ma\u011fdurlar\u0131n zararlar\u0131n\u0131n etkili bir \u015fekilde giderilmesini sa\u011flamak amac\u0131yla, &#8220;b\u00fcy\u00fck \u00f6l\u00e7ekli platform i\u015fletmecilerine&#8221; y\u00f6nelik yeni d\u00fczenlemeler getirilmi\u015f ve yasan\u0131n ad\u0131 de\u011fi\u015ftirilmi\u015ftir.<\/p>\n\n\n\n<p>Reiwa 3 (2021) y\u0131l\u0131nda, bir\u00e7ok ma\u011fdurun &#8220;g\u00f6nderen bilgilerinin if\u015fa edilmesi talebi&#8221;nde bulunmas\u0131yla, yarg\u0131 s\u00fcre\u00e7lerinin a\u011f\u0131rl\u0131\u011f\u0131 sorun haline gelmi\u015f ve h\u0131zl\u0131 ma\u011fdur yard\u0131m\u0131 i\u00e7in, g\u00f6nderen bilgilerinin if\u015fas\u0131n\u0131n tek bir prosed\u00fcrle yap\u0131lmas\u0131n\u0131 m\u00fcmk\u00fcn k\u0131lan dava d\u0131\u015f\u0131 i\u015flemler olu\u015fturulmu\u015f ve yasa bu y\u00f6nde de\u011fi\u015ftirilmi\u015ftir. Ancak, &#8220;hak ihlalinin a\u00e7\u0131k olma \u015fart\u0131&#8221; ve yabanc\u0131 \u015firketlerin kullan\u0131m ko\u015fullar\u0131n\u0131n Japon yasalar\u0131n\u0131 ve zarar\u0131n ger\u00e7ek durumunu dikkate almamas\u0131 gibi sorunlar belirtilmi\u015f ve sistem her zaman yeterince i\u015flevsel olmam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Reiwa 6 (2024) y\u0131l\u0131ndaki de\u011fi\u015fiklikle, sa\u011flay\u0131c\u0131lar\u0131n uygun bir \u015fekilde i\u015flemesi i\u00e7in gerekli d\u00fczenlemeleri g\u00f6n\u00fcll\u00fc olarak yapmalar\u0131 beklenen bir sistem tasarlanm\u0131\u015f ve belirlenen &#8220;b\u00fcy\u00fck \u00f6l\u00e7ekli platform i\u015fletmecilerine&#8221; silme kriterlerinin olu\u015fturulmas\u0131, m\u00fcdahale durumlar\u0131n\u0131n kamuoyu ile payla\u015f\u0131lmas\u0131 gibi y\u00fck\u00fcml\u00fcl\u00fckler getirilmi\u015f ve cezai yapt\u0131r\u0131mlar da uygulanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>De\u011fi\u015fiklikler a\u015fa\u011f\u0131daki gibidir:<\/p>\n\n\n\n<ol>\n<li>Yasa ad\u0131n\u0131n de\u011fi\u015ftirilmesi<\/li>\n\n\n\n<li>&#8220;B\u00fcy\u00fck \u00f6l\u00e7ekli platform i\u015fletmecilerinin&#8221; ifadesi, \u00f6rne\u011fin, silme talep formunun kolayca bulunabilir olmas\u0131, ya\u015f s\u0131n\u0131rlamas\u0131 nedeniyle hesap olu\u015fturamayan ki\u015filerin de silme talebinde bulunabilmesi, gizlilik gibi haklar\u0131n ihlal edilmemesine dikkat edilmesi gibi hususlar\u0131 i\u00e7ermektedir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"%E2%80%9CHak_Ihlali_Bilgi_Inceleme_Uzmani%E2%80%9Dnin_Atanmasi_ve_Bildirimi\"><\/span>&#8220;Hak \u0130hlali Bilgi \u0130nceleme Uzman\u0131&#8221;n\u0131n Atanmas\u0131 ve Bildirimi<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>&#8220;B\u00fcy\u00fck \u00f6l\u00e7ekli platform i\u015fletmecileri&#8221;, hak ihlali ma\u011fdurlar\u0131ndan bir silme talebi ald\u0131klar\u0131nda, gecikmeksizin ilgili hak ihlali bilgileri \u00fczerinde gerekli incelemeyi yapmak zorundad\u0131rlar (Madde 23).<\/p>\n\n\n\n<p>\u0130ncelemenin, hukuki i\u015flemleri uygun bir \u015fekilde y\u00fcr\u00fctmek i\u00e7in, internet \u00fczerinden meydana gelen hak ihlallerine y\u00f6nelik m\u00fcdahaleler konusunda yeterli bilgi ve deneyime sahip &#8220;Hak \u0130hlali Bilgi \u0130nceleme Uzman\u0131&#8221;n\u0131n atanmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>&#8220;Hak \u0130hlali Bilgi \u0130nceleme Uzman\u0131&#8221;n\u0131n gereklilikleri a\u00e7\u0131s\u0131ndan, \u00f6zellikle, Japon k\u00fclt\u00fcr\u00fc ve sosyal meseleler hakk\u0131nda yeterli bilgi ve deneyime sahip hukuk profesyonelleri (sadece ger\u00e7ek ki\u015filer) uygun olarak kabul edilmektedir.<\/p>\n\n\n\n<p>Hak \u0130hlali Bilgi \u0130nceleme Uzmanlar\u0131n\u0131n say\u0131s\u0131, &#8220;ayl\u0131k ortalama 10 milyon g\u00f6nderen kullan\u0131c\u0131 ba\u015f\u0131na en az bir ki\u015fi veya ayl\u0131k ortalama 2 milyon uzatma ba\u015f\u0131na en az bir ki\u015fi&#8221; ancak hangi bilgilerin (ifadelerin) silinmesi gerekti\u011fine dair somut kararlar, &#8220;b\u00fcy\u00fck \u00f6l\u00e7ekli platform i\u015fletmecileri&#8221;nin \u00f6zerkli\u011fine b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Hak ihlali ve yasa d\u0131\u015f\u0131 bilgiler, Ceza Kanunu&#8217;na kar\u015f\u0131l\u0131k gelen su\u00e7lar\u0131 ifade eder, ancak ifadelerde farkl\u0131l\u0131klar vard\u0131r. kan\u0131tlanmal\u0131d\u0131r ve bu, talep sahibinin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcd\u00fcr.<\/p>\n\n\n\n<p>Silme talepleri, yay\u0131nc\u0131 bilgilerinin a\u00e7\u0131klanmas\u0131 taleplerine k\u0131yasla daha y\u00fcksek bir engel olu\u015fturmamakla birlikte, &#8220;hak ihlalinin a\u00e7\u0131k olmas\u0131&#8221;
