Bu tan\u0131mlar\u0131 anlamak, i\u015f\u00e7i sendikalar\u0131yla ilgili t\u00fcm hukuki meseleleri de\u011ferlendirirken temel bir \u00f6neme sahiptir.<\/p>\n\n\n\n<p>\u00d6ncelikle, Japon \u0130\u015f\u00e7i Sendikalar\u0131 Kanunu&#8217;nun 2. maddesi, &#8216;i\u015f\u00e7i sendikas\u0131&#8217;n\u0131 &#8216;i\u015f\u00e7ilerin \u00f6nc\u00fcl\u00fc\u011f\u00fcnde, kendi istekleriyle \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n korunmas\u0131 ve iyile\u015ftirilmesi, ekonomik stat\u00fclerinin y\u00fckseltilmesi gibi ama\u00e7larla kurulan \u00f6rg\u00fct veya bu \u00f6rg\u00fctlerin birli\u011fi&#8217; olarak tan\u0131mlar. Bu tan\u0131m olduk\u00e7a geni\u015f kapsaml\u0131d\u0131r ve belirli bir istihdam t\u00fcr\u00fcyle s\u0131n\u0131rl\u0131 de\u011fildir. For example, if a union notifies of a strike, verifying whether the decision process has followed the procedures set out in the bylaws (and hence Article 5 of the Labor Union Act), namely a majority decision by the direct secret ballot of the union members, becomes extremely important information for assessing the legal legitimacy of the strike and considering the company&#8217;s response strategies.
