adl\u0131 davac\u0131n\u0131n teyit edilmi\u015f bir faydas\u0131n\u0131n olup olmad\u0131\u011f\u0131d\u0131r ve mahkeme bunu kabul etti.<\/p>\n\n\n\n<p>\u0130kinci ve \u00fc\u00e7\u00fcnc\u00fc tart\u0131\u015fma konular\u0131, m\u00fczik okulundaki performans\u0131n telif hakk\u0131n\u0131 i\u00e7erip i\u00e7ermedi\u011fi sorunudur.<\/p>\n\n\n\n<p>22. maddesi &#8216;Japon Telif Hakk\u0131 Yasas\u0131&#8217;na g\u00f6re, &#8216;yazar, eserini, halka do\u011frudan g\u00f6stermek veya dinletmek amac\u0131yla (\u2026) performans hakk\u0131n\u0131 sahiptir&#8217; ve bu performans hakk\u0131n\u0131n ihlali telif hakk\u0131 ihlali olur. Burada &#8216;halk&#8217;, genellikle &#8216;belirsiz veya \u00e7ok say\u0131da ki\u015fi&#8217; olarak kabul edilir.<\/p>\n\n\n\n<p>\u0130kinci tart\u0131\u015fma konusu (m\u00fczik okulundaki performans\u0131n &#8216;halka&#8217; y\u00f6nelik olup olmad\u0131\u011f\u0131) hakk\u0131nda, \u00f6ncelikle, &#8216;m\u00fczik okulu i\u015fletmecileri&#8217;, kendilerinin &#8216;Japon Telif Hakk\u0131 Yasas\u0131&#8217;n\u0131n 22. maddesinde belirtilen performans hakk\u0131n\u0131n hedefi olan &#8216;halka do\u011frudan g\u00f6stermek veya dinletmek amac\u0131yla&#8217; performans\u0131 ger\u00e7ekle\u015ftiren ki\u015filere dahil olmad\u0131\u011f\u0131n\u0131, bu nedenle JASRAC&#8217;\u0131n y\u00f6netti\u011fi m\u00fczik eserlerinin kullan\u0131m\u0131na ili\u015fkin talep hakk\u0131n\u0131n &#8216;m\u00fczik okulu i\u015fletmecileri&#8217;ne kar\u015f\u0131 ge\u00e7erli olmad\u0131\u011f\u0131n\u0131 savundu.<\/p>\n\n\n\n<p>Performans\u0131n \u00f6znesi &#8216;m\u00fczik okulu i\u015fletmecisi&#8217; de\u011fil &#8216;\u00f6\u011fretmen&#8217; veya &#8216;\u00f6\u011frenci&#8217; kendisi ise, bu tart\u0131\u015fma konusunu tart\u0131\u015fmaya gerek kalmadan &#8216;m\u00fczik okulu i\u015fletmecisi&#8217; taraf\u0131ndan yap\u0131lan telif hakk\u0131 ihlali reddedilir. Ancak, mahkeme, Club Cat&#8217;s Eye davas\u0131 karar\u0131nda (Yarg\u0131tay, 15 Mart 1988 tarihli karar) belirtildi\u011fi gibi &#8216;Karaoke Hukuku&#8217; olarak adland\u0131r\u0131lan yakla\u015f\u0131m\u0131 benimsedi ve bunu reddetti.<\/p>\n\n\n\n<p>Bu, &#8216;Club Cat&#8217;s Eye&#8217; adl\u0131 bir snack bar\u0131n i\u015fletmecisinin, karaoke cihaz\u0131n\u0131 d\u00fckkan\u0131na kurarak m\u00fc\u015fterilere ve hosteslere \u015fark\u0131 s\u00f6yletmesi \u00fczerine, JASRAC&#8217;\u0131n performans hakk\u0131 ihlalini gerek\u00e7e g\u00f6stererek tazminat talep etti\u011fi bir durumdur.<\/p>\n\n\n\n<p>Yarg\u0131tay, bir snack bar\u0131n i\u015fletmecisinin karaoke cihaz\u0131n\u0131 d\u00fckkan\u0131na kurarak m\u00fc\u015fterilere \u015fark\u0131 s\u00f6ylemeyi teklif etti\u011fi, m\u00fc\u015fterinin se\u00e7ti\u011fi \u015fark\u0131n\u0131n karaoke band\u0131n\u0131 oynatarak di\u011fer m\u00fc\u015fterilerin \u00f6n\u00fcnde \u015fark\u0131 s\u00f6ylemesini sa\u011flad\u0131\u011f\u0131 ve bununla d\u00fckkan\u0131n atmosferini olu\u015fturdu\u011fu ve m\u00fc\u015fteri \u00e7ekti\u011fi ve kar elde etmeyi ama\u00e7lad\u0131\u011f\u0131 durumlarda, i\u015fletmecinin, m\u00fc\u015fterinin \u015fark\u0131 s\u00f6yleme eyleminin \u00f6znesi olarak performans hakk\u0131 ihlali nedeniyle haks\u0131z fiil sorumlulu\u011fu ta\u015f\u0131d\u0131\u011f\u0131na karar verdi.