Ancak, &#8220;sanat&#8221; kelimesi tek ba\u015f\u0131na geni\u015f bir yelpazeyi kapsar ve \u00e7e\u015fitli bi\u00e7imler al\u0131r.<\/p>\n\n\n\n<p>&#8220;Sanat&#8221; kelimesi iki kategoriye ayr\u0131l\u0131r. End\u00fcstriyel \u00fcr\u00fcnler gibi uygulamal\u0131 g\u00fczel sanatlar\u0131n telif hakk\u0131 niteli\u011fi ta\u015f\u0131mas\u0131, telif hakk\u0131 kanunu taraf\u0131ndan a\u00e7\u0131k\u00e7a telif hakk\u0131 niteli\u011fi tan\u0131nan &#8220;sanat ve zanaat eserleri&#8221; ile s\u0131n\u0131rl\u0131d\u0131r.<\/p>\n\n\n\n<p>End\u00fcstriyel \u00fcr\u00fcnlerin tasar\u0131m\u0131, ba\u011f\u0131ms\u0131z bir seyirlik nesne olmad\u0131\u011f\u0131 i\u00e7in, &#8220;edebiyat, bilim, sanat veya m\u00fczik alan\u0131na ait&#8221; gereklili\u011fini kar\u015f\u0131lamad\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>Bunun arkas\u0131nda, end\u00fcstriyel tasar\u0131m\u0131n, tasar\u0131m hukuku ile korunmas\u0131 gerekti\u011fi ve telif hakk\u0131 kanunu taraf\u0131ndan sa\u011flanan 70 y\u0131ll\u0131k \u00e7ok uzun koruman\u0131n uygun olmad\u0131\u011f\u0131 d\u00fc\u015f\u00fcncesi bulunmaktad\u0131r.<\/p>\n\n\n\n<p>Tasar\u0131m hukukunun s\u00fcresi, 2020 y\u0131l\u0131ndan (Gregorian takvimine g\u00f6re 2020) itibaren yap\u0131lan tasar\u0131m tescil ba\u015fvurular\u0131 i\u00e7in, \u00f6nceki 20 y\u0131ldan 25 y\u0131la uzat\u0131lm\u0131\u015ft\u0131r, ancak hala telif hakk\u0131 kanunu taraf\u0131ndan sa\u011flanan korumaya k\u0131yasla \u00e7ok daha k\u0131sa bir s\u00fcredir.<\/p>\n\n\n\n<p>Ayr\u0131ca, telif hakk\u0131 kanunu ve tasar\u0131m hukunun \u00e7ak\u0131\u015fan uygulamas\u0131n\u0131 gev\u015fetmek, tasar\u0131m hukunun varl\u0131k amac\u0131n\u0131 ortadan kald\u0131rabilece\u011fi g\u00f6r\u00fc\u015f\u00fc de g\u00fc\u00e7l\u00fc bir \u015fekilde var olmu\u015ftur.<\/p>\n\n\n\n<p><a href=\"https:\/\/monolith.law\/corporate\/design-package-color-law\" target=\"_blank\" rel=\"noreferrer noopener\">https:\/\/monolith.law\/corporate\/design-package-color-law[ja]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Akatonbo_Davasi\"><\/span>Akatonbo Davas\u0131<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2021\/03\/industrial-products-copyright4.jpg\" alt=\"\" class=\"wp-image-31375\" \/><\/figure>\n\n\n\n<p>Uygulamal\u0131 sanat eserlerinin telif hakk\u0131 niteli\u011fi \u00fczerinde tart\u0131\u015f\u0131lan bir dava olan &#8220;Akatonbo Davas\u0131&#8221;, davac\u0131 \u015firketin b\u00fcy\u00fck miktarda \u00fcretip satmay\u0131 ama\u00e7lad\u0131\u011f\u0131, &#8220;Akatonbo&#8221; adl\u0131 renkli seramik fig\u00fcr\u00fcn\u00fcn, al\u00e7\u0131 ile kal\u0131p al\u0131n\u0131p kopyalar\u0131n\u0131n \u00fcretilip sat\u0131ld\u0131\u011f\u0131 iddias\u0131yla, daval\u0131 \u015firkete kar\u015f\u0131 telif hakk\u0131 ihlali temelinde \u00e7o\u011faltma ve sat\u0131\u015f\u0131n durdurulmas\u0131 talebiyle ge\u00e7ici tedbir ba\u015fvurusunda bulunmu\u015ftur.