AB b\u00f6lgesine hizmet sunan Japon \u015firketleri de bu yasan\u0131n kapsam\u0131na girdi\u011finden, bilgi sahibi olmalar\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Bu b\u00f6l\u00fcmde, Dijital Hizmetler Yasas\u0131&#8217;n\u0131n ana noktalar\u0131n\u0131 ve Japon \u015firketler \u00fczerindeki etkilerini ve al\u0131nmas\u0131 gereken \u00f6nlemleri, Japon mevzuat\u0131 ile Hizmetler Yasas\u0131&#8221; (DSA = Digital Services Act), 2022 y\u0131l\u0131n\u0131n Kas\u0131m ay\u0131n\u0131n 16&#8217;s\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe giren ve 2024 y\u0131l\u0131n\u0131n \u015eubat ay\u0131n\u0131n 17&#8217;sinde tam anlam\u0131yla uygulamaya konan, AB&#8217;deki elektronik ticarete ili\u015fkin kapsaml\u0131 kurallar\u0131 i\u00e7eren bir yasal d\u00fczenlemedir.<\/p>\n\n\n\n<p>AB, 2000 y\u0131l\u0131nda elektronik ticaret direktifini y\u00fcr\u00fcrl\u00fc\u011fe koymu\u015ftu; ancak internet ve \u00e7evrimi\u00e7i platformlar gibi dijital ortamlar\u0131n evrimi, bu direktifin uygulanmas\u0131n\u0131 zorla\u015ft\u0131rd\u0131\u011f\u0131 i\u00e7in, s\u00f6z konusu direktifin yerini alacak ve do\u011frudan hukuki ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 olan bir AB birle\u015fik kural\u0131 (reg\u00fclasyon) olan DSA (Dijital Hizmetler Yasas\u0131) y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.<\/p>\n\n\n\n<p>Bu yasa, &#8220;Dijital \u00c7a\u011fa Uygun Bir Avrupa&#8221; olarak bilinen AB&#8217;nin dijital stratejisinin bir par\u00e7as\u0131 olarak uygulanmaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"DSA%E2%80%99nin_Amaci\"><\/span>DSA&#8217;n\u0131n Amac\u0131<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/monolith.law\/wp-content\/uploads\/2024\/02\/Shutterstock_2298684713.jpg\" alt=\"DSA'n\u0131n Amac\u0131\" class=\"wp-image-64330\" \/><\/figure>\n\n\n\n<p>15 Aral\u0131k 2020&#8217;de DMA (Dijital Pazar Yasas\u0131) ile birlikte a\u00e7\u0131klanan DSA (Dijital Hizmetler Yasas\u0131)&#8217;n\u0131n amac\u0131, birinci maddede, &#8216;\u2460 Avrupa Birli\u011fi Temel Haklar \u015eart\u0131&#8217;nda garanti alt\u0131na al\u0131nan temel haklar\u0131n t\u00fcm dijital hizmet kullan\u0131c\u0131lar\u0131 i\u00e7in korundu\u011fu, daha g\u00fcvenli ve g\u00fcvenilir bir dijital alan\u0131n olu\u015fturulmas\u0131, \u2461 AB pazar\u0131nda ve k\u00fcresel alanda yenilik\u00e7ili\u011fi te\u015fvik etmek i\u00e7in adil rekabet ko\u015fullar\u0131n\u0131n sa\u011flanmas\u0131&#8217; olarak iki ana ba\u015fl\u0131k alt\u0131nda a\u00e7\u0131klanmaktad\u0131r.<\/p>\n\n\n\n<p>Bu yasan\u0131n odak noktas\u0131, yasad\u0131\u015f\u0131 i\u00e7eriklerle m\u00fccadele olarak kabul edilmektedir. Di\u011fer bir deyi\u015fle, &#8216;\u00c7evrimd\u0131\u015f\u0131 ortamda yasad\u0131\u015f\u0131 olan her \u015fey \u00e7evrimi\u00e7i ortamda da yasad\u0131\u015f\u0131d\u0131r&#8217; ilkesini hayata ge\u00e7irmek amac\u0131yla, \u00f6rne\u011fin \u00e7evrimi\u00e7i ortamdaki nefret s\u00f6ylemi veya ter\u00f6r\u00fcn k\u0131\u015fk\u0131rt\u0131lmas\u0131 gibi yasad\u0131\u015f\u0131 i\u00e7erikler ve sahte \u00fcr\u00fcnler gibi yasad\u0131\u015f\u0131 mallar i\u00e7in, \u015firketlere silme dahil \u00e7e\u015fitli \u00f6nlemler alma zorunlulu\u011fu getirilmektedir. AB i\u00e7inde kullan\u0131c\u0131lar\u0131 bulunan Japon \u015firketler, bu yasaya uyum sa\u011flamak