi gibi) h\u00fck\u00fcmleri nedeniyle i\u015f\u00e7i \u00e7alman\u0131n yasakland\u0131\u011f\u0131 durumlar veya \u00f6zel anla\u015fmalar yap\u0131ld\u0131\u011f\u0131 durumlarda, yasad\u0131\u015f\u0131l\u0131k durumu ne olursa olsun tazminat talep edilebilir.<\/p>\n\n\n\n<p class=\"has-very-light-gray-background-color has-background\">Medeni Kanun Madde 709 (Haks\u0131z Fiil Nedeniyle Tazminat)<br>Bir ki\u015fi, kasten veya ihmal sonucu ba\u015fka bir ki\u015finin haklar\u0131n\u0131 veya yasal olarak korunan \u00e7\u0131karlar\u0131n\u0131 ihlal ederse, bu durumdan kaynaklanan zarar\u0131 tazmin etme sorumlulu\u011fu ta\u015f\u0131r.<\/p>\n\n\n\n<h3 Heisei 3 (1991) 25 \u015eubat) a\u015fa\u011f\u0131daki d\u00f6rt maddeye odaklanarak genel bir de\u011ferlendirme yap\u0131lmas\u0131 gerekti\u011fi belirtilmi\u015ftir.<\/p>\n\n\n\n<ol>\n<li>\u0130\u015ften ayr\u0131lan \u00e7al\u0131\u015fan\u0131n \u015firketteki konumu<\/li>\n\n\n\n<li>\u015eirket i\u00e7indeki muamele ve personel say\u0131s\u0131<\/li>\n\n\n\n<li>\u00c7al\u0131\u015fan\u0131n i\u015ften ayr\u0131lmas\u0131n\u0131n \u015firket \u00fczerindeki etkisi<\/li>\n\n\n\n<li>\u0130\u015ften ayr\u0131lma teklifinde