<\/p>\n\n\n\n<p>Daval\u0131 \u015firket, s\u00f6z konusu fig\u00fcr\u00fcn end\u00fcstriyel kullan\u0131m amac\u0131yla seri \u00fcretim \u00fcr\u00fcn\u00fc olarak yarat\u0131ld\u0131\u011f\u0131n\u0131, bu nedenle bir telif hakk\u0131 eseri olamayaca\u011f\u0131n\u0131 savundu.<\/p>\n\n\n\n<p>Yine de, mahkeme, &#8220;Akatonbo&#8221; fig\u00fcr\u00fcn\u00fcn, ayn\u0131 adl\u0131 \u00e7ocuk \u015fark\u0131s\u0131ndan al\u0131nan bir imaj\u0131 bir heykel olarak ifade etti\u011fini, fig\u00fcr\u00fcn \u015fekli, ifadesi, giysinin deseni ve renklerinden, duygusal yarat\u0131c\u0131 ifadenin kabul edilebilece\u011fini belirtti. Fig\u00fcr\u00fcn sanatsal de\u011fer ta\u015f\u0131d\u0131\u011f\u0131n\u0131 ve Japon Telif Hakk\u0131 Yasas\u0131&#8217;n\u0131n korumas\u0131 alt\u0131nda oldu\u011funu kabul etti.<\/p>\n\n\n\n<p>A\u015fa\u011f\u0131da, karar\u0131n \u00f6zeti incelenecektir.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Sanatsal bir eserin, seri \u00fcretim amac\u0131yla yarat\u0131ld\u0131\u011f\u0131 ve ger\u00e7ekten seri \u00fcretildi\u011fi ger\u00e7e\u011fi, eserin telif hakk\u0131 niteli\u011fini reddetmek i\u00e7in tek ba\u015f\u0131na bir gerek\u00e7e olamaz. Ayr\u0131ca, s\u00f6z konusu fig\u00fcr\u00fcn bir yandan Japon End\u00fcstriyel Tasar\u0131m Yasas\u0131&#8217;n\u0131n korumas\u0131 alt\u0131nda olabilece\u011fi i\u00e7in end\u00fcstriyel tasar\u0131m tescili m\u00fcmk\u00fcn olsa bile, end\u00fcstriyel tasar\u0131m ve sanatsal telif hakk\u0131 eserleri aras\u0131ndaki s\u0131n\u0131r\u0131n hassas bir konu oldu\u011funu, her iki durumun da bir arada var olabilece\u011fini kabul etmek gerekti\u011finden, end\u00fcstriyel tasar\u0131m tescilinin olas\u0131l\u0131\u011f\u0131n\u0131, bir eserin Japon Telif Hakk\u0131 Yasas\u0131&#8217;n\u0131n korumas\u0131 d\u0131\u015f\u0131nda b\u0131rakmak i\u00e7in bir gerek\u00e7e olarak kabul etmek m\u00fcmk\u00fcn de\u011fildir. Dolay\u0131s\u0131yla, s\u00f6z konusu fig\u00fcr, Japon Telif Hakk\u0131 Yasas\u0131&#8217;nda belirtilen sanatsal el sanatlar\u0131 olarak korunmal\u0131d\u0131r.<\/p>\n<cite>Nagasaki B\u00f6lge Mahkemesi Sasebo \u015eubesi, 7 \u015eubat 1973 (1973) karar\u0131<\/cite><\/blockquote>\n\n\n\n<p>Seri \u00fcretim amac\u0131yla yarat\u0131ld\u0131\u011f\u0131 ger\u00e7e\u011fi tek ba\u015f\u0131na bir gerek\u00e7e olarak telif hakk\u0131 niteli\u011fini reddetmek m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 ve uygulamal\u0131 sanat\u0131n da sanatsal el sanatlar\u0131 oldu\u011fu s\u00fcrece telif hakk\u0131 eseri olarak kabul edilebilece\u011fi y\u00f6n\u00fcnde bir karard\u0131r.