y\u00f6netilmedi\u011fi \u015f\u00fcphesi varsa, idari makamlardan y\u00f6nlendirme veya yapt\u0131r\u0131m alma olas\u0131l\u0131\u011f\u0131 bulunmaktad\u0131r. \u0130dari yapt\u0131r\u0131mlar\u0131n i\u00e7eri\u011fi ve idari y\u00f6nlendirmelerle aras\u0131ndaki farklar\u0131 a\u00e7\u0131kl\u0131yoruz.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Japonya%E2%80%99daki_Bakim_Tesislerine_Yonelik_Idari_Yaptirimlar\"><\/span>Japonya&#8217;daki Bak\u0131m Tesislerine Y\u00f6nelik \u0130dari Yapt\u0131r\u0131mlar<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Bak\u0131m tesislerine y\u00f6nelik idari yapt\u0131r\u0131mlar, Japon Bak\u0131m Sigortas\u0131 Kanunu h\u00fck\u00fcmlerine dayanarak, idari organlar\u0131n bak\u0131m hizmeti sa\u011flay\u0131c\u0131lar\u0131na uygulad\u0131\u011f\u0131 yasal \u00f6nlemlerdir. Bu idari yapt\u0131r\u0131mlar, bak\u0131m hizmetlerinin kalitesini g\u00fcvence alt\u0131na almak ve kullan\u0131c\u0131lar\u0131n haklar\u0131n\u0131 korumak amac\u0131yla uygulanmaktad\u0131r.<\/p>\n\n\n\n<p>Bak\u0131m hizmeti sa\u011flayan i\u015fletmeler i\u00e7in, Bak\u0131m Sigortas\u0131 Kanunu kapsam\u0131ndaki belirli bir ataman\u0131n iptali veya durdurulmas\u0131 gibi durumlar idari yapt\u0131r\u0131ma \u00f6rnek te\u015fkil etmektedir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Idari_Yonlendirme_ve_Idari_Yaptirim_Arasindaki_Fark\"><\/span>\u0130dari Y\u00f6nlendirme ve \u0130dari Yapt\u0131r\u0131m Aras\u0131ndaki Fark<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>\u0130dari y\u00f6nlendirme, yasal ihlallerin \u015f\u00fcphesi oldu\u011funda idari organlar\u0131n i\u015fletmelere yapt\u0131\u011f\u0131 tavsiye ve y\u00f6nlendirmelerdir. Bak\u0131m hizmeti i\u015fletmeleri, y\u00f6netim organlar\u0131ndan belirleme alarak Japon Bak\u0131m Sigortas\u0131 Kanunu&#8217;na uygun olarak bak\u0131m i\u015fletmecili\u011fi yapmaktad\u0131r. Y\u00f6netim taraf\u0131ndan verilen belirlemenin iptal edilmesi durumunda, bak\u0131m hizmeti i\u015fletmesi bak\u0131m \u00fccretlerini alamaz ve i\u015fletmeyi s\u00fcrd\u00fcremez hale gelir.<\/p>\n\n\n\n<p>Ayr\u0131ca, belirleme iptali y\u00f6netmelik cezas\u0131n\u0131 ald\u0131\u011f\u0131n\u0131zda, iptal tarihinden itibaren 5 y\u0131l boyunca yeni bir belirleme alamazs\u0131n\u0131z. Belirlenen personeli bak\u0131m tesislerinde veya i\u015f yerlerinde sa\u011flayamama veya yerle\u015ftirememe durumu, personel standartlar\u0131na uymama olarak kabul edilir ve y\u00f6netim cezas\u0131na tabidir.<\/p>\n\n\n\n<p>\u00d6rne\u011fin, b\u00f6lgesel olarak yo\u011funla\u015ft\u0131r\u0131lm\u0131\u015f g\u00fcnl\u00fck bak\u0131m hizmetlerinde (g\u00fcnd\u00fcz bak\u0131m\u0131) kapasite 10 ki\u015fi veya daha az ise, hem\u015fire veya bak\u0131m personelinden en az birinin mutlaka bulundurulmas\u0131 gerekmektedir. Ayr\u0131ca, evde bak\u0131m hizmetlerinde, ziyaret eden bak\u0131m personelinin tam zamanl\u0131 e\u015fde\u011feri olarak en az 2.5 ki\u015finin yerle\u015ftirilmesi gerekti\u011fi belirtilmi\u015ftir.<\/p>\n\n\n\n<p>Yeterli olmayan personel say\u0131s\u0131yla i\u015fletme y\u00f6netimi veya nitelik gereksinimlerini kar\u015f\u0131lamayan personelin i\u015fe al\u0131nmas\u0131 gibi faaliyetler, personel standartlar\u0131na uymama kapsam\u0131nda y\u00f6netim cezas\u0131na tabi ihlallerdir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Isletme_Standartlarina_Uymama\"><\/span>\u0130\u015fletme Standartlar\u0131na Uymama<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>\u0130\u015fletme standartlar\u0131na uymama, belgelerin kaydedilmesi ve saklanmas\u0131 veya i\u015fletme y\u00f6ntemleri gibi her i\u015fletmenin belirlenmi\u015f standartlar\u0131na ayk\u0131r\u0131 davran\u0131\u015flar\u0131 ifade eder.<\/p>\n\n\n\n<p>\u00d6rne\u011fin, hizmet plan\u0131 gibi belgelerde eksiklikler olmas\u0131 veya evde bak\u0131m hizmetlerinde, ziyaret edilen bak\u0131m\u0131n s\u0131kl\u0131\u011f\u0131 ve frekans\u0131 hakk\u0131nda kullan\u0131c\u0131ya yeterli a\u00e7\u0131klama ve anlay\u0131\u015f sa\u011flanamamas\u0131 gibi durumlar i\u015fletme standartlar\u0131na uymama olarak de\u011ferlendirilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bakim_Ucretlerinde_Usulsuz_Talep\"><\/span>Bak\u0131m \u00dccretlerinde Usuls\u00fcz Talep<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Bak\u0131m hizmetlerinden elde edilen bak\u0131m \u00fccretlerinin usuls\u00fcz talep edilmesi de bir ihlal olup, y\u00f6netim cezas\u0131na tabidir.
