Bu disiplin cezas\u0131 d\u0131\u015f\u0131nda herhangi bir disiplin cezas\u0131 almam\u0131\u015f ve \u00e7al\u0131\u015fma durumunda da \u00f6zel bir sorun bulunmamaktayd\u0131.<\/p>\n\n\n\n<p>2017 (Heisei 29) y\u0131l\u0131n\u0131n 28 Nisan g\u00fcn\u00fc, o zaman \u00e7al\u0131\u015ft\u0131\u011f\u0131 lisenin meslekta\u015flar\u0131n\u0131n ho\u015f geldin partisine kat\u0131lmak i\u00e7in, okuldan \u00f6zel arac\u0131n\u0131 kullanarak parti yerine yak\u0131n bir otoparka park etti ve yakla\u015f\u0131k d\u00f6rt saat boyunca ho\u015f geldin partisine kat\u0131ld\u0131 ve alkol ald\u0131. Daha sonra 20 km&#8217;den fazla uzakl\u0131ktaki evine d\u00f6nmek \u00fczere \u00f6zel arac\u0131n\u0131 kullanarak yola \u00e7\u0131kt\u0131 ve 100 metre gittikten sonra ihmal sonucu maddi hasara yol a\u00e7an bir kaza yapt\u0131.<\/p>\n\n\n\n<p>Miyagi Eyaleti, 2017 (Heisei 29) y\u0131l\u0131n\u0131n 17 May\u0131s tarihinde, alkoll\u00fc ara\u00e7 kullan\u0131m\u0131 ve maddi hasara yol a\u00e7an kaza yapmas\u0131 nedeniyle, disiplin cezas\u0131yla i\u015ften \u00e7\u0131karma ve emeklilik \u00f6dene\u011finin tamam\u0131n\u0131n (17.246.467 Yen) \u00f6denmemesi karar\u0131n\u0131 (tam \u00f6deme k\u0131s\u0131tlama cezas\u0131) verdi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Yuksek_Mahkeme_Karari_Emeklilik_Odeneginin_Tamaminin_Odenmemesi_Takdir_Yetkisinin_Sinirlarini_Asar\"><\/span>Y\u00fcksek Mahkeme Karar\u0131: Emeklilik \u00d6dene\u011finin Tamam\u0131n\u0131n \u00d6denmemesi, Takdir Yetkisinin S\u0131n\u0131rlar\u0131n\u0131 A\u015far<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Davac\u0131, Miyagi \u0130li&#8217;ne kar\u015f\u0131, disiplin cezas\u0131 olarak verilen i\u015ften \u00e7\u0131karma ve t\u00fcm emeklilik \u00f6dene\u011finin \u00f6denmemesi kararlar\u0131n\u0131n iptali i\u00e7in dava a\u00e7t\u0131.<\/p>\n\n\n\n<p>\u0130lk derece mahkemesi olan Sendai Y\u00fcksek Mahkemesi, i\u015ften \u00e7\u0131karma karar\u0131n\u0131n yasal oldu\u011funu belirtti.
