Telif hakk\u0131 yasas\u0131nda eser olarak a\u00e7\u0131k\u00e7a belirtilmi\u015f olmas\u0131na ra\u011fmen, ge\u00e7mi\u015fteki yarg\u0131 kararlar\u0131na g\u00f6re &#8220;ki\u015fisel ifade alan\u0131n\u0131n s\u0131n\u0131rl\u0131 olmas\u0131 ve edebiyat, m\u00fczik, g\u00fczel sanatlar gibi eserlere k\u0131yasla yarat\u0131c\u0131l\u0131k kabul edilebilirli\u011finin daha az oldu\u011fu&#8221; belirtilmi\u015f olup, bu durumun de\u011ferlendirilmesi zor bir y\u00f6n\u00fc bulunmaktad\u0131r.<\/p>\n\n\n\n<p>Bu t\u00fcr sorunlarla ilgili olarak, 2022 (Reiwa 4) y\u0131l\u0131nda Tokyo B\u00f6lge Mahkemesi taraf\u0131ndan, konut haritalar\u0131n\u0131n &#8220;eser kapsam\u0131na girdi\u011fi&#8221; y\u00f6n\u00fcnde bir karar verilmi\u015ftir. Davac\u0131, harita bilgilerinin ara\u015ft\u0131r\u0131lmas\u0131, \u00fcretimi ve sat\u0131\u015f\u0131n\u0131 yapan Zenrin Co., Ltd. \u015firketidir. Bu \u015firket, Japonya&#8217;n\u0131n d\u00f6rt bir yan\u0131ndaki harita bilgilerini ara\u015ft\u0131rarak, &#8216;Zenrin Konut Haritas\u0131&#8217; ad\u0131 verilen ka\u011f\u0131t medya haritalar\u0131n\u0131 ve CD-ROM gibi ortamlarda saklanan &#8216;Dijital Konut Haritas\u0131 Digitown&#8217; gibi \u00fcr\u00fcnleri olu\u015fturup satmaktad\u0131r.<\/p>\n\n\n\n<p>Daval\u0131 olan posta da\u011f\u0131t\u0131m \u015firketi, Nagano prefekt\u00f6rl\u00fc\u011f\u00fcnde merkezli olup, reklam materyallerini her eve da\u011f\u0131tmak gibi i\u015flerle u\u011fra\u015fan bir limited \u015firkettir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zenrin_Konut_Haritasi_Olayinin_Ozeti\"><\/span>Zenrin Konut Haritas\u0131 Olay\u0131n\u0131n \u00d6zeti<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Daval\u0131, i\u015flerini y\u00fcr\u00fctmek i\u00e7in Zenrin&#8217;in konut haritalar\u0131n\u0131 sat\u0131n ald\u0131. Da\u011f\u0131t\u0131m personelinin posta da\u011f\u0131t\u0131m\u0131n\u0131 yapaca\u011f\u0131 b\u00f6lgeler i\u00e7in, sat\u0131n al\u0131nan konut haritalar\u0131n\u0131 k\u00fc\u00e7\u00fcltmek gibi y\u00f6ntemlerle kopyalay\u0131p, birka\u00e7 par\u00e7ay\u0131 kesip yap\u0131\u015ft\u0131rd\u0131ktan sonra, apartman isimleri, posta kutusu say\u0131lar\u0131, da\u011f\u0131t\u0131m adetleri, kav\u015fak isimleri, yol durumlar\u0131, da\u011f\u0131t\u0131m yasa\u011f\u0131 olan evler gibi posta da\u011f\u0131t\u0131m i\u015fi i\u00e7in gerekli bilgileri ekledi\u011fi bir ana harita olu\u015fturdu. Olu\u015fturulan bu ana haritay\u0131 kopyalayarak da\u011f\u0131t\u0131m personeline verip, posta da\u011f\u0131t\u0131m i\u015fini yapt\u0131rd\u0131.<\/p>\n\n\n\n<p>\u00dcstelik, daval\u0131lar, da\u011f\u0131t\u0131labilir say\u0131, bo\u015f ve harabe evler, yeni yap\u0131lar, yeni yollar, ev giri\u015fleri ve posta kutusu konumlar\u0131 gibi bilgileri elde ettiklerinde, bu bilgileri posta da\u011f\u0131t\u0131m\u0131 i\u00e7in kullan\u0131lan ana haritaya s\u00fcrekli olarak ekleyip, bu ana haritay\u0131 kopyalayarak da\u011f\u0131t\u0131m personeline verdiler.