<\/p>\n\n\n\n<p>\u00d6te yandan, telif hakk\u0131n\u0131n kabul edilmedi\u011fi durumlar da vard\u0131r. Bu durumlar, d\u00fcnya \u00e7ap\u0131nda tan\u0131nan bir sanat tasar\u0131mc\u0131s\u0131 olan davac\u0131n\u0131n, kendi tasarlad\u0131\u011f\u0131 sandalyenin (Ni Chair) kopya \u00fcr\u00fcnlerini Tayvan&#8217;dan ithal eden daval\u0131ya kar\u015f\u0131, Japon Telif Hakk\u0131 Yasas\u0131&#8217;n\u0131n ihlali gerek\u00e7esiyle \u00fcretim ve sat\u0131\u015f\u0131n durdurulmas\u0131 talebiyle ba\u015flat\u0131lan &#8220;Ni Chair Davas\u0131&#8221;d\u0131r.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Japon Telif Hakk\u0131 Yasas\u0131&#8217;nda &#8220;sanat&#8221; terimi, genellikle, sadece estetik de\u011ferlendirme konusu olan saf sanat\u0131 ifade eder ve uygulamal\u0131 sanat olan ve ayn\u0131 zamanda pratik bir amaca hizmet eden estetik yarat\u0131c\u0131 eserler, yaln\u0131zca yasan\u0131n 2. maddesinin 2. f\u0131kras\u0131 uyar\u0131nca \u00f6zellikle sanatsal telif hakk\u0131 eserlerine dahil edilen sanatsal el sanatlar\u0131 ile s\u0131n\u0131rl\u0131d\u0131r.<\/p>\n<cite>Osaka Y\u00fcksek Mahkemesi, 14 \u015eubat 1990 (1990) karar\u0131<\/cite><\/blockquote>\n\n\n\n<p>Bu karar\u0131n ard\u0131ndan, davac\u0131, karar\u0131 Japon Y\u00fcksek Mahkemesi&#8217;ne temyiz etti, ancak reddedildi.<\/p>\n\n\n\n<p>Bu \u00f6rneklerden de anla\u015f\u0131laca\u011f\u0131 gibi, geleneksel davalar\u0131n \u00e7o\u011funda, bir eserin tek par\u00e7a olarak \u00fcretilen sanatsal el sanatlar\u0131na m\u0131 ait oldu\u011fu, yoksa saf sanatla ayn\u0131 seviyede estetik de\u011ferlendirme konusu olup olmad\u0131\u011f\u0131, telif hakk\u0131 karar\u0131n\u0131n temelini olu\u015fturmu\u015ftur. Uygulamal\u0131 sanat\u0131n telif hakk\u0131 niteli\u011fi kabul edilmesi i\u00e7in y\u00fcksek bir engel olu\u015fturulmu\u015ftur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"TRIPP_TRAPP_Davasi_Ilk_Derece_Mahkemesi\"><\/span>TRIPP TRAPP Davas\u0131 \u0130lk Derece Mahkemesi<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2021\/03\/industrial-products-copyright3.jpg\" alt=\"\" class=\"wp-image-31374\" \/><\/figure>\n\n\n\n<p>\u00c7ocuk sandalyesi olan TRIPP TRAPP&#8217;\u0131n hak sahibi olan daval\u0131 \u015firket, daval\u0131 \u015firketin \u00fcretti\u011fi ve satt\u0131\u011f\u0131 sandalyenin \u015feklinin TRIPP TRAPP&#8217;\u0131n \u015fekline \u00e7ok benzedi\u011fini ve bu \u00fcr\u00fcn\u00fcn telif haklar\u0131n\u0131 (\u00e7ogaltma veya uyarlama hakk\u0131) ihlal etti\u011fini iddia etmi\u015ftir.