zorunda olduklar\u0131 i\u00e7in b\u00fcy\u00fck bir etkilenme s\u00f6z konusu olacakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"DSA_Uygulama_Kapsami\"><\/span>DSA Uygulama Kapsam\u0131<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>DSA d\u00fczenlemelerinin kapsad\u0131\u011f\u0131 d\u00f6rt t\u00fcr sa\u011flay\u0131c\u0131 (arac\u0131 hizmet sa\u011flay\u0131c\u0131lar) a\u015fa\u011f\u0131daki gibidir:<\/p>\n\n\n\n<ol>\n<li>Arac\u0131 Hizmetler<\/li>\n\n\n\n<li>Bar\u0131nd\u0131rma Hizmetleri<\/li>\n\n\n\n<li>\u00c7evrimi\u00e7i Platformlar<\/li>\n\n\n\n<li>\u00c7ok B\u00fcy\u00fck \u00c7evrimi\u00e7i Platformlar (VLOP) &amp; \u00c7ok B\u00fcy\u00fck Arama Motorlar\u0131 (VLOSE)<\/li>\n<\/ol>\n\n\n\n<p>DSA, AB b\u00f6lgesi i\u00e7indeki kullan\u0131c\u0131lara y\u00f6nelik dijital hizmetleri kapsamaktad\u0131r ve sa\u011flay\u0131c\u0131n\u0131n bulundu\u011fu yer (\u00fclke) \u00f6nemli de\u011fildir. Japon \u015firketler, AB&#8217;ye dijital hizmet sunarken DSA d\u00fczenlemelerine uymak zorundad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"DSA_Kapsaminda_Saglayicilara_Yuklenen_Alti_Yukumluluk_ve_Muafiyet_Hukumleri\"><\/span>DSA Kapsam\u0131nda Sa\u011flay\u0131c\u0131lara Y\u00fcklenen Alt\u0131 Y\u00fck\u00fcml\u00fcl\u00fck ve Muafiyet H\u00fck\u00fcmleri<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>DSA, sa\u011flay\u0131c\u0131lar\u0131n i\u015fletme \u00f6zelliklerine ve b\u00fcy\u00fckl\u00fc\u011f\u00fcne g\u00f6re a\u015famal\u0131 y\u00fck\u00fcml\u00fcl\u00fckler getirmekte ve muafiyet gereklilikleri de farkl\u0131l\u0131k g\u00f6stermektedir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Saglayicilara_Yuklenen_Yukumlulukler\"><\/span>Sa\u011flay\u0131c\u0131lara Y\u00fcklenen Y\u00fck\u00fcml\u00fcl\u00fckler<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>DSA taraf\u0131ndan belirlenen sa\u011flay\u0131c\u0131 y\u00fck\u00fcml\u00fcl\u00fckleri, &#8220;Kullan\u0131c\u0131 Koruma&#8221;, &#8220;Kullan\u0131m \u015eartlar\u0131&#8221;, &#8220;\u0130\u00e7erik vb. ile \u0130lgili \u0130\u015flemler&#8221;, &#8220;\u00c7evrimi\u00e7i Reklamlar&#8221;, &#8220;Sorumluluk ve \u015eeffafl\u0131k&#8221; ve &#8220;Di\u011fer\/Genel&#8221; olmak \u00fczere alt\u0131 kategoriye ayr\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Ayr\u0131ca, AB i\u00e7inde ayl\u0131k ortalama 45 milyon kullan\u0131c\u0131ya (AB&#8217;nin %10&#8217;u) ula\u015fan &#8220;\u00c7ok B\u00fcy\u00fck \u00c7evrimi\u00e7i Platformlar&#8221; = VLOP (Very Large Online Platform) ve &#8220;\u00c7ok B\u00fcy\u00fck \u00c7evrimi\u00e7i Arama Motorlar\u0131&#8221; = VLOSE (Very Large Online Search Engine) i\u00e7in daha kat\u0131 kurallar y\u00fcr\u00fcrl\u00fc\u011fe konulmu\u015ftur.<\/p>\n\n\n\n<p>Belirlenen VLOP ve VLOSE, karar\u0131n tebli\u011finden d\u00f6rt ay i\u00e7inde, kendi sistemlerini, kaynaklar\u0131n\u0131 ve s\u00fcre\u00e7lerini DSA&#8217;ya uygun hale getirmeli, azalt\u0131c\u0131 tedbirlerin uygulanmas\u0131 ve yasalara uygun ba\u011f\u0131ms\u0131z sistemlerin kurulmas\u0131 gerekmektedir. Bunun \u00fczerine, denetim ve ilk y\u0131ll\u0131k risk de\u011ferlendirmesini ger\u00e7ekle\u015ftirmeli ve sonu\u00e7lar\u0131 Avrupa Komisyonu&#8217;na bildirmelidirler. Ayr\u0131ca, veri eri\u015fimi sa\u011flama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc de getirilmi\u015ftir.