<\/p>\n\n\n\n<p>Buna kar\u015f\u0131l\u0131k, Zenrin, kendi olu\u015fturdu\u011fu ve satt\u0131\u011f\u0131 konut haritalar\u0131n\u0131n kopyalan\u0131p, kesilip yap\u0131\u015ft\u0131r\u0131larak posta da\u011f\u0131t\u0131m i\u015fi i\u00e7in kullan\u0131lan haritalar\u0131n olu\u015fturulmas\u0131, bu kopyalar\u0131n da\u011f\u0131t\u0131lmas\u0131 veya kiralanmas\u0131 yoluyla kamuya sunulmas\u0131, bu haritalar\u0131n g\u00f6r\u00fcnt\u00fc verilerinin y\u00f6netildi\u011fi web sitelerinde yay\u0131nlanmas\u0131 gibi eylemlerin, s\u00f6z konusu konut haritalar\u0131yla ilgili telif haklar\u0131 (\u00e7o\u011faltma hakk\u0131, devir hakk\u0131, \u00f6d\u00fcn\u00e7 verme hakk\u0131 ve kamuya iletim hakk\u0131 gibi) ihlali oldu\u011funu iddia etti. Zenrin, posta da\u011f\u0131t\u0131m \u015firketi ve temsilcisine, zarar\u0131n bir k\u0131sm\u0131n\u0131n \u00f6denmesini ve Japon Telif Hukuku&#8217;nun 112. maddesinin 1. ve 2. f\u0131kralar\u0131na dayanarak, \u00e7o\u011faltma, bu \u00e7o\u011falt\u0131lm\u0131\u015f eserlerin kamuya da\u011f\u0131t\u0131lmas\u0131 veya \u00f6d\u00fcn\u00e7 verilmesi, otomatik kamuya iletim veya iletime haz\u0131r hale getirilmesinin engellenmesini ve \u00e7o\u011falt\u0131lan haritalar\u0131n imha edilmesini talep etti.<\/p>\n\n\n\n<p>\u0130lgili makale: <a class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Telif Hukuku&#8217;nun 10. maddesinin 1. f\u0131kras\u0131nda &#8216;Bu kanun kapsam\u0131nda telif eser olarak say\u0131lanlar genellikle \u015funlard\u0131r&#8217; denilerek \u00f6rnekler verilmi\u015f ve 6. s\u0131ra olarak &#8216;Haritalar veya bilimsel nitelikteki \u00e7izimler, grafikler, modeller ve di\u011fer \u015fekiller&#8217; ifadesiyle haritalar\u0131n telif eser oldu\u011fu belirtilmi\u015ftir.<\/p>\n\n\n\n<p>\u00d6te yandan, Heisei 13 (2001) y\u0131l\u0131nda verilen bir kararda belirtildi\u011fi \u00fczere, &#8216;Haritalar, arazi kullan\u0131m durumlar\u0131 gibi unsurlar\u0131 belirli semboller kullanarak objektif bir \u015fekilde ifade eden \u015feylerdir ve ki\u015fisel ifade alan\u0131 az oldu\u011fundan, edebiyat, m\u00fczik, g\u00f6rsel sanatlar gibi telif eserlerle k\u0131yasland\u0131\u011f\u0131nda yarat\u0131c\u0131l\u0131k kabul edilebilirli\u011fi daha azd\u0131r&#8217; (Tokyo B\u00f6lge Mahkemesi, Heisei 13 (2001) y\u0131l\u0131n\u0131n 23 Ocak karar\u0131) \u015feklinde bir genel g\u00f6r\u00fc\u015f bulunmaktad\u0131r.<\/p>\n\n\n\n<p>Yine de, ayn\u0131 karar &#8216;Hangi bilgilerin se\u00e7ilip g\u00f6sterilece\u011fi ve bu g\u00f6sterim y\u00f6ntemi konusunda, harita \u00fcreticisinin ki\u015fili\u011fi, bilgisi, deneyimi, yerinde yap\u0131lan ara\u015ft\u0131rman\u0131n derecesi gibi fakt\u00f6rler \u00f6nemli bir rol oynayabilir ve bu nedenle yarat\u0131c\u0131l\u0131k g\u00f6sterebilir&#8217; (ayn\u0131 karar) diyerek belirtmi\u015ftir.