<\/p>\n\n\n\n<p>Tokyo B\u00f6lge Mahkemesi, bu &#8216;Karaoke Hukuku&#8217;na dayanarak, performans\u0131n \u00f6znesinin \u00f6\u011fretmen veya \u00f6\u011frenci de\u011fil &#8216;m\u00fczik okulu i\u015fletmecisi&#8217; oldu\u011funa ve &#8216;m\u00fczik okulu i\u015fletmecisi&#8217; a\u00e7\u0131s\u0131ndan \u00f6\u011frencinin say\u0131s\u0131na bak\u0131lmaks\u0131z\u0131n &#8216;belirsiz&#8217; bir ki\u015fi oldu\u011funa ve &#8216;halk&#8217; oldu\u011funa karar verdi.<\/p>\n\n\n\n<p>\u00dc\u00e7\u00fcnc\u00fc tart\u0131\u015fma konusu (m\u00fczik okulundaki performans\u0131n &#8216;dinletmek amac\u0131yla&#8217; ger\u00e7ekle\u015ftirilen bir \u015fey olup olmad\u0131\u011f\u0131) hakk\u0131nda, m\u00fczik okulundaki dersler, \u00f6\u011fretmen veya oynat\u0131lan kaynak taraf\u0131ndan ger\u00e7ekle\u015ftirilen performansla \u00f6\u011frencilere \u00f6dev par\u00e7as\u0131n\u0131 dinletmek ve bunu dinleyen \u00f6\u011frencinin \u00f6dev par\u00e7as\u0131n\u0131 \u00e7almas\u0131n\u0131 sa\u011flamak ve \u00f6\u011fretmenin bunu dinlemesini sa\u011flamak i\u00e7in tekrarlan\u0131r, bu nedenle, \u00f6\u011fretmen veya oynat\u0131lan kaynak taraf\u0131ndan ger\u00e7ekle\u015ftirilen performans\u0131n halk olan \u00f6\u011frencilere dinletmek amac\u0131yla ger\u00e7ekle\u015ftirildi\u011fi a\u00e7\u0131kt\u0131r, dedi mahkeme.<\/p>\n\n\n\n<p>D\u00f6rd\u00fcnc\u00fc tart\u0131\u015fma konusu (m\u00fczik okulundaki iki \u00f6l\u00e7\u00fcl\u00fck performans\u0131n performans hakk\u0131n\u0131 i\u00e7erip i\u00e7ermedi\u011fi) hakk\u0131nda, m\u00fczik okulundaki performans\u0131n amac\u0131 performans tekniklerini vb. \u00f6\u011frenmektir ve performans tekniklerini vb. \u00f6\u011frenmek, m\u00fczik eserine dahil edilen d\u00fc\u015f\u00fcnce veya duygular\u0131n ifadesini yeniden \u00fcretmeden olamaz, bu nedenle, m\u00fczik okulunda sadece telif hakk\u0131 olmayan k\u0131s\u0131mlar\u0131n tekrar tekrar ders verildi\u011fini d\u00fc\u015f\u00fcnmek m\u00fcmk\u00fcn de\u011fildir ve derslerde iki \u00f6l\u00e7\u00fcl\u00fck birim olarak performans ger\u00e7ekle\u015ftirilse bile, bu, ba\u015ftan sona belirli iki \u00f6l\u00e7\u00fcy\u00fc tekrar tekrar \u00e7almak de\u011fil, iki \u00f6l\u00e7\u00fcy\u00fc keserek belirli bir dereceye kadar birle\u015fik bir ifade \u00e7almak olacakt\u0131r, dedi mahkeme.<\/p>\n\n\n\n<p>Be\u015finci tart\u0131\u015fma konusu (performans hakk\u0131n\u0131n t\u00fckenmesi) hakk\u0131nda, t\u00fckenme, t\u00fckenmi\u015f ve yok olmu\u015f olmak anlam\u0131na gelir ve genellikle fikri m\u00fclkiyet haklar\u0131 ile ilgili bir sorundur.
