i\u015fverenin i\u015f\u00e7ilere i\u015f ko\u015fullar\u0131n\u0131 a\u00e7\u0131k\u00e7a belirtmek i\u00e7in verdi\u011fi yaz\u0131l\u0131 bir belgedir. \u0130\u015f ko\u015fullar\u0131, \u00fccret, \u00e7al\u0131\u015fma saatleri, mola saatleri, tatil g\u00fcnleri, sosyal sigorta ve refah gibi, i\u015fle ilgili \u00e7e\u015fitli hususlar\u0131 i\u00e7erir.<\/p>\n\n\n\n<p>Bu &#8220;\u0130\u015f Ko\u015fullar\u0131 Bildirim Belgesi&#8221;, yasal d\u00fczenlemeler gere\u011fi i\u015fverenin i\u015f\u00e7ilere bildirmesi gereken bir belgedir ve taraflar\u0131n anla\u015fmas\u0131yla olu\u015fturulan bir belge de\u011fildir. \u00d6te yandan, i\u015f s\u00f6zle\u015fmesi, i\u015fveren ve i\u015f\u00e7i aras\u0131nda anla\u015fmayla yap\u0131lan bir belgedir ancak yasal olarak talep edilen bir belge de\u011fildir.<\/p>\n\n\n\n<p>A\u015fa\u011f\u0131daki 1&#8217;den 6&#8217;ya kadar olan, i\u015fe ba\u015flarken son derece \u00f6nemli olan ko\u015fullar ve hususlar &#8220;kesinlikle a\u00e7\u0131k\u00e7a belirtilmesi gereken maddeler&#8221; olarak kabul edilir ve yaz\u0131l\u0131 bir bildirimle a\u00e7\u0131klanmalar\u0131 gerekmektedir. Bu belgeye &#8220;\u0130\u015f Ko\u015fullar\u0131 Bildirim Belgesi&#8221; denir. \u0130\u015f\u00e7i isterse, belge verilmesi yerine, faks veya e-posta gibi elektronik y\u00f6ntemlerle de bu ko\u015fullar a\u00e7\u0131klanabilir.<\/p>\n\n\n\n<p>7&#8217;den 14&#8217;e kadar olan maddeler &#8220;g\u00f6receli a\u00e7\u0131k\u00e7a belirtilmesi gereken maddeler&#8221; olarak kabul edilir ve s\u00f6zl\u00fc olarak a\u00e7\u0131klanabilirler.<\/p>\n\n\n\n<ol>\n<li>\u0130\u015f s\u00f6zle\u015fmesinin s\u00fcresi<\/li>\n\n\n\n<li>S\u00fcreli i\u015f s\u00f6zle\u015fmesinin yenilenmesi durumundaki kriterler (toplam s\u00f6zle\u015fme s\u00fcresi veya yenileme say\u0131s\u0131)<\/li>\n\n\n\n<li>\u00c7al\u0131\u015fma yeri ve yap\u0131lacak i\u015fler (de\u011fi\u015fiklik kapsam\u0131 dahil)<\/li>\n\n\n\n<li>\u0130\u015fe ba\u015flama ve biti\u015f saatleri, fazla mesai varl\u0131\u011f\u0131, mola saatleri, tatil g\u00fcnleri, izinler vb. hakk\u0131ndaki i\u015f ko\u015fullar\u0131 bildirim belgesinin verilme zaman\u0131, s\u00fcresiz d\u00f6n\u00fc\u015f\u00fcm ba\u015fvuru hakk\u0131n\u0131n do\u011fdu\u011fu s\u00fcreli i\u015f s\u00f6zle\u015fmesinin yenilenme zaman\u0131d\u0131r.<\/p>\n\n\n\n<p>Heisei 25 (2013) y\u0131l\u0131 Nisan ay\u0131nda yap\u0131lan \u0130\u015f S\u00f6zle\u015fmesi Kanunu&#8217;nda yap\u0131lan de\u011fi\u015fiklikle yeni olarak getirilen s\u00fcresiz d\u00f6n\u00fc\u015f\u00fcm sistemidir.<\/p>\n\n\n\n<p>S\u00fcresiz d\u00f6n\u00fc\u015f\u00fcm sistemi, belirli \u015fartlar\u0131 sa\u011flad\u0131\u011f\u0131nda, i\u015f\u00e7inin iste\u011fi \u00fczerine s\u00fcreli i\u015f s\u00f6zle\u015fmesinden s\u00fcresiz i\u015f s\u00f6zle\u015fmesine ge\u00e7i\u015fi sa\u011flayan bir sistem olup, &#8220;i\u015fverenin s\u00fcreli i\u015f s\u00f6zle\u015fmesini k\u00f6t\u00fcye kullan\u0131m\u0131n\u0131 (i\u015ften \u00e7\u0131karmalar veya so\u011futma) engellemek ve istihdam\u0131n istikrar\u0131n\u0131 sa\u011flamak&#8221; amac\u0131n\u0131 ta\u015f\u0131maktad\u0131r.<\/p>\n\n\n\n<p>\u00d6zellikle, ayn\u0131 i\u015fverenle yap\u0131lan s\u00fcreli i\u015f s\u00f6zle\u015fmesinin &#8220;bir kez veya daha fazla yenilenmi\u015f olmas\u0131&#8221; ve &#8220;s\u00f6zle\u015fme s\u00fcresinin toplamda 5 y\u0131l\u0131 a\u015fm\u0131\u015f olmas\u0131&#8221; gibi iki \u015fart\u0131 sa\u011flayan s\u00fcreli s\u00f6zle\u015fmeli i\u015f\u00e7iler ba\u015fvuruda bulundu\u011funda, s\u00f6zle\u015fmeleri s\u00fcresiz i\u015f s\u00f6zle\u015fmesine d\u00f6n\u00fc\u015ft\u00fcr\u00fcl\u00fcr (\u0130\u015f S\u00f6zle\u015fmesi Kanunu Madde 18).<\/p>\n\n\n\n<p>S\u00fcresiz d\u00f6n\u00fc\u015f\u00fcm ba\u015fvuru hakk\u0131n\u0131 kullanabilece\u011finiz ge\u00e7erli s\u00fcre, bu hakk\u0131n do\u011fdu\u011fu s\u00fcreli s\u00f6zle\u015fmenin s\u00fcresi i\u00e7inde (1 y\u0131l) oldu\u011fundan, dikkatli olunmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>S\u00fcresiz i\u015f s\u00f6zle\u015fmesine ge\u00e7i\u015f zaman\u0131, ba\u015fvuruda bulunulan s\u00fcreli i\u015f s\u00f6zle\u015fmesinin biti\u015f tarihinden (6. y\u0131l) itibaren ertesi g\u00fcn (7. y\u0131l) ba\u015flar.