<\/p>\n\n\n\n<p>\u0130lk derece mahkemesi olan Tokyo B\u00f6lge Mahkemesi, uygulamal\u0131 sanat\u0131n telif hakk\u0131 yasas\u0131 ile korunmas\u0131 i\u00e7in,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Telif hakk\u0131 yasas\u0131 ile koruma ve tasar\u0131m yasas\u0131 ile koruma aras\u0131nda uygun bir denge sa\u011flamak i\u00e7in, pratik i\u015flevlerden ayr\u0131ld\u0131\u011f\u0131nda, estetik bir yarat\u0131c\u0131l\u0131\u011fa sahip olmas\u0131 gerekti\u011fini belirtmi\u015ftir.<\/p>\n<cite>Tokyo B\u00f6lge Mahkemesi 17 Nisan 2014 (Gregorian Takvimi 2014) Karar\u0131 <\/cite><\/blockquote>\n\n\n\n<p>ve bu \u015fekilde, \u00f6nceki yarg\u0131 kararlar\u0131n\u0131n ak\u0131\u015f\u0131na uygun bir standartta inceleme yaparak, TRIPP TRAPP&#8217;\u0131n telif hakk\u0131 niteli\u011fini reddetti. Telif hakk\u0131 yasas\u0131 ile koruma ve tasar\u0131m yasas\u0131 ile koruma aras\u0131nda uygun bir denge sa\u011flama duru\u015fundan, pratik i\u015flevlerden ayr\u0131ld\u0131\u011f\u0131nda, estetik bir yarat\u0131c\u0131l\u0131\u011fa sahip olup olmad\u0131\u011f\u0131n\u0131 belirleme kriteri olarak kabul etti.<\/p>\n\n\n\n<p>Buna kar\u015f\u0131l\u0131k, daval\u0131 taraf temyiz etti, ancak temyiz mahkemesinde, \u00f6nceki d\u00fc\u015f\u00fcnce tarz\u0131ndan farkl\u0131 bir standart belirtildi.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"TRIPP_TRAPP_Davasi_Temyiz_Durusmasi\"><\/span>TRIPP TRAPP Davas\u0131 Temyiz Duru\u015fmas\u0131<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Temyiz duru\u015fmas\u0131nda, Fikri M\u00fclkiyet Y\u00fcksek Mahkemesi, Japon Fikri M\u00fclkiyet Hukuku&#8217;nun 2. maddesinin 2. f\u0131kras\u0131nda belirtilen &#8220;Bu kanuna g\u00f6re &#8216;sanat eserleri&#8217;, sanat ve zanaat eserlerini de i\u00e7erir&#8221; h\u00fckm\u00fcne ili\u015fkin olarak,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\">\n<p>Yukar\u0131da belirtilen h\u00fck\u00fcm, sadece &#8216;sanat eserleri&#8217; \u00f6rne\u011fini belirtir ve &#8216;sanat ve zanaat eserleri&#8217; \u00f6rne\u011fine uymayan uygulamal\u0131 sanatlar da, 1. maddenin 1. f\u0131kras\u0131nda belirtilen eser niteli\u011fi gerekliliklerini kar\u015f\u0131lad\u0131\u011f\u0131 s\u00fcrece, &#8216;sanat eserleri&#8217; olarak kabul edilip, bu kanunla korunmal\u0131d\u0131r.<\/p>\n<cite>Fikri M\u00fclkiyet Y\u00fcksek Mahkemesi, 14 Nisan 2015 (Gregorian Takvimi) Karar\u0131<\/cite><\/blockquote>\n\n\n\n<p>ifadesini kulland\u0131. Fikri M\u00fclkiyet Hukuku&#8217;nun &#8220;Bu kanuna g\u00f6re &#8216;sanat eserleri&#8217;, sanat ve zanaat eserlerini de i\u00e7erir&#8221; h\u00fckm\u00fcndeki &#8216;sanat ve zanaat eserleri&#8217;, sadece bir \u00f6rnektir ve 2. maddenin 2. f\u0131kras\u0131, sanat ve zanaat eserleri d\u0131\u015f\u0131ndaki uygulamal\u0131 sanatlar\u0131 d\u0131\u015flamamaktad\u0131r.