<\/p>\n\n\n\n<p>Sonu\u00e7 olarak, haritan\u0131n telif eser olup olmad\u0131\u011f\u0131na dair karar &#8216;Hangi bilgilerin se\u00e7ilip g\u00f6sterilece\u011fi ve bu class=\"ez-toc-section\" id=\"Zenrin%E2%80%99in_Iddialari\"><\/span>Zenrin&#8217;in \u0130ddialar\u0131<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Davac\u0131 Zenrin, a\u015fa\u011f\u0131daki nedenlerden \u00f6t\u00fcr\u00fc, konut haritalar\u0131n\u0131n yarat\u0131c\u0131l\u0131k i\u00e7erdi\u011fini ve harita eserlerine tekab\u00fcl etti\u011fini iddia etmi\u015ftir:<\/p>\n\n\n\n<ul>\n<li>Zenrin&#8217;in konut haritalar\u0131, bir\u00e7ok ara\u015ft\u0131rmac\u0131n\u0131n detayl\u0131 saha ara\u015ft\u0131rmalar\u0131yla elde etti\u011fi do\u011fru ve hassas bilgileri se\u00e7erek ve elerken, bu bilgileri harita bilgisi olarak nas\u0131l do\u011fru bir \u015fekilde d\u00fczenleyip ifade edece\u011fi ve kullan\u0131c\u0131lar i\u00e7in nas\u0131l daha anla\u015f\u0131l\u0131r ve g\u00f6z al\u0131c\u0131 bir d\u00fczenleme ve ifade olu\u015fturaca\u011f\u0131 \u00fczerine yo\u011funla\u015farak, yenilik\u00e7i ve yarat\u0131c\u0131 d\u00fczenlemeler yaparak birle\u015fik bir \u015fekilde d\u00fczenlenmi\u015ftir.<\/li>\n\n\n\n<li>Her haritada belirtilen bina \u015fekil \u00e7er\u00e7eveleri (binalar\u0131n ku\u015fbak\u0131\u015f\u0131 g\u00f6r\u00fcn\u00fcm\u00fcn\u00fc temsil eden \u00e7er\u00e7eve \u00e7izgileri), saha ara\u015ft\u0131rmas\u0131 yapan ara\u015ft\u0131rmac\u0131lar taraf\u0131ndan, \u00e7evredeki binalarla olan konum ili\u015fkisini g\u00f6z \u00f6n\u00fcnde bulundurarak, g\u00f6z karar\u0131 veya ad\u0131m sayarak kabaca konum ve uzunlu\u011fu belirlerken, herkesin \u00e7izimi kal\u0131nl\u0131\u011f\u0131 ve uzunlu\u011fu, \u00e7er\u00e7eve i\u00e7inde belirtilen sakin isimleri gibi fontlar vb.) aras\u0131ndan belirli bir ifade y\u00f6ntemini benimsemi\u015ftir.<\/li>\n\n\n\n<li>Her harita olu\u015fturulurken, Japon Ulusal Co\u011frafya Enstit\u00fcs\u00fc&#8217;n\u00fcn \u015eehir Planlama Temel Haritas\u0131na ba\u015fvurulabilir; ancak, her harita ile \u015eehir Planlama Temel Haritas\u0131 aras\u0131nda g\u00f6r\u00fcn\u00fcm a\u00e7\u0131s\u0131ndan tamamen farkl\u0131 bir izlenim bulunmakta, co\u011frafi haritalara hava haritalar\u0131n d\u00f6rt kenar\u0131nda \u00f6l\u00e7ek bulunmakta ve haritan\u0131n \u00fcst, sa\u011f \u00fcst, sa\u011f, sa\u011f alt, alt, sol alt, sol ve sol \u00fcst k\u0131s\u0131mlar\u0131nda yer alan harita numaralar\u0131 belirtilerek, aranan haritan\u0131n kolayca bulunabilmesine olanak tan\u0131nmaktad\u0131r.<\/li>\n\n\n\n<li>Haritalarda, yol veya kald\u0131r\u0131mlar ile arsa s\u0131n\u0131rlar\u0131 aras\u0131ndaki s\u0131n\u0131rlar kesik \u00e7izgilerle, yol ve kald\u0131r\u0131m s\u0131n\u0131rlar\u0131 ise kesik \u00e7izgilerle \u00fczerinde bulunan binalar\u0131n ku\u015fbak\u0131\u015f\u0131 g\u00f6r\u00fcn\u00fcm\u00fcn\u00fc temsil eden ev \u015feklindeki \u00e7er\u00e7evelerle i\u015faretlenmi\u015f ve bu \u00e7er\u00e7evelerin i\u00e7ine s\u0131\u011facak \u015fekilde, binalar\u0131n sakinlerinin isimleri, d\u00fckkan isimleri, bina isimleri gibi bilgiler eklenmi\u015ftir.<\/li>\n<\/ul>\n\n\n\n<p>Ayr\u0131ca, park alanlar\u0131 veya otoparklar gibi kullan\u0131lan arazilerde, park veya otopark isimleri gibi bilgiler de yer
